thank you. fog is there. yesterday from san jose, to the peninsula. now it's on the sonoma and marin coast. san mateo coast and santa cruz coast. fog is there but it's favoring the coast. 20s, a few locations. patchy fog, mainly near the coast, clear and cold. a lot of sun. a little warmer inland. temperatures running above average. 27, napa. 28, santa rosa. fairfield, 29. livermore is 32. i'm sure not far away you can find colder than that. concord 33. three dog night here. 19 up in tahoe. 32 sacramento. colder air, very still, calm conditions except for the fog and maybe occasionally a higher fog. it will be warmer inland, especially santa clara valley over toward santa cruz, upper 60s to near 70. back to the desk. >> thank you, steve. developing news. a suspected drunk driver is accused of causing a serious

crash in hayward. ktvu's tara moriarty joins us from the scene to show us the extensive damage. good morning, tara. >> reporter: good morning. this looks like a deadly crash but miraculously it was not. the driver apparently allegedly drunk walked away with only a bloody nose. this car is the one he was driving. this is the silver car you can see here. it's completely mangled u underneath it, a classic 1966 mustang that the opener was keeping here for storage purposes. let me show you exactly the path of this car. we're here on grove way. this is near western boulevard just south of the 238/580 split. if we kind of come over here, this all happened around 2:30 this morning. you can see that the tow truck is here on scene. they will be taking away several cars. take a look at the damage. this is all of the glass and debris that the car hit on its way. it tore through this front yard here. took out a couple of branches from the tree, tore up this

whole -- all of the glass, everything. and this bmw that's sitting in the driveway over here, this also sustained some damage. and then if we walk over here, if we can kind of turn and walk the other direction, we can show you it actually hit a car parked at the end of the street. that is what the first car it hit. over here is momam. he's one of the neighbors to tell us exactly what happened. did you hear the crash this morning? >> yes. yes, i hear big boom. yeah. it looks like a -- >> reporter: did you come running outside? >> yeah. i looked through the window and -- yeah, i saw the car right on top of that mustang over there. yeah. >> reporter: and then the driver, he appeared to be drunk? >> yeah. yeah, definitely. yes. >> reporter: all right. >> he was drunk and this gentleman, he was over there. i came out. everything was quiet.

you know, and then -- yeah, he was in the car, still in the car, yeah. >> reporter: okay. well, thank you for joining us this morning. but you can see quite a bit of damage here all the way extending from down the block almost to the entire block actually that he sort of tore up here. so now, of course, the cleanup process has begun and they have to tow one, two, three cars away from this scene. so we're gonna try to get an update with the chp. we haven't been able to talk to them. they've been very busy since this happened. so that's the latest here live. we'll bling you more coming up in -- bring you more coming up in our next hour. tara moriarty, ktvu channel 2 news. >> thank you, tara. well, the chp is investigating a deadly new year's day freeway crash in oakland. it happened hours ago on interstate 580 near park boulevard. the chp says a white suv veered off the highway and flipped over. a female passenger was killed.

the male driver was transported to the hospital with minor injuries. it's still not clear what caused the suv to go off the highway. and the chp is also trying to determine the cause of a deadly new year's eve crash in a remote area of west marin county. the car you see ended up in the water after the rollover accident near tomales bay early yesterday evening. the chp says a passenger was killed when the car flipped over and landed on its roof near shoreline highway. bystanders came to the rescue of the driver who was not seriously hurt. and san francisco police have arrested a driver in a deadly new year's eve accident that killed a 7-year-old girl. police say a mother and her two children were crossing polk when the driver of the car turned right and hit them. the mother and 4-year-old boy are expected to recover. the 7-year-old girl died from her injuries. >> pedestrians were in the crosswalk with the light and the vehicle had the light as

well. because the vehicle was making a right-hand turn and the vehicles are in the cross walk, the vehicle is obligated to yield to the passengers. >> the driver did stop and is cooperating with police. police say at this point, it does not appear that drugs or alcohol played a role in the accident. the chp this morning will release the number of arrests it made during the new year's eve drunk driving crackdown. >> put your feet together. arms down your side. follow my finger with your eyes only. don't move your head. >> this driver was among several pulled over while we were on a ride hey long with the chp -- ride along with the chp. the man took a field sobriety test but was not arrested. officers arrested 208 people for drunk driving in the bay area. gunfire marked new year's eve in oakland. around 9:30 a young person was shot on walnut creek street and 04th avenue -- 104th avenue. the victim was hit in the chest and rushed to the hospital in critical condition. there are no suspects at this time. there are at least two

