with arson investigators joining us live from the scene, good morning tara. and from the fire department, i should say, i spoke with them this morning, at 8:30 he will be sitting down with the police department to review this surveillance. i will show you where it came from. >> reporter: if you look to the left, you can see this video camera and that camera can yield some important clues. the fire broke out at about 9:30 at the chinese consulate at the corner of gary and lagooner. a person got out, poured two buckets of gasoline on the front door before torching it. they are working with the fbi

to figure out who is responsible. they called the arson attack a violent crime in the united states. security has been beefed up and you can see the police cars patrols are beefed up here and we know that the fire chief will be speaking with investigators. san jose police are investigating the first homicide of the year. a man was shot 1:30 this morning near south 33rd street. he died at the hospital shortly after. right now it's not clear what led to the shooting but so far no arrests have been made. janine de la vega is gathering information at the scene and will have a live update in the next half hour. and they found the

discovery of a human skull at one of the areas' most popular parks. here is more on what led them to this gruesome discovery new year's day. this is obviously a very popular park in the oakland hills. we are just a short distance away and this is where people come and take a look at the view and this is where the discovery was made just a short distance from where it was. when police were out here, it was 5:30 when they got an anonymous tip. they got up here found that human skull on a plate surrounded by bees. obviously a lot of questions about how it got there and there were some people up here, the family was trying to enjoy the view and certainly they were taken back by the discovery. >> it was kind of scary to

looking? >> weatherwise, it looks pretty good but is a little cold. i will tell you, we have some bad air quality again and it is called an inn version and story said she liked this graphic and it is cold apt the surface. all of a sudden you hit a layer of warm air this time of year and it just traps everything. high pressure and it will equal a few. lots of sun, hazy, high clouds and patchy fog on the coast, 40s and 50s on the temperatures, it is 3 to 5 degrees warmer than it was yesterday, occasionally high clouds and mostly sunny and favoring the afternoon, we have another beautiful sunrise, 60s for some, i think a couple of lower 70s to the south, here is sal. we do have traffic which is busier than the years passed.

let's show you traffic is going to be okay at the bay bridge toll plaza with no major delays and traffic continues to look pretty good as you drive onto the bridge and we don't have anything major going on. let's look at the commute here on the interstate 880 and traffic is actually not bad on the nimitz freeway and it continues to look good if you are driving out to the area. in the bay view, near 3rd and this area, it is not causing a big delay but the streetcar is only going after them heading into the downtown area from there. san jose police are investigating the first homicide of the year and there is new information about the victim, janine de la vega?

>> reporter: we just learned the victim was wearing an ankle bracelet and they are still trying to confirm who he is and making some new leads into this case. crime scene technicians are fanning out in this neighborhood of east and san antonio, they want to find out what led up to this and they called to say gunshots had been seen but they spotted a man lying on the driveway of a home in san antonio. it appears he had been shot at least once. they performed a "c" pr but were not able to save of him. it doesn't appear there are any witnesses. at this point we have no idea what the motive may have been. we have no idea at this point,

it could have been just about anything. >> police say it appears the victim is a latino mail in his late 20s -- male in his late 20s but investigators say it is too early to tell if it is gang- related. after talking to people in the neighborhoods we learned they did hear gunshots but did not call it into police for some unknown reason and the passersby called 911. and the coroner has not been called yet because detect tis are all calling for more investigations. ktvu channel 2 morning news' tara moriarty is talking to arson investigators and she is back live to tell us what will happen in just about two ours from now, tara.

. welcome back, a gruesome discovery on new year's day. live on grizzly peak boulevard, visitors are still reacting to the location of a skull. >> reporter: this is the vista area and you can take a look, this is an incredible view. this is not what brought up police but they were brought up by an anonymous called which alerted them to a human skull. officers came and found the skull in plainview and it was on a plate surrounded by beads and the coroner said they now have it in custody and expect it to be examined today.

the oakland girl was declared brain dead and the family is still trying to move her out of children's hospital to a long- term care facility. jahi mcmath's uncle has found an ambulance and a plane to transport her and they still have not secured the facility. no surgeries can be performed on jahi mcmath and three doctors have declared her brain dead. >> no amount of time or surgery or hope will bring her back. we hope the family finds peace in 2014 and isable to move forward. >> jahi mcmath is the victim, our family is the victim and it is not fair and it is cruel for them to spin the story to make it that children's hospital is the victim. >> jahi mcmath had surgery on december 9th but suffered complication cakes and -- applications and she is under
