dives town into the northern plains and great lakes. sunny and nice. it will be a hazy day. 60s to near 70. let's go back to the desk. sal is is off this morning. but we are still keeping an eye on traffic for you. over on the east bay taking a look at highway 4 in bay point, still pretty dark out there. but things are moving well this morning. and this is a look at highway 24 near lafayette. traffic on the right moving toward the new caldecott tunnel. there is been a few accidents. excuse you, pam. that weaver been telling you about-- that we've been telling you about. we do have a crew keeping an eye on things here and we will bring any new information as we get it. fremont police are still trying to piece together an accident that killed a teenager and seriously injured a baby. claudine wong is joining us now where it happened. >> reporter: good morning, pam. this is where the three victims

were walking across the street when they were hit by a vehicle going southbound down this road. they were not in a crosswalk. and the accident left a 19-year- old woman dead. and a three-month-old baby in critical condition. here's what we know. this happened last night. just before 10:00 p.m.. a 17-year-old girl, a 19-year- old woman were walking west across the parkway. the 19-year-old was carrying a three-month-old baby boy in her arms. the three were all hit by a truck going southbound down the parkway. the 17-year-old suffered nonlife threatening injuries. the three-month-old boy and 19- year-old girl were critically injured and the teen has now died from her injuries. the baby boy still fighting for his life. >> we have not determined if any laws were broken. if there was any impairment or anything else. >> reporter: what we know about the driver at this point is that the driver is a 64-year- old man. he did stop after the accident.

police say he has been cooperating with them. and he was questioned over night and has since been released. at this point its still unclear if charges will be filed. police are asking anyone who might have been out here who was a witness to this accident to give them a call. live in fremont claudine wong ktvu channel 2 news. >> thank you. san francisco police have arrested the driver in a deadly new years eve accident that killed a seven-year-old girl. police say a mother and her two children were crossing polk when the driver of the car turned right and hit them. the mother and a four-year-old boy are expected to recover. the seven-year-old girl died from her injuries. >> pedestrians were in the crosswalk with the light. and the vehicle had the light as well. however because the vehicle is making a right hand turn and pedestrians in the crosswalk, the vehicle is obligated to yield to the pedestrians. >> now the driver did stop and is cooperating with police. police say at this point it does not appear that drugs or alcohol played a role in the

accident. the chp now investigating another holiday tragedy. tara moriarty is joining us now from the bay bridge toll plaza with more on the deadly night. tara. >> reporter: good morning. we have seen a steady stream of cars go in and out of san francisco all morning. i know when i first came to work probably around 2:00 in the morning the bridge was absolutely packed. we have seen a lot of chp out and about this morning. we want to bring your attention back to an accident that happened in oakland. a deadly accident off 580 westbound at the park boulevard exit. the road was shut down there and the onramp for two hours early this morning when a silver car sideswiped a white suv. the suv flipped killing the female passenger and the male driver who had not been drinking was transported to the hospital with minor injuries. no word on whether the driver of the silver car was ever caught or if alcohol was a factor. now in a remote area of west

marin county they are trying to determine the cause of a deadly new years eve crash. the car landed in the water after a roll over accident. the chp says a passenger was killed when the car flipped over and landed on its roof near shoreline highway. bystanders came to the rescue of the driver who was not seriously hurt. now usually we see an increase in the mountain of dui accidents. given it is a holiday. so those numbers are coming in a little bit later. we will be sure to pass them along to you. i'm tara moriarty ktvu channel 2 news. time is 6:05. this morning the chp will release the number of arrests made during the new years eve drunk driving crack town. now this driver you see here was among several pulled over last night while we were on a ride along with a chp officer in oakland. the man took a field sobriety test but was not arrested.

