are dealing with very serious allegations against several students. their charged with hate -- they are charged with hate crimes against an after am roommate. how students are reacting. welcome to "mornings on 2." i'm tori campbell. >> i'm dave clark. steve, should they take an umbrella? >> well, for a few, especially out towards -- maybe livermore to san jose. fremont. but after that, things are going to be winding down here pretty fast. not before some great rainfall from the north together south. coast all the way over. concord 1.7 0. livermore, 1.58. all associated with a very vigorous low sending one final band boy. is it moving fast and the wind is cranking up, especially in some of the higher elevations. some of things to come. could be a little bit of rain. a little blip there. there's a couple of around

oakland, pede mawbt. had a good band going through from oakley, brentwood, antioch, to pleasant hill and livermore. it's starting to end to the north. around the altamont pass things are enhancing towards claudine wong. over towards fremont, sunol grade, milpitas, san jose. still getting a little bit of rain. temperatures are cooler. 49 now santa rosa. but the low is rapidly moving south. as it does, high pressure builds in. the wind will kick in. tomorrow we are talking about how sunny and windy it is. some afternoon sun. it will clear out probably pretty fast. 60s on the temperatures or upper 50s. here's sal. we're looking at a commute that looks low because of the wet weather. where it has been raining. the bay bridge, we have about a 25-minute delay. there are no problems on the span. we had an earlier crash. that was gone a while but -- gone for a while but the

metering lights did come on earlier today. also looking at the san mateo brick. traffic is still moderate. see some brake lights on the span. it does look like it's been raining on the bridge. 580, steve mentioned it. so has claudine. claudine wong is a mess coming through livermore and dublin. one of the reasons, it's been raining there. the road sensors are showing a lot of slow traffic. not only on 580 but pleasanton heading towards fremont. let's head back to the desk. a hate crime investigation is underway at san jose state university. among the allegations. a bike lock put around one student's neck. ktvu's janine de la vega is live at the school. so janine, is the university doing anything about this? >> reporter: well, the d.a. 's office is reacting. but we reached out to the spokesperson to find out if there will be action taken, if the students will be

sanctioned. we've not heard back. this alleged taunting happened at one of these high rises in the campus village dorms that you see behind me. the district attorney's office says three white male students are charged with misdemeanor hate crime and battery against their black freshman roommate who was 17 at the time. the incidents began in august and involved the defendants calling the black student a three-fifths or fraction, referring to how the u.s. census used to count black slaves. they placed a bike lock on the teen's neck and refused to dwiv him -- to give him a key to unlock it. they also hung a confederate flag in the room and barricaded the victim inside the closet trying to lock him in there. >> there's no joking about what's going on. i don't know how they thought this would be a joke, knowing that they put up a confederate

flag, pe thut a bike rack around him. there's no joke about that. very disappointing. >> reporter: the prosecutor says the defendants kept a picture of adolph hitler and a pentogram in the gram. the university has learned about this. they are holding a conference at 12:00. the defendants are colin warren, joseph bumgardner and logan beshler all of them are 18. if convicted, they face one year in county jail. reporting live from san jose, janine de la vega, ktvu channel 2 news. 7:05. new this morning -- in santa clara, a lot of police activity. we're getting reports. two people were arrested during a home burglary in the 2200 block of crocker way. reportedly, both suspects had

guns. one of them reportedly was bitten by a police dog. the santa rosa city council taking rare action. it's in response to the controversy surrounding the fatal shooting of 13-year-old andy lopez. the council is releasing controversial e-mails about how to respond to the shooting of a teenager carrying a toy gun. in many e-mails, council asked for legal advice about what they should and should not say about the controversy. the city attorney tells them to say nothing and refer all questions to the police. happening today -- in just two hours, b.a.r.t.'s board of directors meets to discuss a major new development in the labor dispute. last night, b.a.r.t.'s two largest unions said they are willing to sit down with b.a.r.t. to work out differences over a contested part of the tentative agreement. but that's only if b.a.r.t.

directors ratify the new contract. earlier, the board had said it would reject the deal citing an expensive paid leave provision it says was mistakenly included in the contract. a bay area labor group will hold a rally in oakland before the meeting. the group wants to show its support for union workers in this latest dispute. brian flores will have a live report at 7:30. san francisco's police chief responding in the mission district. the video showed undercover police officers involved in this melee with several people outside of the valencia gardens housing complex. it was followed by claims of police brutality. today's chronicle reports that greg suhr wants his police officers to wear cameras to help monitor tense situations. within the next couple of weeks, a pilot program equipping some of the undercover police officers with

cameras is due to begin. some berkeley property owners may not be forced to make their -- may be forced to make their buildings safe. this was discussed tuesday night, directed at the owners of 158 residential buildings with five or more units considered unsafe in an earthquake. the ordinance would require the owners to tell the tenants the buildings are not earthquake safe. and it would also require the owners to submit plans to retrofit the buildings by january 2017. final vote will be taken at the next council meeting, december 3rd. there's talk of mayor ed lee eyeing another job. sfgate.com reports there's speculation from city hall to washington, d.c. that lee could become the next u.s. am was der to china -- ambassador to

