dead in a stairwell seven months later. ktvu is unveiling documents which detail what went wrong. good evening i'm frank somerville. >> and i'm julie haener. who was to blame and who did not do their job. you may be surprised by the response of those involved in the search for that missing woman. 2 investigates tonight, david stevenson has poured over the reports from the hospital and tell us how staffing issues involving sheriff deputies may have hurt that search. >> reporter: we obtained these documents. names are retacted but they're raising new questions about the thoroughness and attitude of those involved in the search for lin spalding. almost immediately after she disappeared from her san francisco general hospital room the search for lin spalding

went awry. she was described twice as an african american woman and once as an asian woman. and the documents reported, she was going to be discharged and decided to leave. and the daughter made a stink about it and that's that. >> the daughter making a stink about it was trying to find out what happened to her mother. >> reporter: overtime was not available the following day. >> so they literally didn't continue the search. because they weren't going to get paid. how disrespectful is that? >> to the best of my knowledge that was not related to the overtime issue. >> reporter: an october 4th call between the hospital and staff says, there is someone

who got lost in the stairwell. he said in was somebody lying on the stairwell. okay we'll take care of it. thank you. bye. it was not until three days later that spalding was called. praoplting -- prompted this call. well they found her. two guys have f-ed up real bad. i'm just laughing. >> certainly there's concern when some of the language is not professional. >> they lost a person, didn't search to find her. when they find her dead they're laughing about it. it's outrageous. >> reporter: the sheriff department says there's still work to be done but tells us its investigation into spalding's death is being continued. ktvu news. developing news a 48-year- old woman is the first person to die from the flu in contra

costa county so far this flu season. the department confirmed the death saying the woman had underlying conditions when she contracted the h1n1 virus also known as swine flu. officials say she died within the last week. last friday santa clara county announced its first death. a 41-year-old woman who also became ill with the h1n1 virus. a bay area woman isn't giving up on finding the person who killed her son seven years ago today. last night we told you about elsa casillas campaign on social media. this afternoon she joined supporters in prayer for her son alberto. they met at the same spot where the young man was shot and killed on 13th and fulsome in san francisco in 2007. they also handed out fliers to spark awareness of the shooting. >> somebody needs to know who

these guys are. probably they may have talked about the crime, the homicide in the past years and think we forgot but we don't forget. >> reporter: elsa casilla says the passage of time has not diminished her pain and grief. a reward is being offered in the case. the men who triggered an amber alert last friday night after kidnapping a 7-year-old child in antioch admits that he did it. today david douglas talked on camera for the first time and he also made some bizarre statements to our reporter allie rasmus. allie is live now at the jail in milpitas. >> reporter: in a 15 minute interview this afternoon, accused kidnapper david douglas says he abducted the 7-year-old from her home as a plea for help. >> reporter: david douglas contradicted himself several times during the interview. at first he said the kidnapping was out of character for himself. >> this is completely out of my

nature to do something like this. >> reporter: but he went on to explain he had gone to wal-mart several times with intention to kidnap a child. he says he spotted a mother and daughter loading groceries into their car. followed them home and abducted the 7-year-old girl. >> we were both shaking. she was shaking in fright. i was shaking in fright. she looked at me and said i'm scared and i told her i was scared. we both laugh cried. >> reporter: did you hurt the little girl. >> no i did not hurt her. >> reporter: why did you do it though? >> as a plea for help. >> reporter: douglas claims he has special abilities and that his family and government are conspiring against him to keep him from his son. >> my only problem has been trying to reconcile with my family. >> reporter: douglas says before he was arrested he had

been living in his car at the antioch marina after having a falling out with his family. the family tried to file a restraining order against him and was denied. we're expecting the district attorney's office to file charges against douglas tomorrow. the man accused of setting fire to the chinese consulate remains behind bars tonight. a judge appointed a public attorney. today a neighbor showed us this photo she hook of police activity. >> all of a sudden cop cars start pulling up behind my truck and apparently it was for the house.

