today more than two months after a deadly crash in san francisco the driver who caused the collision is being charged. gamp, i'm tori campbell. 16-year-old kevin sam was riding in a van with his mother and sister when they were rear- ended back in september. katie stevenson was there as they announced the charges a short time ago. anne has learned new details about the investigation that led up to the announcement. david? >> garden tori. police back in september booked jimmy zoo on a vehicular manslaughter charges, they said today she will be facing felony charges, felony vehicular manslaughter and two counts of reckless driving causing injury. this is the result of a september crash in which they say she was going as fast as 70, not 80 hours, in her mercedes suv before she rear-

ended a minivan, that killed kevin sam. sam's sister was injured, and his mother, a salsalito post office work arer, has suffered a broken spine. the suv accelerated without warning and says she did not remember making any attempt to push the brake, turn the ignition off or put it in another gear to stop the car, we have also learned the investigators brought in a mercedes engineer and a member of the accident investigation team to examine her suv we're told for hnidy effects before filing charges. >> it's seven years, but i don't want people to think that she would necessarily look at going to prison for seven years, we don't know at this point. >> he she had no previous record and a clean driving record as well. we reached out this morning to kevin sam's family and her for

comment on the charges, no response, zoo will be back in court thursday to be arraigned on the charges, she is out currently on $320,000-bail. david stevenson, ktvu channel 2 news tori tori we're following a development story in near big sur where people living in the path '06 a fire are not being allowed to go home. the fire started around midnight in the fiver ridge area of the las pa degree national fifth in southern monterey county. the flames are burning towards the ocean across dry vice- presidential takings. so far, 500 acres have burned, there are a number of homes scattered along the fire's path. 15 structures have burned the forest service has not saved yet in any of those are homes and there is no word, yet, on a possible cause. today is the ninth consecutive day that a winter spare the air alert has been issued for the bay area. this is a live look out towards mount diablo. the alert means that it is

illegal 20 burn wood or any other solid fuel, either indoors or outdoors unless it's your only source for hit. rosemary is here to tell us about the near records for parts of the bay area. rosemary? >> as you know tori and for big sur as well as for us, one of the driest years on record thus far. so we're hoping for some change here. but not for today. in fact we are looking at the possibility of nearing some record warmth. santa rosa right now 61 degrees, and around the bay area, most of us anywhere from 2 to 4 degrees warmer than where we were just yesterday. 65 in livermore right now. i have to point to the half moon bay, though, take a look at half moon bay, 66 degrees. half moon bay started out at 57 degrees this morning. santa cruz also right about 67 degrees this hour, santa cruz may be one of those cases where we break a record today. 76 in the forecast for santa cruz, we'll see how close we get. gilroy 7 the, the old record

gallons of water that gushed from a broken sky main. >> you had water cascading down the stairwell, down the escalators. >> police say it was a chaotic scene when emergency crews first aride at 2:15 a.m. hot water was flowing out of the broken line for an hour before it was turned off. >> about 180 degrees so there was a lot of steam coming out and then that triggered the sprinkler system. >> it left a soppy mess with broken ceiling tiles and possible electrical problems. areas were standing water were roped off which included baggage claim and security. confused travelers arriving for flights were still able to check in but they had to walk or take a shuttle to terminal b to check their bags and get screened for security. >> it was unexpected for all of us really, wait, what's goin' on here, they told us the water main broke, we are running a little late, all the air flights here are delayed. >> the airport confirmed it caused several delays and at least one canceled flight. clean up cruise worked for

hours using mops and fans. yards of stuff was spread out to soak up water. >> our in line baggage system is down right now and we're assess hag kind of damage there was there as well as the tsa equipment. >> all baggage equipment is now arriving at terminal b. airport officials will be investigating what caused the water main to break, coming up at 5:00, my colleague robert honda will have an update on the situation here at 5 and 6:00. reporting live from the airport, gineen de la vega. thank you. a judge ruled the practice of collecting bulk phone records violates the constitutional ban on unreasonable searches. two playoffs brought the suit and the judge agreed that their privacy interests outweighed the government's interest in collecting the detachment but the judge put his decision on hold pending a nearly certain government appeal. the data collection information

was leaked by edward snowden. santa clara police are investigating a deadly crash involving a man riding a motorized scooter in a parking lot. the man was found around 4:30 this morning lying on the pavement in the winchester shopping center on stevens creek boulevard. the man's body was near his scooter. police say no other vehicles were involved and the man may have hit one of those harking stall cement curb stops. >> the riderrer hit either a curb stop or a pole and combination of one or the other. we're trying to figure out what happened. >> the man's name has not yet been released. police also say he was not wearing a helmet. anyone with information about what happened is asked to call santa clara police. a 13-year-old oakland girl remains on life support this morning in a tragic medical case surrounded by controversy. jahi mac mcmass was judged brain dead after she went into

hospital for ton sil surgery. the family accuses the hospital of inadequate care that led to the girl suffering a heart attack after the procedure. the hospital is promising a full investigation. the vallejo city council plans to hold a public hearing tonight on a proposal to impose some pay and heat health care provisions on the police department. the provisions including 5% cuts in police pay and a 25% increase in the cost '06 health care contributions. the city manager says it is necessary in order to close the city's budget deficit. >> we have about $5 million less revenue than we need for our current expenditure levels so we have been in negotiations with all of our bargaining units, really, since the end of bankruptcy, with the police association it's been since may of 2012. in order to close that gap and to move forward we need to complete these negotiations.

