now another noon a 13-year- old oakland girl has only five hours left until a court order expires. allowing the hospital to remove her from life support. we'll hear from the hospital spokesperson. dry conditions throughout the bay area raising concerns for an upcoming drought and also forcing fire crews to be on alert on a time of year they can normally relax. a packed courtroom in san francisco as the fight continues to keep city college san francisco accredited.

good afternoon, i'm tori campbell. time is running out for the family of jahi mcmath. when just five hours left before the brain dead teen can be taken off life support. alex savidge is live with the options the family has left. >> we have not heard from jahi mcmath's family so far today. but their attorneys have indicated they will file an appeal today. an order from the judge last week said essentially that she can be removed from life support at some point after 5:00 p.m. although this morning we heard from the hospital spokesperson and he couldn't say exactly what the hospital will do once that deadly comes. he pointed to privacy laws in this case. the spokesman also had not heard of any court filings by

the county's attorney. jahi suffered cardio arrest. a facility in new york has decided it was unwilling to take the teen who's been declared brain dead by a court appointed doctor. still her family remains hopeful but the hospital says there's nothing more that can be done. >> jahi mcmath is unfortunately deceased. no amount of prayer, no amount of hope, no amount of any type of medical procedure will bring her back. our sympathies -- our deepest sympathies go to this family and friends and this community. >> reporter: in order for jahi to move to a care facility she would need surgery to insert a breathing tube and also have a feeding tube inserted as well. children's hospital doctors are

refusing to perform those procedures on someone who has been declared legally dead. again, we understand there have been no new court ordered and barring any sort of intervention from the courts, jahi mcmath can be taken off life support after 5:00 p.m. today. we'll have full coverage for you tonight on the news at 5:00 and 6:00. we're live this afternoon in oakland, alex savidge. >> thank you, alex. it's been such a dry winter that state fire officials have put a no burn ban in effect in parts of the east and south bay. janine dela vega joins us where firefighters say the potential for fire is great, good afternoon janine. >> we're here in the east bay hills where you can find plenty of dry vegetation. since july 1st, only 1.56- inches of rainfall we've had here in the city. so there is a greater likelihood of fire danger. calfire put a rare winter burn

ban into effect that prohibits all backyard and open burning in unincorporated parts of alameda and santa cruz counties. they're experiencing record low cumulative rainfall. low humidity and dry fuel moisture level. for example, fire officials say in november in santa clara county there's been 25 vegetation fires which is above average. normally they would experience five during that time period. >> the burning conditions as far as the moistures and the fuels are at the levels that they've been at since september and october. so if we were to have a typical kind of a wintertime north wind that comes through, the potential for a large fire is definitely increased due to a lack of rainfall. >> in the south bay, reservoirs are about 34% of normal. county authorities say it's causing major problems for wildlife that rely on creeks as a source of water. while the conditions are a

problem it's not necessarily to enforce mandatory water restrictions. as far as the burn ban goes it will remain in effect until there's a significant amount of rainfall. violators of the ban can face fines of about $200. reporting live from san jose, janine de la vega, ktvu news. >> thank you, janine. sierra watershed saw just 4- 1/2 inches of rain since october which is 30% less of average. if the agency does not see significant rainfall soon. the water and storage won't last long. >> cautiously monitoring the rainfall situation and the snow situation. in february if things don't begin to change we will begin to take steps to prepare. >> if the east bay m.u.d. board decides to -- the governor has created the task force to monitor the issue. >> and not surprisingly the

reports are expected to be dismat as water officials prepare for the first -- results are expected to be far different than last winter's snow pack survey. it shows water content at 150% of normal for the date. water content right now could be only around 20% of normal. let's turn now to steve fulson. steve any rain or precipitation in the advisory. >> no tori. some projections i've seen to january 15th and no rain. that could change. very hazy skies. we're back to that now. maybe a few high clouds. a little bit of patchy fog. we lost that little easterly breeze that gave us record high temperatures on wednesday. but the rain stats coming in. the driest year in san francisco. i mean if san francisco is dry you know everybody else is as well. there's even lesser amounts as

you go east and south. 1970, 19-inches of rain fell. in 1917 there were four months with no rain whatsoever. this month we've only had two. so there's one little positive. it's a done deal folks. this is the driest calendar year ever with 5.59. even years that were close had almost double what we had this year. things really don't look that good. everything is going up and over that high ridge. and december is going down just like every other month. very dry, hazy. slightly cooler conditions. into early january still doesn't look good. the snow pack won't be good. the rain isn't good but the temperatures are nice. we'll have more of that coming up in 10 minutes. the fight to keep city college of san francisco accredited is under way again today. the judge hears more arguments into two separate lawsuits