it was exciting but, crazy morning. >> reporter: a woman who lives next door to phang tells us phang has a wife and two children. phang is from china but has u.s. residency status. police have had a hard time making an arrest because they still don't know if the crook is a man or a woman. ktvu's robert handa is live now in milpitas where the robber hit another target, robert. >> reporter: when we broke this story at noon today. we showed you this picture given by investigators and while the images are helpful they are raising questions investigators are still trying to answer. >> san jose police, milpitas police and the fbi are looking for a sereal robber. it's still not clear if the robber is a man or woman. >> well at first, i thought

it's a guy. but looking at the other picture, i think it's a woman. >> it looked like a female. most of the pictures. koáfpblt -- couldn't tell if it was a man. >> reporter: police describe the suspect as a man, 110 pounds. they don't believe a black curly wig or hat or dark glasses will fool anyone who knows the suspect. >> we know someone know who is this person is. everyone though the suspect is using a disguise. without a doubt someone is going to know where she works, where she lives, associates, what kind of car she drives. her name. >> reporter: police say the robbery started on november 9th at a wells fargo bank in milpitas on ranch drive followed by a wells fargo bank and bank of america in san jose. then a different milpitas wells fargo bank and comerica bank in milpitas yesterday. what authorities are concerned

about is the robber is getting more brazen. >> reporter: an $11,000 reward is being offered. coming up what police are worried about if the robber isn't caught. robert handa, ktvu channel 2 news. a princess cruise ship has delayed its arrival in hawaii as a desperate search is under way for a crew member who apparently jumped from the ship. the missing person is a 34-year- old filipino young man. princess cruise ship says video shows the man intentionally going overboard. that cruise liner has now joined two other ships and a coast guard helicopter in the search which is going on about 1,000 miles northeast of hilo hie -- hilo hawaii. a court case for jahi mcmath has been cancelled today. the judge said now that jahi has been transferred the

proceeding was no longer necessary. jahi was declared legally brain dead nearly a month ago but her family has pushed to continue treatment. sutter health tells ktvu it plains plain -- plans to cut more than 350 positions this month. it hopes to make the cuts through attrition and says that cuts are needed to help balance their books. the hospitals are already understood staff, tell us nurses. >> less staff means more work for everyone. the threat of lay off and the threat of having to work way more hours than we're used to working under very stressful conditions with not only less nurses but less ancillary staff. >> sutter also announced it will shut its unit at the sutter campus. apple announced that last year users spent $3 million at its app store.

apple said that december was the single best month for app store sales ever. it reported nearly 3 billion app down loads at a cost of $1 billion. on wall street today investors show optimism for the upcoming earning season. stocks finished higher. the dow is up more than 100 points while the nasdaq was up almost 40 and the s & p500 was up 11. much of the country is still in the grips of record cold. take a look at buffalo new york where near white out conditions were in effect today with windchill of minus 20 degrees or more. and a foot or more of snow. areas that don't often see such extreme cold are also experiencing bitter weather. in parts of florida, a freeze watch is in effect tonight. citrus growers near tampa say they're worried the cold snap will harm their crops. more than a dozen arrivals and departures were scrubbed today.

new at 6:00. a young girl in concord collapsed in her classroom but is doing okay today thanks to her school nurse. >> reporter: connie wynn miller will tell you she was just doing her job as a school nurse. but she may have very well saved a little girl's life. >> i am so glad that she started breathing. so i thanked god she started breathing. >> reporter: it happened yesterday morning, miller got a word that a student put her head on the desk and appeared unconscious. >> it was like she was sleeping when i went in there and i could not rouse her.

