off. >> i am julie haener. ktvu's rob roth is live in oakland with the message they have for the country. >> reporter: during today's celebration here at the b.a.r.t. station the family of oscar grant called for an end to violence on the street and for the police and the community to come together. >> reporter: among the 200 people at today's celebration of oscar grant was his daughter. now 9 years old. her aunt tells the little girl about her father. >> telling her funny things about him. things i remember. her birthday party. her driving with her dad and her hair crazy. him trying to comb it. >> reporter: what happened 5 years ago still happens, too many young people are killed by the hands of police. >> it is about fighting.

lives are not taken senselessly. grant was killed by officer johannes mehserle. it sparked debate about police use of force. the family says it is necessary to keep the issue alive. >> the message is to not forget. we have children dying at the hands of police. >> such tributes may be too much. >> i feel like we are making a celebration. i think we need remember him and we can do it another way. i think it is time let him rest in peace. >> the family will continue holding events like this every new year's day so what happened won't be forgotten. rob roth, ktvu channel 2 news. police are investigating the city's first homicide of 2014, hours into the new year, a 13-year-old boy died. police say the teen was walking

home when he was shot several times. around 9:30 p.m. last night. police don't have a motive and no arrests have been made. police are also investigating a shooting that left a woman dead. investigators say the 21-year- old was sitting in a car with friends and someone opened fire on them. friends took her to the hospital where she died. it marked the 92 homicide of 2013. no arrests have been made. a six-year-old girl was one of two pedestrians struck and killed on new year's eve in san francisco and their deaths mark a grim milestone. ktvu's david stevenson tells us what is being done to keep people safe. >> reporter: san francisco officials say the death of the little girl over there in that intersection should spark a change on the city streets.

>> reporter: the six-year-old was killed in the intersection new year's eve. the highest number of pedestrian deaths since 2007. >> people don't pay attention to the pedestrians. you know? you know, we are small people, you know, trying to get somewhere as well. >> reporter: police say they were struck by the driver. the company expressed sympathy for the family and police booked him on voluntary manslaughter. >> going in the wrong direction. >> reporter: advocates said the death and the death of the 86- year-old in this intersection tuesday gives new urgency to make the efforts safer for everyone. >> calls for a 50% cut in collision by 2021.

>> reporter: increasing crossing time, adding curve ramps and targeting the most hazardous corridors. >> it appears the driver failed to come to a complete stop. the pedestrian was in the middle of the cross walk. had the right of way. >> few minutes ago we obtained a statement on the death, she called for greater scrutiny of pedestrian safety and ride share companies. reporting live in san francisco, david stevenson, ktvu channel 2 news. today begins what some called the biggest improvement ever in american healthcare. every residents is eligible to be covered. ktvu's john fowler has been following the story and joins us for what it means. >> reporter: the affordable care act kicked in today. for most people little change. for others profound. >> you can just date the

will process their claims. drunk driver left a trail of destruction for residents to clean up new year's day. take a look. the california highway patrol says the driver was speeding over railroad tracks and went air born. landed on top of a 1964 mustang. >> the driver was in the back seat of the car. he didn't have a seatbelt on. >> he had a bloody nose. out of it. you can smell alcohol. drunk. you can tell he was drunk. >> officers say the driver who is facing dui charges was taken to a hospital with minor injuries. the number of dui arrests this new year was similar to the past few years. chp reports 50dui arrests over two days. statewide, 324 dui arrests and

two deadly crashes. a man is being charged with lying to police about the killing of a neighbor's two dogs. they charged jonathan christ with one count of ubtrucking an officer -- obstructing an officer. he was protecting his father, randy christ. the son told them he shot and killed the dogs because they broke into a chicken coop and killed 20 chickens. the elder will not be charged because it is legal to kill dogs to protect live stock. relatives of jahi mcmath exchanged harsh words with oakland children's hospital today. as the family tries to move jahi mcmath. doctors declared her brain dead, december 12, following cardiac arrest following a tonsillectomy. family says she is still alive and want to move her. however children's hospital will not insert tubes saying it

is unethical. >> the family attorney is misleading the family. jahi mcmath is deceased. >> jahi mcmath is the victim. our family is the victim. and it is not fair and cruel for them to spin this story and make it as if children's hospital is the victim. >> the family and the hospital are set to present arguments to a judge on friday. the deadline to keep jahi mcmath on a vent later is january 7. hundreds of new laws. governor jerry brown signed 800 new laws now taking effect. including a gun control measure. one law requires the set to collect information about shotgun and rifle purchases. that information would be stored on a database. this new law and others led to a rush on gun and ammunition sales. there is a law spelling out the

rights of transgender students in public schools. students can participate in sports and use rest rooms that reflects their gender identity. the law could be suspended if opponents collect enough signatures to place a repeal on the ballot. california drivers will be required to keep a 3-foot distance from bicyclists when passing and anyone with a hybrid car can keep using the carpool lanes till 2019. the first baby of the new year in the bay area arrive as the clock was striking midnight. gasia mikaelian tells us why the parents were hoping for an earlier debut. >> cute. mom was so focused on her labor she didn't realize it happened as everyone was toasting 2014. >> happy. >> the dad said he was hoping for baby to be born before midnight to take the tax write off but he got a healthy baby and it doesn't get any better than that. gasia mikaelian ktvu channel 2 news. >> and parents in toronto are celebrating their twins born in different years. she arrived at 11:52 p.m. and she followed 38 seconds after midnight. the mother says she was stubborn and didn't want to come out. two other babies were born at midnight. increasing the minimum wage. pay increases for bay area

anncr: at jennie-o we heard of a place in iowa where every thursday people ride 10 miles for tacos. we thought we'd show up and surprise them with a better kind of taco made with jennie-o ground turkey cooked thoroughly to 165. i feed my kids turkey tacos over regular tacos any day. i think they are light and they are just fresh tasting.

you will find both owners working hard to keep employee cost down. >> 15 cents more in a year, pretty heavy on us. >> the minimum wage in san jose went up, 15-cent hike for inflation. san jose joins san francisco as one of two cities in california that has inflation based raises. he says this will keep workers here ahead of the curve. >> if you don't tie it to the cpi, and the inflation, it will fall behind. >> reporter: san francisco is on example. minimum wage was $8.50 in 2004 and after increases, it was $10.55 in 2013. rises to $10.74 today. >> $11 an hour. >> reporter: they made a decision to go above and beyond

the new minimum wage. >> we thought it was a good thing for the employees to get the added money. gives them a better feeling of coming to work. >> boost to morale boosts business too. >> people come in to work with a better attitude. the customers will see that and will want to come back. >> the rest of the state will close the gap. the minimum wage for the state of california goes up to $9 an hour in july. in san jose, ann rubin, ktvu channel 2 news. the family of a woman killed in a pedestrian accident is holding a vigil at this hour at the scene of the crash. the 19-year-old was holding her three-month-old and walking with her sister when they were all struck. the baby is in critical condition tonight. the sister was treated and released. the crash happened at 10:00

p.m. last night. the family is in shock. >> it is unbelievable. tragic. i can't believe this happened to my niece. family is with you one day and gone the next. >> the sisters were in a car but had an argument and decided to get out and walk. the driver of the truck is cooperating with police. alcohol does not appear to be a factor in the crash. the transportation of the highway one devil's slide area into a trail is on schedule. a mile of the road will reopen on march 15 as a biking and hiking trail. the project was launched soon after the tunnels opened last march. for decades the highway was notorious for accidents and land slides. brave athletes spent the morning making a break from from alcatraz. because of the king tides the
