a pedestrian walks right into evening traffic and is hit and killed by a car in front of city hall. good evening everyone i'm frank somerville. >> and i'm julie haener. the victim made it across six of seven lanes before being hit. new at 10:00, heather holmes is live in the city. she's learned the victim had been in an argument just before he ran out into traffic.

heather was just inside city hall when the accident happened. >> reporter: when we walked out we found van nuys between hayes blocked. the victim was actually running in and out of traffic here on busy van nighs when he was hit by the car. his body then flew in the air before he hit the bumper of a parked car. investigators take pictures of a handa police say minutes earl littler the pedestrian a 38- year-old man had been in an argument with a couple standing at the crosswalk. >> it was simply an argument.

it was not physical. there was just loud yelling between the two. the man attempted to cross. made it to the center median. when trying to go from the center median to the east side of van nuys and was struck. >> reporter: the female driver in her 20s did stop and is cooperating. there's nothing to indicate that she was under the influence of drugs or alcohol. now to the east bay where sutter health has confirmed plans to lay off 358 employees at alta bates medical center. the lay offs include 180 full time positions at alta bates

three locations. sutter health said the cuts are necessary to return alta bates to health. but nurses say these cuts go to deep. >> to have the lay offs or to say you're going to have lay offs is outrageous because you can't even staff with the nurses you have to provide adequate care now. >> reporter: the hospital says it plans to make the cuts by january 10th that's friday of this week. more changes are possible with additional cuts down the road. legislation to increase unemployment benefits -- president obama made a push for the renewal saying the long term employed are not lazy. >> it's hard out there.

we have a lot of our friends, a lot of our neighbors who have lost their jobs and they're working their tails off every single day trying to find a new job. >> john boehner says he wants the extension paid for plus changes to obama care act. officials are declaring a drought emergency in the coming weeks. ken wayne has more on how it will affect some customers more than others. >> reporter: the state seems closer to declaring a drought. for water agencies that are more independent such as the one here in san francisco, they will make their own assessment on their water supplies and whether or not rationing or other steps are needed or not. we can have a sparse snow pack, our water levels can be very

low but not until governor brown declares a the drought is it official. and he's closer to doing that. >> for the state it allows them to set up a water bank. it also helps for water agencies to do transfers. san francisco puc general manager harlan kelly says that a state drought declaration does not have a direct effect on water districts such as san francisco. which relies on its own water supply from local reservoirs such as crystal springs. >> as of right now we're at 70%. every day that passes without any rain or snow we are growing concern about our water supply. >> reporter: for the state a drought emergency would allow more water to be sent to the

of the the drought emergenc. . chief meteorologist bill martin is looking at how long it's been since we've gotten rain. >> it's not good at all. let's check out december real quick. we had one day of rain. or significant rain in december 6th. we move forward we look at january that's been dry. in the forecast you're going to see here in a little bit there is a chance for something coming up on thursday but so far a very dry december and now heading into january. what does it mean? well, 12% of average in the north bay. 21% of average in san francisco. in san jose just 27% of average rainfall for this time of year. these numbers are way down. last year at this time we were 130% of average so we're really hurting for rain as bad as i've ever seen it. when we come back, i will talk about rain chances as we move

into the five day. all of this dry weather has prompted the call for help from a higher power. the california conference of catholic bishops is asking people of all faiths to pray for rain. >> all the california bishops sent out a letter to 1,100 parishes of the state of california, 10 million catholics asking for special prayers to bring an end to this low rainfall. >> the head of the conference says that watt -- water is necessary for all lives. and that the need is in farming communities and increased danger for wildlife. the judge ordered sherwin williams and conagra to pay $1.5 million into a fund to

remove lead paint. the money goes to san francisco and oakland as well as the counties of alameda, santa clara, san mateo and solano among others. this is the largest public nuisance award in california history. there is word of an arrest in connection with the killing of an 8-year-old oakland girl during a sleep over last summer. alicia kerridan was at a friend's house when someone knocked on the front door then opened fire. the father of alicia's friend 25-year-old antwon york was the intended target and that the shooting was in retaliation of a shooting in berkeley. officials now say they arrested york. investigators believe he killed 26-year-old germane davis hours before alicia was killed. also the two men responsible for alicia's killing appeared in court for a preliminary hearing. a plea for help.

