the coroner's office. this was video taken just 20 minutes ago. the officer was accidentally shot by another b.a.r.t. officer this afternoon in dublin. good evening everybody, i'm frank somerville. >> and i'm julie haener. it happened during a probation search. ktvu's allie rasmusen is on dorethy road where that shooting happened. allie. >> reporter: investigators plan to be on the scene here for the next several hours. you can step out so you can see where we're talking about. this deadly accident happened in the very back of the park sierra apartment complex that's also the dorthy road in dublin. this is still an active investigation so police are keeping us a little bit far away. this is the closest we can get to the scene. now that it's evening time, we are seeing some of the residents returning home. let's show you the view from

news chopper 2. four b.a.r.t. police officers and a dub dublin police officer came to this apartment complex to do a probation search for a man wanted for several robberies at robberies on b.a.r.t. property. turns out that man was not home. but while police officers were doing a search, one of the b.a.r.t. police officers weapons was fired and it hit one of his fellow officers. that officer was taken to the hospital where he died from those injuries. we don't know the name of that officer, but as we reported, amber lee spoke to the officer's brother we know that he is a 42-year-old man who has a young daughter. again we don't know his name or identity. but we've also learned that he has 20 years of experience with b.a.r.t. police. the officer who accidentally shot him had more than 10 years of experience with b.a.r.t. police. right now investigators are trying to figure out how this happened. >> that's going to be part of the investigation. is to find out if this was an

accidental discharge or target misidentification. either way it's an accident. and we're going to try to figure out exactly what happened and the circumstances that led up to it. >> reporter: now we don't know where the bullet struck the officer who died. but according to the sheriff's office. all four officers who went in and were involved in this active search were wearing bullet-proof vests. this is the first time a b.a.r.t. police officer has been killed in the line of duty since the agency was created 40 years ago. investigators are going to be on the scene here for the next several hours. crime scene technicians are here as well. ktvu's ken pritchett will have an update for this story on the 10:00 news. allie rasmus, ktvu news. very good thank you allie. right now we want to take you to eden valley medical center. this is where that officer was taken. we are waiting for b.a.r.t. police officer chief ken raney to start speaking. that's him right there toward the right of the screen.

we will hope he has something to say here in a moment. as allie just mentioned we did speak with the brother of the officer. he's a 42-year-old officer with a young daughter. here's chief kenton raney now. let's hear what he has to say. >> good evening. it's with a heavy heart that i have to announce the tragic loss of the first officer killed in the line of duty in the history of the b.a.r.t. police department. at approximately 1:45 today, members of our detective's unit were conducting a probation search in the city of dublin. when the officer was fatally struck by gunfire. our condolences goes out to the immediate family and friends. and the extended b.a.r.t. family. and the entire b.a.r.t. district. the alameda county sheriff's department will be conducting this investigation. we ask that everyone please

give us a chance to catch our breath, breathe and we'll be doing an update probably tomorrow morning. but no questions tonight. again, our condolences go out to the immediate family. and please, keep us in your prayers. thank you. >> can you tell us anything about this officer? >> chief we were told that the guy ewe guys were looking for -- >> you've been listening to a brief statement there right outside of eden medical center from chief raney. following the news that a b.a.r.t. police officer the first one in the line of duty in b.a.r.t.'s history was shot and killed by a fellow officer while serving a probation or doing a probation search at the park sierra apartment complex happening around 1:45 this afternoon. he says with a very heavy heart that he had to make that announcement today. we're still waiting to hear the officers name. he was a 42-year-old man with

