tonight. ktvu tom is breaking down the financial impact that one sentence could have in that contract. >> but first, ktvu's jana talked with union members who blasted bart saying bart's negotiating team is to blame for this mistake. januarya >> julie, there are a few people waiting here. the board has been in closed session now. no one wants to see another bart strike, but this is a huge mistake, and it could unravel this tentative deal that both unions have already passed. tonight's public comment, union leaders said bart negotiators were the once who presented the final draft of the section on paid family medical leave for the union and both sides reviewed the language. >> you must stand behind what you signed. this was hard negotiations that was not done overnight. >> that is what you paid for. we have a signed tentative agreement that we gave to our members that the district of what it contained as we were

fully aware of what their understanding was, and they are the same. >> the unions proposed the sentence in section 4.8 which gives workers six weeks of paid family medical leave. managers say they never intended even though negotiator thomas hawks, assistant general manager and attorney signed it last summer. bart's general manager dave informed the union on november 7th of the mistake and later alerted the board. >> we've got to figure out who messed up first. >> tonight's board president says he's hopeful the union might agree to modify the language. board members want to know how much it could cost and whether it could break bart's budget. >> if i find out we can't meet our obligations then to operate the system within our budget then i'm going to, but i need to find out the facts before i make a decision. >> union members just told mae short while ago that they can't change the language in this contract with without going through an entire new vote of their membership.

the board president says that there is the vote scheduled for the board on thursday. depending on what happens in this meeting going on right now, there is a possibility they could delay that vote. reporting live in oakland janna ktvu channel 2 news. you wouldn't think a few words could cause so much trouble, but ktvu's tom vacar did the math and tells us just how much money is at stake. tom. >> plenty of money is at stake. here are the agreed provisions. they are in black and white and they are indeed signed by both parties. >> i sat down with labor lawyer and former bart board member mike to discuss the hugely expensive family clooef clause in the new contract. >> in 30 plus years of following bart negotiations, nothing like this has arisen before. >> the signed tentative agreement, part of the larger agreements already approved by the union. it allows up to six weeks paid leave to care for a close family member. >> bart management says that

this provision on paid family leave was bargained out of the contract in a very early stage. >> under the expired contract, employees did not get paid for family leave. they could use up vacation time, sick leave, and any additional paid time to offset the cost, but after that was exhausted, employees footed the rest. >> a good part of that will be what does the staff say about the potential cost. >> using conservative numbers, let's assume the average union member gets a hundred thousand dollars a year in pay and benefits. six weeks of family leave would cost bart $11,500 per employee. multiply that by more than 2500 union members, the total potential cost is about 29 million $a year so bart's expected $67 million contract would now climb to almost a hundred million. bart's board can approve or

reject it. >> i think everyone is so fed up with the situation that shom agreement will be reached. if it's not, everyone should be fire department. >> only about workers get paid family leave. reporting live, tom vacar, ktvu channel 2 news. and our coverage continues on ktvu.com. we posted the family leave section of the tentative contract at the center of this dispute. you can read it for yourself. just look under hot topics right on our home page. there were frightening moments today on an american air license flight that made an emergency landing at san jose international airport because of a bird strike shortly after take off. the federal aviation administration says the plane departed san jose this morning headed to dallas, but at 900 feet, a bird hit the no. 2 engine of the plane. passengers on board said they heard a loud noise. >> i heard a pop, seen a flash,

and then airplane slowed down a little bit. >> you could feel that things were -- the engine was running down, and it was just stopping so a little bit harrowing really >> the plane safely returned to san jose. passengers say the pilot was calm and told them he has trained for this type of situation. the faa reports from january through this year, there have been 46 bird strikes at the airport in san jose. san jose police motorcycle officer was hospitalized today after colliding with another vehicle. it happened about 11:30 this morning. police say the officer was seriously hurt but is expected to survive. a police spokeswoman said there's no word yet on exactly what happened, and the civilian driver involved is cooperating. police say neither alcohol nor drugs appears to be a factor in this crash. smoke billowed from the refinery in contra costa county today following a power out auj at the plant.

