and good morning, everyone. welcome to mornings on 2. it's saturday january 1st. i'm mike. >> and i'm in for claudine wong. >> reporter: good morning to you. we're going to be dry through the mlk weekend and for today mostly clear, cold start a lot like yesterday as we step outside. some of us have sunk into the 30s once again. for the afternoon temperatures will come down just a few degrees and today is the spare the air day. have we'll -- we'll have a look at the air quality coming up. they're looking at a small fire. and it started 9:20 last night and it was along the fair faction ridge line. they're calling it suspicious, it has burned about one acre and is 50% contained. they expect full containment by the end of the day. >> no clue on what started the fire at this point. it started after dark and it's in an unusual spot. >> it includes marin county

fire and cal fire. they say because of the conditions this fire has the potential to grow to 75 or 100 acres. firefighters in the bay area and across the state are on heightened alert on this weekend. the unseasonably warm weather and dry conditions are keeping the fire cautions high. people are advised to clear away dead brush away from their homes. vegetation is drier than normal and more susceptible to catching fire. 1200 firefighters are bat allege wildfire around las angeles. it's scorched 1900 acres and is 30% contained. calm winds have slowed the spread of the fire which is 30 miles from downtown las angeles.

>> the conditions are still extreme out there and once we have this fire put out it doesn't necessarily mean we don't have conditions throughout southern california that something like this can't take place again. >> three men are in custody accused of starting the fire. the men allowed their camp fire to get out of control. they're expected to face federal charges which could come as soon as next week. another spare the air day. stagnant air is trapping smoke and pollutants close to the ground. wood burning is banned as a reminder. this goes from november through february. a drought emergency, he's asking everyone to cut their water usage voluntarily by 20%. he signed an emergency declaration at his san francisco office. it gives the state flexibility in deciding how to allocate water resources and it means more wild land firefighters

will be hired. >> we're facing perhaps the worst drought that california has ever seen since records began being kept 100 years ago. >> a number of reservoirs are at their lowest levels in year. conservation could become mandatory in a matter of weeks if there is no rain. this is the second drought declaration, the first came in 1976 during his first term. they're already responding to the declaration. there was a water off campaign yesterday. posters were maiden couraging people to stop using water. one asked people to hold off on washing their cars. >> you'll have some with hot lines established where people will call in and report water being wasted.

>> the lake reservoir is lower than it was during the drought of 1976. the city of hillsborough will consider restrictions on tuesday. voluntary conservation has been in effect in hillsburg since last summer. >> now, to the 49ers quest for the sixth superbowl championship. the team is waking up in seattle. we have 15 minutes or so until the official sunrise, a live look over the bay point area and a beautiful start to the day with crystal clear skies over your area. air quality a bit poor for some of us. we have moved into unhealthy to sensitive groups. areas along the coast and central bay slipping above that 100 air quality index mark. if you're sensitive to the air pollution, be aware of it for this afternoon and today. unless you are allowed to burn, it is illegal for today. 47 degrees in oakland, 30 in napa, 28 for santa rosa, this is one of the colder spots, 46 in sfo and 33 for concord. these numbers are a lot like yesterday. if you're up early and outside, you know what to expect. we have 37 degrees hillsburg,

46 reported in petaluma. taking a look at the satellite and here a ridge of high pressure. we have a few weak systems rounding over this ridge. this has flattened for just a bit. that ridge has moved its way south. this is going to bring us a cooling trend as we get into the weekend. we'll be above average. but, we're not as likely to break records as we have been doing the whole week. giving you a look at the afternoon highs, 68 for nevada beautiful day, and upper 60s for you. east bay shoreline 68 for you. upper 60s for san leandro, 60 expected in brentwood, into the santa clara valley mostly sunny skies. upper 70s in santa cruz, along the peninsula along the