china. gary locke is stepping down early next year. there's also talk that steve westly, who deep toys to silicon valley, may be on the short list for ambassador. the san francisco municipal transportation agency approved and electronic system for hailing cabs. the board is giving a five- year, $6 million contract to free the transportation. it's supposed to set up a system similar to what uber, lift and side car use. some cab companies oppose that. the information is necessary to make the system work. 7:09. we want to take you back to our stormwatch coverage. there's still some lingering rain around the bay area after we got steady rain in many parts of the bay area during the night. claudine wong is in livermore right now. so what's it like out there now, claudine? >> reporter: it's still coming down a little bit.

it's very, very light. that's good news because these drivers don't need anything else slowing them down. if you take a look at interstate 580, it's slowing. so much so we can show you no one has their windshield wipers on now. that was different earlier when the rain was coming down steadily in livermore. we are near the airway boulevard, collier canyon boulevard exit. it really has picked up and slowed down quite dramatically this video is from san jose where it was steady there. it's been one of those mornings where the bands have made their way through the bay area. earlier this morning about 4:00 a.m., when we were in pleasant hill, it was raining there and it kind of moved its way down and we came down here to livermore and now it's headed through san jose as well. no major problems this morning in contrast to what we saw yesterday with a lot of spinouts yesterday. maybe everyone took more time this morning to get to work.

it is 7:14. an internal army e-mail suggesting the army not use pretty women in public relation photographs and the reason is generating some controversy. according to politico, the e- mail from an army specialist says "ugly women are perceived as competent while pretty women are perceived as having used their looks to get ahead." the e-mail goes on to suggest that if the army wants to be success full in introduce -- successful in introducing women in combat roles, it would be better to use average-looking women in these shots. jackie speier said "pretty women perceived as not competent by army colonel, great message, pentagon." chuck hagel, horrible. another tweet that speier sent out, another example that the u.s. army does not get it."

new this morning, afghanistan president's said they should support a security agreement with the united states even though he said there's little trust between the two countries. this is hamid karzai. president karzai said he does not trust americans and americans don't trust him. the five-day gathering will discuss the proposed security agreement which outlines a plan for allowing up to 15,000 u.s. troops to stay in afghanistan beyond 2014. 7:16. if you live in the fairfield area, you may see and you may hear military highlighters overhead. about 8:00 this morning, just a little while from now, soldiers from travis air force base will take part in a joint helicopter training exercise. it includes the 21st

contingency response wing and the california army guard chinook helicopters. they will try to rio vista to show how fast they can load and unload gear in a combat situation. there's a jumbo jet stuck at a small airport in kansas after it landed there by accident. but it may be able to get off the ground in the next couple of hours. it's a big one. the boeing 747 was supposed to land at mcconnell air force base in wichita, kansas, but it landed about 12 miles away. the plane is called the dream lifter but it carries parts of the dreamliner jet. it's so big, it can't turn itself around in the airport. it's been taken care of. but all of the cargo has to be unloaded so it can take off on the short runway. airplane seats are getting smaller, even though passengers are physically getting bigger. 20 years ago, the seats were 18

inches. now the average seat is 2 inches smaller. in the meantime, obesity around the world has doubled since 1980. the smaller size allows airlines to add more seats but there is an effort to stop the seats from getting smaller. an airplanemaker, airbus has launched the campaign for wider seats. happening today -- more than 1 million californians could find out today if they will be able to keep their healthcare plans that don't meet the standards of the affordable care act. as kyla campbell reports from our washington, d.c. newsroom, the board that oversees covered california is meeting today. kyla? >> reporter: those five board members will consider a proposal that would let people keep their current policies. president obama said people can keep their current plans another year. but the board is also considering an extension only through march. some analysts say any extension could shake up the market and

there. if you are driving on 880, it's backed up out of san leandro all the way down to fremont and near the stevenson exit. san mateo bridge is also pretty slow. bay bridge toll plaza, 25 to 30- minute delay before you make it on the span. 7:32. back to the desk. new this morning, police in vallejo warning people be alert. last night, there was seven armed robberies just four hours apart and they may be related. ktvu's tara moriarty live in vallejo now to tell us about a key piece of evidence, tara. >> reporter: there are surveillance cameras here at costco. one of them caught images of the guestaway car -- getaway car. the delivery driver was held up at gunpoint. the photo is grainy. police want residents to be on the look out for this car, a dark lexus with silver trim. the suspects used the getaway car in seven robberies over a four-hour stretch starting at

