>> reporter: we're live in benicia where thousands of people are without power this morning. we just got an update from crews who let us know when the power would be back on. tree students arrested after -- three students arrested after one pulled a stun gun on police officers. the violent encounter at the school that sparked the incident. it's the last full day of autumn. winter begins tomorrow. i know it feels like winter has been here for a while. we'll take a look at some cold

lows and see how the weekend shapes up. >> reporter: we're live in san jose at santa's workshop where needy toils will receive toys. but the charity is still close. we'll tell you by how much. good morning. welcome to "mornings on 2." you are looking at live pictures from benicia this morning. there you can see pg&e crews trying to restore power to thousands of people in the dark on this cold morning. this all after a pair of outages overnight and into this morning. how people are coping with the cold and an update from tara moriarty. it's friday, december 20th. i'm claudine wong. tori campbell has the morning

off. >> good morning. i'm dave clark. let's check weather and traffic. >> is it winter yet? >> tomorrow morning. 9:11, official time. pleasant hill, 28. concord, 29. hidden brook, vallejo at 32. redwood shores, 37. redwood city is 34. pacifica, 33 degrees. in the mission, 43 degrees. it's officially cold because joslyn when she tweets me from daly city if she tweets me and says it's cold, it is cold. we have temperatures in the 30ss, 40s. it will be breezy for some, not too bad for others. 32, concord. 33 walnut creek. the temperature held up fairfield. antioch livermore because of a breeze. 32 half moon bay. 27 in santa rosa. it's cold for some. any clouds, yeah, if you are up in seattle portland or maybe a few high clouds for us. it's a dry a pattern. highs -- highs coming up.

sunny, northerly breeze and that will help a few, santa rosa and napa get in the 60s. other locations will be in the soft 60s. there are no major problems at the bay bridge this morning. you can see there's a slight delay. but it's much lighter than it normally is. looking at the commute on 880, the traffic good in both directions. chp has been warning about gusty winds on the bridges so just be careful. if you are driving on 680 san ramon. there was standing water reported. however, it's not causing a major traffic issue. let's go back to the desk. happening now in solano county, a power outage in benicia and vallejo have left more than 4500 people without power this morning. ktvu's tara moriarty is live in benicia where she just got an update from pg&e. tara? >> reporter: i spoke to the tow truck guy. he says this is one of three

generators being delivered to the location. it will give power to the entire neighborhood. in about an hour. that's good news. the bad news, if you can see right here where they are working on this blown transformer, that will take quite a bit of time to repair. one man told us he was boiling water this morning in order to take a bath. he actually lit a log fire to keep warm. people have been using flashlights and candles throughout the my. pg&e crews obviously gonna be very busy repairing this vault that exploded last night. we're on turner drive near south hampton road where the underground transformer blew at 7:30 and caused two outages. about 3500 people lost power initially all but 950 customers had power restored by 9:15. but then at 2:45 this morning. 4500 people were again in the dark. we spoke to one man who says his mother is frail and keeping warm in this cold has been tough. >> she's extremely thin and

gets cold very easily. we -- she doesn't have electric blankets. we added probably like five layers of blankets on her to keepler warm. >> reporter: most most outages are around rose and columbus parkway. crews expect the power to be restored in about an hour. that's the temporary fix they are working on. there's also a middle school down the street. we're gonna try to get an update from them. we placed a call in to them to see if they've been affected. tara moriarty, ktvu channel 2 news. a huge fight yesterday outside of oakland high school tleedz to three arrests. want -- leads to three arrests. i want to show you cell phone video. it was sent to us from a viewer. police say two girls started fighting. one of the girls pulled out a stun gun when police officers tried to stop the fight. when police tried to detain her, they say she passed the gun to someone else who police say put up a fight when they

tried to detain him. the investigation on into the fight. 18 months after opening the doors, an oakland charter school hoping to boost the achievement level of african- american boys will be closing next month. 100 black men community school will close january 24th. he was suffering from financial problems. low enrollment and a high staff turnovers. members of the nonprofit organization created the school in the thurgood marshall avenue. one member says the charter school may possibly reorganize and open again in a few years. a bold move by b.a.r.t.'s new board president, moments after joel keller was placed to the post he announced he wants voters to support a ban on strikes. members of the service union employees and the transit un young walked off the job.