other shootings last night in oakland as well. the first happened just before 9:00 at 54th and martin luther king, junior way. a man was shot in the leg but he is expected to be okay. around 9:10, a woman was also shot in the chest on the 1800 block of 22nd avenue. she was taken to the hospital where she was later pronounced dead. no arrests have been made in any cases so far. 7:07. people across the bay area celebrated the new year with fireworks. this is what it looked like at the stroke of midnight in oakland. although there were no official works in the show, you can see illegal fireworks lit up the skies. there were extra patrols out looking for illegal fireworks. an estimated 200,000 people showed up to see the big new year's eve fireworks show in san francisco. [ cheers ] >> the crowd started showing up to the embarcadero early to get a good spot for the fireworks

display. one woman already had her spot planned out before she got there. >> we just go to our own specific place we go to so there's not that many people there. >> there was a zero-tolerance policy for drinking in public and open container. at ktvu.com, you will find a special feature bidding farewell to 2013. it's the year-end review. look for hot topics on the front page. 7:08. there are new laws in the new year. for teenagers, anyone driving under the age of 18 can no longer send or receive texts while behind the wheel, not even with hands-free technology. teens had been allowed to use voice activation, hands-free devices but not anymore. texting by hand while driving was outlawed back in 2009. there's also a new law spelling out the rights of transgender students in school. the law states that students can participate in sports and

use restrooms that reflect their gender identity, regardless of what is listed on their birth certificate. the law could be suspended in opponents collect enough signatures to place the issue on the november ballot. the boy scouts of america is beginning this new year with groundbreaking new policy. starting today, openly gay boys can join the scouts for the first time in the organization's 103-year-old history. the new policy is winning praise for many gay right supporters around the country. bill harrison is from the richmond gay foundation in virginia. >> man cannot be -- have high morals or be a good american because he happens to be gay is based on ignorance. >> however, some gay rights advocates say the new policy does not go far enough. the boy scouts will continue its current ban on gay adult leaders. it's 7:09. stanford is looking for its second straight rosebowl victory this afternoon.

the number 5 cardinal faced michigan state in the 100th rosebowl. stanford is in pasadena for the second straight year. it's michigan state's first trip since 1988. stanford is considered a slight favorite for today's game. before the rosebowl, of course, is the tournament of roses parade. the 125th annual parade begins this morning at 8:00 in pasadena. some people have been camping out for days to stake their spot along the a roid route and float designers say the wait will be well worth it. >> you look at this float ten times you will see different things every time you look at it. it's soy detailed. and dole food company has had the winning float for the past three years. floats are decorated with only natural materials, such as flowers, seeds, fruits and vegetables. you can watch the parade on our sister station. live coverage is underway right now, it started at 7:00 this

they rang in the new year with a special song as you saw there about being stuck in the ice. the 74 scientists, tourists and crew on the russian ship have been stranded there since christmas eve. they posted that video on youtube. the passengers say they are trying to keep their spirits high this new year's day and when the weather gets a little bit better, a helicopter will eventually rescue them. a united airlines flight was forced to make an unscheduled landing after the pilot started having heart problems mid-flight. the plane was on its way from iowa to colorado monday night when the copilot noticed the pilot was really sick. the copilot then decided to land in nebraska. 154 passengers were on board at the time, including two nurses, who rushed to help. >> it was chaotic at the front. they extradited him out of the cockpit and then laid him on the floor right up there in the first class area and they got an id on him. >> the pilot was taken to a nearby hospital and is expected to recover.

7:14. former first lady barbara bush remains in the hospital this morning. the 88-year-old is being treated for early signs of pneumonia. she was admitted to methodist hospital in houston last night. friends and family are sending her well wishes for a quick recovery. >> well, she's a tough gal who will outlive us all but our love is with her because she's not just the former first lady of america, she's at the first lady of our hearts. >> the hospital says mrs. bush is in great spirits. there has been an outpouring for support for a little girl fighting brain cancer and her family is giving back. her family held a blood drive at the church of the jesus christ latter day of saints in livermore. she was diagnosed with a brain tumor three months ago. her family says the blood drive is their way of helping others going through the same thing.