5:15, robbing victims of cell phone, wallets and jewelry. police say this is the time of the year when robberies typically spike. >> during christmas, halloween, that kind of thing, we have more robberies. it's just the hours. it's darker sooner. that sort of thing. and also there's more shoppers. so there's more victims. >> reporter: this map shows where the robbers struck homes and businesses from olympic drive and louisiana street to the parking lots the seafood city, costco and pep boys. the suspects are two to three african-american men, wearing ski masks and bandanas. one being lighter skinned one being 5'9", 180 pounds, if you have any information call the vallejo police department. tara moriarty, ktvu channel 2

news. rohnert park say a wanted parolee led them on a high- speed chase through sonoma county around 1:30 this morning. a police officer spotted a utility truck with the headlights off on golf course drive west headed towards the new greaten casino. the -- graton casino. the speeds topped almost 100 miles an hour. the chp finally stopped the truck and set up a strike stip. it's still not clear if the truck with a cherry picker on it was stolen. there was an arrest warrant for the driver. we could get a better idea whether there could be a third b.a.r.t. strike. in about 90 minute, the bart board is schedule -- b.a.r.t. board is scheduled to vote on a tentative deal, a clause that b.a.r.t. says should not be in there. brian flores has more. >> reporter: good morning,

tori. yeah, definitely uncertainty this morning. we're talking about the paid family leave clause in that contract. it is certainly causing some headaches and uncertainty especially for b.a.r.t. riders. this is the infamous section 4.8 in the contract agreement between unions and management. this is that paid family leave clause that states that eligible b.a.r.t. workers could get up to paid family leave. but, of course, the issue came into question as b.a.r.t. management identified the clause saying it was a mistake and inadvertently put into the final contract. the district says it would cost an additional $44 million on top of the $64 million from the four-year contract agreed to earlier. it will be up to the board of directors to approve the overall agreement but their vice president anticipates the board will reject it, and there

were concerns from riders that negotiations could lead to another strike. >> i'm getting anxious. i go to school in san francisco. i work two jobs and i work at urban outfitters in san francisco. it's gonna be a hard time for me to get to school and to work and to get into the city. >> reporter: the new development is that union leaders say they are willing to sit down with b.a.r.t. management and the mediator to work out their differences. but only if the board of directors ratifies the contract today. union leaders say a chance of a strike is slim but they say they will make their next move after the results of the board meeting which is scheduled for 9:00 this morning in oakland. there's also a rally planned minutes before that meeting. we're planning on heading there now and will have a live report in our 8:00 hour. brian flores, ktvu channel 2 news. >> thank you. it is 7:37. a high school teacher in santa rosa is back home from the hospital after a terrifying attack that led to a campus lockdown. police say a student stabbed him several times yesterday at

midrose high, an alternative school on bellview avenue. investigators say the unprovoke attack happened during lunch break while some students were sitting in class. they say the 16-year-old boy approached the teacher from behind and stabbed him in the cleft and neck with a -- chest and neck with a metal mechanical pencil. ktvu news spoke to several classmates who witnessed the attack. >> mostly in the neck and the hand. >> a lot of stab wounds? >> yeah, multiple. a whole bunch. sphbli saw him on the -- >> i saw hill on the ground. there was like some blood on the ground. >> the teacher tyleralborn is -- tyler alborn is expected to recover. the teen is in custody. school officials have decided they will change the controversial apache name of the mascot of its main high school. ♪ >> now, for 13 years, native-

americans have said the apache mascot at vallejo high school was offensive and should be changed. last night they gathered in a drum circle, praising the school board's decision. >> i'm not a relic from antiques road show. i'm a living and a human being. i'm not a mascot. >> it's not derogatory. we're praising them. we're proud to be -- >> some of the students in the alumni oppose the change. they say there feel connected to the a -- they feel connected. students and staff will help select a new mascot name in january. only on 2, ktvu has learned that investigators are blaming criminals for the flooding on the south bay freeway last night. several lanes of southbound highway 87 in san jose had to be closed for more than four hours because of flooding at the taylor street overpass. two and a half feet of water

covered all of the southbound lanes. cars had to squeeze by on the center divide. the caltrans says someone stole copper wire and ran beneath the freeway which cut off the power. >> it's a problem with the wires. without the pumps, it will always flood once it pains. >> the chp says the problem is so bad, they created a special task force to deal with it. caltrans is using a temporary generator to pump out the water and they are working on a permanent solution. despite this morning's drizzle, sfo is reporting no major delays right now. however, that could all change. this is a live look at sfo where we just talked to an airport spokesperson. he says while flights are on time for the most part, there are problems in and out of denver due to snow there. and that could create a domino effect for flights throughout the rest of the country. a new study by the u.s. travel association is warning travelers that the years ahead

could be even worse at sfo. the report predicts in the next 25 years every single day could look like the day before thanksgiving. the travel association says sfo needs more runways, more customs and border ajends and update -- agents and updated air traffic control agents. coming up in about 15 minutes, a new report on the problems following the asiana disaster last july, including communication followups. and the new steps -- foulups and the new steps to reunite families during emergencies. disturbing allegations against san jose state students against an african-american roommate. what they are accused of doing to the roommate. and an 85-year-old palo alto man detained by authorities in north korea. the reason his son says it was