>> reporter: and what's even worse is she was not breathing. >> reporter: i put her on the ground because that's the way -- >> i put her on the ground and starts cpr. because that's the only way you can do cpr is on the ground. >> reporter: the principal stood by watching. >> i was like please, please, starlet breathing. please. >> reporter: the girl has gone to home and is doing well. and the school is thankful of having someone like wynn miller. many schools in california don't have a full time nurse. the school will not say what caused the girl to have these problems but they do expect her to be back in class real soon. and when she does return, nurse miller says that she will be right here. >> i'm looking forward to seeing her yes, absolutely. >> reporter: rob roth, ktvu news. california children as young as 4 years old could get a jump start on school under an ambitious plan we're hearing about today. some northern california

schools are already experimenting with transitional kindergarten. state senate democrats say it would cost nearly $1 million over five years but supporters say the cost would be offset down to road by a lower school drop out rate. >> it's just that excitement about schools they enjoy it. they enjoy learning. they enjoy writing. when they learn to write their name. it's just celebration. >> the money would come from a surplus in the state's proposition 98 education fund. it's not clear if governor brown will back the idea. he's expected to unveil his budget blueprint on friday. first lady michelle obama is headed to the white house. she will be holding a woman's conference. the money raised will go to help elect democrats to congress. the first lady had to cancel her last planned trip in october due to the partial government shut down. a winter wildfire in humble

county is now 65% contained. calfire says there are 445 crew members on the fire along with 19 engines and a helicopter. 15 members of the fight team are those fighting the fire. they expect to have the fire contained by thursday. the fire is burning in privately owned timber land. the fire has burned more than 350 acres. more dry conditions around here. we had clouds today. you saw those. then they went away then the coastal fog came back. we have fog at the coast. it's back tonight. we will see valley fog show up late tonight, early tomorrow morning. in san jose you're at 63. temperatures they're just well above the average and not what you want to see this time of year when you expect to see rain. cold temperatures and low temperatures, we are seeing a pattern that is split. here's the subtropical moisture. here's the dynamics of the

moisture. if those were to phase together we would be getting rain. with the dynamics well to the north they can't access. the moisture is coming through but just not getting lifted and not getting pressed into pushing out rain. so as we go into tonight we're going to get cool. mid-30s, low 30s. current numbers are in the low 50s. 55 in san jose. the temperatures will stay kind of on the mild side because there's a little bit of a breeze out there. if you notice the breeze is coming most places offshore. west wind and offshore. eight-miles-an-hour. san francisco airport that's telling. those westerly wind clear out the air. so no spare the air day. they also have the tendency to bring the fog back to the coast. that's what we're looking for. without those offshore winds we've been seeing we're going to see temperatures not quite as warm as they have been. here is how it goes. this little system tweaks through. no big deal some clouds. the next system tweaks through

bigger and that gets in here thursday morning. maybe a few sprinkles up in the north bay. the computer model says it this way. there's the valley fog. there's the coastal fog tomorrow morning. here comes thursday. all right, what do you do with that. sprinkles at best. valley fog, coastal fog and sprinkles at best. as we go into the next 48 hours just clouds. more of the same with that next system. with the five day forecast with the bay area weekend in view lots of moisture in the area but nothing to trigger it. jet stream is not going to be there. this would normally be a real week for us. we're getting numb with this weather it's been so unprecedented. this extreme warmth and dryness. >> it really is something. >> we all grew around here and

and several sharks will be appearing. one time who won't be there logan couture probably would have made it for team canada. one of the shark's outstanding players but he's going to miss an extended period of time probably close to a month. he is having surgery on his injured hand. that will come up tomorrow and at that point the sharks says an organization will feel more comfortable about giving an exact diagnosis as to how much time he will miss. meantime the sharks are trailing down in nashville to the predators 1-0. they are in the second period. full highlights of the warriors and the sharks of course tonight at 10:00. but that's the sporting life for right now. >> those hockey teams are always known for not talking very much about injuries. here's fine. >> they said it was an upper body extremity. we had to do some investigating to find out it was his hand. >> and how about those warriors. they're great. >> the crack down on alcohol and one of san francisco's