last year they arrested 208 people for drunk driving in the bay area. people across the bay area also celebrated the new year with fire works. i want to show you what it looked likes at the stroke of midnight in oakland. although there were no official fire works show in the city as you can see those are illegal fire works lighting up the skies. police say there were extra patrols out looking for those illegal fire works. an estimated 200,000 people showed up. the crowds started showing up to get a good spot for the fire works display. one woman already had her spot planned out before she even got there. >> we just go to our own same specific place we go to so there won't be that many people. >> she is not going to tell us where it is either. police were out in full force to make sure things stay safe. there was also a zero tolerance policy for drinking in public and open containers. now on our website we will find

a special feature bidding farewell to 2013. it is the year in review. it includes popular topics, videos, and slide shows. there are new laws for the new year. for teenagers. anyone driving under the age of 18 cannot send or receive texts while behind the wheel. not even with hands free technology. teen drivers had been allowed to use voice activated hands free devices but not anymore. texting by hand while driving was outlawed back in 2009. and there is a new law spelling out the rights of transgender students in school. the law states that students can participate in sports and use restrooms that reflect their gender identity regardless of what is listed on their birth certificate. however the law could soon be suspended if opponents collect enough signatures. time 6:07. the boy scouts of america is beginning this new year with a new ground breaking policy.

openingly gay boys can join the scouts for the first time in the organizations 103-year-old history. the new policy winning praise from many gay right supporters. bill harris harrison. >> man cannot have high morals or be a good american because he happens to be gay is based on ignorance. >> however, some gay rights advocates says the new policy does not go far enough. the boy scouts will continue its current ban on gay adult leaders. stanford looking for its second straight rose bowl victory. the number five cardinals faces number four mission state. this is michigan's first trip to the rose bowl. before the rose bowl is the tournament of roses parade. here's a little peek at some of the beautiful floats. the 125th annual parade begins this morning at 8:00 in

that video on youtube. the passengers say they are trying to keep their spirits high this new years day. when the weather gets a little better, a helicopter will eventually rescue them. a united airlines flight was scheduled to make -- flight had to make an unscheduled landing when the pilot got sick. the co-pilot decided to land in nebraska. 154 passengers were on board at the time including two nurses who rushed to help. >> it was chaotic. they rushed him out of the cockpit and laid him on the floor and got an iv on him. >> the pilot was eventually taken to a hospital and is expected to recover. former first lady barbara bush remains in the hospital this morning. the 88-year-old is being treated for early signs of pneumonia. she was admitted to methodist hospital in houston last night but friends and family are

sending her well wishes for a quick recovery. >> barbara bush is a tough old gal who will out live us all but our love is with her because she is not just the former first lady of america. she is the first lady of our hearts. >> the hospital says mrs. bush is in great spirits. she is being visited by her husband and other family members. today is the day that the new health care reforms under the affordable care act kick in. so far mar than two million people have signed up for insurance through the state and federal health care exchanges. in california 400,000 people sign up through the cover california exchange. under the law all americans must have health care coverage by march 31st or face a fine. the law also guarantees no one can be denied coverage for precysting conditions and mandates equal race for women and men. late yesterday just hours before the affordable care act

took effectson somewhere society pie -- sonya sotomayor gave the government until friday to file a response mt. case. pope francis has a new years day message for the world's 1.2 billion catholics. the pope expressed his hope for world peace. pope francis also urged catholics to help the hungry and poor around the world. starting today some people in the bay area will get a bigger paycheck. the minimum wage going up in san jose because of an ordnance passed by voters last year. it goes up from $10 an hour to $10.15. san francisco will also see a raise. also taking effect today is the extension of the green sticker program. it is now good for another three years. now that means plug in hybrid drivers can use car pool lanes

weekend dry but slightly cooler. in business new apple is denying knowledge of a national security agency. a german newspaper reports the nsa developed a system to hack into iphones as you use personal information such as text messages and contact lists. in response apple says it has never worked with the nsa to create back door channels. netflix is doing early spring cleaning. starting today more than 80 movies and a handful of tv shows will be no longer available. they are cowing such movie

happy new year. more than a million people rang in the new year in new york's time square last night. singers like miley city ruses and melissa e ridge also performed the crowd. new york is also ridging in a new year. he took the office just after midnight. alongside his wife and two children. he is the city's 109th mayor. at 9:00 this morning pacific time he will take a part in a much larger out door ceremony. they will be presided by former president bill clinton.