that's the message accused kidnapper douglas davis was sending when he abducted a 7- year-old girl from inside her home in antioch. douglas spoke to allie rasmus in what can only be described as a bizarre jailhouse interview. >> why did you do it though? >> as a plea for help. >> reporter: 43-year-old david douglas claims he has special abilities and that his neighbor, family and the government are in his own words conspiring against him to keep his from his kids. >> i need to get rid of it desperately. >> reporter: he says he had gone to this wal-mart in antioch several times before with the intention of kidnapping a child. on friday night he spotted a mother and daughter loading groceries into their car. >> saw them in the parking lot. the mother made a very obvious effort of turning and looking right at me. for not just glancing at me she looked right as me as if she was cignitying -- signifying

at me that she was a part of this. >> reporter: so that was a cue for you to take her daughter? >> to at least follow them to see what would happen. >> we were both shaking. i was shaking in fright. she was shaking in fright. she looked at me and she said i'm scared. and i told her i'm scared and we cried laughed together. >> i can just imagine. sure. absolutely. you have to appreciate how desperate i am -- i'm sorry. it's too much. >> reporter: i asked douglas if he's ever been diagnosed with or treated for a mental illness. he said no. we're hoping to learn more tomorrow when the district attorney's office is expected to file formal charges against him. allie rasmus. douglas is currently being

a 48-year-old woman has become the first person to die from the flu. officials are not releasing her name or where she lived but they are urging people to take precautions. patti lee live in martinez tonight where she spoke to specialists about the serious threat the h1n1 virus is posing to the community. patti-- >> reporter: this danger is significant and so far 18 people in the county have ended up in the icu because of the flu. that's the official number. health officials tonight tell us the actual number could be much higher. in martinez, the message to get a flu shot is hard to miss. and some pharmacies are offering discounts to people who do. but the contra costa county health department says the message needs to be taken more seriously. >> here at contra costa we've had a death of a 48-year-old woman from h1n1.

>> reporter: erica jensen says so far this season flu has hospitalized half as many people as the entire flu season last year. >> this is what we have so far. >> reporter: the problem is reporting hospitalization and death from flu is voluntary. and excludes patients 65 years and older. so far three bay area counties have reported flu deaths. today contra costa, last week santa clara county and last month alameda. >> i didn't know that anybody had passed away from or died from having the flu. >> the news prompted these friends to talk about vaccinations for the first time ever. >> these guys right here did not get a flu shot. so we need to talk to them into having a flu shot. >> reporter: despite the warnings from the health department and incentives like these, we met quite a few people who just do not want to get a flu shot. health officials say everyone if you're had the flu -- you've

had the flu this season, get the flu shot because it could protect you from another strain. patti lee. more details now as children return to willow glen elementary in san jose. the principal used a pa system to remind them how they can help from spreading colds and the flu. >> so i want to remind everybody to be sure that you are washing your hands. clean hands, extremely important. >> reporter: the cdc warns that children with chronic health problems such as asthma are at a higher risk of developing serious complications from the flu. as for parents, you're advised to keep your children at home if they're sick. >> reporter: universal preschool is an idea that advocates say helps lower the -- it's an idea who's time has come. state democratic leaders unveiled a plan to create transitional preschools for all 4-year-olds in the state. the programs would be voluntary. democrats say it would cost

nearly $1 billion over five years. supporters say the cost would be offset down the road by a lower drop out rate and less money needed for special education. governor jerry brown is due to unveil his state budget proposal this week. and today he received some positive news about the economic health of the state. the legislative analysts office says california generated $2 billion more income tax revenue than expected. that's 8% more money than administration officials had been counting on. the richmond city council passed a resolution tonight calling on kaiser permanente to offer financial assistance to struggling doctor's medical center in san pablo. administrators say the hospital may not have enough money to stay open through the year. more than 40,000 patients visit its emergency room every year. and many of those patients are from richmond. kaiser has provided financial support for the hospital before. a spokesperson from kaiser says the request for more assistance is being evaluated and that

