good morning, welcome to mornings on 2. we are live in half-moon bay this morning. where the crowds will soon be gathering to watch the mavericks invitational. swells upwards of 40 feet is what we are hearing. i heard a report, surfers in hawaii, the north shore had to be closed because the as well swells -- swells are so big. the world's best big waive surfers will be competing and starts in just about an hour. good morning, thank you for joining us. it's friday january 24th. i'm pam cook in for tori campbell. >> i'm dave clark. let's talk about weather traffic. maybe some partly cloudy skies, a little band coming up from monterey, impacting east bay, maybe a little bit south bay, overall, above average on temps, 30s, 40s to 50s and looks like another record setting day. some of the high elevations, east bay hills, not nearly as bad as yesterday. 22 coming off the caldecott

yesterday. oakland tied a record high of 72 yesterday. last time set was 1958. 58 fairfield. santa rosa at 41. red flag warnings, all elevations above a thousand feet, and some partly cloudy skies inching up here. look for a mix of sun and clouds today. mostly a dry forecast. after today, sunny, mostly sunny, mild to warm. patchy fog not making much of a push toward the coast. patchy fog to the south. 60s to near 70 again. here's sal. >> steve. we have had some problems for poem trying to get to mavericks. or people just going in and out of the half-moon bay area in general. i want to show you the map here where we have had a cup the incident. one was on over turned videocassette on highway 92, just near highway 1 coming down over the hill. traffic going out and coming in is going to be slow. then up the road, just outside

of half-moon bay really, near the harbor, the left turn lane, someone was hit in the crosswalk there. minor injuries, that person was taken to the hospital. and traffic is pretty busy. people coming down to see the competition and just a lot of people just going to work. making for a tough area. let's move along to the bay bridge toll plaza, westbound, that's a 5 minute delay at the toll plaza, 10 minutes on the bridge. total 15 to 20 minutes getting into san francisco. driving this morning on the nimitz freeway, 580: so far so good into the main part of oakland. happening, today: the best big wave surfers are here in the bay area for mavericks. the contest gets underway in a half hour. allie rasmus is in half -- alex savage is in half-moon bay. >> reporter: the top you surfs are fired up. massive waves, light winds and of course it should be a nice

bright sunny day out here. good day to watch the mavericks surf competition. we're here at the pillar point pier. it's getting more and more crowded. we have been watching as the competitors have been arriving and getting their gear and boarding some of the boats that will take them out on the water later today for the competition. organizers predicting 40-foot waves, possibly bigger than that when it's all said and done. these are some of the most talented surfers from all around the world that will take part in the mavericks competition that gets started an hour from now near half-moon bay. this is video we shot of mark heely, a surfer from hawaii's north ore, one of 24 competitors that will take to the water today, and there will be a lot of local talent in the water, too. about half of the surfers are from the bay area. competitors are excited about the perfect conditions expected today, but they also know this puts a lot of pressure on them. one of the surfers was asked this morning if he gets nervous

riding those giant waves? >> i actually get more nervous when the waves are small. at least when they're big, you're distracted from the contest because there's the whole survival element. >> reporter: and it will be a huge crowd on hand here later today. they are expecting about 15,000 or so people will watch the competition in the parking lot of the nearby oceana hotel where they have big screens set up there. the harbor patrol is telling people not to go anywhere near the water or the beaches in this area for their own safety. if you plan to come down, come down early, traffic starting to pick up in this area. and the gates open to the viewing grounds there at the oceana hotel, 7:30 this morning, so things will get more and more crowded here, and again, the competition gettings started at 8:00. live this morning, near half- moon bay, alex savage, ktvu channel 2 news. it's going to be exciting and don't forget, you can go to our web site, ktvu.com, we have

more details about mavericks and where you can watch. look for our web links in our hot top you cans section. if you're going to be headed to the coast, be careful, a high surf advisory continues this morning, not just at mavericks, it's all along the bay area coastline, all the way up from sonoma county to monterey county. if you walk or fish along the coast, watch out for rip currents and sneaker wavers. that high surf warning is expected to last until 9:00 tonight. time now 7:05. new this morning, firefighters have been real busy this morning battling separate fires around the bay area. i want to show you what happened in vallejo. a mobile home there was destroyed. another one was damaged, just a couple of hours ago. now, the fire's out. the firefighters are still looking for hot spots. no one was hurt. ktvu's brian flores is there now. he'll bring a live update at 7:30. also this morning, an illegal marijuana operation discovered just hours ago in this burning house in pittsburg. the house is in the 2600 block

of tampico drive. firefighter were called at 1:00 a.m., and they found a sophisticated pot growing operation. the investigation into the marijuana grow operation and how this fire started, that continues. >> we do get a fair number of grow house fires. a lot of times it's related to the electrical use. >> no one was home at the time, so far no arrests have been made. it cost about $150,000 damage. the county officials say at least 35 marijuana grow house fires have been reported in the past two years. the flames reached 20 feet high in this brush fire early this morning, near east francisco boulevard in san rafael yell. took fire crews 45 minutes to get it under control. several businesses are nearby, incoming a home depot, but they were not damaged. the fire did scorch about 3

acres of dry brush. we are learning new information about this week's deadly shooting of a b.a.r.t. police officer by a fellow officer. today's chronicle reports that tuesday's tragic incident was not captured by body cameras that are issued to all b.a.r.t. police officers. now, that's because the five officers who entered the building were either not wearing the cameras or did not have them turned on. now, the coroner has released the autopsy report of the b.a.r.t. officer killed in that accidental shooting. it shows sergeant tom smith died from a single gunshot wound after the bullet somehow passed through a small gap in his bullet proof vest. >> those of us in law enforcement know best, but it always seems that these kinds of things happen and the vests just don't afford 100 percent protection. it's not like a bomb suit or a suit of armour. >> investigators have still not revealed exactly how that deadly shooting unfolded. the funeral for sergeant smith will be held at a