afternoon. 60 redwood city. pacifica and stretching into half moon bay, temperatures will be cooler for tomorrow. you have the holiday on monday. fair weather in the forecast. temperatures remain mild, but no wet weather in the extended forecast. i'll have a look at your lunchtime numbers for today coming up. >> we're following breaking news out of the south bay. there are reports of a large fire at a coffee shop. no injuries are reported. multiple crews are on the scene. we'll give you more information as it comes into the newsroom. hundreds of passengers on the flight that crashed at sfo, they're filing a lawsuit. they say boeing should have known it had inadequate low flying control and they should have known the pilots were not qualified to fly that plane. more than 180 were injured and

over the bailiff from san francisco. san francisco 48 degrees. more right, now, on that breaking news out of the south bay. a large fire out of a coffee shop in san jose. this is one of our traffic cameras. you can see smoke coming up from that coffee shop. this is a live shot from our traffic camera. no injuries have been reported. there are multiple cruise at the scene. they're in the city of san jose. we'll continue to cover this story as news comes into the newsroom. it's on hillsdale avenue at a coffee shop. 212 people were -- 21 people were killed in afghanistan. many foreigners and afgans were having dinner. he came through a back-door and

opened fire. a taliban has claimed responsibility. the military says it could take weeks to determine how a young man died during training at a camp. the josh died on monday during a 30 minute water treading test. while they're awaiting the results of an autopsy, the death is not consistent with a drowning. islam was a high school baseball star in northern california. and he was known to be one of the hardest working persons he's ever met. >> he would be one of the best of the best. >> he just graduated from combat training on january 10th. the death toll from the flu continues to arrive in california. it claimed the lives of women

from 52 and 62. there have been 22 deaths this season. dozens of people have ended up in intensive care units. >> what's unusual about this season is really the severity of illness, the number of reports and who is getting sick. >> even healthy people can fall victims. the 49ers should take precauses, and so should the fan. they need to bring in fresh air. and wash your hands. two babies have died, they're investigating 50 other deaths that may be flu related as well. a federal government report shows that 60% of the people hospitalized were between 18-64 years old. intel plans to layoff 5,000 employees. the company now says it wants

to boost its bottom line, demand for its personal computer chips is flat and the company was slow moving along from p c's and mobile devices. it was intel's worldwide work force. five of the top ten of the best companies is right here in california. google took the top spot. the others are jenetic, the tenth is dpr construction out of redwood city. san francisco mayor ed lee made affordable housing one of his major points. >> my challenge is to insure that at least one third of those will be permanently affordable to low to moderate income families. >> he says one reason for the

housing problem is the addition of 42,000 jobs in the city. he proposes raising the minimum wage. and improving services for the mentally ill and homeless population. and he wants to add more police officers. president obama will deliver the state of the union address in ten days. he touched on some of the themes in this morning's weekly address. >> we're primed to bring back jobs from the competition, but that requires a year of action. i want to work with congress this year on proven ways to create jobs. >> 2014 must be a year of action, focusing on expanding opportunities for the middle class and fixing the immigration system. the projected drop does not appear to be the uc system, it has seen a rise of application,

a record number of applicants for next fall's class, 148,000 have applied to one uc campus. it also beat its own record receiving 284,000 undergraduate applications. uber is offering free rides for the holiday weekend. they can take two free trips using uber x. they'll pick up passengers in different points. the ride sharing service hopes it will get people to use uber x. today caltran is celebrating their anniversary. a free ride is being marked for passengers. it leaves 9:30 and will arrive at santa clara at 11:00.

a group of dogs is catching some waves in brazil.

they're training for a paddle board competition. the organizer got the idea when he was surfing and couldn't stand seeing his dog tied up on the beach. they have to make it through the course without having the dog fall off the board. dog owners are going wild on the run to the championship game. they're showing their pride through their pets. >> i etched a number 7 on my dog and people caught on and the next thing mu know i was coloring ears and tails and feather extensions, nail polish and it was all for the 9ers. >> wow k-9 concepts said all of its grooming services has included requests for 49er decorations. the dyes used are vegetable based and serviced on animals. it costs from $500 to $100.

your lunch hour. sunset is around 5:17, 5:18 those days. it will be cooling under clear skies. oakland you have temperatures into the mid to upper 60s today. if you're going to be out this evening, we know as soon as that sun goes down it turns chilly. mountain view upper 30s by now, but you'll be in the mid-50s by 10:00 or so. it will be in the forecast for mostly sunny skies. temperatures slightly cooler, but still unseasonably warm. 74 in areas. right around san jose. upper 60s in santa rosa, the extended forecast, always in view, notice the cooling trend will continue. it's a minor one. it's one of those trends that takes several days before we even notice the temperatures are changing, but as we get into mlk, if you have the holiday on monday, as ali mentioned there is none in site for the next several days.