and you is see michael bloomberg as he was surrounded by friends and family. one of his last acts was hosting an interface breakfast at new york city's public library. the millionaire businessman says he plans to keep a lower profile from now on. new york's new mayor is taking a controversial position that could hurt the city's tourism industry. mayor de blag owe is vowing to ban horse and carriage rides throughout the city including central park. he calls the treatment of horses inhumane. while animal rights activists are applauding the decision, many tourists say an important part of the city would be gone. >> i road horses back in new zealand. they love doing their work and as long as its not cruel, its a good idea. >> i heard they are thinking of getting rid of them. i don't understand it. >> carriage rides have been offered since they opened in

1858. suspicious grass fire in santa clara county is under investigation. it started at 5:30 yesterday morning on mount hamilton near san jose. investigators say two abandoned cars were found nearby. one of the cars was completely destroyed. the other had been vandalized. >> the fire was started in the area where the vehicle that was on fire was found. we just don't know if the fire was started because people started fire outside the vehicle or if the vehicle started the fire. >> the fire burned about 40 acres but no one was hurt. you remember that mysterious crop circle in monterey county? well, it has been mowed down. the property owner says all of the attention had become a nuance so he decided to get rid of it. so far no one has taken credit

for that crop circle. time is 6:25. if you live in contra costa county you may hear emergency sirens later this morning but it is just a test. and it sounds like that. the sirens are tested every month but since its happening on new years day and more people will be at home county officials want to make sure everyone knows it is just a test. it starts at 11:00 this morning. 6:26 is the time right now. a place for jahi. the new york facility that is willing to accept the 13-year- old girl declared brain dead and the latest battle between the girl's family and oakland children's hospital.

ukiah at 30 degrees. 32 sacramento. 19 up in tahoe. it will be a sunny and nice. slight warmup today. temperatures 60s. a few upper 60s. we are going right back to average. back to this. sal is off this morning. we are keeping an eye on the bay area freeways. hope no problems. extra cars on the road early on. hopefully people are back home safely. this is 680 sunol grade. down on the south bay. heading toward fremont. there is one car. you can see headlights out there. pretty quiet. 280 in san jose. also looking pretty quiet as well. chp reporting a few minor collisions but nothing major down there. we do have a crew monitoring accidents. the roads around the bay area if there is anything you should know about, we will bring that to you as soon as we get it.

time is 6:30. gunfire marred new years eve night in oakland. there were at least three separate shootings including one that wounded a child. around 9:30 the person was shot. the victim was hit in the chest and rushed to the hospital in critical condition. police have not yet released the person's identity or age. there are no suspects at this time. in another shooting a woman died after also getting shot in the chest. a medical facility in new york says it is willing to accept 13-year-old jahi mcmath if her family can get her there. jahi's family want breathing and feeding tubes surgically implanted to allow her to be transported. but oakland children's hospital says its ethically wrong to perform surgery on a body. >> they are setting up roadblocks at every road we try to go down to try to save jahi. because imagine this, if jahi does come back as we hoped,

imagine what childrens is going to have to face. >> the court and three physicians have ruled this young lady dead. she is not coming back under any circumstances and that is sad, sad truth. >> a judge ordered children's hospital to maintain jahi's ventilator at least until a federal court hearing next tuesday. now an organization founded by the family of the late terry schiavo says it is working with the mcmath family to find a place for jahi. in 1990 schiavo's husband wanted to have the feeding tube removed after she was in a vegetative state. but her family battled against it. the facility where she may be transferred is dedicated to schiavo. colorado is the first state in the nation to allow the sell

of marijuana for recreational use. retail pot sales officially began this morning. and starting today anyone over the age of 21 can buy up to an ounce of marijuana at a licensed store. >> this certainly is something that the nation is watching us for. and the city and a lot of other entities have been working really hard to make sure that everything is done in a precise manner that accommodates everybodies needs. >> there are posters and fliers posted across the state spelling out the new rules in colorado. amongst them you cannot spoke pot in public. you cannot drive under the influence of pot. you cannot give the marijuana into anyone under the age of 21 and you can't take it out of the state. a man has been charged with lying to police about the death of two dogs. prosecutors acruised jonathan christ of protecting his father who shot and killed the neighbors dog in september because they broke into his chicken coop and killed about