>> people have been there to help us. this is the only way we know to give back is to -- is good. she's already had 14-plus transfusions. >> hundreds of people have been showing their support for delaney on facebook. her father says delaney will have to go through more transfusions and chemotherapy as part of the ongoing treatment. today is the day the new healthcare reforms under the affordable care act kick in. so far, more than 2 million people have signed up for insurance through state and federal healthcare exchanges. in california, 400,000 people signed up through the covered california exchange. under the law, all americans must have healthcare coverage by march 31st or face a fine. the law guarantees no one can be denied coverage for preexisting coverage. late yesterday, hours before the affordable care act took effect, supreme court justice sonya so toe mayer -- so toe

mayer -- sotomayer granted a temporarily exemption for contraceptive coverage. pope francis has a new year's day message for the 1.2 billion catholics. he expressed his hope for peace at the vatican. he also urged catholics to help the hungry and poor around the world. 7:17. both the san francisco police and fire departments have put up help wanted signs. there are currently 1450 firefighters but the department tells the examiner it needs up to 600 more firefighters to handle the city's population growth. by the year 2040, san francisco's projected to grow by a third to 1.8 million people. the police department says it will need 300 to 500 additional officers. starting today, some workers in the bay area will be

getting paid more. the minimum wage is going up in san jose because of an ordinance passed by voters last year. it goes up from $10 an hour to $10.15. san francisco will also see a rise the minimum wage in that city goes up to 10.74 an hour. also taking affect today is an extension of the green sticker program. that means plug-in hybrid drivers can use carpool lanes without meeting the minimum occupancy requirements until 2019. the law is one of eight authored by san francisco state senator leland yee. most places are closed on this new year's day. all federal, county, state offices are closed. banks and post offices are also closed. most bay area transit agencies will be running on a sunday schedule and parking meters in san francisco will not be enforced today. all right. 7:18. we want to check in with steve to see what's happening with the weather. >> look at this.

>> yeah. >> colder this morning. we have just a few high clouds. yesterday, we had more. that held up the lows. it was still cold. fog is on the coast, parts of it from san francisco north. south it's mainly clear. some patchy fog. we are ending -- well, we ended the driest year ever for many. i try to -- there was so many occidental into the russian river usually gets a lot of rain. 57 inches. they had 15.45. driest ever. kentfield, marin county, also what can be a wet spot, 48- inches is average. 7.80. that's just abysmal. los gatos, they should have over 23 inches of rain. these were all records. calistoga was in there, st. helena, i could go on and on and on. for december, san francisco had .039. december is usually one of our wettest months over 4.56. the maximum temperature for those of you living in the city, 57. that's normal but the minimum

was 2.2 degrees below average. december was cold. it was also very dry. 27 napa, 29 fairfield. 44 in the city. i know there's colder readings than that. concord, 33. even 30s on the coast. novato, 35. there's a lot of 20s and 30s. much more than we saw yesterday. 19 in tahoe. 23 reno. nationally, if it's quiet here, there must be things going on. some of that tropical air will come together. chicago, snow lining up to omaha and back to denver. this is all looking like it wants to come together. for boston and new york, there are blizzard warnings out. it's quiet now, but they expect all of this to come together. if you have travel plans, right now would be a good time to go. for us, sunny, hazy. it will be nice and a little warmer. some patchy fog favoring those by the coast. afternoon temperatures, continue to be above average. we should be 56 to 61. we're way above that.