kaiser is concerned about access to health care for underserved residents of richmond and contra costa county. a nurse in concord is being hailed at a hero tonight. ktvu's rob roth tells us how her quick thinking may have saved a young girl's life. >> connie wynn miller will tell you she was just doing her job as a school nurse here at conroe elementary. but she may have saved a little girl's life. >> i am so glad she started breathing. i thanked god she started breathing. >> reporter: wynn miller got a report that a girl had layed her head down and became unconscious. >> it was like she was sleeping. i could not rouse her. >> reporter: it appeared the girl was not breathing. >> her breath was more shallow. so i decided to put her right on the ground because that's the best place if you have to give cpr is on the ground.

system. it's not that strong you can see that. we'll talk about the temperatures as they move downward as we move toward the end of the week. we'll see you back here at 10:45. chp pilots say they rescued a hand glider today in one of the most difficult operations they've performed in years. officers say the 63-year-old pilot crashed into a large eucaliptus tree. he was stuck about 50 feet off the ground and firefighters say they couldn't get their truck and ladders to the man so a chp helicopters was called in. an officer was lowered, the two were lifted to safety. the pilot was not hurt and that hand glider rather was left behind. first bone chilling cold then thousands of cancelled flights. in our next half hour the growing sea. look at that the growing sea of unclaimed luggage at sfo. >> they lost the person, didn't

tyco integrated security. safer. smarter. tyco. two investigates tonight with new information about how a woman layed dead in a stairwell for days before she was discovered. david stevenson reports they raised disturbing questions about the thoroughness of the search and the attitude of many involved. >> reporter: almost immediately after she disappeared from her san francisco general hospital room, the search for lin spalding went ar ray. in sheriff deputy log notes she was described described twice as an african american woman and once as an asian woman. the person was going to be discharged any way and she decided to take off then her

daughter made a stink about it that's all that was. >> the daughter making a stink is their interpretation of their daughter frantically trying to find out what happened to my mother. >> reporter: deputies were directed to search stairwells only about half were checked. sheriff department staffing was about 30% minimum. a log note indicates that over time or ot was not available the following day. >> so they literally didn't continue the search because they weren't going to get paid. how disrespectful is that. >> to the best of my knowledge that was not related to the overtime issue. >> reporter: a call details the first time spalding was spotted. there's a somebody who got lost in the stairwell. stairwell eight on the fifth floor. he said there was somebody lying on the landing. okay we'll take care of it. thank you. bye.

at least one dozen flights were disrupted. as ktvu's robert handa tells us surveillance pictures has investigators baffled they literally can't tell whether the suspect is a man or a woman. >> reporter: san jose police say it's tough for banks to -- >> it's scary. so i will be scared coming here late in the morning. because that's the time i come to the atm. >> reporter: while the surveillance cameras are clear police are still not sure if the suspect is a plan or a woman. investigators describe the suspect as black, 110 pounds, speaking with a feminine voice. >> some tellers are telling us that they believe that it's a male dressed as a female.

other tellers have told us that they think it's a female. >> reporter: police say the robberies started on november 9th at the wells fargo bank on ranch drive. followed by a wells fargo bank and bank of america both in san jose. then a different milpitas bank. somewhere -- >> she could be any where from the bay area and is using the cities of milpitas and san jose to throw us off. >> reporter: the suspect is getting bold, brandishing a gun more often and now threatening some tellers. for customers we talked to it doesn't matter if the suspect is male or female. >> any robber is a threat. you just don't know how high of the scale the danger level. >> reporter: investigators say they don't believe the disguise will fool anyone who knows the suspect. an $1,100 reward is offered in this case. robert handa. only on 2, the bay area with a staggering drop in

call for a moratorium on liquor licenses. the city took up a proposal by supervisor david schuh for a two year suspension. one man who was building a lounge and restaurant on broadway says a ban on new liquor licenses is unfair. >> i've never served a drink.