20 chickens. christopher told animal control he had killed the dogs. his father will not be charged because it is legal to kill dogs in california while protecting poultry. protest test tours -- bart police officer johan mistoday's vigil is set to begin at noon at the fruitvale station. members of the family are expected to attend. there was a large police presence around oakland city hall last night. officers were called in after occupy oakland called for a new years eve demonstration. police were on alert all night but the demonstration never took place. despite last nights shootings, we mentioned earlier oakland along with richmond showed significant drops in

deadly violence in 2013. there were 89 crosses on display. 125 people were killed in 2012. that is is nearly a 30% decline. >> the city of richmond has experienced a large drop in violent crime as well. there were 43 homicides in 2009. 18 in 2012 and 16 last year. police credit more resources including several dozen detectives working in specialized units from homicide to narcotics. now vallejo was one bay area city where the homicide rate went up. there were 25 homicides in 2013. compared to just 16 the previous year. san jose saw a slight improvement in 2013 as well. there were 43 homicides

compared to 46 back in 2012. a number of new gun control laws hit the books in california today. one law requires the state to collect specific information about shotgun and rifle purchases. that information would then be stored on a computer data base. in the past only handgun purchases were permanently recorded in california. this new gun law and others led to a last minute rush on gun and ammunition sales at gun stores across the state. starting this week the ged test will be completely different. now the test will focus more on critical thinking skills and use new standards that could make it harder to pass. test takers will be required to use a computer instead of pencil and paper. and it will cost more to take the test. it is the first update to the test in more than ten years. we are getting words on the first bay area babies born in 2014. a baby girl was born two seconds past midnight.

a baby boy born in san francisco eight seconds past midnight. happening right now its the annual new years day parade in good old london, england. this is a live picture of the festivities in england where it is currently 2:40 in the afternoon. this years parade has some bay area flavor among the 8500 participants from 20 countries are two local marching bands. many are performing in the rain as you see there. one of the high schools pittsburg high and the other from oak grove high in san jose. the kids from oak grove celebrated the new years last night before getting ready for today's big parade. this is a picture there. the oak grove band pictures posted a photo online. the post red new years disco. happy new year from london. bring on 2014. 6:37 is the time. waiting for their money. some unemployed californians say there are still problems getting benefit checks on time. people are heading to

welcome back on this new years day. 6:40 is the time. thousands of people in russia enjoyed a huge fire works display. festive spirit though had been over shadowed by those two bombings in volgograd last week that killed 30 people. russian president vladimir putin made a -- he added flowers to a memorial that has been growing at the site of the one of the two suicide bombings. in his new year eve address president putin said russia will continue to fight terrorists quote certainly, fiercely, and consistently. the attacks come weeks before the winter olympics begin. chp is trying to determine the cause of a deadly new years eve crash in a remote area of west marin county. the car ended up in the water after the roll over accident near tomales bay. the chp says the passenger was killed when the car flipped

over and landed on its roof. bystanders came to the rescue to the that driver that was not seriously hurt. in fremont a car slammed -- police say a 19-year-old woman and a 17-year-old girl were walking across the parkway just before 10:00 last night. the 19-year-old was carrying a three-month-old baby. investigators say a truck hit them. half an hour ago we learned the 19-year-old died from her injuries while the baby boy remains in the hospital with life threatening injuries. >> we are still in facing the collision -- we are still investigating the collision and we haven't determined if think laws were broken or impairment. >> police are still investigating to see who if anyone is at fault. the 17-year-old woman was also hurt but her injuries are not considered life threatening. the 64-year-old driver did remain at the scene and the roadway was blocked for about five hours over night.