stocks opening higher on wall street the day after sinking on worries the fed might be able to go back. taking a live look at the big

board, the dow is up 80. the nasdaq is up 34 and s&p up 10. just checking tesla's stock right now, and it's up slightly at the moment, about 7 point -- .7%. that's after it lost 4% yesterday. the palo alto-based electric carmaker has seen the stock drop more than 35% since the end of september when it was selling for more than $193. the price tumbled after sales were lower than analysts expected. and a safety investigation was lunched into three model s fires. one analyst believes the shares could fall another 20%. if you are among the first to get the next generation iphone, you may be paying more than you expected. historically, apple sells it's newest iphone for the same price as the model it replaces, then drops the price on the older model. well, the next iphone is expected to have a larger screen and other feature that raises the manufacturing cost.

some tech analysts say the price tag on the next iphone may be $100 more than the iphone 5 that were introduced in september. and mcdonald's mcrib sandwich will not be available across the country. franchise groups can decide if they will put it on the menus. the pork sandwich which comes with pickles, onions and barbecue sauce has been available nationwide the last three years. but when it debuted, it was only available in a few places which led to the cult status among fans. concern growing for a local man who is designed in north korea. as pam cook reports from our newsroom, pam, this may have to do with his service in the u.s. military more than 50 years ago. >> merrill newman is 85, lives in palo alto. but he wanted to visit the country he fought over during the korean war. he traveled to north korea last month with a neighbor. his son says the day before his father was scheduled to depart,

he ended up in a conversation with north koreans and talked about his service in the war. the next day, he was escorted off the plane just minutes before takeoff. that was on october 26th. it's family has not had any contact with him since. newman's son told us why his father wanted to go to north korea. >> like the world war ii vets who have had an interest in going back to normandy, my dad who was a veteran of the korean conflict wanted to go back to the northern part of the peninsula. he had been to the southern part of the peninsula before. this was a life-long dream of his. the u.s. state department is working with china since it's north korea's top ally. we've always been told that newman's family has been working with the swedish embassy to try to secure his release and that the swedish ambassador was able to deliver heart medication to north korean authorities for newman.

merle newman lives with miss wife at chaning house, a retirement community in palo alto. in our next hour of "mornings on 2," we'll hear from one of newman's neighbors about what his wife is doing back here in palo alto. reporting live in the newsroom, pam cook, ktvu channel 2 news. we have new information about a deadly tragedy that involves a virginia state senator and his son. "the washington post" reports 24-year-old gus deeds was recently evaluated at a local mental hospital. he was sent home. doctors said they couldn't find a place for him in a facility. police say he later stabbed his father, creigh deeds before he took his own life. senator deeds, by the way, is expected to make a full recovery. 7:48. for the first time, we're hearing from a man who rushed to save an 18-year-old high school student who was set on fire on an a.c. transit bus. dan gale said he was on his way home from work when lush sasha fleischman was set on fire.

gale said he heard a group of teens talking on the bus. when he turned around, he saw fleischman's skirt on fire. >> i heard, you are not gonna do that, more in a joking way. that's when it all started. >> gale said he used his sweatshirt to put out the fire with the help of another passenger. 16-year-old richard thomas is now facing hate crime charges. the oakland high school student is being charged as an adult. richmond police are investigating whether a dispute between neighbors led to several trees being poisoned. a woman found poison in the soil. she called police and they installed a camera. police say dave karl who lives directly above her was the only person seen on the video besides a contractor.

city officials say carl asked them to cut down the trees in the past. police are calling him a person of interest. 7:49. sal is back. you are watching the roads and those bridges. >> that's right. we're starting with the san mateo bridge and westbound 92, the traffic is going to be busy as it normally is. you can see the roads are wet. it's not been raining in the last few minutes. as steve and i have been telling you this morning's commute is still going to be wet. it was just raining a little while ago here and there kind of showers but driving purposes. that means you will be in slower traffic than you would probably like to be, slower than usual. the bay bridge, the same thing goes. about a 20, 30-minute delay. it's drying off. i want to show you road sensors you may not like to see. if you are taking 880 and heading out, it looks red. deep red color on 880 as you head south out of san leandro all the way down into the fremont area. so please give yourself extra time. let's go to steve.

look at this. a san francisco school bus had to be pulled out of wet cement yesterday. got stuck at bayshore boulevards about 3:00. luckily, in one was hurt. a city public works crew had just poured that cement in the street. they said all of the proper signs were out. but the bus driver still drove right into it. the city of sausalito wants tour buses to stay away.