alongside his wife and two children. outgoing mayor michael bloomberg there doing the honors on the left. deblassio is the 109th mayor but first democrat in two decades. he will take part in 90 minutes in a larger ceremony that will be provided oef -- presided over by former president, bill clinton. and you can see barely see michael bloomberg last night. he ended his 12 years as mayor walking down the steps of city hall. he hosted a breakfast at the library. the billionaire businessman says he plans to speak a low profile. new york's mayor is already taking a controversial position that could hurt the tourism industry by banning horse and carriage rides. he calls the treatments of horses inhumane. while animal rights decisions

are applauding the decision, many tourists say an important part of the city would be gone. >> as long as it's not cruel, i think it's a good idea. >> carriage rides have been offered since central park opened back in 18 a 8. carriage riders are opposing the decision fearing they will be out of a job. san francisco police have identified the man they say led officers on a chase through the city. police say 29-year-old jack samuel started the pursuit before 9:00 on monday night in the bayview district. the chase went onto interstate 280, 19th avenue and into golden gate park. it ended when he crashed into a concrete barrier. one officer was hit by samuel's car who was treated and released. another officer opened fire hitting the suspect's car. police in gilroy are asking for the public's help searching for a bank robber.

was captured on a surveillance camera as he robbed a union bank at santa teresa boulevard yesterday afternoon. he's described as white, in his mid-20s without facial hair. he was wearing a black bearable cap, a black hooded wet shirt and white tennis shoes. if you live in contra costa county, you may hear emergency sirens later this morning but it's just a test. [ sirens ] >> they sound like that. the sirens are tested every month but since it's happening on new year's day and more people will be at home, county officials want to make sure everyone knows it's just a test. it starts at 11:00 this morning. well, that mysterious crop circle in monterey county has been mowed down. the property owner says all of the attention had become a nuisance so he decided to get rid of it. hundreds of people flocked to see the elaborate design which looked like a computer chip. it sparked a lot of talk about

news. >> thank you. in fremont, a car slammed into a group of people killing one woman and leaving a baby in critical condition. police say a 19-year-old woman and a 17-year-old girl were walking across paseo padre parkway and mowry avenue before 10:00 last night. the 19-year-old was carrying a 3-month-old baby. investigators say a truck hit them. half an hour ago, we learned that the 19-year-old died from her injuries while the baby boy remains in the hospital with life-threatening injuries. >> we're still investigating the collision, we haven't determined if any laws are broken, if there was any impairment or anything else of that nature. >> police continue to investigate to see who if anyone is at fault. the 17-year-old woman was also hurt but her injuries are not life-threatening. the 64-year-old driver did remain at the scene. the roadway was blocked for about five hours overnight as officers investigated the crash. >> 7:33. a medical facility in new york says it is willing to accept 13-

year-old jahi mcmath if her family can get her there. jahi's family wants breathing and feeding tubes surgically implanted to allow her to be transferred. but oakland children's hospital which considers the girl to be dead says it is ethically wrong to perform surgery on a body. >> you are setting up road blocks at every road that we try to go down to save jahi. because imagine this -- if jahi does come back as we hope, imagine what children's is gonna have to face. >> the court and three physicians have ruled this young lady dead. she's not coming back under any circumstances and that's sad, sad -- that's the sad, sad truth. >> a judge ordered children's hospital to maintain jahi aventilater until at -- jahi's ventilator at least until next tuesday. a spokesperson for the terry

shiavo says they are working with the jahi family. after a long battle, her feeding tube was removed in 2005 and she died. the facility in new york where jahi may be transferred is called new beginnings and is dedicated to terry she shiavo. jahi's uncle says i will fight for you forever, jahi. the rocky mountain state is making history on this new year's day in 2014. colorado is now the first state in the nation to allow the sale of marijuana for recreational use. retail pot sales officially began. starting today, anyone over the age of 21 can buy up to an ounce of marijuana. >> this is something that the nation is watching us for and the city and a lot of other

entities have been working hard to make sure that everything is done in a presis manner that accommodates everybody's needs. >> now, there are posters and fliers posted across the state spelling out the new rules in colorado. they include you cannot smoke pot in public. you can't drive under the influence of pot. you can't give the marijuana to anyone under 21 and you cannot take the pot out of the state. happening today -- protesters in oakland plan a vgeil to mark the fifth anniversary of the death of oscar grant. bart police officer, johannes mehserle, shot and killed him at the fruitvale b.a.r.t. station on new year's day 2009. today's vigil is set to begin at noon at the fruitvale station. members of oscar grant's family are expected to attend along with the director of fruitvale station. that's the movie based on oscar grant's life and death. there was a large police presence around oakland city hall last night. officers were called in after