the refinery is located east of interstate 680. officials say it flared flammable gas that had built up during a brief outage. the dark smoke from the burnoff lasted for about an hour, and county health officials said that the flare did not cause serious health risk. a san jose jury today found a group of schoolgirls and their families liable for damaging the reputation of a catholic schoolteacher. the teacher, john fish ler, was accused of sexual misconduct involving girls at holy spirit cath click school in san jose. police later pursued his accusers and their families claiming they damaged his reputation and ruaned his teaching career. the 16-year-old oakland boy accused of setting another teen on fire earlier this month appeared in court today. supporters of richard thomas gathered outside the courtroom. cameras were not allowed inside. thomas is accused of setting fire to a skirt worn by 18-year-old sasha as they rhode

an ac transit bus. defense attorney bill denied police charges that his client hates gay people. >> he doesn't even know how to spell home phobic let alone be homophobic. there are members of his family who are gay. he has absolutely not an homophobic bone in his body. >> dubois raised constitutional issues about charging his client as an adult and said thomas will not enter a plea until those issues are resolved. facebook today moved ahead with updates to its privacy policy involving the use of personal information. the park company says the policy is intended to let its users know their postings, pictures and other personal data can be used for advertising on its site, however, under pressure from lawmakers and privacy advocates, the company deleted controversial language from an original version of the policy about teen users. that policy said any teenager using the site was presumed to

have gotten parental permission for their data to be used in ads. badkid saved the city. a young cancer survivor's wish to live out superhero fantasy made national headlines and melts the hearts of people across the bay area and beyond. it was a dream come fru for a five-year-old boy who spent most of his life battling leukemia. a full day of crime fighting for miles who donned a cape and mask sxad superhero by his side. it was a full day in san francisco. he started when he rushed out of the ground hyatt hotel in union scare in a bat mobile and headed on over to a cable car line to rescue a damsel in distress. he also stopped the riddler from robbing a bank then ran over to at&t park to rescue the giants mascot who had been kidnapped by the peng bin. he was given a key to the city at city hall and a huge thank you for saving the city. ktvu's rob ross is live now in san francisco where the boy's story of hope brought a city

together. rob. >> well, julie, the nooif-year-old said he always wanted to be a superhero and to many in san francisco today, that's exactly what he is. it was right out of a five-year-old's dream. miles, a little boy surviving cancer wanted to be like his hero batman, and transformed into batkid and went off to fight crime. in the morning, he save adam sell stuck on the cable car line, then stopped the riddler from robbing a bank. then received an heroes welcome wherever he went. >> great story. i'm proud of his family for doing all this, and i'm proud of the bay area for everybody coming together just to make this kid's wish come true. >> the story touched people. they wanted to be a part of it so they cheered at union square and danced on cue. it was all part of the plan to warn batkid that penguin kidnapped giants mascot and sped off to at&t park.

batkid and batman spoiled the plan, saved lucille and was rewarded with a key to the city and also more practical chocolate key to the city. right now it's about noon. the bat mobile -- the batkid is having lunch at the burger bar, and thousands of people have gathered to cheer him on. this man came dressed up as robin and brought his son about the same age as miles. >> i wanted to come support miles and witness this great thing that's going on right now. this is awesome. this is epic. >> an east bay preschoolteacher took a vacation day to be here. >> it's fun, and it's also -- it's good for the soul. >> veteran police officers told us what a truly great fun day this was in the city. >> he fought through cancer. he beat that. i think it goes hand in hand that he is a fan of not only batman but superheroes in general, so here's to our fighter. >> the family also gave san francisco a big pat on the back, and it's going to be tough for

batkid and the city to top this. reporting live in san francisco, rob ross, ktvu channel 2 news. >> and the justice department even got in on the superhero action today drawing up this make believe dooichlt. it accuses the riddler and penguin of wreaking havoc on gotham's san francisco and credits batkid for stopping them. indictment also says, quote, even if you get out of jail some day, you will never succeed in your criminal actions as long as miles, also known as batkid is looking out for the citizens of gotham. >> i just can't get enough of this. i want to show you a picture of the krn kl. today batkid saves the city. i mean, that little boy, he is just so precious. at one point he just raised his fist like that. i have gotten so many comments on facebook from people saying i tried hard, but i couldn't keep the tears from falling. they love saven fran for what they did and how they have a new hero in that little boy.