the marin independent journal reports neighbors don't like the loudspeakers or the roar of the bus engines. although the city council can't keep the buses away, it can ban them from certain streets like alexander. the city council may do that before spring time, before the summer tour season begins. now, the sausalito complaints come just as san francisco banned tour buses in alamo square. some neighbors complained about the noise and the traffic near the famous victorian homes known as the painted ladies. a bible controversy at a southern california costco has stirred up emotions in congregations and on local social media. a pastor made this discovery while shopping in simi valley. a bible with a sticker, 1495 -- 1499, rather, and fiction. the pastor took a photo and posted it on social media with the caption, costco has bibles for sale under the genre of

fiction. he couldn't believe what he was seeing. >> i was trying to find somebody and i couldn't. i checked to see if the other bibles were like that and they were. >> the post prompted all sorts of reef action. the pastor -- reaction. the pastor said costco said officials say it was a distributing error. costco apologized and said they are changing the label. san francisco international airport airport officials are making improvements after learning several important lessons after the asiana crash. the airport is correcting problems with the communications systems, that includes one design to alert key managers during an emergency and the sfo website that went down as people used it to get information on the crash. the review is resulting in other changes as well. airport restaurants will remain 24 hours a day during major emergencies and the airport is working with nearby hotels so they don't raise their

30s and 40s on the temperatures. get ready for the clearing to take place after any lingering rain and a cool breezy day. here's sal. that rain that you mentioned has been just enough to slow people down this morning. so people are going to be slower than usual. the bay bridge started off on the wrong foot as we had an early-morning accident that wasn't major. but it was still there. metering lights went on about a half-hour earlier than any normally do. -- than they normally do. let's take a look at 880 northbound. you can see traffic is going to be busy as you drive past the coliseum. but southbound 880, i've drawn a big white line for you on the maps. it really has been slow. that's probably the slowest traffic in the bay area. we're looking at contra costa county here and 680 south is backed up passing a minor

accident in pleasant hill. that's backed up from 242. it remains slow in alamo. back to the desk. >> thank you, sal. three students at san jose state accused of hate crimes against an african-american american roommate. ktvu's janine de la vega is live on campus with more on the allegations of harassment which included putting a lock around the teen's neck. so janine, how are students reacting too all of -- to all this? >> reporter: disbelief. students say this goes way beyond a prank. they call it bull littling. the alleged racial taunting occurred in one of these high- rise dorms that you see here in the campus village. the district attorney's office says the incidents began in august and involved three white male freshman students. they allegedly nick named their 17-year-old black male roommate three-fifths or fraction, a reference used in the 18th and early 19th century to count black slaves. the district attorney general's

office says the defendants placed a u-shaped bicycle lock around the black student eight neck and refused to give him a key to unlock it. there are also allegations that the victim was barricaded in his room by the defendants and they hung a confederate flag in the common area of the suite. this morning, one student told us how it made him feel. >> it made me feel good. but i'm not -- i'm not going out to beat somebody out. that shows i have no control over myself. i mean, there's nothing i can do but to keep talking like this and hope people will change and stuff. >> reporter: authorities are saying the white students had a picture of adolph hitler. the black student union is holding their black thursday rally on the quad at noon today and it is most likely that this will be talked about. the district attorney's office is charging collin warren,

joseph bumgardner and logan beshler with misdemeanor battery and hate crime. if convicted, they could face a maximum of one year in the county jail. now, we're still waiting from a response from san jose state university. we've reached out to their spokeswoman to see if the students are gonna get any disciplinary action on -- as far as the university's end goes. we're still waiting to hear back. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you. 8:05. new information about a suspected burglary in santa clara. around midnight, police received a call about suspicious activity in the 2200 block of crocker way. when officers arrived, they spotted two people burglarizing a home. a lieutenant tells us during the search, a police dog tracked down and bit one of the suspects. the bite was not serious. the other suspect was taken into custody. the investigators are saying the suspects are juveniles.

8:05. a very unusual response by the santa rosa city council to the controversy surrounding the fatal shooting of 13-year-old andy lopez. the city council's releasing previously confidential e-mails about how to respond publicly to last month's shooting of a teen carrying a toy gun by a sheriff's deput-- sheriff's deputy. the city attorney tells them to say nothing and refer all questions to the police. san francisco's police chief is responding to last week's violent confrontation in the mission district. it was caught on camera. the video shows undercover police officers caught in the melee with several people outside of the gardens apartment complex. it was followed by claims of brutality. greg suhr warrants his police officers to wear cameras to help monitor tense situations. and within the next couple of

weeks a new program equipping some undercover officers with cameras is set to begin. 8:06. some berkeley property owners may be forced to make their buildings earthquake safe. the berkeley city council discussed and ordinance at it's meeting tuesday night directed at the owners of 150 residential buildings with five or more units that are considered unsafe in an earthquake. the ordinance would require tenants that the buildings are not earthquake safe and would require the owners to submit plans to retrofit the buildings by january 2017. a final vote on the ordinance will be taken at the next council meeting december 3rd. there's talk san francisco mayor ed lee could be eyeing another job. sfgate.com reports there's speculation from city hall to washington, d.c. that lee could become the next u.s.able was der to china. lee is san francisco's first