20 years of experience on the b.a.r.t. police force and leaves behind a young daughter. we're still waiting to get information on who he was. his name and the alameda county sheriff's department will be conducting an investigation. we're working to get more information and we'll have that for you just as soon as we learn new details. as we mentioned a couple of minutes ago the officers body was brought to eden medical center after the shooting. officers you see there stood at attention as the body was brought in. our coverage continues on our website we've posted photos and information on ktvu.com. just look on the home page under the top story tab. as parents and a hockey community continue to deal with the fall out of how a convicted sex offender was allowed to

coach the team, there's questions about his hiring. claudine wong has more on the hiring and how other associations should take notice. >> reporter: that hockey coach is not coaching anymore. new policies and procedures are being considered. but2 investigates how this actually happened and why legally it never should have. there's a paper trail that tells a story of former hockey coach charlie jones and his history with the law. the crime happened back in 2002 in michigan when he was 18 years old and the two victims were 15. he was convicted of criminal sexual conduct. and ordered to register as a sex offendser. fast forward 11 years later, jones moved to california and applied to be a youth hockey coach at the oakland ice arena. his conviction showed up on a background check. when police questioned why he didn't register he called it a simple mistake. but he was allowed to coach. everyone though the association knew about the conviction. a board member confirmed to me today that after initially

being denied employment, jones went through an appeals process that's also what he told authoritys in this police investigation. obtained by a parent and private investigator and given to ktvu. >> i went through a legal process, went down to l.a. and sat in a meeting with them. and they said that i was able to coach. and i was very forward about this. because i've been going through the whole process and went to them first before anything came up. >> reporter: but how the board responded seems to be the problem. usa hockey guidelines allows job applicants to appeal rulings. that often happens if an applicant has something like a drunk driving conviction. but this case is different. two investigated further and found this critical portion of megan's law. sex offenders registrant who's sex crimes was against a victim age 15 is prohibited from being

an employer, employee, independent contractor or volunteer with minors. so even though the hockey association told me today that jones had a right to appeal, the law in fact, says he doesn't. and that's exactly what police told jones too. >> legally, you can't coach, volunteer with anybody under 18. ever for any reason. >> where is that stated. >> 29.95. >> reporter: the question is, neither jones nor the hockey association know the law, which leads to the question how do parents protect their kids. legal experts say the law can be confusing and says it's likely that the group that runs the hockey program here isn't the only one in the dark when it comes to these types of appeals processes and says all youth organizations need to get informed and get educated. just within the last 30 minutes i did get an e-mail from shark's ice who runs this ice rink here, it says basically

that they are committed to zero toll repbs -- tolerance and they are working with usa hockey. a man is behind bars after spending hours hidden in an elevator shaft. the man was arrested at 6:00 a.m. in a strip mall in the cambrian neighborhood. he set off an alarm in the dispensary about 2:30 this morning and that's when officers set up a perimeter. after a lengthy search, a police dog helped to find him. >> he was in a small elevator shaft between floors one and two. and the second business. >> police say the suspect got into the dispensary from the roof and used ropes to repel down. they found climbing equipment as well as marijuana and other paraphernalia. he is now been booking into the santa clara county jail. happening now, you'll have to spend more to cross the

golden gate bridge but how and when you spend that extra money is still up for debate and you can have a say in it. tonight, through thursday the golden gate bridge digit is holding public meetings in san rafael, petaluma and san francisco to give bridge users a chance to sound off on proposed toll increases for the next five years. ktvu tom vacar joins us from san rafael's whistle sound center where the meeting has been going on for quite a while. >> reporter: that's where we are. the bridge district knows that any toll increase is controversial especially five years worth needed to make up for a huge deficit building up over the next five years. >> we appreciate the public wanting to understand which is why we're having a meeting this week. it's important we make ourselves available to talk about why we have $142 million shortfall. >> reporter: opinions range from reluctant acceptance to no

bay need to have for world class transportation and we in the east bay deserve it. >> the $484 million system is set to open this fall replacing the current shuttle bus system. the fare has yet to be determined. community groups today called on san francisco to embrace an ambitious goal of eliminating pedestrian and bicycle deaths in the city. >> in 2012, for every one victim of gun violence there are five pedestrian victims of traffic violence. >> reporter: the group calls its plan vision zero supporters say most accidents involving pedestrians and bicyclists are preventable. >> there's actually many other places in the country and the world have adopted vision zero policies and have successfully moved toward implements them. >> organizers say the city needs to spend money on traffic calming measures such as wider sidewalks and improved crosswalks. state unemployment officials are under fire for the length of time it takes to