neighborhood church of castro valley next wednesday morning. the service begins at 10:00 a.m. now, the public viewing will be held the night before the funeral at the chapel of the chimes on mission boulevard in hayward from 7 to 9:00 p.m. tuesday night. the public is invited to attend both memorial services. the time 7:08. city officials in san jose will soon debate a controversial new crime fighting plan. this would give police the power to tap into private security cameras. ktvu's janine de la vega joining us live now to talk about the privacy concerns. good morning. >> reporter: good morning dave. well, we were in this same downtown neighborhood a couple of weeks ago when there was a suspected serial arsonist setting homes on fire. we were surprised at the number of homes that had surveillance cameras. one of the residents told us police have come to his home in the past to look for his footage for other crimes that have occurred here. the suspected serial arsonist was captured on security cameras from different angles

in several neighborhoods, passing byes and setting the house on fire. many homeowners provided the footage to police. and they want a web page that would allow residents to register their video cameras with the police department. a data base like this would save officers the time does effort they spend combing a neighborhood looking for footage for investigations. >> often as a da, i would receive cases three, four weeks old, and we'd go back trying to find video tape evidence and find it had already been recorded over. this gives us an opportunity to save precious video tape, and perhaps better identify suspect. >> reporter: the los los gatos police department has a similar idea set up. they are interested in the idea and would need to explore cost, staff and privacy issues. they wouldn't be able to tap into a live feed of a camera, at any time, officers would

have to ask permission first in each case. the proposal will be discussed next wednesday at a city council meeting. reporting live from san jose, janine de la vega ktvu channel 2 news. people living in the russian river in sonoma county say water levels in late january have not been this low since the 1950s. the river is so low it is not recharging any of the ground water, the river, the main source of water for communities such as cloverdale, healdsburg, that rely on municipal wells. cloversville and healdsburg have ordered people to cut water use by 25%. to the east of sacramento, folsom lake is drying up and drawing tour u.ss, they are driving onto the lake bed to see what's been under the water for many years. many getting stuck in the mud. one tow truck driver says in a normal here he gets three calls to pull a car or truck out of the lake. with all the mud he's had 58 calls since october. lawmakers working on legislation for a statewide ban

on plastic bags at check out counters. last year, another attempt to pass a statewide ban failed because of opposition from plastic bag makers and also concerns that banning the bag means people would lose jobs. under the bill, plastic bag makers would apply for grants to retrain their employees or make reusable plastic bags that meet the criteria spelled out in bills. 90 california cities already ban plastic grocery bags including many right here in the bay area. >> now at 7:12. oakland police still searching for that teenage boy suspected of killing husband own sister. what family members believe may have led up to that shooting. also, another warning ahead of the winter olympics, what some athletes are being told not to wear because of safety concerns in russia. good morning, we are looking at traffic that is moving along slowly in some areas, not so bad in others. we'll give you the highlights

time now, just about 7:15. word just in, a new deadly explosion in cairo egypt, the 4 4th one today. that one was near a movie theater. at least one death reported in that attack. but the police appear to be the targets of the earlier bombings. a car bombing near police headquarters killed four and injured many others, then hours later, another attack targeted squad cars at a metro station. one person was killed there. and then a third explosion near the famous giza pyramids, rocked at police station and no

one hurt in that one. a 4th explosion happened minutes ago near a movie theater. today, by the way, is the third anniversary of the 2011 uprising. the toppled egyptian leader, hosni mubarak. the father of the gunman in the newtown school rampage is helping investigators find answers to that attack. 20 first grade students and 6 educators at sandy hook elementary school were shot and killed 13 months ago. now the father of the 20-year- old shooter adam lanza, talked to an investigator yesterday for more than an hour. he has agreed to help find missing school and medical records that may give information about that shooting. a commission examining the attack says it needs more information about lanza's mental condition before they issue recommendations about changing mental health policy in connecticut. doctors operating while under the influence. it may happen more than you think.

recent studies found that nearly one in five doctors will have addiction problems at some point in their lives. that could lead to being drunk on the job. one bay area woman who wanted a tummy tuck said she ended up disfigured and in constant pain. she later found out her doctor was drunk. >> i was angry at first, but i was more angry and outraged when it turns out i wasn't the only victim. >> there is a proposal that would require drug and alcohol testing for doctors. supporters need 200,000 more signatures in the next two months to qualify it for november's ballot. >> time now 7:17. the u.s. olympic team will be fully decked out in new uniforms for the winter games in sochi but that clothing comes with a warning. athletes with being warned to be very security conscious. that includes not wearing team colors or usa low goes, except in the olympic venues. team members who also competed in 2010 say they didn't hear anything like this when they

went to vancouver. >> we are only 9 days away from super bowl xlviii and there is growing concern about the expected frigid weather at game time, and how it will affect the fans and the players at new jersey's met life stadium. this will be the first time the super bowl will be played outside in such a cold climate. there are fears about frostbite and hypothermia for fans and players. >> when temperatures go below freezing, the body adapts different ways and one of the ways is adapts is to try to maintain body heat. what happens is while the body is okay, the hands and feet suffer. >> now, doctors say as many as 1/3 of players can suffer an injury in a warm weather game, but up to a half could be hurt in the cold. the nfl has discussed the possibility of changing the day or time in case of terrible weather. right now watch the game with us, ktvu february 2nd, kickoff 3:25. time now 7:18. let's check in with sal. you're following several things including what's happening

around the mavericks this morning. >> it's expected. it's a very popular event. a lot of people coming under the coast to try and see what they can see at mavericks. highway 92 near 1, there was an overturned vehicle. no major injuries and also there was a pedestrian that was hit in a crosswalk on highway 1 in grenada at the entrance to the mavericks parking lot. we had a viewer friend of mine sent this in, the car was making a left turn here into the parking lot. if you're familiar with the area, you'll know it and then the pedestrian was here. the paramedics right here. they took that person away. minor injuries. we might even have a little video coming in from that. again, traffic is very busy in this area. let's go to some live pictures now. i want to show you the bay bridge toll plaza, that is backed up now for about a 15 to 20 minute delay. it had been almost nothing. now it's 20 minutes at the toll plaza. another 10 on the bridge.