regarding the school's accreditation. >> reporter: the judge still has to make a determination whether these lawsuits will exist. but this morning he did hear from the attorneys representing the commission. according to the commission's attorneys they want two lawsuits filed by the teachers, students as well as the city of san francisco to essentially be thrown out. they basically want the process of the accreditation to take place outside of the courtroom. these filings were recently brought forward a last ditch effort by the teachers, students as well as the city. this was because of poor financing and academics. the court was packed with students and teachers who say otherwise. >> for me and i believe for everybody else is like, closing the american dream. >> we're an excellent academic institution. we have the one or number two

rated raidology department in the nation. we have one of the finest science departments. >> reporter: now support for ccsf was found inside and outside the courtroom. cameras were not allowed in court today. but the commissioners attorney said today that if the law would allow the lawsuit to happen, that the court should not be allowed to make decisions based on that educational educational process. speaking with the attorney's said they said it likely will not happen today. ccsf may lose its accreditation by july 31st. bryan florez, ktvu news. >> thank you, bryan. b.a.r.t. workers will get a chance at up to $500 in bonuses. according to reports under the new contracts b.a.r.t. agreed to pay its workers $500 for every 4% that core

ridership exceeded. because of the two recent strikes though, ridership is down so b.a.r.t. will still honor the bonus because the union's dropped their claim to a six week family leave. minimum wages are about to rise in the bay area two largest cities. on new year's day, minimum wage in san francisco will go up 19- cents to $10.74 an hour. that is the second highest wage in the country. and san jose's minimum wage will increase 15-cents to $10.15 an hour. california's minimum wage will jump $1 to $9 an hour on july 1st. the faa announces half a dozen locations where the government will test unmanned aircraft known as drones. we'll tell you where. big waves known as king tides are hitting the california coast right now and for the next few days. what scientists are asking beachgoers to do to help with the research.

illuminate a walk way with the vehicle's walk. a gas card was taken. pleasant hill police are looking for information about two armed and dangerous men who tried to rob a woman. she says one of them fired a shot in her direction after she refused to let them in her vehicle. the woman was sitting in her car on maurene lane yesterday when she was confronted by the suspect. they were wearing masks and at least one had a mask. they told her to open her door instead she called 911. the woman says the men then went to a near by car and that's when the shot was fired in her direction. the highest tides of years called king tide are expected to hit california's coast today through thursday. king tides generally run about a foot higher than normal tides. scientists say they are preview of the rising ocean expected over the next 35 to 40 years.

90s. trading though is light today and will be extremely light tomorrow. markets closed wednesday for the big day. the dow at 14. the nasdaq is just down slightly as well as the s & p just down a half percent. tim cook docked himself $4 million in august as apple stocks sank. this as apple decided to align ceo pay per company performance. the ceo takes home more pay. but if the stock performs worse, cook takes home less pay. but still collected more than $1 million in salary and nearly $3 million cash bonus along with $36 million in stock grants. so he's doing okay. 1.3 million americans who were planning to receive jobless benefits this week will have to do without it. money for long term unemployment insurance was not part of the recently passed

federal budget. the average check is $300 a week. benefit checks get spent right away and that's a boost to the committee as well as a lifeline for the people who get the checks. >> removing this bare minimum safety net beyond just being cruel is not going to be productive in terms of getting them back in the labor force or getting them a job. >> reporter: but republicans say it is time to end the program. they say extending it another year would cost the $25 billion. and it makes people more dependent on their unemployment checks rather than encouraging them to go out and find new work. some netflix streaming subscribers could be in for some disappointment new year's day when they try to stream their favorite movies or shows.

titles include titanic, top gun, brave heart, saturday night live and the original dark shadows. the los gatos company routinely removes and adds titles. opponents of building a new warriors arena on san francisco's waterfront are proposing new locations. according to reports opponents say they support a new arena for the team just not at that particular site. instead they are suggesting sights such as the bill graham civic auditorium or part of the masconi center. another option is usings the sight of candle stick park once that stadium is torn down. city officials say these proposals are impractical because most of them are landmarks. the san francisco 49ers are headed to green bay to face the packers in their first play off game. now 49er fans are scrambling to get their seat at the game. tonight on ktvu channel 2 news