that caused the entire bart system to shut down. >> i'm very interested in an open process and transparent process. i think it's time we move on and try to find a way to prevent these labor stoppages in the future. >> he called a war on employees and unions. i believe unions are just the beginning. >> keller's proposal calls for binding arbitration if the district and unions can no reach a deal. but it will not be state law, only the california legislature or a state-wide referendum could ban transit worker strikes. another issue weighing on the b.a.r.t. is the two deaths of the workers from october. b.a.r.t. is reviewing urgent safety recommendations. the ntsb investigated the case in which the train operated by a manager hit and killed 66- year-old lawrence daniels and 58-year-old christopher shepherd. inspectors want a nationwide

ban on a policy called simple approve. that's when they are solely responsible for their safety. the ntsb recommends that workers wear devices that detect or stop oncoming trains. happening now -- volunteers at sacred heart community service in san jose, they are getting ready for their toy giveaway. it starts about an hour from now. ktvu's janine de la vega is there to tell us what kind of toy donations are still needed. janine? >> reporter: sacred heart community service has converted this room into santa's workshop. you know, it may look like a lot of toys but they still need more. yesterday, they were 7,000 toys short. this morning, they still need 3,000. they have enough for the kids today but not for monday. later this morning. parents will have the opportunity to shop for free for their kids. many of these parents, they just can't afford to buy presents. they are scraping by trying to struggle to make ends meet,

paying their rent and utilities. let's go to some video. this is a group of parents waiting outside right now at sacred heart. they have appointments at 8:00 a.m. they wanted to make sure they have the first pick of toys. when they let the parents in, they do it in groups. one couple we spoke to say they feel grateful that they are able to receive this from the charity. they hope that one day they did help out and give back when things are getter for them -- benter -- better for them. >> he had a job. he was laid off. we have to pay for our bills first. everything has gone up so high. we told the kids we're gonna have a small christmas. but when i heard about sacred heart for again this year, i said it doesn't hurt to try it. >> reporter: parents will be able to pick out two toys. the give away on monday will happen. one. areas where the charity is hurting is gifts for teenagers.

there's a lot of toys for some of the younger kids but not for the older children. sacred heart wants to remind children that they give toys away to kids up to 18 years old. they also need more books because it is a priority for them to promote literacy. they are still taking donations because the giveaway is not just for today. they also have one on monday for all of the families who preregistered. reporting live from san jose, janine de la vega, ktvu channel 2 news. the teenager accused of setting fire to the clothing of another teenager on an oakland bus is due in court today. 16-year-old richard thomas is charged with aggravated mayhem in the attack on saw shush fleishman who was asleep on the bus at the time. while prosecutors have charged thomas as an adult, his lawyer will arc the argue the case

should be sent to juvenile court. kwame harris is due in a san mateo county courtroom today. last month, harris was convicted of assaulting his former boyfriend outside of a menlo park restaurant in 2012. the arguments stem from the use of soy sauce in their meal. today, we may find out more about the sentence he will face. many medical marijuana businesses in san jose may have to learn. the city note 2350eued pot clubs located near homes that have -- notified pot clubs located near homes have to close. new restrictions approved by city council will take effect next march. a bay area dna testing company is being hit with another lawsuit. 23 and me of mountain view is being sued for misleading claims in the marketing. the suitcase the company

marketed the kits without any proof that the tests are accurate. the company is already -- has already stopped providing medical information related to the genetic tests. an oakland woman is one of the people suing. a new government study shows more fathers are involved in the day to day lives of their kids. most say they are heavily involved in the lives of their children. 90% of dads eat meals with their families. two out of tree three day they are helping with homework. still a heartbreaking story from oakland, pitting the hospital against a family against a girl declare -- declared brain dead. the fight goes on over jahi mcmath. how her family is hoping to stop the hospital from taking her off life support. passengers take on a gunman aboard a seattle bus.

for just $2 each all december long. welcome back. 7:15. the big wildfire in big sur that started earlier this week, it should be fully contained sometime tonight. this has -- this one has burned about a thousand acres and destroyed 14 homes. evacuation orders are still in effect and hundreds of firefighters are still out there. the cause of the fire is still under investigation.

calfire says most of the bay area is under the extreme fire danger status this morning. strong winds hit the bay area yesterday. it dried out grass and trees. calfire has extra staffing even though we're six weeks past the usual time they start backing off on firefighters. there are some worries still about the wind even those weaker breezes that may topple tree branches and cross power lines and possibly start a fire. there's incredible footage taken on board a bus in in -- in seattle. the video shows a man walking over a passenger with a gun and asking for his cell phone. the gunman had taken the cell phones of several other passengers and they joined into the fight and started to beat and kick him. >> he came up to me and stuck the gun at me and took my phone. he jabbed me harder and says