. a wildfire is burning this morning on the mount. why they're calling it suspicious. >> good morning, we'll get to that story in a bit. we continue to follow the breaking news that we first reported 20 minutes ago. firefighters are battling a fire in a restaurant in san jose. you can see the smoke coming up from the area. they posted a photo online of the fire. it's at the flames coffee shop in hillsdale and roth. there are no suspicions at this time. they're taking a defensive mode from the ground. we continue to monitor the story and we'll have more information again as it comes into our newsroom. this morning firefighters are

working a small wildfire on mount tamipias. that fire started 9:20 last night along the fair faction ridge line. these are the trucks you see near that one-acre fire. the fire is suspicious. again as i mentioned it burned just about one acre, but firefighters continue to stand by unseen making sure it's mopped up and not sparking up again. they expect full containment by the end of the day. we have a reporter at the scone and we'll have a live report for you coming up. here is a look at the top stories we're following you for you this morning. governor jerry brown has declared a drought emergency. he's asking everyone to voluntarily cut their water usage by 20%. they'll decide whether to make water restrictions mandatory. 1200 firefighters are

battling a fire, it's scorched 1900 acres and is 30% contained. calm winds have spread the fire. it's gone from downtown los angeles. an elderly woman is recovering from leg injuries after being hit by a lyft driver yesterday afternoon. the driver was turning left on to larkin when he hit the woman. police say the driver stayed on the scene and was not cited. >> the pedestrians want to get somewhere quick and the driver wants to get somewhere quick and that's where you get the injury. >> there was another crash involving an uber driver and a 6-year-old girl. that involved vehicular manslaughter. a girl was hit and killed on her bike. she was hit at about 7:30 in

the morning at stoke street. she died at the hospital. the train was taken out of service and 40 passengers were buzzed to their destination. surveillance video has been released. the video was taken on december 20th at 9 p.m. it shows what man walking in front of a 37 line bus, a group of people spray the bus with graffiti. they start breaking the windows. a bus coming from the opposite direction was vandalized. it happened in front of the skate board and clothing store which was hosting an after hours party. >> they had maybe five parties since i've been here all year. that's the only time i've heard of that happening. they don't have any kind of incident over there. >> police say the group may have planned the vanned lisp. we've learned that a dozen buses were vandalized last

month at different locations throughout the city. a fire that destroyed a machine shop and forced a dozen people from their homes is under investigation. it happened yesterday before 6:00 in the morning. the firefighters say the machine shop didn't have sprinklers. it spread quickly and reached an apartment building next door. one man started warning the people to get out when he saw the smoke. >> i finally understood -- >> my family, we're fine, we're alive, that's the most important thing. >> all of the 16 residents got out safely including 8 children. this is the fifth major fire in redwood city in the past 8 months. there's new fallout, they're demanding new penalties. the mayor says p and e tried to make a back room deal. they paid fines for failing to have a uniform policy to track

its transmission lines. they wanted to count the money for any fines for the deadly blast. they should be fined for trying to pay a fine for two separate fines. they say the complaint is without merit. the word beach came up a lot it was so nice out we went to the beach. i went out to the beach on tuesday with one of my days off with the family. it was fun. i felt bad i know we need the rain, it was so beautiful. >> i was out there on wednesday. sunny skies. it's nice. you know, in a word, it's just nice out there. today is a spare the air day so our weather changing just a little bit in that manner. a little bit of hazy sky there you can see. we're looking into oakland this morning where temperatures are ranging in the 40s, right around oakland for downtown and at the airport a little cooler, it looks like 37 degrees at the

