[ speaking foreign language ] >> devastating. i lost my son. almost lost my wife. >> reporter: kevin san was killed killed when the van driven by his mother was rear ended by a suv going more than 70 miles an hour. prosecutors announced the driver jennie zhu will face felony voluntary manslaughter and reckless driving charges. >> i think -- i hope she will get what she deserves. >> reporter: the mom is in

therapy recovering from a brain injury. >> the problem is her memory lost a lot. >> reporter: documents indicate jennie zhu told investigators the suv accelerated without warning and didn't make an attempt to stop the car. >> i want her to think deeply on herself. why this happened and cause this to my family. >> reporter: jennie zhu's attorney did not return hour calls but she set to be arraigned thursday. the father will be in court as well. david stevenson, ktvu channel 2 news. developing news now. a dozen homes have been destroyed in a wildfire burning in big sur. helicopters are dropping water over the flames fear pfeiffer ridge road. at this point the highway remains open but that could change. the chelsea prince carbon monoxide -- the chp continues

to monitor the situation. 500 acres burned and there is no containment. one of the homes destroyed belongs to the volunteer fire chief. ktvu's amber amber lee is there and we will hear from her when we get a signal. weather could make a big difference, our ktvu's chief meteorologist bill martin is tracking the conditions. >> the conditions aren't that massive, upper 60s, humidity in the 17s. it has been dry. a dry year. so the hills are not as moist as they would normally be. in the fire zone the weather isn't playing a major role but what is helping, you see that wind out of the southwest, that wind will increase the humidity into the evening hours, it will drop temperatures as well. that is a good direction. here are the clouds.

was preventible. it said after a 2007 fire workers told the company about hazard and nothing was done to address them. the fire sent 15,000 people to helmets with breathing -- hospitals with breathing problems. they suggest they adopt a new system, that requires input from workers, the company and regulators to identify safety hazards. if the company does not implement what is agreed on the regulator can shut down operations. >> i believe it will take a lot of work. i like the effect where workers are given more power to be involved in decisions. >> those changes recommended in the report aren't just for chevron but all california refineries. more details on the fire, three weeks after the fire on october 6, 2012, the u.s. chemical safety board and cal-osha launched an investigation.

january 30 this year cal-osha issued citations for safety violations. october 5, chevron agreed to pay $2 million in fines after pleading no contest to charges from the fire. our coverage continues on www.ktvu.com. we posted the draft report on our website, if you would like to read it. go to our home page and click on east bay tab. city counsel will discuss possible pay cuts for police officers. a 5% pay caught and 25% increase in healthcare contributions. they said it is necessary to close the $5 million budget gap. the city is seeing a string of homicides in recent weeks. the water main break at san jose international airport. things are getting better tonight but travelers are still being inconvenienced. the trouble started early this

morning and created a lot of confusion during a busy time for the airport. ktvu's robert handa is live at san jose international with more on the repairs and the problems and a possible cause here. >> reporter: we have been following this situation since this morning. at this hour people will find life easier than travelers did earlier before the flooding. half an hour ago officials told me engineers say they believe a failed joint is responsible for today's misery. >> reporter: it took one look at the dripping conditions at san jose international airport for travelers to know plans will be doused. >> it is kind of weird. unexpected. we are like wait. what is going on here? >> reporter: work crews are cleaning and repairing after the water main break in the sky bridge connecting terminal a to

the parking area. 2,000 gallons poured out and the hot water temperature set off the sprinklers. >> flooded the bridge, security check point and put us out of operations. >> reporter: one flight to los angeles was canceled and several others delayed. they scrambled to get passengers and luggage on board. >> get tags. and bring them out here. they will load them up here and then you go back into the building. to the check point. >> reporter: screenings went slowly with one lane open. still many could see the damage. >> under the circumstances it looks like it was a devastating situation as far as the timing and everything else. i mean, monday morning commute could be crazy. >> next week it would be worse. >> reporter: officials are advising travelers to check with their airlines and to

arrive two hours early. we have been told a failed joint caused the water main break. the investigation as well as clean up and repairs will continue through the night. live in san jose, robert handa, ktvu channel 2 news. the city counsel is scheduled to disa spending ordinance that bans people from sleeping or living in their cars. they passed the ordinance in october. now the city manager wants to suspend it while the supreme court considers the constitutionallality of a similar law in los angeles. governor jerry brown was in mountain view today talking to leaders about the role silicon valley is playing in the economic recovery. >> employment is coming back. there is tremendous things being invented and still occurring. >> the governor said california