don't make this harder than it has to be. >> amazingly no one was hurt in that incident. the 19-year-old suspect has pleaded not guilty. he faces up to 15 years in prison if convicted in robbery and attempted robbery charges. happening today -- a report being released analyzing the secret service concludes the agency does not have a widespread misconduct problem. the report is from the homeland security department's inspector general. it was ordered after more than a dozen secret service agents were implicated in the prostitution's scandal back in april of 2012. the ner general report makes 14 recommendations designed to improve the secret services processes for identifying and addressing instances of misconduct. president obama this morning ordered a one-year review of the military's handling of sexual assault within the ranks. late last night, the u.s. senate passed a bill that includes changes on how the military deals with sexual

assaults. the ledge langsation away the -- legislation takes away the power of overturning jury convictions among other convictions. president obama and his family are getting ready to head to hawaii this morning on air force one. they would arrive in honolulu after midnight on saturday. the president doesn't have any public events scheduled during his time on the islands and is expected to stay where he's spent the holidays since elected president. a new winner has been crowned in season 3 of "the x factor." fry montpolice have released a video from a violent home invasion robbery. it happened wednesday night on armor way. in the video you saw the person running from the home and gets

into a getaway car. police are hoping someone will recognize the car which is described as a silver or gray infiniti st 35. police say four men kicked their way into the home. a woman was able to lock herself in a bedroom. the men stole jewelry and electronics. solano county investigators say marijuana worth more than $570,000 was found at a home recently robbed. investigators say 110 pounds of processed marijuana and 107 marijuana plants were found inside a home on poplar road just outside of vacaville. four masked men broke into the home and shot one of the people multiple times and beat two others. the suspects are described as two white men and two african- american men. they were seen driving on in a silver toyota. mark zuckerberg is making a dig donation to the silicon county organization. he's giving the organization 18 million shares of facebook stock. that's currently worth a little less than a billion dollars.

it's the largest donation ever received by the community foundation. he gave the group 18 million shares last year but it was worth about half as much than it is this year. 7:25. a man in san francisco made a little girl's christmas wish come true. it's how they met that made the story so unique. a kindergarten class sent messages to santa. a little girl named joy asked for a mermaid doll. a man saw the message and went on facebook to find her. >> i had to find this little girl. i don't know where the balloon came from. i had no clue. i had to find out. terry says that balloon was really a gift from the heavens for him. his mother whose name was also joy, she died about a year ago. he decided he was gonna be santa's helper and get that little girl a mermaid doll.

this morning, almost a dozen pit bulls are being treated for injuries after being rescued for a dog fighting operation. a look at the raid and what else officers found when they went inside an oakland home. the family of a 13-year-old declared brain dead says all they would like to do is stay on life support for one more week. the shocking thing they say doctors told them. we're looking at a decent commute in some areas where it's normally slow. we'll let you know more about the other slow spots in the bay area. it's a beautiful morning. last morning for fall as winter begins tomorrow. it feels colder this morning. we'll take a look at some of the lows and seep if the afternoon highs will warm up. ♪

north wind continues. we're looking at a commute that's not all that bad even in some of the rough spots. traditionally slow. highway 4 for example, normally, we see slow traffic it's sluggish through the construction zone. it's not slow as you can see. 680 is doing very well from benicia to walnut creek with just a couple of spots where it's crowded. as you look at 80 westbound. there are crowded spots. we don't see a lot of stop-and- go traffic. b.a.r.t., caltrain and muni running regular service. no delays. bay bridge is light westbound as you come up to the pay gates. and this morning's commute is not all that bad on 280. i think it's great here downtown on northbound 280 getting up to highway 17. at 7:32. let's go back to the desk. the family of jahi mcmath, the oakland teenager on life support following what was supposed to be be routine

surgery wants a judge to stop doctors from taking her off life support. palm chambers is live at -- paul chambers is live at children's hospital with more on the legal fight. >> reporter: the family is supposed to go to court and file an injunction. he's asking that the jung girl stay on life support. he wants her full medical records. last night jahi's family met with hospital officials and asked that they keep her on life support through at least the next week. >> her brothers and sisters want to celebrate christmas with her. >> reporter: you may remember the 13-year-old came to the hospital earlier this month to have her tonsils removed but complications caused her to go into cardiac arrest. she was later declared brain dead. the family says during the meeting last night, the family asked hospital officials for a feeding tube on whether she will have a chance at full

recovery. >> me getting a second opinion from another doctor is an unusual request for a dead person. he just referred to her as dead. he don't even want to use her name. just dead. that's it. that's the only words he could use for her was dead. >> the hospital said it couldn't comment on the case. they released this statement. our heart goes out to the patient and the family. we continue to work with the family and support them during this painful time. >> reporter: live in oakland, i'm paul chambers, ktvu channel 2 news. >> happening today, a rally is scheduled to remember the teenaged boy shot and killed by a sonoma county sheriff's deputy. family and friends of 13-year- old andy lopez have been holding vigils since the shooting back in october. they are asking people to wear light and bring candles for the rally set at 4:00 p.m. the deputy who returned to duty this month after the shooting say lopez was carrying what looked like a real ak-47 rifle.