airport in oakland. we're taking a look at where it's outright cold, 30 degrees in napa. outside your door of santa rosa, you are below freezing, 28 for you in the airport, again upper 30s, low 40s in hayward, upper 30s low 40s, redwood city, it's reporting 46, 48 degrees right around downtown at this hour. if we get into the east bay we've got temperatures in the 30s as well. 36 for san ramon, upper 30s for pittsburgh, you're checking in at 37 degrees. so, we're taking a look at a ridge of high pressure that remains in place. now, it is actually weakening and it's losing its grip just a little bit. it has to do with just a few week systems that are passing over the north of us. it's not going to bring us any rain unfortunately. we'll bring our temperatures

down. we had widespread records for each passing day through the week. we won't see any records for today, but we'll remain above average. we're going to be with dry weather as we get into next week. with the ridge of high pressure may be a little hard to picture but if i step out and roll this, notice how the rain and the storm track just moves right up and over us. so that ridge of high pressure deinequitying any rain and as we typically say keeping that storm track well to the north. that's what we have all the way to friday. no rain in sight unfortunately. upper 60s to low 70s. from the north to east bay shedding off a few degrees, it will be cooler in many areas today. santa cruz looking good. 78 for you. 78 for redwood city. the extended forecast here with your bay area weekend, as you know no rain in sight. temperatures will continue to cool, but it will be a minor

. good morning to you, a golden sky there from mount diablo. it's a spare the air day, sun will set at 5:17. the fire started last night and crews want to make sure it does not spark up even more. we're live near fair faction with what's happening right now. christian. >> reporter: just to give you a sense of where we are. we're at the staging right now. you can see crews here, this is the crews that just came back from the line a couple of minutes ago. if we come around we can show you the hose line and the fire is along a quarter mile up that ridge area. the fire is 50% contained at this point. no structures are endangered and so far no evacuations. firefighters are telling us that this fire was reported

after 9:00 last night and with the dry conditions we've been experiencing crews rush to prevent it from spreading. it's about a quarter mile east in ad windowed area. the location of the fire and since there are no obvious signs of ignition, they're working on figuring out how the fire started in the first place. >> no clue on what started the fire at this point. it started after dark and it's unusual. >> now, again the idea we're experiencing dry conditions, we're not surprise to anyone. crews are telling us that conditions are unusually dry. the conditions out here are closer to what they would see in august not january. in the next hour we're hoping we can get a chance to hike up along this fire line, this hose line to get a chance to see what the fire is like this morning. we're hearing it's about an acre. crews will be here throughout the day to make sure that fire

not spread. we'll have a live report coming up in a few minutes. an elderly woman is recovering from leg injuries after being hit by a driver in san francisco. it happened yesterday afternoon. the driver was turning left on to larkin when she hit the woman. the pedestrians was walking in the crosswalk when it happened. police say the driver stayed on scene and was not cited. >> they just want to get somewhere quick and the drivers want to get somewhere quick. they're not paying attention and that's where you start getting the pedestrians vehicle injury. a deadly collision. it involved uber and a girl was hit. vehicular manslaughter. a light rail train, this 14- year-old was hit at stoke street. she died at the hospital.

that train was taken out of service and 40 passengers were buzzed to their final destinations. an oakland man died after being thrown off a bulldozer. the accident happened 5:40 p.m. west of highway 12. police say the 38-year-old man was an independent contractor working on a pond. he was driving a john deer bulldozer when he bounced off and was run over. he was not wearing a seatbelt. san francisco police released video of two buses being vandalized by people. an undercover detective showed us the video. what man walked in front of a bus, a group of people sprayed the bus with graffiti and started breaking the windows. a bus coming the opposite direction is also vandalized. it happened in front of the

remain dry. we're talking several days out. for today, mostly clear skies outside our doors this morning. off to a very chilly start, but temperatures are slowly climbing. i'll have a look at those numbers now that we are into the 9:00 hour. for the afternoon, we'll take off a few degrees from afternoon highs. i'll have a look at what you can expect. and today is a spare the air day. a check of your air quality, coming up. we have an update to a wildfire we have been monitoring in marin county. crews now say it is 50% contained. ktvu's christien kafton is live near fairfax, as firefighters work to put out that fire in the flint hills. >> reporter: we've been out here since 6:30 this morning, before the sun came up. now that it's getting lighter, firefighters are getting a better idea on what they are dealing with. firefighters are staged here, planning out what's going on today. this is the staging area, about a quarter mile away from the fire scene. as we come over here, you can actually see where the fire line is. this hose that runs up the hill runs about a quarter mile up