that's about 30 minutes driving into the city right now. highway 4 is also getting a little bit slow coming up to the willow pass grade. 7:19. let's go to steve. all right. pretty picture here i've painted you. we have a little bit of cloud cover coming up from the south. i think mostly cloudy will settle into the south bay, mostly sunny to north bay. we can see a little band lifting north. there's fog off the coast, but there's still a hint of an easterly breeze. it's not nearly as stong as it was yesterday. look for partly cloudy skies here, south bay peninsula for the at least the morning hours. 53 fairfield. 40s for some. 30s for others. 48sfo. 50 in san francisco. most components show an easterly breezing. nothing compared to yesterday. red flag warning for all elevations above a thousand feet and some of the cloud cover now moving into the santa clara valley, continue to go work north and also some wrapping back around from sacramento. it's not that cold. i mean, it's cold.

welcome back to mornings on 2. a pastor in vacaville accused of stalking an ex- girlfriend may be in trouble with the law again. 39-year-old mark lewis is currently out on a half million dollars bail on charges of fire bombing his ex-girlfriend's house. three other people arrested say lewis paid them to toss a molotov cocktail. he's under suspicion of selling myth, and vandalizing homes.

california's health exchange plans to use an extra $155 million in federal grant money to fix customer service problems and also increase low enrollment among unininsured latinos, california has led the country with more than 625,000 people enrolled in health plans through mid january. however, extremely long wait times and problems with the web site may have prevented an even bigger enrollment. in fact, covered california said 51% of callers in december alone could not get through. california's goal was less than 3%. a man who donated his sperm in order to help another couple conceive is now being told he's got to pay child support. william responded to a craig's list ad in 2009 from a lesbian couple seeking a sperm donor. he signed a contract waiving parental right. years later, the couple broke

bay, peninsula. partly sunny, and some wrapping back around from sacramento. over all, after today, mostly sunny and it's still a dry forecast. partly sunny, partly cloudy to the south. breezy for some. patchy fog near the coast, but not on the coast. and 60s to near 70 degrees again. here's sal. >> all right. steve, we have had a number of problems pop up in this last hour. first of all, i want to show you the traffic approaching the mavericks area is a little slower. there was a pedestrian that was hit as he was in the crosswalk trying to get into the main parking lot at maverick. this is video from a little while ago. the injuries were not life threatening. the person is expected to survive. the fire department was there, and highway 1, even though, again, this is all cleared up. highway 1 is going to be very slow as a lot of people are coming to maverick. please give yourself time and a suggestion would be for you to park over by the half-moon bay airport and then walk down. there's to parking really coming down getting close anymore. let's move along and take a

look at the highway 24 commute. at the orinda station, there is someone who fell onto the platform at the b.a.r.t. station. let me start again, someone fell onto the platform at the orinda station at the san francisco bound side. that person was not hit by a train but was injured. the fire department is on the scene. there are major delays on the concord line because trains are being held to allow the fire department to work. let's go to the bay bridge toll plaza. westbound about a 20 minute delay at the toll plaza, no problems on the bridge, total drive time now approaching 40 minutes for the whole thing. now let's go back to the desk. >> sal, thank you, time now 7:33. happening now, serving advance, they're gathering in half-moon bay, these are live pictures. we're just 30 minutes away now from the beginning of the mavericks invitational. you can't go down to the beach, but the gates just opened at a viewing party at the oceana hotel. you can watch the action on

upbo hd screens. there will be food, music, other entertainment. and we have alex savage there. he'll bring you a live report on everything coming up at 8:00. our developing news is in vallejo right now where firefighters are watching for hot spots after a mobile home went up in flames. ktvu's brian flores there with one person who's particularly heartbroken over what happened. brian. >> yeah, pam, good morning, that resident we with spoke with has loved here for 20 years and simply tells me she doesn't know what to do next. you see fire crews here as you mentioned looking for hot spots and they are going to remain here for a little bit longer to look for the hot spots. it's unclear this morning exactly how the fire started. it's believed from vallejo fire that transients may be responsible. they got the call around 5:10 this morning, when they got here, one home was engulfed in flames, another one was being threatened as well. vallejo firefighters attacked it with more than 20

firefighters on scene. it's believed the home where the fire started had been vacant for about a year. we spoke with a resident who lived next door to the fire and was grateful to firefighters for recovering something special to the family. >> they're getting my mom's urn and her jewelry was in the back bedroom. they were ail to get that. >> reporter: stacy says she was getting up to use the restroom when she noticed a bright orange glow coming from the bathroom window and she immediately evacuated along with her son and dog. she says she has a cat and count know where it is, and hopefully it's alive. as take it out here live, the there's an apartment complex behind this mobile home. embers were seen blowing toward the complex. there are no evacuations issued from there, overall firefighters say there were no injuries as a result of this fire. live in vallejo, brian flores ktvu channel 2 news. time 7:35.

a big reward is being offered as oakland police continue to search for a teenage boy who allegedly shot and killed his sister after arguing over laundry. ktvu's tara moriarty joining us live from the apartments where the shooting happened to tell us what is next in the investigation, tara. >> reporter: friend and family say that mario toliver junior would argue with his sister over the years, you know, bickering that sort of thing, but no one ever imagined that it would come to this. they say the 14-year-old killed his sister over laundry. 17-year-old justice toliver was shot and killed yesterday afternoon around 12:30 in her china town apartment on the 5 5th floor. her apartments were not home at the time a grandparent called 911. she was raised by her father in the apartment with her brother, whom police believe is the one who pulled the trigger. relatives say he was angry over some laundry that justice had ruined. now they want him to turn himself in so his father doesn't lose another child.