it turned out to be a replica. brian flores is live for us in san francisco where the district attorney plans to show the public the consequences of driving while under. influence. >> reporter: we're on christmas tree point road and twin peaks where a year ago today there was a tragic accident as a result of drunk driving. this morning the da's office is said to make a major office on that as well as remind drivers of the importance of staying safe. want to talk about the checkpoints taking part tonight. as is the case during the holidays, chp, other law enforcement agencies will be conducting the checkpoints. some throughout this weekend. locations won't be announced to closer when they set up. but we understand that some of the cities where the checkpoints will be include morgan hill, san francisco, martinez, santa clara, redwood city and el cerrito, meantime, this marks one year since a tragic accident here in the twin peaks area. the d.a.'s office set to

announce the sentence at 11:00 this morning on the case of gina eunice. she had three passengers in a car with her at the time a year ago when she struck and killed a 56-year-old. two others were injured. the d.a. said she was found guilty of vehicular manslaughter. later this morning, george gascon will announce her sentence at the hall of justice. the not only was one person killed but eunice was one quarter away from graduating from college. she had plans to become a police officer. brian flores, ktvu channel 2 news. some people who take b.a.r.t. will get a safety escort to the cars. the free service runs between 5:00 and 8:00 p.m. the escorts will wear police

uniforms or they will have on special safety vests. oakland animal control officers, say they've found what appears to be a major dog fighting operation. ktvu's cameras were given exclusive access to a raid yesterday. 11 dogs were found at a home on eldridge avenue by oakland police, while they were serving and unrelated search warrant. police found pit bulls chained up. many of them were wounded. they found modified tread mills and vests used to train dogs to fight. they also found medical supplies for treating their wounds. >> we've had a fair number, maybe a dozen or so dead pit bulls in this neighborhood recover just in the past couple of months. >> the interim director of animal services says this is the one of the biggest dog- fighting operations he's ever seen. officers say a family with children appears to live at the house but no one was home during the raid. so far no arrests have been made. all of those dogs are now being

treated at oakland animal services. meantime a pack of wild dogs are suspected of attacking dozens of sheep at a livestock action yard in san joaquin county. 80 people were attacked sunday night and the ones who did not die had to be euthanized. the person who owns the ranch is worried that people may be attacked as well. >> i feel really bad for the animals. but i think we have a safety issue. there's kids that live in this area and, you know, i don't want them to attack the kids. >> a similar attack happened back in april. 160 goats were killed by wild dogs in that same area. new this morning, a company based in san jose is recalling more than 700 pounds of sausage because it may be contaminated. lee brothers food service incorporated is recalling 16- ounce packages of lee sand westbound brands produced on

february 11th and the code is 042-p. the recall covers 16- ounce pork and chicken pr uckets, 043 -- products and the code is 043 pc the products were sold here in california and nevada. they were also sold online. no illnesses have been reported. credit card companies are working to help people with the data breach at target. they are notifying all customers whose information was stolen. kamala harris says her office is investigating what steps can be taken. she says in the meantime, there are things card users can do. >> in this era of fabulous technology, which is be mindful that it's important to change pass codes frequently to review your statements as they come in in realtime because there are great benefits from the technology but also pitfalls. >> target is suggesting

shoppers put credit card freezes on freezes. they remind those they can get free credit reports oncary -- once a year to report any discepcy. kohl's is holding a holiday shop-a-thon so customers can finish shopping whenever they want. this is the first time kohl's has tried this. kohl's says if it's popular with customers it may do it again next year. this morning, still a mystery, still no word who bought one of two winning megamillion-dollar jackpot tickets earlier this week. that jackpot was $648 million. the california lottery says the person who had purchased a winning ticket at a gift shop in san jose has not claimed the prize. the name of a second winner in georgia has already been announced. the winners will get $324