get someone in their offices on the phone. some had to call as many as 40 times to reach a live person. a spokesman blamed a lack of funds from the federal government for the problem. >> with our federal funding situation the way it is we cannot hire anyone who leaves this department. so we continue to lose critical staff that are needed to provide these services. >> reporter: governor brown's budget asks for an additional 60 workers. the dry weather is prompting fire concern. there's already some anedoctal -- >> reporter: the oldest conservatory in the country. there's concern other animals

will be seeking water in areas beyond their normal areas. >> we're expecting to see wildlife to be looking for water. like people may have water in their yards. >> it was the first time i was a bit weary and worried walking the dog. you know it's the first time i had to keep him real close to me. but you never know. i never, i've never thought that would be something on my mind. >> reporter: at boundary oak golf course, they share the creek with geese. >> this is really dry. and the animals will be coming out all the time now because this is where the water is. >> our hope is to return california wildlife to their habitat. and we're gearing up.

it's going to be busy. >> reporter: lindsay officials say don't be surprised if you find wild animals closer to home. they say they shouldn't be a danger if you give them plenty of space. after all, they are probably just thirsty. in walnut creek, ken wayne. ktvu channel 2 news. another warm day today. temperatures got up there. we had 60s and 70s. we had a couple of records as well. 71 in oakland. we can take a peak here and we'll see what we have as far as cloud cover. there are clouds moving into the area. those clouds are staying south mainly. and we're going to have a day tomorrow. a lot like we had today. so mostly clear tonight. mostly sunny and mild tomorrow. and as we head toward your bay area weekend it continues just kind of on the mild side. 30 tonight in napa. 30 in santa rosa. 30 in fairfield. overnight lows will be kind of chilly. some frost in some areas. tomorrow is a lot like today with temperatures in the 60s and 70s. a low pressure center comes in.

kick it is wind up a little bit. drops temperatures a little bit. those are two degree increments. drops a little bit and the winds kick up. that's where the fire weather watch comes into effect as we go into your wednesday night, thursday. 72, 70 in napa, 70 in fairfield and 70 in vacaville. temperatures a solid five to 10 degrees warmer. there's some patchy fog that showed up at the coast. look for patchy fog late tonight and early tomorrow morning. mostly at the coast. nothing inland. 70 in fremont for your forecast high. no spare the air day at least tomorrow. as we go into the periods of winds kicking up. we're not concerned of air quality because the winds kick up. increasing swells and temperatures in the mid- to upper 60s. 69 in menlo park. for two straight days we've had

record warmth. as we go into your bay area weekend, no wind to speak of. just dry, dry, dry. especially in the north bay. but the story is going to be here on thursday. starting wednesday night but thursday into friday. the winds kick up. those offshore winds. that's the weather watch that will go into effect in the bay hills. we're just looking at lots of dry. i mean lots of dry. and very unusual. never really seen that. >> there's nothing down the pike. >> nothing to point out. some where around february second or third. something could happen. >> when you look at our weather compared to the rest of the country it's completely different. >> they're having winter. yeah. >> thank you, bill. coming up he did it. a couple of weeks earl littler than a lot of fans hoped -- weeks earlier than a lot of fans hoped. but coach harbaugh gave a news conference. >> and here's gasia mikaelian on the stories we're working on

a federal grand jury has indicted a san jose attorney on charges that he tipped off a hell's angel. attorney michael edward hingel allegedly told the hell's angel townsend about the raid. these are pictures of townsend days before his death. hingel asked howesn referred to only as the client about an upcoming drug raid in engle. he has pled not guilty on lying to the fbi. staff of the san francisco bulls hockey team are waiting for word tonight on whether the team will go outover business or move. the team has been losing money for several years. there's an agreement with the new ownership group to move the team to fresno or oakland. that would take league approval. word could come at any time.