some unemployed californians say they are still waiting on backlogged benefit checks even after the state fixed a computer problem. the backlog started at the employment development after a computer system upgraded oaf the weekend. apparently the problems are not over. one unemployed man tells us he's been waiting for money for weeks. >> here i am struggling not having work, not knowing where the next $20 will come from. >> the employment development department says it has solved the vast majority of the problems but says some issues do remain. there has been an outpouring of support for a little girl from livermore who has been fighting brain cancer and her family is giving back. yesterday the parents of two- year-old delaney newton held a blood drive in livermore. delaney was diagnosissed with a brain tumor three months ago.

her family says the blood drive their way helping family and friends going through the same way. hundreds of people have been showing their support for delaney on facebook. her father says delaney will have to go through more transfusions and chemo therapy as part of her ongoing treatment. time is 6:43. mark zuckerberg and his wife made the largest individual charitable donation in the u.s. in 2013. in december the couple gave 18 million shares of facebook stock to the silicon valley community foundation worth about $992 million. they donated the same number of shares to the foundation last year which put them in second place on the chronicle of philanthropy list. facebook stock is worth more this year. they are the first philanthropist at the age of 30 to top the list of donors.

the holidays bringing so many people to disney world that it is turning away visitors. the park was turning away people because it was filled to capacity. take a look at the crowds. for people who got inside, they say there were reports of lines up to five hours long to get on one ride. others say they waited in line to buy tickets only to be told they were not getting in. >> i can't sell you ticks because its closed. too many people. >> the park website says disney reimbursed people for parking and offered half price dining to everyone who was turned away. well, as we've been telling you sal is off today. maybe sleeping in right now. but we are keeping an eye on the roads. usually pretty quiet on new years day. this is a look at highway 24 in lafayette. things are pretty quiet as you make your way toward the caldecott tunnel. that is good news there. over in berkeley things are moving well. east shore freeway a little

welcome back toes morning news. time is 6:52. all over the world the start of 2014 came with hour by hour celebrations. reporter andrew spencer takes a look at the different places where and the different ways how people brought in the new year. >> happy new year. >> reporter: as the final seconds of 2013 ticked away, revelers all over the world celebrated the start of the new year. one of the most iconic celebrations of course is the one in new york's time square. when it cam to the fire works display, its no exaggeration to call the show in dubai record breaking. the city set a world record by setting off roughly 400,000 pyrotechnics to ring in the new year. that is nearly five times as many. london opted to go big on taste. choreographed into the fire works display was a shower of

banana flavored confetti. but the party favors don't take the cake for different from that look to the drag queen drop in key west, florida. here is sushi as he calls herself. entering 2014 in a giant high heeled shoe. and in indiana it was the big watermelon drop and what else in boise, idaho but the big spud. in nashville, tennessee a little country music before the countdown. and afterwards a rowdy round. and who could forget the city that is more bright with neon than with fire works las vegas. as the world rings in the new year one hour at a time. >> people had no fun at all. >> no. the new year is also bringing thing changes to how much people pay for bart and muni. on average they will pate an extra 19 cents per ride. fares will be going up in 2016,

2018, and 2020. muni prices will increase to $15 for a one day pass, $23 for two days, and $29 for seven days. >> the new year is bringing a hike in natural gas and electricity costs. pg&e says average residential natural gas bills will increase about 7%. that means an increase of more than $3 a month. as for electric rates the company says those rate loss increase a little more than half a percent. that will add about 23 cents more to an average customers monthly bill. people in a small town in north dakota are back home but that is after that train explosion forced them to evacuate. the fire is about 90% out. investigators say a train carrying grain derailed and knocked several cars from a separate train off its tracks. that train was hauling crude oil. the accident sent a giant fire ball and plumes of smoke a mile

high. the people in the town were told to evacuate. the ntsb is investigating the crash by examing the trains data recorder. you can't show up at a town hall meeting when you don't have a car. you can't send in a fee mall application when you don't have internet access. >> words from angry survivors of tornadoes thatter to through illinois in november. they disrupted a news conference that was set to announce disaster release. about two dozen tornadoes touched down in one community. a dispute is brewing between starbucks and a small brewery in missouri. exit 6 pub and brewery is located in a st. louis suburb. there are postings about breweries selling an alcoholic beverage called a frappuccino. starbucks sent a cease andy cyst