>> mario, you're a smart, bright young man. even though you made a mistake, this bad mistake, but mario, you know the right thing to do. >> reporter: relatives say they don't know where mario got a gun, and meanwhile condolences continue to pour onto the facebook page for justice. her family says she leaves behind a 2-year-old daughter, a 17-year-old helps care for the grandmother and child. now mario toliver junior is described as 14 years old, african-american, 5 feet tall and slender with black hair and brown eyes, last seen wearing a hooded black sweatshirt running from the scene. a $10,000 reward is offered in this case with any information leading to the arrest. you're urged to contact oakland police with any leads. tara moriarty ktvu channel 2 news. the search is on for a driver who hit a 70-year-old man in hercules and took off.

surveillance video is unbelievable. it's from a passing bus showing an suv stopping for a pedestrian in a crosswalk. then suddenly, lunging forward and hitting that elderly man. now, this happened last friday. 6:30 in the morning, near sick mother and willow -- sycamore and willow avenues. it's what happened next that shocked viewers more. >> he got out of the vehicle, walked over to the victim and when somebody asked if the victim was okay, he says, well, okay he's breathing and got back into the car, backed up, drove around the victim and backed up. >> now, the victim injured his head is now recovering at his home. the suspect's car is described as a dark mid sized suv with possible front end damage. investigators say the driver is a white male in his 40s. 6 feet 2. bald and weighs about 220 pounds. time now 7:38. police in arizona say a passenger on a greyhound bus

went crazy attack ago driver and investigators say the 25- year-old suspect was hallucinating when he attacked the bus driver early yesterday morning. the bus was going 75 miles per hour at the time. two dozen people on board were hurt. some of the passengers captured that suspect. a livermore auto consignment deal r and former race car driver is set to be sentenced today for embezzlement prosecutors say rick boisel promised to sell classic cars to six people and never paid them what they owed. aj galls 96 camaro was among the cars featured on the consignment dealership. he sent a $33,000 check after selling the car, but gall says that check bounced. when they met face to face, they worked out another deal. >> talked to him personally. he gave me a sob story about his wife being pregnant, and said if you just give me a

against the league, but a federal judge dismissed it. now, yesterday san jose filed notice that it plans to appeal that decision and the city says it is pursuing a second lawsuit but accuses major league baseball of interfering with san jose's economic opportunity. the a's are not participating in any case. the san francisco bulls have received an extension to continue negotiations for new ownership. the length of the extension to find new ownership has not been released to the public. but the move would move the bulls out of the cow palace. the team says it does not have any current plans to cancel any games this season. time now 7:41. house speaker john boehner says he's not interested in running for president. he told jay low know that last -- leno that last night. he says it's all about what he's not willing to give up. >> i alike to play golf. i like to cut my own grass. i drink red wine. i smoke gets and i'm not giving that up to be president of the

welcome back to mornings on 2. i want to take you live to new york this morning. a large sell off in a merging market currencies is what is worrying investors this morning. that's taking the dow jones down right now. it's off 165 points right now. the nasdaq and s&p 500 also done. they're down further percentage wise, more than 1 percent, for those two indexes. one bright spot, microsoft, it is up almost 2 percent this morning after reporting good numbers. no word on who will be the next ceo yet. snow and treacherous conditions likely caused the massive pile up on a highway in northwest indiana. the accident happened yesterday afternoon and involved some 30

vehicles. half of those big rigs. so far we know three people died. more than 20 others injured. salvage crews say it will take at least a full day or more to clear that mess which is blocking a main thorough thoroughfare between chicago and detroit. >> the collision was louder than a gunshot. you heard, ask it was crazy. >> because of heavy snow, visibility reduced to about a 1/4 mile or less. buses were brought in to give people shelter while they waited and also to transport the injured to the hospital. >> time now 7:46. the fbi warning u.s. retailers expect more cyber attacks. they discovered 20 more hacking cases that use the same malware that affected target last year. executives and retail, credit card and banking industries say they've become increasingly worried about the security of payment systems. the fbi says most malware cases it investigates involve small

to mid sized businesses. former defense secretary leon panetta said cyber attacks are the most dangerous possible threat to the u.s. panetta who's also a former director of the cia was speaking yesterday in monterey. he warned of a crippling cyber attack that could target the nation's financial institutions, high-tech industries, businesses businesses, can the government and infrastructure. back in 2009, he was told by a cia counter intelligence team that the cia faced as many as 100,000 cyber attacks every day. a marin county judge has sentenced teenager max wade to 21 years to life in prison. wade was convicted of several crimes that include attempted murder for shooting at a teenage couple. he was convicted of stealing the lamborghini of celebrity chef guy fiorini. he thanked the judge for a fair

trial. under law he could apply for parole before he turns 40. he's now 19 years old. the liebers are reacting to their favorite artist's brush with the law. justin bieber was arrested after police spotted him drag racing. he was arrested on a number of charges, including drunk driving. the 19-year-old pop star spent a brief time behind bars before posting a $2500 bond. fans admit they are a bit concerned about their teen idol. >> i would tell him to go to rehab and figure himself out. take a break from the chaos. >> he was a christian kid and came out to be a disaster, but i still love him. >> and while this is bieber's first court appearance, it may not be his last. he's being sued by a body guard who claims the singer hit him and owes him money. that scheduled to go to trial in la next month. time now 7:48. let's go to sal.

you have been busy this morning, didn't quite feel like friday light to me. >> yeah, it didn't really, doesn't really in some areas, although finally we're getting some improvement, so i don't want to discourage you. let's go out and take a look at highway 580. we're seeing improvement here as you drive from the altamont pass. it was slow and you saw a lot of red. there's improvement there. 880 still slow as you drive south. not as bad as it normally is. you see spots where the traffic does let up, and then the traffic getting to half-moon bay has eased up a little bit after some of those crashes have been gone. i want to mention b.a.r.t. delays are still there on the concord line because of a medical emergency at the orinda station there. single tracking around someone who fell onto the tracks but was not hit by a train. that person is being tended to. let's move along and take a look at the bay bridge. that's a 15 minute delay. about 25 minutes into the city, and if you are driving in san jose's downtown area, not too

about 22. yesterday it was 57. it was absolutely howling in the oakland hills. above the oakland zoo, much quieter today than it was yesterday. 66 will be the forecast high in san francisco sitting at 50 right now, and then 59 at noon. speaking of oakland, starting off very mild, but we'll end up with 70. that would tie the mark at 70 going back to 1988. 11 consecutive days. 16 out of 23 days in january. we have set record highs in the bay area. 53 in fairfield. upper 40s for some. 50s for others. kind of cold or mild. red flag warning for all elevations above a thousand feet in the bay area. some of the high cloud deck, partly cloudy, mostly cloudy conditions in the morning. it's not terribly cold for some. it's going to get brutally cold monday and tuesday. dallas is 20. new orleans 34 and froz freezing rain. and 18 in atlanta. and windchills at 40 and 50

