breaking news out of san jose, where police are on the scene of a man barricaded inside an apartment complex. a new effort to tackle the backlog of untested rape kits in california. after a brief police search, a suspected burglar is in custody accused of protelling into a marijuana dispensary in the south bay. we'll tell you where he hid that helped lead to the arrest.

good afternoon. i'm tara moriarty. we begin with breaking news out of the south bay where a s.w.a.t. team is rush hour rounding an apartment -- is surrounding an apartment on richmond avenue. officers were following the suspect in the area of mankor avenue and kingman avenue at 8:30 this morning when the man attacked him. during the struggle, the suspect tried to take one of the officer's taser. when he couldn't get the taser, he ran into a nearby apartment. about 50 officers are on scene trying to get him to surrender. >> they tried to go ahead and distract -- to get his attention by breaking out windows to the front of the apartment complex. >> is that with the rubber bullets? >> yeah, the .40-millimeter rubber bullets. no response. there has been some movement inside. but as of yet, the suspect has not come out. >> we're told nobody is in the apartment bup the suspect. we'll stay on top of this

situation andy -- but the suspect. we'll stay on top of this suspect. the state cases a major backlog in rape cases. sal castanedo is live where one local congressman is introducing a bill to get these predators off the streets as well of. >> reporter: state legislators are taking a swing at clearing the backlog and that new legislation was introduced here this morning in woman. nancy skinner along with the alameda district attorney and others announced a new proposed law to force california law enforcement agencies to test rape kits which she says in many cases remain untested for months even years in police evidence rooms. >> to not test a rape kit is a second assault on the victim. it leaves a perpetrator, potentially a perpetrator on streets, to be able to assault again. >> reporter: ab-1517 would

require law enforcement to submit sexual assault forensic evidence to the crime lab no later than five days after being collected and uploaded into a crime database after no more than 30 days. heather marlo said she was assaulted in may of 2010. she said it took san francisco police investigators two and a half years before her rape kit was tested even though the police had a suspect. she said eliminating delay will help other women who find themselves in other situation and speaking out she said was crucial. >> it's neither good or bad. it's just necessary. i speak for, you know, the other unknown amount of kits that haven't even been -- that are supposed to be audited in san francisco and they have not been audited. >> reporter: alameda county district attorney says in alameda county alone there are some 2,000 untested rape kits. she and others say it's time to catch up with the backlog.

she says she supports this proposed legislation. live in oakland, sal castanedo, ktvu channel 2 news. all right. thank you, sal. an armed man was shot and killed by chp officers following a chase through oakland early this morning. investigators say the man was driving a stolen bmw suv with no plates when the other tried to pull him over just before 3:00. after a short chase, the driver crashed into two parked cars neve international boulevard fat 57th avenue. investigators say the man was holing a gun when he -- holding a gun when he ran from the car and that's when two chp officers opened fire. >> immediately after the suspect was struck, the california highway patrol officers initiated cpr until medical personnel could alive on scene. >> when medical personnel arrived on scene, they pronounced the driver. >> the suspect has not been identified. no officers were shoot. the shooting is being investigated by oakland police.

the chp and the alameda county district attorney's office. well, a man is in custody after being suspected of breaking into a san jose marijuana dispensary early this morning. this is video of him being detained around 6:00 at a strip mall on hillsdale avenue. police say he set off an alarm in the dispensary and that's when officers set up a perimeter. they found him a short time later crouched in an elevator shaft of a neighboring business. >> that was the hard part. we needed to force open the elevators and convince him to come down. >> it was apparently a small, cramped space. he was there for quite a while, at least what? three hours. >> police say the suspect broke into the building from the roof and used rope to rappel into the dispensary. they say that equipment they found as well as marijuana and other paraphernalia he's stolen. officers believe he did act alone. he has been booked into the santa clara county jail. as russia tries to reassure

the world that next month's games in sochi will be safe, there are concerns. police in sochi are handing out fliers in their search for this woman. she's 22 years old. the widow of a jihadist militant killed by security forces. she's one of three so-called black windows they believe who are responsible -- black widows they believe responsible for suicide bombers. >> it only takes one person, one corrupt guard who is willing to look the other away in exchange for a bribe to have the entire thing come apart. >> last month, two separate suicide attacks killed 34 people in the city about 600 miles from sochi. russian officials plan to have as many as 40,000 security guard at the games. there will be two u.s. navy ships nearby in case americans need to be convicted. caltrans is reviewing video to find out what happened

moments before a train hit two people. the two men were hit by a san francisco-bound train just north of the santa clara station around 5:30. one of the men died and the other was taken to the hospital with serious injuries. witnesses say that the survivor was lying ong the tracks at the time -- on the tracks at the time of the collision and the man killed appeared to be leaning on the tracks of the oncoming train. >> we need to understand what went on between the two victims and whether there's something more that needs to be investigated. that's one of the things that we'll be able to talk with the second victim about when he comes out of surgery. >> this is caltrain's first deadly incident of the year. now, grief counselors are on the campus of delmar high school in san jose today. they are there to help students cope with the death of a schoolmate hit and killed by a vta light trail train last week. friends say danica was riding her bike to school on friday and may have tried to beat the train across the track. a san jose man is behind

