before the hospital planned to take her off the ventilator. ktvu's john fowler explores why the case is getting so much attention but we begin with rob roth, with the last minute reprieve. >> reporter: right now the attorney for the family is in front of the hospital addressing the media. now he won a reprieve for jahi mcmath less than two hours ago. the judge extended his restraining order keeping jahi mcmath on a ventilator till january 7. >> i was going to -- [ crying ] >> please give her more days. please give her more days. >> the original court order was to have run out at 5:00 p.m. that would have meant the hospital could have taken her

off life support. doctors here and an independent expert declared her brain dead but the family insists she is not brain dead, she moves. >> how could you say my child is dead if she responds to my voice. >> yes, people who are deceased can show signs of moving but that is not a sign of life. that is is a sign that involuntary muscle reflex occurred. >> the family also says a care facility in new york agreed to take jahi mcmath and they arranged for air transportation. today the hospital spokesman said they haven't heard from that facility. the spokesman said the hospital will comply with the order and will file its own motion. jahi mcmath would still need doctors to insert breathing and feeding tubes. so there is still a lot to sort

out but the family will continue fighting. reporting live, job r, ktvu channel 2 news -- rob roth, ktvu channel 2 news. >> more details on the jahi mcmath case. started december 9 when she went in for tonsillectomy. three days later she was declared brain dead after cardiac arrest. a judge issued a restraining order that prevented the hospital from taking her off to vent later till 5:00 p.m. tonight but today's extension after 4:00 p.m. now gives the family till january 7 to move jahi mcmath to a new facility. >> now jahi mcmath's case gained world wide attention. ktvu's john fowler on why the story has touched a nerve. john? >> reporter: news crews from around the country are here outside the hospital. this story resinates because it

is something many of us will face at some point. >> reporter: the family made its crisis public and drew the world's attention but what happened to jahi mcmath occurs daily around it country. -- around the country. >> i know it would be hard for any parent but sometimes that is just a decision you have to make. >> this is an example of a problem that is been going on for 20 years in the united states of america. >> reporter: she wrote this book and explores the question of modern medicine. >> who gets to define death and when does it occur? >> reporter: she calls it the perfect storm. advancing technology that prolongs the appearance of life combined with autonomy. >> patients and families don't have the knowledge about the limits of technology. >> when physicians say the

fuels are as dry today as october, september. the only difference is it is cold and the days are shorter. >> reporter: he has had to deal with burn bans before but not in december. now the schedule of burning green waste to avoid disease is in limbo. >> as we prune we pile and then we also let that cure so that one of the requirements is that it be dry when you burn to not create a problem with the pollution. so mine are ready to go. >> reporter: san jose firefighters say the unusual winter time burn ban is a good idea because people don't worry about fire danger in december. >> during the holidays people get together outside, have a backyard barbecue or fire but in this type of climate it is unsafe. it would take one spark. >> reporter: farmers can apply

man whose body was found inside a vacant store in daily city. daniel price of san francisco. construction workers discovered the body around 7:00 a.m. last friday. in the old sports authority. a cause of death is under investigation. it does not appear to be a suicide and price was not homeless. a jail house job fair and some inmates don't know when they will get out. the sheriff's department launched a new program today that aims to prepare inmates for their future once they are released. ktvu's david stevenson got a look inside. >> reporter: san francisco county jail houses 768 inmates. many are considered a high security risk. many say they are ready to change their lives. >> we are blessed to have abopportunity like this -- an opportunity like this. >> reporter: the sheriff's

>> reporter: they will give coordinators feed back with an eye towards expanding next year. david stevenson, ktvu channel 2 news. the car service is warning of higher holiday fairs in san francisco during new year's eve. they anticipate fairs between 12:15 a.m. and 2:30 a.m. on january 1 could be 5 times the normal price riders would pay. users will be required to verify that they will accept the more expensive charge. demand is expected to be very high between 8:00 p.m. and 10:30 p.m. tomorrow night. if you are in san francisco and you don't want to pay you can take muni, they will be free from 8:00 p.m. till 5:00 a.m. on new year's day. muni metro service will run till 4:00 a.m. and there will be extra owl bus service till 5:00 a.m.