the hill and that is where the fire begins. they will be looking today to see what kinds of conditions they will be facing today, as they get out here. we have new video of the fire. we could see white ash on the ground, which firefighters told me this morning is evidence of a very hot fire. firefighters are telling us this fire reported about 9:00 last night, with a phone call. with the dry conditions we've been experiencing, crews rushed in to prevent this fire from spreading. they say, again, dry conditions that we're seeing this year are very dry. the conditions right now in january are closer to what they would expect to see in august. with those conditions, they did not want to let this fire get away from them. >> our plan for the day is now that we have a line around it, to continue our mop-up efforts, prevent it from spreading when temperatures come up today, the winds come up and the humidity drops. >> reporter: again, at this point, crews say no obvious signs of ignition in the area. there's no power lines up there, no lightning, so they will have fire investigators out on scene today, trying to figure out exactly how it

drowning. islam was a high school baseball star in north carolina. his former coach says islam was one of the hardest working marines he's ever met. >> he was ready to move on with his next chapter. he had graduated boot camp and so now his next chapter was, as he would say, to be the best of the best. >> islam had just graduated from combat training on january 10th. police in philadelphia are searching for a young man in connection with a shooting of two of his classmates in their high school gym. it happened yesterday afternoon at delaware valley charter school. two 15-year-olds, a girl and a boy, were shot in the arm and injured. hours later, police arrested a 17-year-old student, but he was later cleared and released. police say they have questioned two people, but they are still searching for a third person to interview. >> i'm just so flabbergasted by how a child or whoever was able to bring a gun to school. >> seven students were inside the gym at the time. police say the shooting was captured on surveillance video.

this is the second gun-related incident at a school in the area over the past few days. on wednesday, a 17-year-old boy was arrested for bringing a loaded gun to school. the death toll from the flu continues to rise right here in the bay area. santa clara county health officials confirmed the h1n1 virus claimed the lives of two women, ages 52 and 62. by our count, that brings the bay area total to 22 deaths so far this season. dozens of other people have ended up in the intensive care units. additionally, my challenge is to ensure that at least one third of those will by permanently affordable to low and moderate income families. . a fire breaks out in mount tam's state park. this morning, firefighters are calling it suspicious, all at the same time that a fire warning is being issued for parts of the bay area. welcome back to mornings on 2, everyone. i'm mike mibach. >> and i'm allie rasmus. cool temperatures overnight helped firefighters slowly get a handle on the fire. the remote area of the blaze made it difficult for crews to reach it. christien kafton is near fairfax with an update. what's going on there now? >> reporter: allie, let's start with the good news. there's no evacuations, no structures endangered right now. the fire is about a quarter mile up the ridge line right there. we just saw calfire crews arriving on the scene f we swing the camera over here, you can see the marin fire department is leading a morning briefing on exactly -- marin county fire is leading a

briefing on exactly what they will be doing today. so far, the size of the fire, about 1 to 2 acres in size. firefighters tell me they will spend the day surrounding this fire, making sure it doesn't spread. now, when the sun came up a little earlier, jacob unger and i, my photographer, were able to hike in about a quarter mile to get this new video. the fire is small, but we can tell you it definitely burned hot. firefighters are telling us this fire was reported after 9:00 last night. they say with the dry conditions we've been experiencing this year so far, they say the conditions are closer to what they would expect to see in august, not january. at this point, there's no obvious signs of how this fire started in the first place. >> it is in a remote location, which always brings up questions. our fire investigation team will come out today and they will start to try to figure out what happened. other than that, we don't know except for the fact that it is in a remote location. >> reporter: now, again, photo journalist jacob unger and i were able to get up into the area and we can tell you there were no power lines up in the