and you are taking a live look at the big board this morning. the dow is up by almost -- 65 points. the report made investors happy this morning. we still are expecting a lighter trading volume as we wrap up 2013. at least half a dozen banks are working on proposals to help sprint buy t mobile usa. that's according to financial reporters. it's another sign that the number three cellular carrier is looking to buy the fourth largest cell network in the company. any sale would likely top $20 billion. it's still not clear if the deal would pass antitrust hurdles. selective members of facebook are getting ads for divergent. several say seeing movie trailers are fine but don't want to see a lot of ads that could slow down their feeds. that could be bad for facebook because it could limit the number of ads it would run

which would cut profits. it's a banner year for most car dealships. experts say the last days of 2013 could be the best time in years to buy a new car. chrysler is pushing what it calls its big finish event. ford is offering deals of near lir $9,000 off its f-150 pickup truck. last night in london the ceiling of a theater collapsed. almost 80 people were hurt. seven of them seriously. it happened at the apollo theatre in london. it happened during an almost soldout performance. more than 700 people were inside at the time. some witnesses say they heard a strange noise and then the plaster came crashing down. >> a lot of dust, chandelier landed on five or six rose. >> that's an old theater. it's more than 100 years old.

authorities say the building is now secure and the investigation goes on. new this morning, canada's supreme court declared that country's anti-prostitution laws are unconstitutional. the canadian high court struck down laws against stress soliciting keeping a brothel and living off the profits of another's prostitution. however, the canadian high court gave the parliament one year to come up with new legislation that may be constitutional. prostitution remains a crime in canada until december 2014 and possibly beyond that depending upon whats parliament does next. the white house announced a policy change for people whose health insurance plans were canceled as a result of the new affordable care act. those people with the canceled policies will be allowed to buy catastrophic coverage under what's called a hardship exemption. some republicans criticized the decision. they called it a slap in the

face to whoes who are already replaced -- who had already replaced their plans with difference options. new this morning, harry reid has been admitted to the hospital after complaining that he just didn't feel well. multiple sources say tests have been conducted and everything is normal. doctors ask that he remain in the hospital for observation. so he will not be going back to work today. reid's hospitalization comes on the final scheduled work day of the senate for 2013. 7:47. florida congressman trey redel did not resign despite pleading guilty to cocaine charges. he made the announcement yesterday right after leaving a rehab center and a month after entering his plea. he also said alcohol was the route of his problem -- root of his problem and vowed to remain sober. he defied rick scott and several republican leaders who called on him to resign.

if you have gotten a parking ticket in oakland, you may get a refund. the city auditor was looking a the 2010-2011 fiscal year and said some people overpaid by $316,000 in all. the problem dates back to 2008 and the city now says it broke state law when it did not notify people about the overpayment. we knew that that was just the tip of the iceberg. since the i did, the add -- audit, the administration has gone back and scrubbed their books and identified 2.5 million. >> the tax revenue apologized and blames part of the problem on technology and staffing problems. a number of measures are in place and refund notices are going to be sent out starting january 9th. well, the great highway in san francisco remains closed at this hour. high winds left enough sand across the highway to force the city to shut down.

a week after a shooting at a colorado high school students are being allowed to go back to the school to get their belongings. yesterday, juniors and seniors went back to arapahoe high school. freshmen and soch morse will going -- sophomores go back today. the school was evacuated leaving everything behind when an 18-year-old fellow student started shooting. there is a memorial in front of the school paying tribute to 17- year-old claire davis. she was shot. she's still in a coma. that shooter killed himself in the school's library. in other news, the story about a postal worker, a

federal mail inspector says they arrested a man accused of stealing mail from a truck in the panhandle neighborhood on lions street near hayes. police say the 52-year-old man grabbed the mail, threatened the carrier and ran away. police officers responded and soon arrested the suspect. >> after the investigation it was determined that this person was responsible for the theft of the mail and the threats against the victim and was subsequently placed under arrest. >> police are identifying the suspect as rael niaz. all of the stolen mail has been recovered. in 13 months, the city of san francisco will be assigned a new area code. that number 628. the city is outgrowing the original 415 area cold and the public utilities commission approved a plan to start assigning the 628 area code to new phone customers beginning january 2015. in if you already have the 415

we're doing very well for the most part. the commute has not been bad at all as we continue to look for slow traffic. it's a little bit busy on the eastshore freeway. as you drive into oakland and berkeley, it's busy. it's not stop and go. i will mention the traffic has been a little better than normal. but we do have some slow traffic here and there. bay bridge toll plaza is light. now, we mentioned 80 in richmond there's a touch of stop and go traffic but highway 4 looks great here as you drive through. there's a little bit of slow traffic on highway 4 through the be aty okay area and through -- antioch area and through westbound 24 it's crowded. happening now in solano county, pg&e crews busy trying to get the electricity back for thousands of people in benicia and vallejo. ktvu's tara moriarty, you've been out there for a while in benicia. how many people are still without power? i'm sorry, tara. >> reporter: well, that would be about 700 people. pg&e says that all of the customers now have power except for the 700 people living in this neighborhood off south