. welcome back, a woman in her early 60s becoming the 4th 4th person to die of h1n1 flu virus in sonoma county. the total of flu deaths has hit 29 around the bay area. health officials are still uncourt and jurying people, go out, get a flu shot -- encouraging people, go out, get a flu shot. the peak flu activity is in february. u.s. attorney general eric holder says the obama administration is planning to establish regulations soon that would allow banks to do business with legal marijuana sellers. banks often refuse to let marijuana related businesses open accounts. that's because under current federal regulations, processing under sales puts banks at risk for drug racket tiering. it's become more critical since colorado and washington have legalized recreational use of marijuana. the increasing number of

states legalizing marijuana use boosting enrollment in oaksterdam university. in some cases they come from states where medical marijuana use is not legal but they want to be able to hit the ground running if the laws change. >> there are a lot of states that will be on the ballot in 2016. these people are trying to get in here, learn about what to do before their states actually pass the law. >> currently there are 20 states, plus washington d.c. with medical marijuana laws. other states are considering following the lead of colorado and washington and legalizing marijuana for recreational use. now, a national poll shows a growing number of americans support the legalization of marijuana. the cnn survey found 55% of those polled support legalizing marijuana. 44% opposed, that's a major turn around from two years ago when the majority of americans,

the world's best big wave surfers are there. they're pumped up. getting ready to ride some big swells, we're there with them. alex savage is there. he'll have a report in just a couple of minutes. water looks beautiful. friday morning. >> cold though. >> i know, cold. january 24th. i'm dave clark. >> i'm pam cook in for tori campbell today. and pretty exciting. what are the conditions going to be like. is it going to be nice in half- moon bay. >> yeah, i mean, yesterday was windy and warm. today it's a lot calmer that's for sure. we have high and mid level clouds coming in. some fog is there but still runs into an easterly breeze. incredible. it's still a slight breeze coming out of the oakland hills. 50s for some. 30s for others. upper 40s. temperatures running a little bit warmer, especially south and red flag warning continues. what's new, elevations above a thousand feet and clouds from santa clara valley and santa cruz mons mons -- mons, and a

little -- mountains and a little different twist, there's no sign of significant rain. breezy nor some, nothing like yesterday. patchy fog. 50s, near 70 degrees. steve, right now traffic is moving along relatively well if you are driving in some areas, but we still have some slow traffic at the bay bridge, it's only about a 5 minute delay and 10 minutes off from san francisco. not all that bad once you get onto the bridge. the morning commute is okay on 880. a little bit slower past the coliseum. are you trying to drive down the march robberies, well -- mavericks. well, there's a lot of traffic on highway 1. it's pretty slow coming over the hill, especially. earlier problems that are clear. especially slow on northbound highway 1 getting over to half- moon bay, but again, parking is at a premium. you want to car pool, might have to park far away if you're seeing the surf competition. happening right now, the

mavericks invitational surf contest, scheduled to get underway right now. alex savage is out there with the excitement building. they are expecting some big crowds and big waves. >> reporter: good morning to you, the surfers are all excited. we were talking with them earlier this morning. the fans are also excited n. we're in the middle of the official mavericks viewing party here. this is the parking lot of the oceana hotel near half-moon bay. people are out here with chairs and blankets, a little bit chilly, but should warm up and be a beautiful day for the competition. everyone will be watching the competition on the big screen tv so they can see the action on the water, those surfers are a mile or so away from the location. a good crowd, 15,000 people should be out here to take in the action. let me show you the scene. this is live from news chopper, 2, an aerial look at the surfers out in the water right now. this competition should get underway at any moment now. surfers pumped up because they are expecting massive waves

today. organizers predict 40-foot waves and some competitors, we saw them this morning, they hop on the boats to get out there. these are some of the mostal l wented fors -- most talented surfers from around the world. they say that they know the risk, riding these huge waves but they are able to overcome that fear. >> you kind of try to compartmentalize fear. when you're in a bad situation, you have to turn it from, it has to be less of a palm and more of a math equation. you can't let your emotions get ahold of you. >> reporter: a safety warning is going out to spectators in this area. they're encouraging people to come to the official mavericks viewing party here in the parking lot of the oceana hotel. the parole is warning people that the conditions are dangerous. they don't want people going anywhere near the beaches or

hawaii, one of them is brazilian carlos brulay, he road what was thought to be a 100 foot wave off the coast of portugal. we have more details about mavericks and where you can watch. look for the web links in the high school topics section -- hot toppings section. a high surf advisory continues along all of the bay beaches, from sonoma to monterey county. if you are walking or fishing along the coast, watch out for rip currents and sneaker waves. the high surf is expected to last through 9:00 tonight. new this morning, an illegal marijuana operation discovered just house ago in a burning house in pittsburg. that house is in the 2600 block of tampeko drive. firefighters were called at 1:00 a.m. and when they got there, they found a sophisticated pot

growing operation. the investigation into that operation and how that fire started continues. we do get a fair number of grow house fires. a lot of times it's related to the electrical use. no one was home at the time, so far no arrests have been made. fire caused about $150,000 damage. county officials say at least 35 marijuana grow house fires have been reported in the past two years. also this morning, in san rafael, there was this. flames from a brush fire. they reached about 20 feet high near east francisco boulevard. it took crews 45 minutes to get it under control. you could see it if you were driving on interstate 580. several businesses are nearby, including a home depot, but they were not damaged. the fire burned about 3 acres of dry brush. we are learning new information about this week's deadly shooting of a b.a.r.t. police officer by a fellow officer. today's chronicle reports tuesday's tragic incident at a park sierra apartment complex