occupy oakland called for a demonstration protesting the shooting as well as other issues. police were on alert all night. but the demonstration never took place. a brentwood man has been charged on suspicion of lying to police about the deaths of two dogs. prosecutors accuse 32-year-old jonathan crisp of protecting his father who shot and killed the neighbor's dogs in september because they broke into his chicken coop and killed about 20 chickens. he told animal control he had killed the dogs. he faces a misdemeanor obstruction count. his father will not be charged because it's legal to kill dogs in california while protecting poultry. despite last night's shootings we mentioned earlier, oakland along with richmond showed significant drops in deadly violence in 2013. a church in oakland held the annual memorial for homicide victims. there were 89 crosses on display, signifying all of those killed in oakland last

year up until yesterday afternoon. 125 people were killed in 2012. that's nearly 30% decline but still, some say it's too many. >> i got more loved ones up here, people i know, people i grew up with, i know they are like family. it's hard. when is it gonna stop? >> the city of richmond has experienced a large drop in violent crime. there were 43 homicides in 2009. 18 in 2012 and 16 last year. police credit more resources including several dozen detectives working in specialized units from homicide to narcotics. vallejo was one bay area city where the homicide rate went up. there were 25 homicides in 2013. that's compared to 16 the previous year. in san jose, they saw a slight improvement in 2013. there were 43 homicides compared to 46 in 2012. a number of new gun control laws hit the books in

california today. one law requires the state to collect specific information about shot gun and rifle purchases. that information would then be stored on a computer base. in the past, only handgun purchases were permanently recorded in california. this new gun law and others led to a last-minute rush on gun and ammunition sales at gun stores across the state. starting this weeks. ged test will be completely different. the test will focus on critical thinking schools and use more standards that could make it harder to pass. test takers will be required to use a computer instead of a pencil and paper and it will also cost more to take the test. it is the first update to the test in more than a decade. 7:39. and we're now getting word of the first bay area babies born in 2013 -- 2014. i should say. the baby girl was born two seconds past midnight at kaiser permanent san jose medical center. and a baby boy was born at

7:43. in business news, threat flicks is doing some early spring cleaning starting today. more than 80 movies and a handful of tv shows will no longer be available for streaming through the site. netflix is cutting such movie favorites as brave heart, do the right thing, flash dance, ploo toon and war games.

no specific reason was given for the cuts in the netflix catalogue. apple is denying any knowledge of a national security agency program that can snoop on iphone users. a german newspaper reports the nsa developed a system to hack into iphones and view personal information such as text messages and contact lists. in response, apple says it has never worked with the nsa to create backdoor channels in the products that would allow spying. a west sacramento cheese company is recalling all flavors. cashew cheese because the possible salmonella contamination. the cultured kitchen company says the cheese was sold in eight-ounce containers at natural food stores and farmers markets in the bay area, sacramento and reno. seven flavors are involved. the recalled containers have, pieration dates through april 19th. president put be made a

don't have computer access. >> angry survivors that tore through illinois back in november disrupted a news conference yesterday that was set to announce disaster relief. storm victims blame state leaders for communication breakdowns and the slow response in assistance. about two dozen tornadoes touched down in one central illinois community. the new year is bringing a hike in natural gas and electricity costs across the bay area. pg&e says average residential natural gas bills will increase about 7%, more than $3 a month. as for electric rates, the company says those rates will increase a little more than .5%. that will add 23 sents more to a customer's monthly bill. and there's fare changes. on average, b.a.r.t. passengers will pay an extra 19 cents per ride. fares will be going up again in 2016, 2018 and 2020.

mustang. the driver walked away with barely a scratch. only a bloody nose. officers say it happened around 5:30 this morning on grove way near western boulevard just south of 238/580 split. the chp says the driver was speeding over railroad tracks and went airborne, slammed into a parked car, a speed limit sign, plowed through two front yards, fences, damaged a bmw and then landed on top of the mustang. neighbors say they heard the twisting of metal and ran outside. >> the driver was in the back seat of the car. >> reporter: he didn't have his seat belt on? >> no. >> reporter: and i understand he had a bloody nose? >> he had a bloody nose, kind of out of it. you could smell alcohol. he was drunk. he said he wasn't but you could tell he was drunk. >> reporter: officers say the driver was taken to the hospital an will be charged with dui. the tow truck has taken two of the three trucks away. you can see this empty beer bottle here that actually you can tell it's been split open and there's beer laying on the sidewalk. that's what fell out of the car