area. firefighters tell me there was no lightning last night, so they are still trying to figure out exactly how the fire started. fire investigators will be on scene trying to determine how this fire started. crews will also be spending the day making sure this fire does not spread. so again, this morning, briefing right now, planning out strategy. from what we understand, since the fire is relatively small, about 1 to 2 acres in circumference, they will try to surround it and make sure it does not spread as temperatures build through the day and as the wind builds through the day. for now, christien kafton, ktvu channel 2news. we have new video coming into our newsroom of the breaking news we've been telling you about from the south bay. around 6:20 this morning, a restaurant called flames coffee shop located on hills dale and ross in san jose caught fire. a couple of workers were preparing to open the place up when the fire began. then they ran to the fire station around the corner to call for help. flames were fueled by cooking oils and furniture. the blaze ripped through the

building, causing several sections of the roof to collapse. it took firefighters about an hour to put the fire out. the damage is estimated at $1 million. almost 1200 firefighters are now battling a wildfire that's continuing to burn near los angeles. the colby fire has scorched nearly 1900 acres and is only 30% contained. but firefighters have caught a big break. calm winds have slowed the spread of that fire, which is about 30 miles northeast of downtown los angeles. >> the conditions are still extreme out there. and once we have this fire put out, doesn't necessarily mean that we don't have conditions throughout southern california that something like this can't take place again. >> three men remain in custody accused of starting the fire by allowing their camp fire to get out of control. they expect to face federal charges, which could come as soon as next week. back in the bay area, today there's another spare the air day. the bay area air quality management district says pollutants are trapped close to

the ground. as a reminder, wood burning is banned. this is the 28th spare the air alert of the winter season, which goes from november through february. an elderly woman is recovering from leg injuries after being hit by a lift driver in san francisco. it happened yesterday afternoon near jackson and larken street. police say the driver was turning left onto larken when she hit the woman. investigators say the pedestrian was walking in the crosswalk when this happened. police say the driver stayed on scene and was not cited. >> you get the pedestrians that want to get somewhere quick and drivers that really want to get somewhere quick and they are both not really paying attention. that's where you start to get the pedestrian vehicle injuries. >> the accident follows a deadly collision on new year's eve, involving an uber driver and a 6-year-old girl. the 57-year-old driver in that case was arrested on suspicion of vehicular manslaughter. in san jose, a young teenager riding her bike was hit and killed by a vta light rail train. the 14-year-old girl was hit at about 7:30 in the morning at

stokes street. police say she died at the hospital. the train was taken out of service and about 40 passengers were bussed to their destination. san francisco police have released surveillance video of two muni buses being vandalized by a group of people. an undercover detective showed us the video, taken on december 20th at 9:00 p.m. it shows a man walking in front of a 37 line bus near ashbury. a group of people started spraying the bus with graffiti, then started breaking the windows. later, a bus coming from the opposite direction was also vandalized. police say it happened in front of the rvca state board and clothing store, which was hosting an after-hours party. >> they have had maybe five parties since i've been here all year and that, that's the only time i've ever heard of that happening. they usually don't have any kind of incident over there. >> police say they think that the group may have planned the vandalism. we have learned that more than a dozen buses were vandalized last month at different locations throughout the city.

day. a bit of a haze. today is a spare the air day, but a nice beach day with temperatures in the 60s and 70s. 9:44 on the clock. let's recap some of our top stories for this morning. 49er fans greeted the team, as players and coaches arrived in seattle last night. head coach jim harbaugh says his team is ready to take on the seahawks with that trip to the super bowl on the line. kickoff set for 3:30 tomorrow. firefighters across the bay area are on heightened alert this weekend. the unseasonably warm weather mixed with the bone dry conditions are keeping the fire danger high. there were two fires today, a restaurant fire in san jose, and a wildfire near fairfax that started late last night. governor jerry brown has officially declared a drought emergency across the state. he is asking everyone to voluntarily cut their water usage by 20%. water agencies will soon decide whether to make water restrictions mandatory. governor jerry brown's drought declaration comes as no surprise to ski resorts in the lake tahoe area.

