i'm john sasaki. bebegin with -- we begin with developing news out of santa clara where police rushed to an apartment complex where a woman was shot. janine de la vega is there now. it appears someone is in custody? >> reporter: yes, police are questioning him right now. we're here on granada avenue. police have the royal ambassador apartments roped off with crime tape. they are escorting residents into that complex and right now, they are interviewing people to see if they were witnesses to this shooting. now we know at 11:00 a.m., they received a report of gunshots at the apartment complex. when officers arrived, they found a woman who had been shot. we don't know where but they were able to track down a male suspect. now, we're still waiting to hear from police to find out what the motive in this shooting was. don't know if there was a relationship between the victim and the suspect but at this point, we are hearing that he

is in custody. we know the woman was rushed to the hospital. right now, police weren't able to tell me the extent of her injuries or how serious they were. we're expecting a spokesman to arrive to see if they can shed any more light on the shooting. reporting live from santa clara, janine de la vega, ktvu channel 2 news. a san francisco elementary school is on lockdown right now after a late-morning shooting that injured one person in the portola district before 11:00 a.m. the victim is male. not clear how old he is or bad how badly he was hurt. students are ordered not to go outside. the b.a.r.t. contract dispute will be heading to court. the two biggest unions announced they've filed suit against the transit agency. ktvu's sal castanedo is live from oakland where the union leaders just spoke out moments ago.

>> reporter: john, the lawsuit was filed at 10:00 this morning here at alameda county superior court. it accuses b.a.r.t. of breaking the law, bargaining in bad faith and refusing to negotiate. now, today a union attorney said b.a.r.t. cannot choose to honor only part of a valid agreement. >> b.a.r.t. continues to point fingers at others and is not taking responsibility for its own actions. b.a.r.t. has never offered to us to negotiate over this supposed mistake. instead, it has approached us by saying take it out. it must come out of the total package agreement. otherwise, we will not approve the contract. >> reporter: attorneys pointed out the b.a.r.t. board repeatedly said it was very involved in negotiations and indicated the agreement signed was the final agreement. this is another chapter in contentious labor negotiations that have taken up a large part

50s. 49 at hillsborough. 55 menlo park. mid-50. saratoga, 53 for you. 50 in orinda. low 50s walnut creek. 50 in pittsburg and low 50s for san ramon and brentwood. the system is moving through the area. the front is pulling through bringing snore to the sierra where there is a -- snow to the sierra where there is a winter weather advisory. for you, the cold weather -- for us, the cold weather will linger. temperatures will be cool, a freeze warning for the north bay and parts of the delta and then tomorrow night into thursday this freeze warning is going to be more widespread. that tells you that more cold weather is going to come and it's going to linger. i will have a look at your afternoon high for today and just how low the temperatures will go -- coming up.

two dozen treasure island residents are meeting tonight to discuss their temporary relocation during a major cleanup effort on the island. the residents are likely being moved to other housing on the island as the navy cleans up chemicals found in the soil. the navy says treasure island is a safe place to live. it could be as late as 2020 before all toxic waste is cleared out of there. the sonoma county board of supervisors is creating a new task force in the wake of the andy lopez case. it will be a a 20-member panel made up of law enforcement and the community. a sheriff deputy mistook lopez's air soft gun for the real thing. the task force is being formed to ensure that future incidents are investigated fairly. >> certainly when you have a lack of trust in any capacity, you need to deal with it and address that. i think there's many ways to deal with that.

whether this committee will morph into a full-blown subpoena serving investigative body is yet to be seen. >> the final recommendations are due a year from now. the santa rosa police department continues to investigate the lopez shooting and the district attorney will decide if criminal charges are warranted. the long bitter dispute between the city of san jose and the police union could be settled. the police officers association just announced the members voted to accept the agreement reached by negotiators last month. if a deal is approved on december 10th by the city council, police officers will get a 4% this raise this year and 3% over the next few years. some san francisco giants' minor league players have been hurt in a car accident. tara moriarty has more. >> we know four people with the minor league organization were taken to the hospital this morning. three had cuts and scrapes. one person had more seer yours

