the latest on the investigation underway right now in san francisco. what we've learned about the fatal accident involving a garbage truck and a pedestrian. and the family of a 13-year- old girl on life support continues to fight. what they are demanding from the hospital and the legal action they are now taking. plus -- thousands of children will have toys under the tree thanks to one south bay charity but the last-minute push to help thousands of others continues at this hour. the noon news starts now.

good afternoon. i'm claudine wong in for tori campbell. topping our news, one man is dead after the driver of a recology trash truck ran him over. brian flores is in san francisco's tenderloin neighborhood with what he's learned about the circumstances surrounding that accident. brian? >> reporter: claudine, good afternoon. i just got off the phone with the medical examiner's office. they have yet to identify the man hit by the truck. right next to me is the exact spot where the man was standing when the truck was backing up around 7:30 this morning. want 0 go to shoo of the truck that hit the pedestrian. according to police, a male pedestrian was walking off an alley way near jones and south of o'farrell. the driver was backing up when at a low rate of speed when he hit the man. we doesn't know exactly --

[audio difficulties] >> okay. we apologize for the technical problems. we'll try to get back to brian as soon as we can. today's deadly accident comes one day after an 84-year-old woman was hit and killed chinatown yesterday morning at 11:30 a.m. near jackson and stockton street. police say the woman parking on jackson street, hit a car, a procedure pole the woman and another person. no word on the extent of their injuries. a san jose jan ter is under arrest on suspicion of attacking two women in two attacks less than a month a apart. the man is accused of attacking the victims as they were walking home from work. police say an 18-year-old woman was attacked in september. and then a 20ing why woman was attacked -- 20-year-old william was attacked in november. meza is being held without bond. new information about one

family's fight to keep their family member on life support. rob roth is live with what legal action the family is taking to keep her with them until christmas rob? >> reporter: claudine, it appears what's next will be up a court. this morning, the attorney for the family of the 13-year-old girl filed a motion in alameda county superior dowrt seeking a temperature restraining order to prevent the hospital from taking jahi off life support. that hearing is scheduled at 1:30. the motion "the child provide her with nutrition through a feeding tube. she currently receives fluids through an i.v. and they are asking her to be kept on life support until a full hearing can be conducted. >> right now we're just living step by step and this family is living day by day and minute by minute. as long as that child is still alive, we'll keep fighting

whatever way we can. >> reporter: jahi mcmath was declared brain dead after complications from a surgery to remove her tonsils. doctors said she continued to believe and then suffered a heart attack. the family wants her on life support until at least the christmas holidays but the hospital, they say, won't agree from that. the hospital is bound from speaking publicly because they don't have the family's permission to speak public. >> the process has started. we'll continue to fight. we'll be back in court later this afternoon. we just appreciate the court to be open for people like us to be able to use and get justice. >> reporter: the attorney says if the family doesn't get the restraining order they will most likely appeal. reporting live in oakland, rob roth, ktvu channel 2 news. >> thank you, rob, for that report. oakland police are looking for a gunman who shot a woman multiple times near lake merritt. it happened near 12th and madison streets. investigators say the injured

woman stumbled for about a half a block collapsing. the gunman drove off. police do not believe the shooting was random. they say it appears the 33-year- old victim was targeted. the woman was taken to the hospital and is in stable condition. in just over an hour, an oakland teen is due in court to face charges that he set fire to another teen's clothes. richard thomas is charged with aggravated mayhem and police say he set sasha fleishman's skirt on fire while he was sleeping on a bus at the time. three students were arrested after a huge fight yesterday outside of oakland high school. you are taking a look at cell phone video sent to us from a viewer. police say two girls started fighting and then one of the girls pulled out a stun gun when police tried to stop the fight. when police tried to detain her, they say she passed the stun gun to someone else. police say he put up a fight when they tried to detain him.