bars accused of hitting and injuring three children in vacaville and then driving away from the scene. the children were playing outside yesterday when they were hit by a truck. one child suffered a crushed pelvis and a broke -- and a broken collar bone. >> really scared. the police were here. i was really scared. >> the driver 31-year-old wesley murrey was arrested about 40 miles from the scene. authorities say he has several outstanding warrants. in one hour, san francisco's municipal transportation agency will meet to desid if commuter shuttle buses can use muni stops. right now the sticking point appears to be over how much to charge. the current proposal says each time a bus operator from a tech company like google uses a bus stop, the cost would be one dollar. supporters say it would add $1.5 million to muni's bottom line every year, but opponents argue that muni should get more money to help maintain the bus

stops. >> i'm not sure what would be fair. but i guess for the amount of money they generate, they could cough up a little bit more. >> do you think a dollar is enough? >> no, i don't think a dollar is enough, when you have buses and there's 30, 50 people in there. maybe a dollar for each person. >> tech crunch received a copy of a memo that google gave it workers. it offers suggestions for those who want to speak at the meeting. the meeting starts at 1:00 in san francisco city hall. well, dozens of firefighters battled flames at a home in el cerrito. the fire broke out at 8:15 at a house on terrace drive near king drive. the fire caused damage to a neighboring home. almost 30 firefighters were on scene to battle the blaze.

it took them 45 minutes to get the fire under control. luckily, in one was hurt and there's no word yet on what caused the fire. fire investigators are trying to figure out what caused a san jose apartment fire that forced dozens of people out of their homes. it was first reported around 2:00 this morning at an apartment complex on cadillac drive. although the fire only reached one alarm, several of the units were severely damaged. officials say a total of 36 people live in the two-story complex. luckily, nobody was hurt. a massive snowstorm pounding the east coast right now. how it is affecting work in the nation's capital and the impact it's causing in the bay area. but here in the bay area, it's another beautiful day of weather. ktvu's rosemary orozco will be here to see if there's rain on the horizon. surf contestant organizers have their eyes on a huge swell headed towards hawaii and the california coast. what it could mean for the

killed the shooting appears to be targeted. the federal government is taking a snow day today as a powerful storm pounds the nation's capital. up to 8 inches of snow is expected. kyla cam bem joins us live from washington. even 1 inch is a lot in d.c. >> reporter: good afternoon, tara. with each passing hour, yes, the snow -- is edging up on the ground. the winds are whipping faster and the temperature is dropping. you can see that the snow is kicking on the grass and while the roads appear to be just wet, we found that some of them are slick. one of our crews witnessed an accident near the lincoln memorial a couple of hours ago. there were fewer people on area roads. congress is on recess. the government closed offices for the day. many employees are working from home. tourists are hard to come by. take a look at this open-top tour bus. they are popular, even in the winter but not today.

>> i wasn't notified ahead of time for this change. so now i have to figure out where to stay for the night. >> some forecasters say this could be the biggest storm yet for the east coast. at last check, flights from san jose and oakland were running on time mainly because they left much earlier this morning. petaluma police are warning people about a burglary scam involving a man pretending to be from the water department. the suspect asked a 78-year-old woman to turn on a faucet because of a problem with a water line in the neighborhood. as she did that an accomplice went into her home and stole thousands of dollars worth of gold jewelry. neighbors say it makes them nervous. it's really scary, we have a little baby at home. we work you worry about what's going on in your neighborhood. i thought this is a really close-knit neighborhood where everyone is watching out for each other. police describe the suspect as a white male about 40, 6'6", 220 to 245 pounds and clean

shaven. he was wearing an orange and green vest with reflective tape on it. anyone with information call pem -- petaluma police. tonight members of the municipal water district is expected to take action regarding the trout. county officials may call for a 20% voluntary cut back in water use. last week, governor brown declared a drought in california because of the dry conditions. the city of santa cruz already has mandatory water restrictions in place. the rules require residents to blow or sweep sidewalks instead of watering them down. restaurants can only serve water upon request. there's a warning for the first offense and up to a $500 for repeated vests. the three-day holiday weekend is usually a big moneymaker for ski resorts and

other businesses. this past weekend, the warm weather had people stay away. holiday crowds this weekend were barely above a regular monday. >> it's not even close to what we need it to be. we pretty much make up everything during the snow season. >> some of the smaller ski resorts have closed due to the lack of know. the bigger ones are staying open due to snow-making machines. the warm weather may be keeping the people away from the sierra, but it's bringing out the bears. instead, the bears are out and about looking for food. this one was spotting running across the ski resort in heavenly. another broke into several homes and the shores on the lake's north side. animal experts say that people should lock up trash and food and be on the lookout. massive waves are in the forecast for later this week which could be good news for half moon bay's maverick's surf contest. officials are monitoring the

after the holidays, stocks remain mixed today as investors confess the latest round of corporate earnings, you can see that the dow is down. we're over 16,000 points here but still down. the ceo of target is now encouraging all retailers and banks to replace the old magnetic strip card technology. he says the magnetic strip is more vulnerable to hackers whereas microbaseed chip cards like those used in europe and canada are more difficult for thieves to steal information from. target and vita tried out the cards ten years but shoppers complained it slowed down the checkout process. so those cards were abandoned. a meeting to discuss the future of san francisco's minor hockey league will be discussed today. the bulls must relocate or could be forced out of business. they have reportedly lost $4 million over the last two season. insiders say the coach is working on deals to possibly