in dublin was not captured by body cameras, issued to all b.a.r.t. police officers. that's because the five officers who entered the building were either not wearing the cameras or they did not have them turned on. meantime, the coroner has released the autopsy report of the b.a.r.t. officer killed in that accidental shooting. it shows sergeant tom smith died from a single gunshot wound after the bullet somehow passed through a small gap in his bullet proof vest. >> those of us in law enforcement know best, but it always seems that at least kinds of things happen, and the vests just don't afford 100 percent protection. it's not like a bomb suit or a south of armor. >> investigators have still not revealed exactly how the deadly shooting unfolded. now, the funeral for sergeant smith will be held at the neighborhood church of castro valley next wednesday morning. that service begins at 10:00

a.m. the public viewing will be held the night before the funeral. that will be held at the chapel of the chimes on mission boulevard in hayward from 7 to 9:00 p.m. tuesday night. the public is invited to attend both of those memorial services. your time is 8:08. would you give permission to let the police have access to your security camera? a san jose city councilman is proposing allows the police to tap into private security cameras to solve crimes. ktvu's janine de la vega joining us live in san jose with more details on all of this. good morning janine. >> reporter: good morning dave. some wonder if their privacy would be compromised. i spoke to a woman who has a camera and lives in this neighborhood, and she's fine with sharing. many people have cameras on their homes and so do businesses that they specifically got to deter criminals. plisses footage of the serial arsonist was key in helping capture him. several surveillance cameras in numerous neighborhoods showed him passing by and setting fires. those resident gave the footage to police and that prompted sam

lacardo to come up with the idea of creating a data base that would allow residents to voluntarily register their video cameras with the police department, and it would save time and effort combing neighborhoods looking for footage. one resident who footage of the arsonist thinks it's a good idea. >> this is not the first time you have provided video foughtage to the police department. -- footage to the police department. i have given them footage in the past, and one time i actually had to go out there and tell them that i had video footage. if they knew they would just come and ask. >> reporter: surveillance footage has also helped capture thieves stealing packages off people's porches. video such as this is helpful for their investigations. they are interested in it but would need to explore, cost, staffing and privacy issues. as part of the proposal he's asking the city to reach out to private video surveillance companies to offer discounts to

homeowners and apartment property owners who want to install systems and register them with the city. this proposal will be discussed next wednesday at the city meeting. reporting live from san jose, janine de la vega ktvu channel 2 news. people living near the russian rivers say water levels in late january have not been this low since the 1950s. the river is the main source of water for many communities, such as cloverdale, healdsburg. they have already ordered people to cut water use by 25% as we have been reporting. now, the drought is drying up folsom lake as well. that's east of sacramento, and that is bringing in a lot of people who want to see what it's like to go under where the water is. many of those people are driving out on the lake bed. it looks dry but about 2 inches below the surface is slick mud. cars and trucks getting stuck. a tow truck driver says he's pulled 58 trucks out in october, compared to 3 or 4. time now 8:11.

the most recent took place an hour ago outside a movie theater. one person was killed. you can see the devastation there. the other bombings appeared to target police officers. now explosions went off at police headquarters near squad cars and at a police station. five people died in the attacks. dozens others injured. today is the third anniversary of the 2011 uprising that toppled long time autocratic ruler, hosni mubarak. protesters also put up street barricades in kiev fueling tensions following failed talks with the president. opposition leaders and the president are at an impasse over the release of demonstrators in future arrests. the opposition claims these are the concessions that would end the street fighting. 8:16. new this morning, from virginia, former governor bob mcdonald and his wife just appeared in court. first court appearance on federal corruption charges. i want to show you new video.

here's the governor and his wife maureen arriving at the courthouse in richmond virginia. a federal prosecutors accused mcdonald of taking more than $165,000 from the owner of a dietary supplement maker in exchange for improperly promoting his company. mcdonald has denied the allegations. today, the judge ordered the mcdonald's not to leave this country. reportedly they've already surrendered their passports. athletes, representing the u.s. at the 2014 olympics will be covered in red, white and blue, but they're being told not to wear the team uniforms everywhere. now, the state department is warning the olympic team to keep american flags and logos under wraps when they're outside the olympic venues, the athletes were sent a memo saying wearing team usa clothing could put their personal safety at risk. your time is 8:17. only nine days away from the super bowl. super bowl xlviii. and concern is growing about the expected freezing weather

easterly breeze off the oakland berkeley hills. nothing like yesterday. yesterday was a wind tunnel. i mean, people were saying, my goodness it was crazy up there. and i come down here, and downtown oakland is not that bad. 50 san francisco, high of 66. oakland, if you were speaking of yesterday, they hit 72. that tied a record high. it felt warm. today 70. that would also tie a record high and for my friend in the east and fremont, what in the sam hill is going on around here. she texted me and said my parents used to say that. another record high is possible. we have had 16 days out of 23 this month of record highs in the bay area, and i think we've had ten consecutive days amazing. 30s, 40s or 50s and temperatures because it's so mild, so warm, even though we're getting the cloud cover, we have red flag warnings for all elevations about a thousand feet. i'm enhancing this a little bit. little guys, but some of that is definitely producing a sprinkle or two. the incredibly cold air settles

into the deep south. freezing rain towards new orleans. there's been snow in galveston, freezing rain in houston, and the next system is dropping down to one coming in the blast for monday night, monday into tuesday. might be colder than the one they had about three weeks ago. windchills 40 to 50 below early next week. you can see the line of freezing rain as it slides to the deep south, for us, there were 87 record highs yesterday for mendocino county to del norte. 8 #. there might have been more. that's what i counted. after today, things will calm down. patchy fog, maybe a sprinkle or two towards the south bay or santa cruz mountains. but overall, 60s and 70s. again, cloud cover might take the edge off some of these to the south, but looks like a partly to mostly cloudy morning, and a partly sunny afternoon. this will be out of here by tomorrow and we're back to sunny, mild and warm. temperatures, though, just above average for a while. >> as we have been saying, the

welcome back. time is 8:25. a church pastor in vacaville accused of stalking a former girlfriend may be in new trouble with the law. mark lewis is out on a half million dollars bail. he's accused of fire bombing his ex-girlfriend's home. three other people who were arrested say that lewis paid them to throw a molotov cocktail. the court records show he's also under suspicion of selling methamphetamine, intimidating witnesses and vandalizing homes. we have a follow up to a story we report on wednesday from arizona state university. students posted photos online showing them attending a party commemorating dr. martin luther king junior day. now civil rights groups say the party was filled with negative stereotypes and offensive costumes. now the school has announced that it is severing ties with that fraternity. that's kapa open p -- epsalon.