chinese-american mayor and speaks fluent mandarin and cantonese. gary locke is stepping down next year. there's also talk that former state controller steve, wesley, who has -- steve westly, who has deep ties will be on the short list of replacements. president karzai told a gathering of elders and political leaders they should support a security agreement with the united states even though there's little trust between the two countries. here's some video. this is president karzai speaking to the grand council of about 2500 afghans today. he said he does not trust americans and the americans don't trust him. the five-day council gathering will talk about the proposed security agreement that outlines a plan for letting up to 15,000 american troops stay in afghanistan beyond 2014. and an internal army e-mail suggesting the army not use

pretty women in public relations campaigns and this is causing quite a controversy. now, according to politico, the e-mail from an army specialist says and i'm quoting "ugly women are per seeshed as competent -- perceived as competent while pretty women are per seeshed as using their looks to get ahead." if the army wants to be successful in combat roles, it's better to use average- looking women in their publicity photos. bay area congresswoman jackie spear made a comment about that e-mail on twitter. she wrote "pretty women perceived as not competent by an army colonel, great message, pentagon. chuck hagel, horrible. there's still some lingering rain after a steady downpour in many parts of the bay area. claudine wong is watching the

commute. what's the weather like right now. you got your hood off. it can't be raining too hard. >> reporter: no, it's not raining anymore. this was one of the last spots the rain made before it headed down south. this is interstate 580, rolling through livermore pretty slowly. no major accidents. this is a busy corridor around the rain did slow things down this morning. i want to show you what it looked like earlier in san jose as well. depending upon where you woke up this morning, some people heard pounding rain on their windows and worried about the commute. some other people thought it was done. it was making that last, last stretch through the bay area. one person we talked to said he was surprised it wasn't worse. >> actually, it was not too bad. it's kind of -- last two days has not been all that great. been a lot worse. >> reporter: back live out here along interstate 580 livermore

happening now -- a giant cargo jet, that one right there, it landed at the wrong airport in kansas last night. it's now scheduled to take off at noon. again, these are live pictures from the mcconnell air force base in wichita, kansas. it's sitting on the runway. here's what it looked like last night -- this boeing 747 landed at a smaller airport about 12 miles away by accident. the crews finally managed to turn that big thing around. and they say the jet will be able to take off despite a

short runway. the pilots say they didn't realize what happened. now at mineta airport, you will be able to join the precheck program that gives them an express lane. it doesn't require laptops to be taken out of their cases or -- or passengers to take off their shoes, belt or jackets. airport officials will introduce the screening later today. about 100 airports including sfo and oakland are part of that prechecked program. after months of threat, the senate majority may finally use the so-called nuclear option. the senate has started debatingle the drive to change rules, aimed at curbing republicans' power to block president obama's nominations. senate majority leader harry reid is expected to force a vote as soon as today to require only 51 votes to end

filibusters or delaying tactics against nominees for high judgeships or officials. currently, 60 votes are required. the senate banking committee just voted to approve the nomination of janet yellen to lead the federal reserve. yellen is expected to be confirmed by the full senate. but a vote has not been scheduled. yellen is the vice chair and would replace ben bernanke. former president obama said last week if you like your health insurance plan you can keep it for another year but the board that oversees covered california could decide today how long californians can hold onto current policies. kyla campbell is live in washington to explain what is

on the table. zblferm the meeting in sacramento, it's sigs hours, scheduled to start at 10:00 a.m., the focus, the 1 million californians whose medical insurance policies don't meet the new healthcare law standards. five-member board could decide if californians can keep those plans. if so for how long. it would be the one-year extension president obama announced last week or it could be just through march. some analysts say any extension could lead to higher premium prices for everyone in california. meanwhile, republicans focus on the president's promise that he might not be able to keep. >> where the government was gonna lay out all of these things they were gonna require in the healthcare plan, no plan would exist. >> reporter: hospitals are filing lawsuits in order to keep plans affordable, many of the new insurance policies exclude top-rated and children's hospitals.

that means families could end up paying more if they need to get those special services only offered at those facilities. live in washington, kyla campbell, ktvu channel 2 news. there are questions as to whether american skier lindsey vonn will recover in time for the winter olympics. on tuesday, she suffered a partial lig ga meant tear -- ligament tear during training. doctors say her chances to recover and compete in next year's winter olympics will be determined by the extent of the ligament tear. a mild tear will need a few weeks' rest but the winter olympics are coming up in a few minutes. >> right. sal's coming up right now. >> let's take a look at 24. it's slow in la fayette as you