hampton road. they have brought in three massive generators like the one that you see behind me here, the big white one in order to take care of the problem temporarily. but we understand that it could take at least a half a day to fix the underground transformer that blew. the vault where it's stored exploded at 7:30 last night. neighbors say flames shot ten feet into the air in front of the house on turner drive near benicia middle school. 3500 people lost power initially. many folks that live in areas around rose drive and columbus parkway. most people had their power on last night and then at 2:45 this morning, most people were dak in the -- dash were back in the dark. >> we heard a crash. we looked out the windows, they still had christmas lights on and then all of a sudden, everything went black. >> reporter: neighbors say they piled on the blankets and built log fires to keep them warm.

many used flashlight, candles and lanterns to see what they were doing. one man said he boiled water to take a bath. you can see that this is a look at benicia middle school which is very close by here. it's not affected by the outage we're told. that's the good news. again, power to 3800 customers is restored and those remaining 700 should have electricity, very shortly. live from breesh, tara moriarty, cut -- benicia, tara moriarty, ktvu channel 2 news. three people were arrested after a huge fight in front of oakland high school. want to show you cell phone video sent to us from a viewer. when police tried to detain her, they say she passed the stun gun to someone else who they say also put up a fight when they tried to detain him. the investigation into the fight continues. well, just 18 months after opening its doors an oakland charter school hoped to boost the achievement levels of african-american boys.

but instead it's going to close down next month. the school is going to close on january 24th. it suffered some financial problems, low enrollment and high staff turnover. one of the school's board members say -- says the charter school may possibly reorganize and open again in a few years. b.a.r.t.'s new board president made a bold move moments after joel keller was named the new president, he said he wants to place an advisory measure on next november's ballot asking voters to support banning transit strikes. members of the service employees and the transit unions walked off their jobs for several days in july and october. shutting down the entire b.a.r.t. system. >> this would be an advisory measure asking the state legislature to determine that b.a.r.t. workers are essential employees to be treated like fire and police.

>> that's the whole reason of having collective bargain. when you trak away striking there's only power on one side. >> keller's proposal calls for binding arbitration if the district and unions can't reach a deal. but this measure would only be public opinion, not state law. only the california legislature or a statewide referendum could ban transit worker strikes. b.a.r.t. is reviewing urgent safety recommendations from the ntsb. they were made after the october deaths of two track workers in walnut creek. a train hit and killed, 66-year- old lawrence daniels and christopher shepherd. the ntsb wants a nationwide ban on a policy ban on a policy called simple approval. that's where workers are solely spoons infor their safety. the board members that workers wear electronic devices that can spot or -- spot or stop oncoming trains. parents in san jose

on monday there won't be enough. so many people registered to receive. there are surprised at the amount of people in need. even though the economy is improving, some are still struggling. i want to show you outside about an hour and a half ago, parents were waiting outside. they were huddled in the cold, they wanted to be the first to go in and pick out a toy. some of them were laid off their jobs. some of them who are still working, they just don't have enough extra to spend on gifts. >> we want people to focus on taking care of their family, make sure they can continue paying the rent have a warm and safe place in their household. we want to make sure they can pay their utility bills. it's cold. >> we want to make sure they are buying enough food for their families. >> i feel blessed. some day maybe i can turn around and give somebody that needs it, too. i'm willing to give them a gift for their kids and put a smile

2 news. 8:09. the teenager who is accused of setting fire to the clothing of another teenager on an oakland bus is due in court today. 16-year-old richard thomas is charged with aggravated mayhem and felony assault with a hate crime enhancement on the attack on sasha fleishman asleep on the bus at the time. prosecutors have charged thomas as an adult. his lawyer will argue this case should go to juvenile court. san francisco police busy searching for a robbery suspect who critically injured a 71- year-old woman. police say the woman was walking to church wednesday morning when a man tried to steal her purse. there was a struggle and a thief punched her in the face. she was rushed to the hospital with critical injuries including bleeding on the brain. the suspect escaped with her purse. many medical businesses in san jose may have to close soon. ktvu has learned the city notified pot clubs located near

homes that they have to close by january 31st. reportedly the city's code enforcement sent letters and will target 14 more after the holidays. new restrictions approved by the city council will take effect next march. there are 82 medicinal businesses operating. calfire says here's still in a state of high fire danger. strong winds hint the bay area and that did dry out the -- that did dry out the grasses and the trees. there are worries that more wind, even the weaker breezes today could send a tree branch across the power line and that could cause a fire. a wildfire is expected to be fully contained tonight. it's burned almost 1,000 acres and destroyed least 14 homes. evacuation orders are still in effect. hundreds of firefighters are still on the scene. the fire is still under investigation.

