surrender to authorities. ktvu's robert handa has been looking threw the -- through the police documents. >> reporter: here on campus tonight the hate crimes are the main topic of conversation and arguments here and as we will show you, the talk is libel to get more -- likely to get more heated. >> reporter: turmoil on campus starting in august till allegation surfaced in october. now three white students have been suspended after being charged with hate crimes directed at a african american roommate. ktvu obtained the host state police reports -- that showed san jose state police reports. the police investigation showed the three students started by nicknaming the african american student as 3/5 and fraction and the students put up a

confederate flag in their suit, wrote racial slurs and posted a picture of hiltler. but then the hate crime prosecutor said it effectilated to violence -- escalated to violence and they forced a bicycle lock around his neck. >> they were unable to do it but the victim was injured in the process. >> reporter: they filed a battery charge and hate crime charge against the three roommates. if convicted the maximum penalty would be one year in county jail. the naacp says there should be felony charges and wants the investigation broad tornado a federal level -- broad tornado a federal level. -- broadened to a federal level. why the district attorney decided for misdemeanor and not felony charges. >> these are college students

who are not sophisticate. not part of a larger organization and the level of violence was not as high as it could be. >> reporter: one accused student is this young man. the other two. police say they are in contact with the other two students and making arrangements for their surrender. robert handa, ktvu channel 2 news. are group of students marched through -- a large group of students marched through the campus to speak about the dorm crime. >> the march ended at the statues of the san jose state alums who made that black power salute on the stand at the 1968 olympics. some students told us they experienced racial intolerance on campus but others were surprised to hear about the

allegations. >> first time i was called the "n" word was last year at a football game by a white male. >> wherever i walk, i can just feel like i am welcomed anywhere. >> black student organizations presented a list of demands to the administration. they want african american studies made a prerequisite and zero tolerance. san jose state president released a statement today condemning what happened to that student. she said we speak directly to all freshman about discrimination and harassment during orientation and at meetings. we will reexamine our programs and safety measures within campus housing and throughout the university. that incident has sparked a lot of debate on our ktvu facebook

page. join the conversation and tell us what you think. a man's body was found in a submerged car in richmond. the car was pulled out at 11:15 a.m. this morning. police say someone called 911 a few hours earlier to say they saw a car in the water. dive teams worked to find the car and pull it out. investigators after the sure how long it was dollar there. the man hasn't been identified but witnesses say he lived on the boat in the harbor. b.a.r.t. is waiting for the unions to act after the board approved a deal but rejected a piece of it. ktvu's tom vacar spoke to union leaders who are deciding what they are going to do next. tom? >> reporter: it is fair to say b.a.r.t. is in serious disarray.

california's commissioner said it would not have hurt the exchange. >> presenting consumers from renewing their contracts is a disservice to the consumers and breaks the promise they were given. >> 8 other states have also decided to cancel policies that don't meet the requirements. today covered california released new numbers. 30,000 people enrolled for policies. 56% were 45 to 64 years old. 23% were 18-34. they are taking steps to help people who may lose their policies. they created a phone hot leap thatopeps -- line that opens monday. the president visit is creating a buzz because of changes he made. president obama a list of appearances set for his visit to san francisco next monday but this time around his poll numbers are at a all time low.