. we are just hours away now from the opening of one of the most of anticipated roadway projects in the east bay. today transportation officials held a big celebration for the opening of the long-awaited fourth bore of the caldecott tunnel and announced it's set to open some time overnight. federal state and local leaders were on hand for a ribbon cutting ceremony. after midnight, drivers should expect to see the third close for several hours as work crews repaint the lain stripes and remove temporary bar kasd. by 5:00 tomorrow morning, all bores affected marking the end to manuel bore switches used to control the flow of traffic.

>> during weekends, during sporting events, sometimes as many as 13 bore switches a weekend. that's all going to be eliminated. >> the $417 million project took less than 4 years to complete. new at 6:00, an east bay city tonight is trying to figure out what went wrong. what hundreds of city workers, including firefighters and police didn't get their paychecks. this is payday for a lot of people, but today it was more complicated for hundreds of city workers in richmond. as ktvu john shows us, the city's quick work averted serious problems. >> i'm a happy employee. >> richmond firefighters stopped at a credit union today not for a car crash but more of a financial accident. >> we didn't receive our direct doe poz sits. >> we learned the city of richmond's direct deposit systems is out of order. >> it didn't affect me too much because i have appropriate amount to pay for my mortgage, for example, but i could see how

it may affect other people that might not necessarily have those kind of backup plans like i do. >> today on payday, no one got their money automatically, but to make sure everyone got paid, the city worked overtime. police chief chris magnus is acting city manager. >> they financed the employees and several folks from human resources really spent most of the night here working to make sure that those cheks were printed off so they would be available today. >> getting their paychecks in hand when workers tend to jump through more hoops than normal. otherwise out of commission could have had bigger problems. >> we work together. if they're aware of it and they know they need to have it deposited we can go take deposit form. >> if the city hadn't so quickly workers and contractors, the situation would have been much worse. >> we value our employees a great deal in the city. it's important that they get paid at timely and predictable way. when that doesn't happen, no one

likes that so weir very sorry it happened. >> city officials say they have yet to figure out what caused this problem, but they plan to have it solve and had fixed before the next payday. i'm john ktvu channel 2 news. a federal judge has ordered law enforcement officials to respond to state senator ron calderon's claim that he was a victim of retaliation. the state senator says the fbi and u.s. attorney's office leaked an affidavit alleging that he accepted $88,000 in bribes. calderon says the leak was in retaliation for his refusal to wear a wire to secretly record conversations with two other state senators. >> temperatures dropped off a couple more dprees today in some places. it was a nice day. look at the numbers. 70 in fairfield. one of the worse. temperatures on the mild side. it gets a little cooler tomorrow as the system drops down from the north, and it comes straight to the north. that's why it's a cold system.

it's going to bring cooler air now. i think the big thing you know sort of morning overnight lows it's going to be downright cold as we get into sunday morning and monday morn wg temperatures in the freezing levels in the north bay and in the east bay. those are the current numbers right now. lots of 50s. outside tonight it's beautiful night. partly cloudy. tomorrow a nice day slightly breezy. cool erer tomorrow specifically for san francisco chilly. 49 grows when you wake up in san francisco. chilly. 50 degrees in oakland when you get going tomorrow morning. 43 degrees in concord. so it's very cool overnight as this system gets closer to us. it brings that cool air. it also sets us up with light winds offshore or moderate wind office shore. in the bay area weekend, dry but just mild to cool, cooler than we have seen because it has been a very warm week, as you know. there's the system the model brings down rain but that's

about where it stops. shouldn't come much further than that so we look to be dry. mostly to partly sunny right through the bay area weekend. it has been dry around here for much of november obviously, and we do now, as i mentioned before, have a shot at something coming in here on tuesday night into wednesday, and here's how the model shapes up for tuesday. we got our fingers crossed on this one because it looks like it might have some ability to bring us quarter inch of rain, half ifrmg of rain in the heaviest locations in the north bay. that's a ways down tuesday into wednesday. in the meantime thinking about your bay area weekend. it's going to be a nice one. 63 in clear lake, 63 in fairfield. far cry from where we were yesterday -- not yesterday, day before yesterday and monday/tuesday. temperatures 70s and 80s. these temperatures are down, so they're cooler but still you're in the mid and low 60s for bay area sad. forecast high along the coast little bit cooler, upper 50s. take a jacket. five-day forecast with bay area weekend. look at overnight lows for sunday and monday morning. temperatures are downright