injuries -- steer jurs -- serious injuries. a transport van carrying 11 people pulled out of a driveway when it was struck by a kia sedan. the sedan hit the van in the side, spun, hit a tree. luckily, no life-threatening injuries. >> the want was loaded. there -- the van was loaded. there were 12 people in there. they were part of the giants organization and they were on their way to a training camp. >> the giants conducts training in scottsdale. the team trainer is headed to the hospital to check on the players. the club's major league team also has spring training there. at this point in the investigation, police say the driver of the van, a 41-year- old tempe man will be cited for failing to yield. the driver of the korea was not hurt -- of the kia was not hurt. back to you. >> thank you. emergency crews are searching for dale smithant his

four passengers -- smith and his four passengers. air traffic control lost contact with him on sunday. this is his beach bonanza plane. air traffic controllers say he reported engine problem. the idaho national guard resumed the search this morning. a man who spent most of his life protecting others is being remembered by friends and loved ones. the mulberry funeral service is being held. daniel armenta died from a rare cancer last week. he worked at fire station 1, which is one of the busiest fire stations in the nation. he's one of about a dozen firefighters who went to ground zero after -- after 9/11. he's one of three firefighters who have tied from this rare cancer. two others have been diagnosed with the same disease. >> every firefighter in the

church knows why he had cancer. he had multiple exposures throughout his whole career. >> he retired in june of 2011 after a career of more than 30 years as a firefighter. members of the police department are also mourning the loss of a foam former colleague. neville gibbons died on sunday. her is everybodied with the -- he served with the department for 30 years. a rude awakening in cupertino after a big rig dump truck slammed into a garage this morning. and a deadly shark attack in hawaii. where it happened and the precautions being taken to prevent future attacks. let's go back to sal castanedo with more on the lawsuit filed by b.a.r.t.'s two unions. >> reporter: i've just taken a look at the lawsuit here filed in alameda county. in its b.a.r.t.'s two largest unions accuse the management of breaking an agreement. b.a.r.t. said they had no choice but to file the lawsuit. they said the six-week paid leave family act was negotiated

during their long and contentious negotiated battle that resulted in two strikes throughout the year. so b.a.r.t.'s union said they will continue with the lawsuit. they will -- they will ask b.a.r.t. to honor the contract it signed. so far, b.a.r.t. has only said that the language pertaining to the family leave, six-week portion of that contract was a mistake. they've gone forward to sign a contract without that provision in it. coming up later on the evening newscast, my colleague, tom vacar, will have more on b.a.r.t.'s reaction and what riders can expect after the filing of this lawsuit. live in oakland, sal castanedo, ktvu channel 2 news. a shocking visitor for the owners of a cupertino home. a big rig dump truck crashed into the detached garage around 6:30 a.m. the house is on foothill boulevard. the truck knocked down a utility pole. the driver said he lost control of the truck.

no word how fast he was going. neighbors said they complained in the past about speeding trucks going to a nearby quarry. the santa clara sheriff's office is investigating the cause of the crash. >> i will say that we don't believe that alcohol is a factor in this collision. >> investigators say no one as the house was -- at the house was injured. the truck driver has minor crashes. we're learning that bill beckwithwas the individual who died in the motorcycle accident. he crashed into a car last night in the city's lower haight neighborhood. he was pronounced dead at the scene. police say the driver of the car is cooperating. beckwith's family has created a facebook page where peach -- where people are remembering. the fire at the marina

apartments forced dozens their from homes. flames broke out in a unit that had been vacant. woman who lived there had been gone for days and someone broke into the apartment before the fire started. >> it looks like the apartment had been burglarized. the window had been -- the front door had been knocked out and i believe there was an accelerant placed within that apartment. >> the fire displaced at least two dozen people. the firefighter who was injured suffered second-degree bushes. a 56-year-old man was arrested for theft at the new site of apple's space ship headquarters on saturday night. he's accused of stealing copper pipes and wiring from the future site of the apple 2 campus. he faces burglary and possession of burglary tools charges. a popular walnut creek business has closed its doors after 26 years in business. the owner of yogurt park says he's one of many tenants that have to move out by the end of