according to witnesses. we've discovered that this mustang's owner is actually out of the country. he brought this car to his friend's house to keep it safe while he was away. unfortunately, that did not turn out to be the case. luckily, no one was killed which spans about an hour football field. we're live in hayward, tara moriarty, ktvu channel 2 news. >> such a sad site. >> thank you, tara. the chp is investigating a deadly new year's day freeway crash in oakland. it happened hours ago on interstate 580 near park boulevard. the chp says a white suv veered off the highway and flipped over. female passenger was killed. the male driver was transpored to the -- transported to the hospital with minor injuries. it's still not clear what caused the suv to go off the highway. the chp is trying to determine the cause of a deadly new year's eve crash in a remote area of west marin county. you can see the car ended up in the water after the rollover

accident near tamales bayer iy yesterday evening. a passenger was killed when the car flipped over and landed on the roof near shore line highway. bystanders came to the rescue of the driver who was not seriously hurt. this morning, the chp will release the number of arrests it made during the new year's eve drunk driving crackdown. >> put your feet together, arms down your side. follow my fin finger -- finger with our eyes only. don't move your head. >> this vehicle was pulled over while we were on a ride along. the man took a test but was not arrested. last year, arrests arrested 2 -- officers arrested 208 people. people across the bay area celebrated the new year with fireworks. this is what it looked like at the stroke of midnight in oakland. although there were no official fireworks shows in the city, as you can see, illegal fireworks lit up the skies. police there were extra patrols owl looking for those -- out looking for those. an extra 200,000 people

technology. teens were able to use the hands-free devices but not anymore. texting by hand was outlawed in 2009. there's a new law spelling out the rights of transgender students in schools. the law states students can participate in sports and use restrooms that reflect their gender identity regardless of what's listed on their birth certificate. the law could soon be suspended if opponents collect enough signatures to place the issue on the november ballot. the boy scouts is beginning with in a groundbreaking pollcy. starting today, openly gay boys can join the scouts for the first time in the organize's 103-year-old history. this is winning praise from many gay rights supporters around the country. bill harrison is one of them. he's from the richmond gay foundation. >> cannot have high morals or be a good american because he happens to be gay is based on

great spirits and is being visited by her husband and family members. there has been an outpouring of support for a little girl from livermore who is fighting brain cancer. now her family is giving back. yesterday, the parents of 2- year-old delaney newton held a blood drive at the church of jesus christ of latter-day saints in livermore. delaney was diagnosed with a brain tumor three months ago. her family says the blood drive is their way of helping other children and families going through the same thing. >> people have been there to help us. this is the only way we know to give back is to -- is blood. you know, she's already had 14 plus transfusions. >> hundreds of people have been showing support on facebook. her father says she will have to go through more transfukeses and chemotherapy as part of her ongoing treatment. today is the day the new healthcare reforms under the new affordable care act kick in. so far, more than 2 million people have signed up through

it is 8:24. both the san francisco police and fire departments have put up the help wanted sign. there are currently 1450 firefighters in the city but the department tells the examiner it needs up to 600 more firefighters to handle the city's population growth. by the year 2040, san francisco is projected to grow by a third to nearly 1.1 million people. the police department says it will need 300 to 500 additional officers. starting today, some workers in the bay area will be getting paid a little more. the minimum wage is going up in

san jose because of an ordinance passed by voters last year. it goes up from 10 an hour to 10.15. san francisco will also see a rise. the minimum wage in that city goes up from 10.55 to 10.74 an hour. also taking effect today is an extension of the green sticker program. that means plug-in hybrid drivers can use carpool lanes without meeting the minimum occupancy requirements at least until 2019. the law is one of eight authored by san francisco state senator yee. san francisco police have identified the man they say led officers on a chase through the city. police say 29-year-old jacques samuel started the pursuit between 9:00 on monday night in the bayview district. the chase went on to interstate 80, 19th avenue and into golden gate park. it ended when he crashed into a concrete barrier. one officer was hit by sam um's car. he -- samuel's car.