has a budget surplus after facing devsets year after year and it was accomplished through cuts and taxes. >> we cut, we tax and we are still investing. those three things are very important to stabilize and advance our country. >> the governor says there is a lot of excitement in silicon valley and people come here from all over the world. a judge ruled today that the nsa's practice of collecting phone records in bulk is unconstitutional. 5 plaintiffs brought the suit against the government. the judge ruled the practice violates the ban on unreasonable searches and the judge agreed the privacy of the

plaintiffs outweighed the government's interest in collecting the data. the adjustment put the decision on -- the judge put the decision on hold pending a government appeal. 7 people in berkeley all robbed since thursday. the one factor most had in common. >> we went from record lows to near historic highs. how long the warm weather will last where you live. >> and a san jose pilot and his passengers missing in idaho. >> trees, snow. >> what one volunteer told us about the rescue continuing after authorities called off the search.

. developing news out of big sur, a wildfire destroyed a dozen homes. the pfeiffer fire is burning quest of highway -- west of highway 1. ktvu's amber lee just arrived there, what are fire crews telling you tonight? >> reporter: well, we are at the big sur rangers station. we could smell the smoke and off highway 1 we could see the flames and here with me is scott miller to bring us up to date on the fire. >> the fire is very active. it is 0% contained. i was up on the mountain reviewing what happened and our evacuations we have done, and i have seen the devastation of the homes that have been destroyed. >> reporter: how many homes destroyed? >> it appears at least 15 homes have been troyed. narrow roads -- destroyed. narrow roads, it was a quick moving fire and little chance to save the structures.

>> reporter: what is the game plan for attack? >> the game plan is to cross our fingers and hope the fire moves towards the ocean and we are hoping based on the weather forecast that that will work out. we believe there will be less structures if any that will be in danger if the fire moves in that direction. >> reporter: at this point i understand it was fueled by high winds, doesn't seem that windy now, is mother nature in your favor? >> we believe so. the problem is no rain. we have had no rain and there is a great deal of fuel. moving rapidly. >> reporter: how many people evacuated and what is being done for them? >> we had a hundred people evacuated and a few people refused. we are making sure people have a place to go and food to eat. the red cross is here working with us. >> reporter: thank you for your

time. again, night fall now, they are continuing the work but mother nature is in their favor. not very windy right now but everybody is keeping their fingers cross. as soon as we have more we will bring you the latest. amber lee, ktvu channel 2 news. despite the official search effort ending, friends and relatives continue to look for a missing plane caring a san jose pilot and his family. dale smith, his son, daughter were all on board. they were flying to montana two weeks ago. a group of friends just returned from a week of searching but they found no sign of the plane or those on board. >> if it was any one of us, anyone period, he would have been out there leading the search himself. >> the family created a

facebook page devoted to the search. it includes satellite image to help people on the ground. police say a man found dead in a strip mall parking lot lost control and crashed a scooter he was riding. the body was found 4:30 a.m. this morning in the lot at the shopping center on stevens creek road. he hit a curve and a pole and police say he was not wearing a helmet. the spike in robberies near the university of california at berkeley has students and residents on all -- on alert. ktvu's allie rasmus has more. >> reporter: it is finals week at university of california at berkeley and it is not hard to find students with their smart phones or laptops. >> i don't think about it. i take care of myself. >> reporter: police are 1ing

students and residents -- are warning students and residents. >> don't have that stuff out, maybe that person won't we considered desirable to robbers. >> reporter: after midnight thursday morning police say a man walked into this shop, cut the ipad that was attached to the register in front of the employee. sunday morning two university of california at berkeley students were held up at gun point and 3:00 a.m. sunday university of california at berkeley police say a student was the victim of an attempted robbery -- a man tried to steal her bag. the student scream and the suspect ran away. >> shocks people, it is so close. people think they are safe. >> reporter: police are working to increase patrols in the area

wheres the robberies happened. on saturday afternoon a woman had her cell phone ripped out of her hand. police started doing joint patrols with b.a.r.t. police. >> we are not the only city facing the problems. >> reporter: robberies are up 22% city wide from a year ago. allie rasmus, ktvu channel 2 news. california voters may get a say in reshaping death row. officials submitted a initiative. it calls for the end of single cell housing at san quentin and death penalty cases wouldn't automatically be appealed. the cases would go to the state court of appeals. supports believe it would save money. >> the number one cost of the death penalty is the cost of keeping prisoners on death row for 25 years.