>> that meeting starts this evening on santa clara street in falah hoe. federal investigators are to present a draft report after their recommend immigrations after last year's fire at richmond refinery. they are expected to say the refinery did spot maintenance rather than clock looking at the big picture. they are also likely to call on california to change the regulations to a more comprehensive system used in the united kingdom, norway and australia. the city of san francisco officially began rolling out free wi-fi on market street. it is now available on 3 miles of the busy thoroughfare from the embarcadero to castro street. the wi-fi service is expected to cost the city half a million dollars after some donations from a few high-tech companies. marily says the free wi-fi will allow them to do everything from finding when the next bus is coming to checking out job

>> tori: a wild blast shook part of san francisco south of market neighborhood today. police used a water cannon to break apart a box suspected of being a bomb. it started around 8:20 this morning with the report of a suspicious package chained to the front gate of the san francisco public health building on howard street near ninth. officers called the bomb squad who shut down howard between 9th and 10 th streets, the box was described as being 3 feet long 2 feet wide and 3 feet tall. it is unclear what was inside. workers were allowed back in the biddings about 11. 20 within the last few minutes they gave the all-clear to go back into harvard university buildings in a bomb threat. they were evacuated after university police received a call saying bombs were planted there. a search did not close any

explosives. a dorm, two classroom buildings and the science center were re- opened after it was searched. it is exam time and some students were just about to start finals whether when the threat was received. >> because of all the bombings recently we should have precautions and i think so it's important we are. >> law enforcement firms say the whole thing appears to be a hoax. the f.b.i. from cambridge and harvard university are investigating. a sky thinking new report was relisted tooth about workers helping people sign up for health insurance under the affordable care act. some of those so-called health 1/2 gators are breaking the law. kyla campbell joins us to explain how your taxpayer dollars could be wasted. kyla? >> tori, they sent me this report, highlighting examples of those 1/2 gators encouraging people to lie. >> don't get yourself in trouble by declaring it now.

>> exactly. >> this is undercover video provided by conservative activists caught on camera. 1/2 gators encouraging people to not claim cash income, to not admit they smoke, all to get more assistance in the form of taxpayer money and pay lower premiers for health care. the oversight committee says the administration is not doing enough to stop fraud. one taxpayers advocate says the administration supports it in order to get more people to enroll in '0'bama care. >> the administration basically is bribing people with their own money by increasing the sub si december and making it available to more people. >> they tell me 1/2 gators caught on camera encouraging fraud were fired. they say this oversight committee report just released today is the republicans latest attempt to prevent americans from getting quality affordable

health care. kyla campbell, ktvu channel 2 news. >> tori: thank you kyla. university workers are expected to vote on a contract this week. the union is calling the contract an historic deal. the union represents nearly 15,000 workers throughout the system. the proposed contract includes wage increases from 11 to 13% over a four-year period. ac transit contract negotiations are expected to resume today. the talks come as the agency rolls out new routes and extended hours. the union says those changes violate the terms of a court- ordered 60-day cooling off period between the union and management. the union could go on strike once the cooling off period ends in a week. and in palo alto the city council is considering a plan to help preserve more street parking for residents. they would charge for permits. most of the permits would go to residents but some employees would work for nearby

[ ♪ ♪ ] it's a great day to head to the beach. >> gineen: temperatures anywhere from 4 to 6 degrees warmer in some areas than what we had yesterday. in areas like concord at this hour, 4 degrees warmer than yesterday, livermore 5 degrees and san rafael 7 degrees above what we had at this hour yesterday. go giving you a live look, there, at high clouds and hazy sunshine, as tori mentioned at the top of the hour, another spare the air day, ninth confidential secretaritive as we get through your monday. we do have air quality poor in most cases, we're above that threshold so just to be aware for the north bay. the coast central bay as well as the eastern district and into the santa clara valley. all areas would be a shade of

orange indicating if you are very susceptible to the air pollution, to be aware of the you suffer from respiratory. >> , suffer from as ha, this to be aware of limited outdoor activities if you can spare the air day today. possibly even into tomorrow. because we just don't see much change going on. i put the arrows here to point you to this ridge of high pressure that remains in control of our weather pattern. so the storm track staying well to the north and we are so dry we could definitely use some rain, but the system continues to just push those storms off to the east. eventually this is going to break down, in the days ahead, eventually we'll break down, we may see some showers over the sierra, we may get a slight chance come thursday, but that's really about it. it's not really anything that will amount to much. not what we need for sure. if you do see those high clouds overhead today, they are coming in from a system off the southern portion of the coast. this is actually moving to the bay area, going all the way into nevada, so the high clouds streaming from here, if you look up today, see those high

clouds, this is where they are coming from. 67degrees right now, santa rosa, 63 san francisco, oakland, you're checking in right about 56, one of the cooler spots concord, 62 outside the door, san jose right now 59 into the afternoon, you're looking at just 66 by 3:00, san jose, expected to top out at 68 this afternoon. 60degrees as we settle into about 6:00 and sunsetting, oh, anywhere from 5 to 10 minutes before the 5:00 hour these days, so for today mostly sunny, temperatures will be at their warmest for today, 66 hayward, 68 mountain view, we're looking at near 70 degrees in some areas like santa rosa, santa cruz going to nice and warm, already in the upper 60s to 70s, half moon bay, temperatures beginning to drop off slightly tomorrow. a bigger drop coming wednesday, thirst that possibility a slight chance at this point, the models keep pulling back on that possibility of us getting any rain, we're going to turn cool and turn breezy.
