ktvu's eric rasmussen is in the news room, he has been reviewing the video with a former fire investigator and you learned about possible punishment for the firefighter who shot that video. >> reporter: this afternoon sources confirmed the fire chief filed disciplinary charges against the chief for wearing a camera on his helmet. he said that violates policy but leaders dispute that, now the video could play a role in the claim by the victim's family that first responders were negligent. >> there is a body right there. >> firefighter's helmet cam video captured the first warning about a victim on the ground near the crash of asiana airlines flight at san francisco international airport.

a second recorder shows a firefighter directing a truck around the victim. 13 minutes later attorneys say the same truck ran over the girl after she was covered in fire fighting foam. she died from blunt injuries consistent with being run over. today an attorney for the family told ktvu the video answers the questions the family has waited months to hear. the 16-year-old's parents know five firefighters saw her before she was covered with the foam and run over and that none of them checked her pulse or checked if she was breathing, none of them protecting her, she was left alone and alive and two trucks ran over her. >> it is a terrible accident. >> reporter: he reviewed the video with us. he says it is possible firefighters may not have felt a pulse on her even though her

actions beginning tomorrow. ktvu's john fowler shows us the change that is happening for the first time in two decades. >> reporter: this is phoenix lake. emergency reserve that officials will begin pumping out tomorrow for the first time in 20 years. >> what we want to do is maximize the available water we have in our system now while we can do that. >> reporter: he told me levels today are 71% of normal, so low without rain water rationing including fines may be six weeks away. >> i think it is a good idea. we use too much water as it is. >> i think they should impose it -- should have at the beginning the of year. >> reporter: rations 37 years ago required building a water pipeline. >> that will help retain the

water. >> reporter: he lived through those days and says it scares him. >> now i am afraid the people will stop calling and wanting panting and they will postpone it. >> reporter: he says this garden is a good investment, cutting water use by half. >> i am thinking of a water collection system. >> reporter: officials say conservation won't be enough, it has to rain and doesn't look good. john fowler, ktvu channel 2 news. the defense for a man accused of raping and murdering a 13-year-old girl wants the case thrown out. attorneys say the prosecution did not provide them with an e- mail from the coroner. he said it suggests no evidence she was raped and that her

death was accidental. the prosecutor refused to comment. two attorneys not involved in the case say it is unlikely the judge will dismiss the case. a warning for people tonight about a series of day time break ins. one woman found her door kicked in when she arrived home monday afternoon, jewelry are missing. her home is one of four targeted. >> that is not what we expect to have happen here. this is a busy street. that was the surprising thing. >> police say they suspect a group of two men and a woman is responsible and they are analyzing surveillance video. a man who was charged with kidnapping a 7-year-old girl entered a not guilty plea

today. he agreed to delay his hearing date. he kidnapped a 7-year-old girl after following her home from a walmart store. the girl was found hours later inside his car. he is due back in 40 in february. police -- court in february. police are trying to track down a hit-and-run driver who hit and killed a pedestrian about 7:30 p.m. last night. the victim's name hasn't been released. people in san francisco have questions about the handing of suspicious device -- handling of a suspicious device at 6:00 p.m. last night. someone found the device while clearing out the home of a man who died. the bomb squad blew up the device that sparked a fire. no one was hurt but a neighbor

summit medical center today accusing operators of mishandling their money. many nurses don't know if they will be keeping their jobs. a week ago the parent company sutter health announced they will cut 358 nursing positions. they claim patient care is suffering while top executives are taking home hefty pay checks. >> we have short staffing every night, every day. we are short 3, 4, 5 nurses to cover the mandated number of nurses required for patient by the state. and this is an ongoing problem. >> the hospital said the cuts are in response to a decline in the number of patients. the california highway patrol said a group of people jumping from a hot air balloon interrupted a burglary investigation. a officer was looking into a burglary this morning when he

a church suffered major damage after a woman drove her car into the church. it looked like the woman hit the gas instead of the breaks. she rammed into the church on patrick street yesterday afternoon. it was a close call for folks who were in line it receive food donations. >> people were crying and in shock. they thought the car was going to hit them. >> the driver swerved and missed the line of people. no one was hurt. witnesses say the church's organ may have saved lives because it kept the car from going further. police ramped up enforcement against gangs to cut down on the number of gang related crimes and homicides. ktvu's robert handa shows us a

approach by police to tackle the problem at its roots. >> reporter: san jose police added a twist in their fight against gangs. he helped launch a pilot program called teen kids at an elementary school to steer kids away from gang life. >> it is a time when they haven't necessarily developed hardened thoughts about these things. >> reporter: they will address issues like understanding consequences, bullying and building self asteep to four classes -- esteem to four classes. >> i want to impart to them i am a human being, i am a dad, i am a father and a police officer. >> reporter: one student we talked to acknowledges kids grow up too fast in this neighborhood, often without seeing a police officer as anything more than a person who

arrests people. >> our neighborhood -- has a lot of gangs. helps us to understand why we shouldn't join them. i think someone influenced them. >> a lot of the students here have seen a lot of violence and a lot of trouble. they are having issues with it and they needed to know the community was going to pull together for them. >> reporter: that is why he hopes the program takes off. in san jose, robert handa, ktvu channel 2 news. we are learning three homes were destroyed by a fire on the delta. we brought you live coverage of the fire last night. firefighters say 40 to 50 acres burned with a number of outbuildings. we are also told transients may have started the fire that began yesterday afternoon around 2:30 p.m.

a dozen people had to evacuate but no one was hurt. if you are out and about today you noticed a lot of people enjoying our record warm weather. in pacifica the water was warm. surfs took -- suffers took advantage of this day. >> i have family in boston, they don't want to hear about it. it is a big score for the 49ers. they secured another 10,000 parking spaces within walking distance. that will bring the total number of spaces to 31,000. the original plan called for 21,000. more than half of the spaces will allow tailgating and because of this week day cames are back on. the cost of parking is going up from $30 at candlestick park to $40. mark ibanez is packing for seattle because you are getting