morning and this will be with us most of the day here, partly sunny, partly cloudy, probably partly sunny to the north, mostly cloudy to the south. at least we're getting something in here besides severe clear. still 70 in oakland. a little east breeze off the oakland, berkeley hills, nothing compared to yesterday. 72, being oakland, 70 today if they hit there, another record high. temperatures running cooler for some. warmers for others. all are wind driven or cloud driven. red flag warnings continues for elevations above a thousand feet. you can see the cloud cover streaming north, san jose, and embedded within that is a couple showers, little guys, not guilty much. they're there. might get a few sprinkles. after today, the low responsible and all the clouds be get out of the picture and mostly sunny and dry. patchy fog, a little breezy for some. partly sunny, mostly cloudy for a while. 60s to near 70 degrees again. here's sal. steve, good morning, we have had a pretty decent commute i would say today, we don't have a lot going on, especially in this last hour.

the drive time here between 680 and the caldecott tunnel is down to about 10 minutes which is pretty good here as you drive through. sometimes it's up as high as 15 to 20 minutes, but today it has improved. also the morning commute at the toll plaza is down to a few minutes at the toll plaza. 10 minutes on the bridge. so less than 15 minutes all the way across. we have been looking at highway 92 closely. i think a lot of people are going to half-moon bay, and the el granada area. the slowest traffic is on nob 101 approaching 280. 8:33. let's go back to the desk. >> sal, thank you. firefighters in vallejo still at the trailer park in vallejo that caught fire a couple of hours ago this morning. one mobile home was destroyed. another one was very badly damaged. ktvu's brian flores is there to tell us why one resident is in particular is really heartbroken over what happened. so what happened brian. yeah, dave. good morning to you.

well, in terms of that residence, she has mixed emotions this morning. obviously today she is very devastated with what happened but also very grateful for vallejo firefighters because they were able to recover personal art facts. look behind me. this is it. this home completely destroyed. we're on sandy hook road here in vallejo at the carcinas mobile estates and the home to the left was also heavily damaged. that was the home where this woman lived this morning. if we go to video from earlier, so you can clear exactly l how ited, it's -- exactly how it started, it's believed transients may have been the source. as you mentioned dave, one home was f engulfed in flames, another was also being threatened as well. talking with firefighters this morning, it looks like the other home is unlivable. firefighters attacked this fire with 20 firefighters on scene, 6 engines in response as well. it's believed that the homes where the fire started had been vacant for about a year.

we spoke to a resident next door to the home where the fire started. she's devastated over what happened and grateful firefighters were able to recover special things including an urn carrying her mother's ashes. >> i got up to use the bathroom, and my bathroom window faces their house, and the window was lit up like really bright, and so i opened the window and i looked outside, and their house was just going up in flames. >> reporter: stacy also says she immediately evacuated along with her son and dog who also live at the home. they left after the fire. firefighters were also able to recover jewelry that belonged to her mother also. she also has a cat she says, but doesn't know where it is, and hopefully it is alive. again, fire investigators out here this morning. in terms of the fire response it was pretty large. in fact there was an apartment complex behind where the mobile home complex is located. and there were embers burning

from a nearby tree that were blowing over that apartment complex. but fire officials decided not to evacuate. there was no threat to the apartment complex behind, but overall, no injuries were reported as a result of this fire. we're live in here vallejo, brian flores ktvu channel 2 news. police continue to search for a teenage boy in oakland who is accused of shooting and killing his own sister over laundry. ktvu's tara moriarty joins us now from the apartments where the shooting happened with more on now a reward being offered for the boy's arrest. >> reporter: yes, a $10,000 reward being offered for the capture of mario toliver junior. we checked out his facebook page. it hasn't had any activity since this summer. police are now actively looking for them: trying to bring him in for questioning. but his family says that the 14- year-old shot and killed his sister over laundry of his that his sister ruined. now, 17-year-old justice toliver was shot and killed yesterday afternoon around

12:30. her parents were not home at the time. a grandparent called 911. she was raised by her father in the china town apartment with her brother, whom police believe shot his sister. relatives say he was angry because justice bleached some of his cloths. now, they want him to surrender safely. >> just call, please, son. turn yourself in or call your daddy so we can turn yourself in. i don't want nothing to happen to you. >> reporter: relatives say they don't know where mario got a gun. condolences continue to pour onto facebook for justice. her family says she leaves behind a 2-year-old daughter. the 17-year-old worked at mcdonald's and helped care for her grandmother and child. now, mario toliver junior is described as 14 years old, african-american. 5 feet tall and slender, with black hair and brown eyes, last seen wearing a black hooded sweatshirt, running from the scene. again, a $10,000 reward is being offered for any information leading to

toliver's arrest. live in oakland. i'm tara moriarty ktvu channel 2 news. time is now 8:37. the police search goes on now for a driver who hit a 70-year- old man in hercules, then took off. surveillance video from a passing bus shows an suv stopped for a pedestrian in a crosswalk. then suddenly, the driver lungs forward and hits the elderly man. this happened friday morning at 6:30 near sycamore and willow avers. it's what happened next that has shocked people even more. >> he then stopped his vehicle, got out, walked over to the victim, and then when somebody asked him if the victim was okay, he says, well he's breathing and got back into his car, backed up, drove around the victim and left. >> now, that victim injured his head, but is recovering at home now. the suspect's car described as a dark mid sized suv has possible front end damage. investigators say the driver is a white man in his 40s, about 6- foot 2. he is bald and weighs

about 220 pounds. a dive team had to pull an unusual car out of the oaklandest chew ware -- estuary. $130,000, officials say the driver and his wife pulled onto a boat dock at 6:30 last night, and got out. for some reason, the car kept rolling and rolled right into the water. sheriff's deputies were called to the scene, a dive team hooked cables to the water and was hauled out of the water. the battle over the future of the oakland a's is now moving ahead in two different courts. now, the team owner is interested in moving into san jose and doesn't have the approval of major league baseball. the city of san jose made an antitrust claim against the league. a federal judge threw it out. yesterday, san jose filed notice it will appeal that decision. and the city says it is considering a second lawsuit that accused major league baseball of interfering with san jose's economic opportunities.