>> it looks pretty good. things are calming down. two days ago it was not north bey, russian river, up to mendocino and lake county. yesterday, san francisco, oakland, concord, livermore. i mean, just really good rain. 1.3 at concord. two reports of that. an inch of rain to 2 to 3. kentfield had 3. clouds are clearing out rapidly. now we're gonna focus on clearing. windy and cold at times. a little bit of rain around san mateo san mateo. i doubt much is happening. it looks like it's holding on a little bit. 680 a little bit maybe to the sunol grade. that's about it. things are about done. livermore has had pretty good rain. 40s and 50s. a much cooler pattern is on the way. a colder pattern as this low slides south. wind will not like that, the high won't like it. the breeze will pick up. clouds here in the morning. maybe a lingering shower or two. cooler and breezy, if not already for some.

tara? >> reporter: well, police are gonna come by this costco sometime today to grab surveillance video from this parking lot. they say this is the area where a delivery truck driver was held up at gunpoint last night. we want to show you a photo snapped from the video. it was given to us by a police officer. it's a bit grainy but shows an older model lexus with a silver trim. investigators say the suspects used the car in seven robberies starting at about 5:00 last night. they robbed gyms at gunpoint, stealing cell phones, wallets and jewelry. >> all of the victims reported the same, two male blacks either with ski masks or bandanas and most of the victims describe the same vehicle. again, a late model '90s lexus with a silver trim. >> reporter: now, this map shows where the robbers struck homes and businesses from olympic drive and louisiana street to the parking lots of seafood city, costco and pep boys. police say this is the time of

year when robberies strike. it gets darker earlier. people are out doing their holiday shopping. people want you to be airway of your surroundings. if you have any information, call police. tara moriarty, ktvu channel 2 news. rhonest park police say a wanted parolee led them on a high-speed chase. about 1:30, a utility truck with its headlights off was going down golf parkway west toward the new casino. the driver failed to pull over for the police. then jumped on highway 101. the speeds were topping 90 miles an hour. the chp stopped the truck by putting down spike strips. still not clear if that truck, which, by the way, had a cherry picker on it was stolen. an arrest warrant was out for that driver. also this morning, a high school teacher in santa rosa is recovering from a horrifying stabbing attack. he's back home from the hospital, though. police say a student stabbed the teacher several times

during yesterday's lunch break at midhigh school. investigators say it was an unproinvestigated -- it was an unproinvestigated attack. they -- unprovoked attack. they say the teacher was stabbed in the head and neck with a metal mechanical pencil. ktvu talked to schoolmates. >> stabbed mostly in the neck and head. >> a lot of stab wounds. >> a bunch. >> i saw blood on the ground. >> the teacher identified as 33- year-old tyler a lbeern is expected to -- alborn is expected to make a full recovery. police found his suspected attacker a couple of blocks away at a relative's house. prosecutors are preparing formal charges. a school board in vallejo has voted unanimously to make a mascot change and eliminate the controversial name "apaches." ♪

>> native-americans gathered in a drum circle last night at vallejo high school to praise the decision. the board based its decision in parts on a recommendation by the u.s. commission on civil rights. students and staff will be involved in selecting a new mascot over the next couple of months. only on 2 -- ktvu has learned that investigators are blaming criminals for flooding a south bay freeway last night. several lanes of southbound highway 87 in san jose were closed for more than four hours due to flooding at the taylor street overpass. two and a half feet of water covered all of the southbound lanes forcing cars to squeeze by on the center divide. caltrans says someone stole copper wire that ran underneath the freeway which cut off power to a water pump. the chp is creating a task force to reduce the growing number of copper thefts. 8:36. so far it doesn't appear this morning's light rain slowed things down at sfo.

krunikan, i think they knew what the contract was. i think this is another tactic against the b.a.r.t. workers. i don't think is was a good contract. it was a coon session contract but -- concession contract. but even though, they say they are gonna ignore it. if you have a tentative agreement and the board ignores it, what you are setting up is a very bad situation. >> reporter: b.a.r.t. directors says this is gonna cost $had 4 million over -- $44 million over the next four years. it might have been a mistake. is there a way that this can be -- >> i think the union said they want to compromise and go to an arbitrator. directs say no deal. it's not a money question. they have a lot of money. they were gonna spend $21 million to break the strike and now they are gonna say there's no contract? our view, the b.a.r.t. workers should unite with the ac workers in this contract and go out together. it's time to play hard ball

near 6th street. the city of san francisco wants more people to ride bikes in the city. the municipal transportation agency is considering several ideas including putting bicycle lockers at parking spaces at nob hill, hayes valley and other areas. residents in the the areas would have a chance to store their bikes in the lockers. if approved, san francisco would become the first major american city to have these lockers which are pretty popular in london and other european cities. an 85-year-old palo alto man detained by authorities in north korea, the topic he discussed with some north koreans that may have led to his detention. also, a shocking incident at a major bay area university. what has prompted a hate crime investigation at san jose state? still a little bit wet out there on the roads. westbound 24 is improving. is the rest of the commute improving? we'll tell you that and coming up more on 24.