three southern california bus crashes in rainy -- and rainy weather have killed people and injured other. a tour heading to san diego overturned. at almost the same time, another tour bus from another casino overturned in the freeway's northbound lanes about 50 miles away in corona. tesla is fighting back after claims of another fire. this time in a garage. there's a report there was a fire on the ucer vine campus. it may be -- uc irvine campus and it may be linked to one of the charging stations. the fire happened in a wall

socket where a model s was plugged in, according to reuters. the car did not burn. tesla is on the defensive after two cars caught on fire and a third burned after a collision with a tree. incredible video to show you from an attack on a bus in seattle. a gunman walks up to a passenger, points a gun in his face demanding his cell phone, but the passenger fought back. that gunman stole phones from other people on that bus earlier. they joined in and started beating and kicking him. >> he came up to me and stuck the gun at me and took my phone. and he jabbed me harder an said don't make this harder than it has to be. >> no one was hurt. the suspect pleaded not guilty. he's facing up to 15 years in prison if convicted of robbery and attempted robbery charges. president obama and his family are getting ready to head to hawaii for the christmas holiday. they are expected to leave d.c. this morning on air force one and then they are scheduled to arrive in honolulu after midnight on saturday.

oakland courthouse within a couple of minutes. 8:32. turning now to the case of jahi mcmath. the oakland teenage he on life support following what was smoetioned to be a routine tonsil surgery at children's hospital. this morning a lawyer representing her family will ask a judge to keep her on a ventilator. her family met with hospital officials yesterday afternoon. the family asks that she be kept on a feeding tube rather than a sugar drip iv. they asked for the medical record and want a second opinion whether she can recover. while jahi's family wants her on life support at least through christmas, they say doctors want to take her off the ventilator as soon as possible. >> he yelled it. he pretty much yelled it across the table four times. he said, we can't do that. that's an unusual request. don't you understand that jahi is dead, dead, dead, dead. >> now, jahi went to the

hospital december 9th for a ton sillectomy. she days later -- three days later, she was declared brain dead. the hospital released a statement -- push mush push-- push -- happening today, a rally is scheduled to remember the teenaged boy shot and killed by a sonoma county sheriff's deputy. family and friends of 13-year- old andy lopez have been holding vig yiles and protests since the shooting in october. they are asking people to wear white and bring candles to the rally set for 4:00 p.m. at santa rosa city haul. deputy gem haas who returned -- gel haas who returned to duty said that lopez was carrying what looked like a real rifle with you it turned out to be -- but it turned out to be a replica. kwame harris is due in the

san mateo courtroom today. he was convicted of assaulting his ex-boyfriend in a restaurant. the argument stemmed from the use of soy sauce. we should learn more about the sentence we're facing. there is a reminder that people should not drink and drive this hoyle holiday -- this holiday season. brian flores is live. >> reporter: we're on christmas tree point road and twin peaks here in san francisco. this was the scene of a pretty bad accident one year ago today involving drunk driving. the d.a.'s office and several law enforcement agencies hoping to get that message across this weekend and really any other day to be safe out there during the holiday season. but as is the case during the holidays, chp and other law enforcement agencies will be conducting dui and driver's license checkpoints starting tonight and some through this weekend. locations won't be announced until closer to when they set up. but we understand some of the

cities where these checkpoints will be include morgan hill, san francisco, martinez, santa clara, redwood city and el cerrito. this marks one year since a tragic accident here in the twin peaks area. the d.a.'s office set to announce the sentence at 11:00 this morning on the case of defendant gina eunice. she was accused of driving. she had three passengers in the car with her at the time when she struck and killed a 56-year- old and fell down the embankment. two others were injured. she was found guilty of dui vehicular manslaughter causing the death of the 56-year-old. and later the d.a. will announce her sentence at the san francisco hall of justice. the d.a.'s office is sure to discuss how this has changed the life of many people. that press conference is scheduled for 11:00 this morning. brian flores, ktvu channel 2 news. >> 8:36. oakland animal control officers

