minutes, praying for 13-year- old girl. doctors have declared her brain- dead after comely indications from surgery to have her tonsils removed. on friday, the judge granted the temporary restraining order to keep her on a ventilator until a neurologist can be appointed to examine her further. today, the mother said she would not give up -- >> doctors thought they know everything. if they knew everything, my daughter would not be brain- dead. that's why i lean on god. >> hippocratic oath said do no harm. we are here to stand to answer that oath when you do harm, pause and respect. >> >> reporter: also in the crowd here this afternoon was well- known civil rights attorney john buris. he told me later this afternoon, the family's attorney simply could not be here and actually asked for him

shopping center parking lot. police say somebody called to report the discovery of the body before 1:00 this afternoon in the wal-mart parking lot right off the free bay. the body was found near starbucks, a portion of the parking lot was closeds police processed the scene. drivers could not get in or out of the parking lot, and that caused a bit of a traffic headache for scores of holiday shoppers. police say they are treating the death as a homicide, so far, they have not said if the body is that of a man or a woman or how the person died. >> >> oakland police and the highway patrol investigating a a shooting that happened near the mcarthur maze. kelly explains how officers found some key pieces of evidence they were not expecting. >> 3:00 am, traffic slowed to a crawl, investigators lewissed flashlights to carefully come the pavement. searching for evidence of a

or the sedan. >> we don't have any known motives. >> the driver was coming back from an oakland nightclub when the shooting happened. in emeryville -- ktvu channel "2 news." a man hospitalized in critical condition. it happened just after 7:00 last night near park lane and mcgregor avenue. investigators say it appears the 47-year-old victim was crossing the street when the car nearly hit him. words were exchangedded on the driver got out of his car with the blunt object and began to hit the victim in the head. the victim was taken to the hospital for possible scuplture as well as other facial injuries. the attacker described as a man in his 20s with a thin build. his car, late '80s, early '90s four door sedan similar to a

christmas miracle. ken pritchard talked to the man who helped to save this tiny pooch. >> reporter: this poodle here friday night, stuffed in a garbage bag on a conveyor belt piled high with trash before she was saved gem, >> she's a precious little gem that ended up with the trash can. >> the puppy a few months old is recovering at animal care and control. >> she had some injuries on her. >> >> reporter: wounds on her neck, but she will survive thanks to vets and two workers sorting trash on this conveyor belt by hand and saw a bag wiggling. >> luckily, we stopped the line in time before it fell off the belt into the pit where it would have been one of the landfills. >> gregory foster and hi co- workers acted fast.

called animal control. >> pulled the puppy route of the bag. we examined it. the puppy was frightened, scared, whining. >> reporter: animal welfare would like to know what truck she came on. how she got to this facility. that would help determine where gem is from. the workers i talked to said that would be difficult to determine, if not impossible. one thing is clear, this puppy was disposed of, a deliberate act. animal welfare says if it can't find her owner adoption for it gem should be no problem. police are warning police about a phone scammer who is tricking and threatening victims. police say a resident was recently contacted by someone that claimed to be a vallejo police officer.

he told the resident there was a pending warrant for her arrest and if she didn't pay $2,000, she would be arrested and her children would be placed with child protechsive services some chase bank branches open today to help customers deal with the data breech at target stores. 2 million chase accounts were affected by the breech as a precaution, chase has temporarily limited the amount of atm withdrawals and purchaseses. target announced between november 27th and december 15th, data was stolen from as many as 40 million debt and credit cards.

3:00 tomorrow afternoon. forecast models showing this hot much in the way of overcast, our rain free pattern will continue as well. partly to mostly sunny skies for monday, it will continue into tuesday and for wednesday on christmas day. forecast highs for tomorrow, a little cooler, but still a lot of 60s for santa rosa, san francisco, more neighborhood, more upper 50s out toward the immediate shore line. but a lot of 60s for mountain view and san jose. here's a look at your five-day forecast as we approach christmas day. no major changes. it could be one of the warmest day of the week. we are not going to show the weekend, but by next weekend, a slight chance of a few showers, we'll talk more about that -- we'll also have the football forecast for the last game.