the investigation into the fight continues. san francisco's top prosecutor wants to reclassify crimes. move could save money. according to reports, district attorney george gascon has filed a proposed ballot measure that would reduce nonviolent crimes from felonies to merchandise. the measure needs 5,000 signatures to qualify for the ballot. the president began a press conference by touting the economic recovery before taking questions from reporters. he also said despite the problems with the website, americans are continuing to sign up for the affordable care act. >> the healthcare website problems were a source of great frustration, i think in the last press conference. i adequately discussed my frustrations on those. on the other hand, since that

time, i now have a couple of million people maybe more who are gonna have healthcare on january 1st. and -- >> after the news conference wraps up, the president and his family plan to head to hawaii for the christmas holidays. harry reid is in the hospital after feeling a little ill this morning. multiple sources say tests have been conducted and everything is normal but doctors have asked him to stay in the hospital for hospitalization. this hospitalization comes on the final scheduled work day for the senate for 2013. happening now -- low-income families are getting much- needed help in the. right now, a local nonprofit is opening its doors so parents can pick out toys for christmas. janine de la vega is live. >> reporter: we've seen a lot of smiles here all morning long. many of these parents in this room feel as if a weight has been lifted from from their

chest. they were worried about not being able to buy toys for christmas. but they were able to hand-pick what they wanted for free. parents were welcomed into santa's toyland. the opportunity to shop worry- free was what they had been waiting for. >> oh, my gosh. i'm excited. i didn't think they were gonna have this much stuff here. >> reporter: these parents waited in the cold for hours to preregister their children to receive toys for christmas. this morning, they were waiting for the doors to open. >> if you are asking for headphones for $199, i can't afford that. i want a bike. i can't get that this year. i will get you what i can. >> reporter: she and her husband are able to now. he has been laid off. >> i was heartbroken because i wanted to get the kids something for christmas and now

because they will open back up at 10:00 a.m. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. well, just 18 months after opening its doors, an oakland charter store is closing next month. the community school had hoped to boost the achievement level of african-american boys. it will close on january 24th. financial problems and low enrollment and high staff turnover are blamed for this. one of the school's board members says the charter school may possibly reopen after it reorganizations in a few years. now, we want to go back to brian flores for the latest -- for that latest with the bar bige truck and -- garbage truck and pedestrian. brian? >> reporter: i just got off the phone with the medical

examiner's office. they have yet to identify the victim. we want to go to video of the truck that hit the pedestrian. this is a recology pin delivery truck. according to police, the driver was dropping off a trsh bin to a nearby business when the male was walking on jones and o'farrell. the driver was backing up at a low rate of speed when he hit the man at 7:30. we don't know if the truck was  trying to park but police say they have several clues being examined. >> we do have video and witnesses we're reviewing and talking to. at this point, we haven't come to a final determination in the case. >> while it's being investigated, we also spoke to a few witnesses including owner of a vietnamese restaurant. he says he gave police a copy of surveillance tape that he had. he didn't feel comfortable show us the tape but described the man that was hit as wearing a hat, jacket and perhaps hispanic. he also told us through police that the man may have been drinking at the time. in terms of the driver, he has

new information today about inappropriate behavior in the secret service. the service is rocked by a

prosecution scandal on a trip to colombia more than a year ago. justin gray is live with the results of this long-awaited internal investigation. justin? >> reporter: well, this 145- page investigation does reveal that there have been other incidents between secret service agents and prostitutes and even excessive alcohol but it proves that these are not widespread incidents. a scandal on foreign soil that badly damaged the reputation of the u.s. secret service. a dozen agents suspected of soliciting prostitutes and abusing alcohol on a presidential visit to colombia. this investigation was launched to find out just how far the problems in the secret service go. investigators found that "although individual employees have engaged in misconduct or inappropriate behavior, we did not find evidence that misconduct is widespread in the secret service." >> it's not an animalhouse. >> reporter: this man is author of "inside the president's

secret service" he said it's questions that weren't asked that are a real problem. >> it's the corner cutting by management. it creates a culture where agents can say we'll do whatever we want. >> the report did recommend 14 different changes to procedures to try to make sure an incident like colombia doesn't happen again. live in washington, d.c., justin gray, ktvu channel 2 news. fremont police have released video from a violent home invasion robbery. it happened wednesday night on armor way. you can see the person running away from that home in the video. then that person gets into a getaway car. police hope someone recognizes the car. police say a woman locked herself in a bedroom after four men kicked their way in the home. police say the men stole jewelry and electronics. investigators released this picture of nearly $570,000 worth of marijuana. they say that's likely the motive behind a wednesday night