the january. all of these buildings are being torn down as part of a massive two-year renovation project. >> it's heartbreaking not only for me personally but for the customers we've had through the years and all of my employees. >> the city council could give final approval to the project later this month. a federal report says the commission planning to revoke city college of san francisco's accreditation should be given one year to fix its own problems. the department of education reports the accrediting commission violated regulations in the review of city college. it says the commission failed to get enough educators on its evaluation teams as required. the report does not recommend taking away the commission's authority. the city college stands to lose its accreditation by the end of july. a kayaker is dead after being attacked by a shark off the coast of maui yesterday. the man is 57-year-old patrick brianny of washington state. they say he was fishing from

his kayak between maui and molukinni. brianny died a short time later. a lifeguard says stretches are being taken to keep people safe. >> we're disclosing the beach monitoring, making sure everybody stays safe. >> this latest incident is the eighth shark attack near maui this year. here's dramatic video of a helicopter rescue yesterday to help a kayaker off tomalas bay. no word why the man got sick or his current condition. a winter storm is dropping know in the greater lake tahoe area. a winter weather advisory is in effect right now. this is donner summit early this this morning. some 2 to 6 inches are expected to fall over 5,000 feet.

>> nice and cold and i winter storm. >> if you are headed to the sierra, don't forget to pack the rains. the snow is expected to fall until at least 2:00 this afternoon. and that same wintry storm bringing cold temperatures to our area, mostly cloudy skies even a few sprinkles reported at times. but this system is passing through. behind it, even colder air will be settling in. giving you a live look here. you can see widespread gray skies around the region right now. if i zoom in a little bit, we're looking at perhaps a few sprinkles falling over our east bay hills. we have mainly dry conditions as we get into your afternoon. we may see a little bit more sunshine. the clouds will continue to clear from north to south and if you take a look right to the north here at santa rosa, you can see just to the north a little bit of clearing here. so we may see again a little bit of sunshine for the

afternoon. possibility of the sprinkles leaving the area as well. we'll be left with cool conditions behind. i showed you at the top of the hour how cool we are. low 50s around the region at this lunch hour. it could be a blufrtry day for many. the winds are picking up as well. 10 miles an hour reported at sfo. hayward, 8. 5 in livermore. but i do expect we'll turn a little bit breezier for the second half of the afternoon. take a look at half moon bay. 21 miles per hour reported right now. some areas a few degrees cooler around the bay. the inland communities, 5 to 10 chillier. this is just the beginning of our cooldown. we have advisories that will pop up later this week. the first to see will be over the north bay. it starts later tonight into tomorrow morning from very, very cold temperatures, freezing in some areas and the flees warning again starting late tonight lasting all the way into thursday morning. notice we're widespread with the purple here. many of us will not see the

advisories move into place until wednesday. for tonight only the north bay and san francisco is not participating in this advisory. so san francisco expected to stay in the low 40s for most of the overnight hours. giving you a look here at some of the temperatures, again, it's a cool one out there. oakland 53 right now. for the afternoon, i expect we'll repain -- remain on the cool side. topping out at 56. sun setting before 5:00 and slipping back in the 50s, as we get into 6:00 and temperatures cool into the overnight hours. 56 for san rafael. 54 in concord. 56 for hayward. widespread mid-50s. 54 in san jose. even low 50s for some. 53 morgan hill. 55 for redwood city, your extended forecast showing you temperatures continuing to fall off in the overnight hours. freezing tomorrow. coldest conditions expected thursday. upper 20s to upper 30s in the

forecast thursday morning. we may see some more rain come our way. that's great news. could moderate temperatures a little bit. but all in all a very cool pattern all the way through the weekend. we definitely need the rain. a few inches reported for some of the ski resorts. >> thank you. the city of san francisco's considering is a proposal to ban butterflies from being released at events like weddings and funerals. some groups say releasing butterflies can be hazardous to the environment. if the ban is approved, san francisco could become the first city to outlaw the release of insects. rice says this is the first time in four years he's seen a river otter in the area. experts say the fact that more river otters are popping up in the bay is a sign the bay is
