good afternoon. >> frank is off tonight, i'm ken, and we're on a hour earlier because of tonight's cotton bowl game. jihai, the young girl who was declared brain dead, her family is trying to get her moved out of the hospital. our reporter has attended both hearings and has the latest developments in this emotional case. >> reporter: attorneys for the family and the hospital spent the day in two separate courts. the settlement conference here in federal court in oakland is just now winding down. earlier today the two sides did reach one agreement as they try to move her out of children's hospital oakland by tuesday. while she remains hooked to a

ventilator we confirm that the coroner's officer has issued a generic death certificate for her. her family believes she's still alive. at first they said superior court today as they reached an agreement with the hospital to allow her to be moved to another facility. >> what we needed to know is that when all of the balls are in line, that we could move quickly and not have to then have any impediment. >> they consider her brain dead and have asked the family to accept that. >> i constantly think wouldn't they be able to come to terms with this tragic event and i wouldn't have to stand in front of you all time after time. >> the judge is forced to request force feeding and breathing tubes.

hit another vehicle. the man had gotten out of his car and started running, when he tried to detained them he assaulted them and ran into the southbound lanes of the freeway. he was hit by at least one other car. they're trying to figure out who he is, because he had an id on him that clearly did not belong to him. a vigil is planned for sunday for a popular priest killed this week. he was arrested yesterday after one of his relatives called police. investigators say he confronted the reverand and the man killed freed. he had been arrested the night before but was released from jail hours before freed was killed. damage caused by this fire at the chinese consulate. it did significant damage for the building's facade. the lobby was also damage.

the fire was caused by someone throwing in an incendiary device in the building. they're also investigating the attack. a fire was set for the memorial for andy lopez was an accident. he was killed by a sheriff's deputy. he thought the toy gun was a weapon. some reporters thought that the fire may have been inception at this -- intentionally set. they plan to spend a weekend rebuilding the memorial. at and t are making an aggressive competitor, they're offering $200 credit per phone line to switch service. they're offering $250 credit if the customer trades in their current smartphone. they're not saying how much customers it expects to gain or how long this offer will last. on wall street the dow ended mixed. the dow was up over 28 points