home invasion outside of a house outside of vacaville. 110 pounds of plants were found inside the home. one man in the home were shot. two others were beaten. police are still looking for the four masked robbers who got away. b.a.r.t. is offering special escorts for shoppers using b.a.r.t. tonight. the escorts will walk riders to fruitvale, west oakland, the service is being offered from 5:00 p.m. to 8:00 p.m. escorts will be wearing special uniforms or yellow vests. and power was restored to all homes and businesses in benicia and vallejo following a pair of outages that affected thousands of customers. a transformer failed prompts more than 4500 customers to lose powers. pg&e were able to restore the customers to most customers this morning but at 2:45 a.m., the power went out again.

before the outage, witnesses say they heard an explosion. >> all we heard was this loud crash and all of the lights kind of came on and off for a while. we looked out the windows and they still had their, you know, their lights on their christmas lights on and then all of a sudden, everything went black. >> pg&e officials say the two outages are related. they say the cause of the transformer failure is now under investigation. well, today is expected to be the busiest travel day of the christmas day holiday at san francisco international airport. according to the airport spokesman about 132 travelers are expected to -- 132,000 travelers are expected to pass through today. security lines appear to be moving well so far and flints are on time. the winds won't be as strong today. but calfire says we're still in a state of high fire danger. strong winds are concern and they were a concern yesterday

in parts of the bay area. and there are worries that more wind, even the weaker breezes could still send a tree branch across a power line and start a fire. the fire in big sur is expected to be contained tonight. the fire broke out earlier this week and has burned almost a thousand acres and destroyed almost 13 homes. evacuation orders are still in effect and hundreds of firefighters are still on scene. the cause of that fire is under investigation. about as quiet and as dry as it has been in a lightning time. we got the cold air. we also had a beautiful sunrise as we had severe clear from twin peaks. sunrise over the big city. a lot of sunshine. it was definitely colder this morning. even in san francisco, i know the richmond district was 41 and in the mission it was 43. and there are the temperatures. these are not current. willits, 27. woodside was 29.

concord, pleasant hill, also about 28, 29. i know 30 in palo alto. morgan hill, 29 and really cold temperatures in pacifica, half moon bay. 32, 33. even san bruno was 35 this morning. if you thought it was cold. it was. we have clouds intoard. we have clouds -- in arizona and we have clouds near the oregon border. 61 santa rosa. they made it to 27 this morning. half moon bay, 32. but they are warming up a little bit. but shore is the warmest at 61. we went 67 for the high. if you are traveling up north there's cloud cover but you have to go farther north to find it. the low that gave us the cold air and very little else is starting to churn out. almost everybody across the country except california will have active weather. 38 in tahoe. already freezing rain. a little bit more chicago but the swath of moisture coming up from texas is going to merge with cold air. there's the potential of five

inches of rain and then the divide line between freezing rain and snow and arctic blast will come in. travel plans could be delayed as you head off any time between now and christmas eve except in california. any are looking for a lot of rain. there's been some freezing rain. that's the worst, i think. i would rather have snow than that. the ridge of high pressure is sending everything to the north. some high clouds might still underneath. sunny, breezy for a few. it's not that bad. it was a cold morning. it will be another cold morning. but that northerly breeze will equal warmer temperatures for some. a lot of 60s, including novato and upper 50s for some. a little cooler out to the east, especially antioch and brentwood. 62 oakland, 62 berkeley. santa cruz at 62. 50s and 60s. everyone is close. 60s what a popular -- 60 was a popular number. and winter officially begins tomorrow morning, claudine. this is the last full day of

take a look at positive territory on the big board. that's the dow. it's up by 84 points almost. but the nasdaq s&p also up. they pushed further into record territory. the government raised the estimate for the third quarter of economic growth and people liking that on the market. new jobless numbers are out showing california's jobless rate im-- improved. well, today, we did learn the name of the newest edition to the gorilla family at the zoo. this is 5-month-old kabibe. i think that's how you pronounce it. it means little lady. the staff and public voted on the name. she's set to make her publy debut tomorrow -- public debut