pedestrian cash crash on new year's eve night. she was walking with her mother and younger brother when a car turned right into them. claudine wong is live at san francisco general hospital where the mother and her other child are recovering this morning. we understand you just talked to the witness at the scene. claudine? >> reporter: yeah, that's right. we talked to a witness over at the scene where this happened before we came to san francisco general. as you said, this is where the mother remains. she's in critical condition. her 7-year-old daughter was killed. her 4-year-old son suffered minor injuries. the accident happened about two miles from where we are at the intersection of polk and ellis. police tell us the family was in the crosswalk at that intersection at about 8:00 last night when a driver making a right turn hit all three. police say they are still piecing together everything that happened but tell us the driver stopped and is cooperating with police. in the last hour, we spoke to a man at the intersection about what he and his wife saw and heard. >> i was -- my wife got out. walking down the street.

the accident just occurred. jumped out of his car. screaming. i had a green light. and then somebody else -- i saw this car stop. i didn't think she was gonna step out in front of me. he said i had the green light. i had the right-of-way. >> reporter: police say regardless of the light, pedestrians have the right-of- way and told us during the investigation, police developed enough probable cause to arrest the driver on charges of vehicular manslaughter. if we come back out here live to sf general, this is where the 4-year-old is recovering a as well as his mother. his mother's injuries are described as life-threatening. claudine wong, ktvu channel 2 news. in fremont, a car slammed into a group of people, killing one woman, and leaving a baby in critical condition. police say a 19-year-old woman and a 17-year-old girl were walking across a sayia padre -- paseo padre parkway and mowry avenue. the 19 why was carrying a 3-

month-old baby. investigators say a truck hit them. half an hour ago, we learned that the 19-year-old died from her injuries while the baby boy remains in the hospital with life-threatening injuries. >> we're still investigating the collision. we haven't determined if any laws were broken, if there's any impairsment or anything else -- empairment or anything else of that nature. >> police are still investigating to see who if anyone is at fault. the 17-year-old woman was also hurt but her injuries are not life-threatening. the 64-year-old driver did remain at the scene and the roadway was blocked for about five hours overnight as officers investigated the crash. 8:34. three separate shootings marred new year's eve in oakland. around 9:30 a young person was shot near 104th avenue and walnut creek street. the victim was hit in the chest and rushed to the hospital in critical condition. police have not yet released the person's identity or age. there are no suspects at this time. and there were two other shootings in oeged.

the first -- oakland. the first happened at 9:00 at 54th street and martin luther king, junior way. a man was shot in the leg but he's expected to be okay. around 9:10 a woman was also shot in the chest in the 1800 block of 22nd avenue. she was taken to the hospital where she was later pronounced dead. no arrests have been made in any of the cases so far. the rocky mountain state is making history on this new year's day. colorado is the first state in the nation to allow the sale of marijuana for recreational use. retail pot sales began just a short time ago. this is new video of people lining up in the snow in denver to buy pot. starting today, anyone over the age of 21 can buy up to an ounce of marijuana at a licensed store. >> this certainly is something that the nation is watching us for and the city and a lot of other entities have really been working hard to make sure that

everything is done in a precise manner that accommodates everybody's needs. >> there are now posters and fliers put up across the state spilling out the -- spelling out the new rules in colorado. you cannot smoke pot in public, you cannot drive stoned. you cannot give marijuana to anyone under 21 and you cannot take the pot out of state. a number of new gun control laws hit the books today. one law requires the state to collect specific information about shot gun and rifle purchases. that information would then be stored on a computer database. in the past, only handgun purchases were permanently recorded in california. this new gun law and others led to a last-minute rush on gun and ammunition sales at gun stores across the state. well, starting this week, the ged test will be completely different. the test will focus more on critical thinking skills and it will use new standards that could make it harder to pass. test takers will be required to

use a computer instead of a pencil and paper. it will also cost more to take the test. it's the first update to the test in more than a decade. 8:36. happening today -- protesters in oakland plan a vigil to mark the fifth anniversary of the death of oscar grant. b.a.r.t. police officer, johannes mehserle, shot and killed the 22-year-old man at the fruitvale b.a.r.t. station early on new year's day in 2009. today's vigil is set to begin at noon at the fruitvale station. members of oscar grant's member are expected to attend along with the director of fruitvale station, the movie based on oscar grant's life and death. there was a large police presence around oakland city hall last night. officers were called in after occupy oakland called for a new year's eve demonstration protesting the grant shooting as well as other issues. police were on alert all night long but the demonstration never took place. a medical facility in new york says it is willing to