so for them to blame me and my project for the current problems that are going on is some what insane in my opinion. >> the ban would only affect the two blocks of broadway between columbus and broadway. a bail hearing is set next week for the man accused of setting a fire at the chinese consulate. investigators say phan told them that he set gas containers on fire outside the consulate on new year's day because all the voices he had been hearing were in chinese. a neighbor showed us a photo of police activity as phan was arrested in daly city last friday. >> all of a sudden car cops start pulling up behind my truck and apparently it was for the house. it was exciting but crazy morning. >> a woman who lives next door to phan tells us he has a wife

and two small children. phan is originally from china but has permanent u.s. residency status. police say a man struck a woman in the face with a single punch delivered with a closed fist. it all happened at a strip mall parking lot at the 1400 block of blossom hill road about 4:30 yesterday afternoon. there's no motive for the assault and the suspect ran away. the woman was treated at the scene. the parents of 13-year-old andy lopez are making new accusations against the sheriff deputy who shot and killed their son. they amended their federal lawsuit adding -- the suit sites one incident where he pointed his gun at a woman and

only on 2, richmond's police chief and the dramatic change in the city that once had a reputation for being one of the most dangerous cities in the country. just a few years ago, richmond had more than 40 homicides a year. >> but last year there were 16 and that is the lowest number in more than 30 years. amber lee is live now in police headquarters where she asked

richmond's police chief where she asked about the strategy behind the arrest. >> the department has received a lot of help from the community in fighting crime. but despite the success he says it's not mission accomplished. >> to see people getting shot here in the park it was crazy. >> reporter: this is richmond's iron triangle neighborhood. the park was a magnet for crime and a renovation three months and a strong police presence is making a difference. >> you call them and they're out here. like less than two minutes they're here. >> exciting to see what this has turned into. >> you see efforts coming together all the time of where that planning is paying off. >> reporter: the chief tells me, planning, and strategies that may be controversial are key in the city's turn around. police department statistics show violent crime has dropped about 27% since 2006 when magnus became police chief of

richmond. he tells me a wiretap program has helped out. >> we were literally listening in on some calls where people were planning to go out and kill people. sure enough at the times they indicated in their phone calls that they were then going out armed to the teeth into those very areas where they said they were going to go kill someone to go do it. >> reporter: chief magnus has a connection to richmond. he's lived here the entire time he's been in the area. he tells me continued success in keeping the crime rate low depends on staying the course with hard earned relationships with community members. >> people have sort of figured out they need to be engaged in looking out for each other. we're seeing how that happens we can really drive crime down. >> magnus is the longest serving police chief among major bay area cities such as san francisco, oakland and san jose. he credits extensive officer training for the low numbers of

since then the inventor of mcafee has been named a suspect in a death. this isn't the first such controversy, last year target came under fire for naming the color of one of its plussed sized dresses manatee gray. recology says it's seen an increase in the number of discarded christmas trees it collected this year. there's been 5% jump from last year collecting 150,000 christmas trees. recology says once the trees are put through a grinder the material works well as an energy source. much of it will be shipped to a bio mass plant in woodland. the temperatures today around the area were about where they were yesterday. some areas a little cooler. a couple of areas a little bit

warmer. 65 in morgan hill. 66 in livermore. these temperatures certainly well above the average for this time of year. there were clouds around today but they did clear out. the problem we're having right now. see all these clouds that moved through today. they're separated from the main dynamics. the gap between the two. you have the moisture without the dynamics and you don't get rain. i have had reports out around half-moon bay and pacifica of light showers. actually more like a drizzle event showing up in pacifica. tonight it's cloudy and cool out there. we have a very nice night. there's coastal fog and there will be valley fog later on this evening. so look for the fog. tomorrow the system sort of tweaks through. temperatures down a degree or two. the bigger system comes in on thursday with the chance of morning showers. probably late wednesday night into early thursday morning for a slight chance of a shower and partly cloudy in the afternoon. this is not enough to help us