american freshman. three of his dorm roommates are facing charges of hate crimes. ktvu's janine de la vega, you are there on the campus. you've been gathering new information out there all morning. >> reporter: yes. i just spoke to one black student, a junior here at san jose state university. he says he doesn't know the victim or suspects involved. he said if it was happening to him, he could would have been terrified. there will be a rally at the quad behind me. the district attorney's says they allegedly nicknamed the victim three-fifths or fraction which was in reference to counting black slaves. the district attorney place the defendants placed a u-shaped

bicycle lock around his neck and refused to give him a key to unlock t there are allegations that the victims were barricaded in his room by the defendant and they also apparently hung a confederate flag in the common area of the suite. now, i'm joined now by a student who is with the black student -- >> this is disheartening. this really hurts us that the student didn't feel like he had somewhere to go to and he felt like he was alone. >> reporter: you said you just learned about this yesterday. you called to have black thursday. you are not calling it a protest. what's gonna be done here at noon in the quad? >> at noon in the quad we're basically gonna gather up together and just show support for the student and let him know that he has people for him

this should have never happened. >> reporter: the district attorney general's office is charging those three three students. if convicted, they face a maximum of one year in the county jail. we've been trying to contact the university spokesperson all morning long on campus to find out if there will be any sanctions on the students. we've not heard back yet. reporting live from san jose, janine de la vega, ktvu channel 2 news. a terrible misunderstanding. that's what friends and family are saying about an 85-year-old man from palo alto who is now detained in north korea. ktvu's pam cook is following the developments from the newsroom. really, pam, much of this case

is a mystery. >> it is. the details are being kept pretty quiet. he went on a tour of north korea -- north korea. his u.s. military service more than 50 years ago during the korean war may be the reason he was escorted off the plane as he was about to head back home to palo alto. his son said the day before his father was scheduled to depart, is he ended up in a conversation -- depart, he ended up in a conversation with officials about his service in the war. the next day, he was escorted off the plane minutes before take off. that was on october 26th. his family has not had any contact with him since. this morning, we heard from a us special hive for north korean policy -- specialist for north korean policy. >> north korea could send a

different signal about its interest in having a different sort of relationship with the united states. >> north korea has detained six americans since 2009. now, newman's palo alto neighbors tell us that his wife has talked to him on the phone but it's not clear when she spoke to him last or what he was able to say. friends and neighbors were told that newman's wife was able to send some of his heart medication to the swedish ambassador. we don't know his condition. reporting live from the newsroom, pam cook, ktvu channel 2 news. let's go to sal. there's been a major crash in san jose. where? >> that's right. it's on silver creek valley road at farnsworth drive, east of highway 101. i'm pushing into it now on my maps now. this crash on this road that a lot of people take to get around the golf course here and off of 101, it's reported to be a major injury crash. it's a good area for you to avoid in san jose. stay on 101.

101 is not all that bad. i know a lot of people use this road to get around some of the crowding but this morning it's not a good idea. let's take a look at the san mateo bridge. it's at a standstill again. this is becoming typical. it gets supercrowded on the way to 101. when you get to 101, it's slow. the bay bridge toll plaza has improved. that's a 15 to 20-minute wait. let's go to steve. a lot of people tweeting me saying up in the north bay, the blue sky is here and the wind is picking up. i don't think there is any rain left. we can thank mother nature for this one. longest time without any rain. it we get rain -- db we get -- did we get rain? anywhere from 1 to 3 inches. this system is moving fast. really fast. the wind is cranking up. we'll go from a cloudy, rainy pattern to a cool, breezy one.

drill is underway in the fairfield area with several military helicopters involved. service members from travis air base in solano county are taking part in a special helicopter exercise. these are live pictures right now from travis. boy, you can see how big the helicopters are with the service members right at the bottom there. this morning's exercise includes the 21st contingency response wing and the california army guard chinook helicopters. during the drill, they will fly to rio vista to show how fafs they can -- how fafs they can load -- how fast they can load and unload in a situation. the airport is working to correct some of the communication problems after the asiana crash. that includes the failure of a system designed to alert key managers during an had emergency and the website that went down as people used it to get information on the crash. it's also making other changes. airport restaurants will remain open 24 hours a day during

major emergencies. and the airport is working with nearby hotels so they won't do price gouging, raising their roommate when passengers are stranded. the airport plans to set up an area where families can be reunited. we're learning that president obama is adding a nonfund-raising appearance to his visit to san francisco on monday. according to a white house official, i will make a stop at the betty ong center in chinatown where he will encourage congress to pass immigration reform legislation. the president was already scheduled to appear at a democratic fund-raiser at the san francisco jazz center on monday. ticket sales have been slow there. prices were recently cut in half. let's quickly go to sal. breaking news in our traffic. what happened? >> we have a car into the water in the richmond channel. i just found out about this. it's on whar of street at the end -- wharf street at the end of the richmond channel. this is not what i'm showing on the map. so i -- but i do have -- what