the martin luther king holiday is usually a big ski weekend, but some resorts are worried about business. last-minute visitors say they were surprised to find great deals at the resorts. instead of conserving, we've learned that residents in marin county are actually using 34% more water now than they did a year ago. a water conservation activist says it's time for people to change their habits. >> we should cut our expectations for what we can do in our homes and in our industry and in our agricultural communities for the next year at least. >> experts say people should also prepare for higher water rates and that's because water districts have operational costs that don't go down. one of the world's most famous statues is in need of a repair due to a powerful storm. work will begin on the christ the redeemer statue in rio. the statue's right thumb was chipped during a storm. the 120-foot statue is atop a

steep mountain and is often hit by lightning. a spokesman says the church has a supply of the same stone originally used to build the statue, from 1931. more than 60 passengers on board a royal caribbean cruise ship got sick with what's believed to be the norovirus. the cruise line says the stomach bug quickly spread throughout the ship. passengers say they were given letters warning about the illness and how to avoid getting sick. >> told us that there is some disease or something like that. >> announcements were in english and spanish. they went all morning, all afternoon. >> as crews were cleaning the ship, a new set of passengers were getting ready to board. royal caribbean says they were given the new passengers the option of rescheduling due to the outbreak. crews are deep cleaning an elementary school in portland, oregon after a norovirus outbreak sent more than a hundred students home sick. a spokeswoman for the district says the process will last a

mines personal data like phone records. he wants strict approval from a court before accessing the information. agencies can only target phone calls that are two steps removed from a phone number associated with the terrorist organization rather than three steps removed. in addition, no more eavesdropping on the phone calls of foreign leaders. we are finding out more about the massive data breach at target stores that may have compromised the personal information of 100 million customers. a cyber intelligence firm says the breach may be part of a larger scam and at least six other retailers, including neiman marcus, may be affected. the company works with the secret service as well as homeland security. its report says there is evidence that more data breaches could be on the way. >> when we are seeing these types of attacks before and they create their attack methods and all the associated tools, they don't just target one or two companies. they say, well, how many companies are susceptible to this? let's go after all of them. >> the company says retailers may not even know their credit

card scanners are infected with the malware until it's too late. it also says the malware at the center of the breach was partly written in russian and may be connected to organized crime there. wells fargo is shutting down its direct deposit service. beginning february 1st, new checking accounts that are opened won't be able to use the service. existing customers will be cut off in the middle of the year. the service allowed customers to have an advance of up to $500 before their next electronically deposited check. the bank did not say why it is stopping the service. dozens of oakland police officers are celebrating their new promotions. down during the deadly wind storm in november. some oakland residents say the tree is now a tourist attraction, while others say it's a danger that needs to be removed. >> it's a total hazard. the fact it's been here this long is complete negligence on the city's part. >> if they put a fence around it, you know, where nobody couldn't climb up on it just to look at it, it should be okay. >> the city of oakland says at one point there was a fence around the tree, but someone tore it down. city officials say removing the tree would be expensive, so they are looking into other possibilities. san francisco police are investigating a crash that seriously injured a motorcycle driver. police say the motorcycle crashed into a car at about 3:15 yesterday afternoon at bush and broderick. police say the motorcycle driver is in critical condition. investigators are asking anyone who may have witnessed that crash to call police. the super bowl is just a few weeks away and for some people who are hosting parties, the food is just as important as the game. it's estimated americans will spend more than $1 billion on food for the super bowl.

at noon on the west side of the entrance plaza. sea lion center opened yesterday and is managed by aquarium of the bay. it is a free nature center, where people can learn about the sea lions who have made pier 39 their home. in just about an hour, a 24- hour effort to save the berkeley post office begins. a group of protesters have been trying to save the post office since the postal service announced plans to sell it. at 11:00, the group is kicking off a festival celebration and resistance. activities for the 24-hour long event include petition signing, music and letter writing. well, it is the new year, and for some people that means time for a new spouse. in an analysis by finelaw.com shows a spike in divorces in january, which has now earned the nickname "the divorce month." the spike is followed by a rise and peak in late march. the company also found searches for divorce and related phrases jumped 50% from december to january. attorneys say the spike may be