say they have uncovered what appears to be a major dog fighting operation. cameras were given exclusive access to yesterday's raid. 11 dogs were found at a home on eldridge avenue by oakland police. they were serving an unrelated search warrant. police found pit bulls chained up with no food or water, a lot of them were wounded. they also found modified tread mills and weighted vests for training dogs to fight and they found medical supplies for treating their wounds. >> we've had a fair number, maybe a dozen or so dead pit bulls in this neighborhood recover in the past couple of months. >> the interim director of animal services says this is one of the biggest dog fighting operations he's ever seen. police say a family with children appears to live at the house but no one was home during the raid. so far no arrests have been made. all of the dogs are being treated at oakland animal services. a pack of wild dogs is

suspected of attacking dozens of sheep at a livestock auction yard in san joaquin valley. 80 sheep were attacked sometime thursday night. the ones that did not die, they had to be aught nizzed. the person -- euthanized. the person who owns the ranch is worried that people may be attacked, too. a company based in san jose is recalling more than 700 pounds of sausage because it may be contaminated. lee brothers food service incorporated is recalling 16- ounce packages of lee's sandwiches produced on february 11th. 04-tp is the i.d. food. the sausages were sold here in california, arizona, nevada and also online. target customers affected by the data breach will be getting letters from the discount store chain.

oakland. it happened about 8:00 and near the alameda county courthouse. details still coming in. the sheriff's office says the victim was shot while walking down 12th but somehow managed to get help from a nearby deputy. she's been rushed to the hospital reportedly in stable condition. we're hoping to get more information on this in just a couple of minutes. in solano county, the electricity is back on for almost all of the 4500 customers in benicia and vallejo who lost their power during the night. the problems started last night when an underground transformer went out and knocked out the power. in san jose, right now, needy families are getting much- needed help to make sure there's some presents under their christmas tree for their children. it's the annual toy giveaway by sacred heart. janine de la vega is there and she will bring us a live report coming up in a few minutes. the shopping marathon is on at kohl's.

canceled as a result of the new affordable care act. those people with the canceled policies will be allowed to buy dat strosk coverage under what's called a hardship exemption. some -- cats strosk coverage under controversy -- catastrophic coverage under what's called the hardship exemption. 205,000 people had lost their plans, it's reported, less than millions predicted by critics of the law. if you paid a parking ticket in oakland, you may get a refund. the city auditor said she was taking a look at the 2010-2011 fiscal year when she realized some had overpaid by 316,000. oakland's revenue and tax collector apologized saying part of the problem was technology and staffing issues over the years. a number of corrective measures are in place and refund notices are going to be sent out starting on january 9th.

8:47. we continue to follow breaking news. we've been following it since 8:15. there has been a shooting near the courthouse in oakland. paul chambers just arrived on the scene there moments ago and paul, what can you tell us? >> good morning. i just spoke with the sergeant moments ago. but i can tell you this right now. it all started about 8:00 this morning when the shooting happened. the woman was walking along 12th. and she was shot there. she was able to make it across the street and stumble where she was bleeding. she was shot multiple times. police do not believe this is random. they believe she was targeted. they are pursuing leads at this time. we do know she's a female adult believed to be in her 30s, once again, she was walking down 12th. this happened at 8:00 this morning. she was shot multiple times. we're not sure where she was hit. police say when she was in the ambulance she was talking. right now they don't believe it's life-threatening. we're staying on top of this and giving you the latest. they say this was not random.

there's no safety cautionary here. they don't have information about a suspect or motive. we'll stay on top of this and bring ul the latest as -- you the latest as it develops online and in our newscast. >> thank you, paul. 8:48. sal is here. you've got breaking news. what happened in san francisco. it's a fatal crash in san francisco involving a garbage truck at jones -- on jones near o'farrell going down the hill there. i wanted to push into where this area was. jones is the street that comes down the hill from nob hill down o'farrell into the tenderloin. an elderly man was reportedly hit and killed by a garbage truck. this is closed, jones street at o'farrell for about one block as you head down. so you will have to use a different street to get down to the market street area. we're trying to find out more about this as well. let's take a look at some other things, westbound bay bridge traffic looks good. the richmond bridge has

today we'll finally learn the nail of the newest edition to the gorilla family. the gorilla was born and the zoo officials will announce the winner today of the name. she will make her debut to the public tomorrow. >> look at that face. let's go right out to sal. following some very serious news in san francisco. a deadly accident right there, sal. >> this is a crash involving a pedestrian and a garbage truck on jones street just past o'farrell. this truck hit and killed this pedestrian about an hour ago now on -- and jones street is closed at o'farrell. just avoid the area. san francisco police is doing an investigation in the area. also looking at san francisco freeways, northbound 101, it does look good. it's light coming into the downtown area. there's very little delay at the bay bridge toll plaza.