accept 13-year-old jahi mcmath if her family can get her there. jahi's family wants breathing and feeding tubes surgically implanted to allow her to be transferred but oakland children's hospital which considers the girl to be dead says it is etically wrong to perform surgery on a body. >> you are setting up road blocks at every road we try to go down to save jahi. imagine this -- if jahi does come back as we hope, imagine what children's is gonna have to face. >> the court and three physicians have ruled this young lady dead. she's not coming back under any circumstances and that's the sad, sad truth. >> a judge ordered children's hospital to maintain jahi's ventilator at least until a federal court hearing next tuesday. an organization founded by the family of terri shiavo it is working with the mcmath family

to find a plate for jahi mcmath. in 1990, shiavo's husband wanted her feeding tube removed when she was diagnosed as being a vegetative state. after a long legal battle her feeding tube was removed and she died. the facility where jahi may be transferred is called new beginnings. new crime stats this morning as well as oakland a along with richmond showed significant drops of deadly violence in 2013. there were 89 crosses on display at this church signifying all of those killed in oakland last year up until yesterday afternoon. 125 people were killed in 2012. that's a nearly 30% decline. still, some say it's too many. >> i've got more loved ones up here, people i know, people i grew up with. and i know their families. it's hard. when is if gonna stop -- is it gonna stop in oakland?

>> the city of richmond experienced a large drop in crime. there were 43 homicides in 2009. 18 in 2012 and 16 last year. police credit more resources including several dozen detectives working in specialized units from homicide to narcotics. more details as vallejo was one bay area city where the homicide rate went up. there were 25 homicide in 2013 compared to 16 the previous year. meantime, in san jose, that city saw a slight improvement in 2013. there, there were 43 homicides compared to 46 in 2012. 20 minute of before 9:00 we're getting word of the first bay area babies born in 2014. a baby girl was born two seconds past midnight at kaiser permanente san jose medical center. a baby boy was born at kaiser san francisco medical center at eight seconds past hid night.

welcome back to "mornings on 2." well, the chp is investigating a suspected drunk driving crash in hayward. it happened about three hours ago on grove way. ktvu's tara moriarty joins us live from the scene to show us the extensive trail of damage left behind, tara? >> reporter: well, we want to show you what fell out of the car when the car stopped. it was this bottle of beer. the beer is fresh there on the ground. what happened was that the car that the alleged drunk driver was driving in, that's been since towed away landed on top of this classic mustang. the driver walked away with only a bloody nose. officers say that it happened around 5:30 this morning on groveway near western boulevard just south of the 238/580 split. the chp says the driver was speeding over railroad tracks and went airborne, slammed into a parked car, a speed limit sign, plowed through two front yards, fences, damaged a bmw and landed on top of a classic

to about 34,000. 8:55. we're learning new information about a shooting in east palo alto last night. police say it appears that a man accidentally shot himself in the head while intoxicated on new year's eve. police responded to a home around 9:00 last night. that man was immediately taken to a hospital. but this morning police have not been able to give an update on the man's condition this morning. but they say the shooting does appear to be accidental. netflix is doing some early spring cleaning. starting today more than 80 movies and a handful of tv shows will no longer be available through the site. netflix is cutting brave heart, do the right thing, flash dance, platoon, and war games. no specific reason was given for these cuts in the netflix catalogue. the new year is bringing a hike in natural gas and electricity costs for many people across the bay area. pg&e says average residential natural gas bills will increase

about 7%. that means an increase of more than $3 a month. as for electric rates, the company says those rates will increase a little more than half a%. that will -- half a percent. that will add 23 cents more to the monthly bill. on average, b.a.r.t. passengers will pay an extra 19 cents per ride. fares will also be going up again in 2016, 2018, and 2020. part of a program to generate $325 million to be spent on upgrading the system. muni prices will increase to $15 for a one-day pass. $23 for three days and $29 for seven days. a dispute is brewing between starbucks and a small prury in missouri. exit six pub is located in a st. louis suburb. now, there are postings on social media about the brewing selling an alcoholic beverage called the frappuccino which is