the oakland a's are not taking part in either case. meantime, san francisco bulls, the minor league hockey team, they received an extension to continue negotiations for new owners. the length of the extension to find new ownership hasn't been announced to the public. but the move would move the bulls out of the cow palace after less than two years of being there. the team says it doesn't have any current plans to can cancel games this season. house speaker john boehner says he's not interested in running for president. he told jay low know it's -- leno last night it's about what he's not willing to give up. >> i like to play golf. i like to cut my own grass. drink red wine and smoke cigarettes and i'm not giving that up to be president of the united states. >> he told leno he and president obama have a good relationship but have a hard time agreeing on issues. >> i gathered that, pam. >> i did too. >> time is 8:40. snow and bad weather blamed for

gamble, medical examinerred results. let's bring you up to date on top stories we're following for you. oakland police still out there searching for a 14-year-old boy accused of the fatal shooting of his sister. family members say the two argued over laundry and 17-year- old justice toliver was killed. meantime, a sophisticated marijuana operation was found early this morning in this burning house in vallejo. flames shot through the roof of the house. no one was home. no arrests have been made so far. as we have been showing you, that's a big one. the mavericks contest has begun. it's underway right now. the competition started 40 minutes ago. ktvu's alex savage is live there in half-moon bay amid the fans and the surfers and the excitement, some of the best big wave surfers. >> reporter: yeah, a huge crowd beginning to form here in the parking lot of the oceana

hotel. close to half-moon bay this morning, and look at this crowd here, you can see a lot of people with lawn chairs and blankets all set up here, ready for a few hours of surfing action and they're watching of it here in the parking lot, this is the official mavericks viewing a party, and let me show you the action out in the water in the meantime. about an a mile or so, i should say, offshore, and this is where 24 of the best surfers in the world are in the water right now, and they are riding just some natsive waves today, organizers -- massive waves today. organizers are predicting we may see 40-foot wavers and some thought they may be bigger than that when it's all said and done. local talent in the water today. about half of the competitors involved in the mavericks competition this year are from the greater bay area. some of the surfing fans, we have been talking to them. they say it's incredible to see

the competitors ride such big waves. >> i have been in the area for a few years and never been up. and i heard today is the day, and my friend and i got up at 5 this morning and got some coffee and hit the road, and got lucky getting in. got a great parking spot. it's been a nice morning, you know. >> reporter: a safety concern for spectators at this year's competition, the parole will be out in force making sure people don't get up onto bluffs in this area or go down to the beaches where the mavericks competition is being held to watch the surfs. they are warning everyone the danger of the strong waves, watching from the viewing party. this is where we are this morning. back out here to a live picture, the parking lot of the oceana hotel. organizers say if you want to come by and get inside, you need to do so soon, they are nearly full now. live this morning near half- moon bay, alex savage ktvu

channel 2 news. snow and treacherous conditions likely caused a massive pile up on a highway in northwest indiana. now, that accident happened yesterday afternoon. it involved about 30 cars, half of which big rigs, so far and we do know three people died, more than 20 others injured. salvage crews say it will take at least a full day or more to clear that mess, which is still blocking a main thoroughfare between chicago and detroit. time now 8:37. former defense secretary leon panetta says cyber attacks are the most dangerous possible threats to the u.s. he's the former secretary of the cia and was speaking yesterday in monterey. he warned of a crippling cyber attack that could target the national's financial institutions, high-tech industries, businesses, the government and the infrastructure. he said back in 2009, he was told by a cia counter intelligence team, their agency faced as many as one hundred thousand cyber attacks every day. the fbi is warning u.s.

retailers expect more cyber attacks. that's after discovering 20 other hacking cases that use the same kind of malware used to attack target last year. the fbi says small and mid sized businesses, they're most at risk because attacks on them get less publicity, and those businesses just don't have the security budgets of big companies. 8:48 is the time. let's check back in with sal. i would imagine pretty crowded getting to mavericks. is everybody already there. >> most people are there. the crowd has died down a little bit. it was crowded earlier in the morning, pam and dave. let's go out and take a look at what we have with the other parts of the commute. now, things have actually moved along pretty well here on highway 4 in the last half hour. this commute, that seemingly seems to be over. same thing for the bay bridge. you can see traffic here at the toll plaza. a little bit of a slow down, maybe about 5 minutes and then another 10 minutes into the city. no major problems by the way in san jose where there's slow

record high. 30s, 40s to 50th. fairfield a north breeze. held up all morning long. half-moon bay, yesterday, 68. a big difference. lost a lot of breeze. red flag warnings for the elevations in the bay area and north above a thousand photo. you can see the cloud cover. hard to see. right there. and santa cruz mountains, maybe along the skyline, a few brief light showers: it doesn't amount to a hill of beans. but you know what i mean, it's there. at least we get cloud cover. mostly cloudy to the south, once this area moves out, actually came back in the back door and sneaking out ahead will head back north: it will be out of here tomorrow. partly sunny, a mix back here, sun to the north, clouds to the south. partly sunny, partly cloudy, breezy for some. not like yesterday, that's for sure. even patchy fog out l. temperatures will continue to be above average for most, 60s and 70s. some areas might be a little warmer r. the cloud cover could hold things back a little bit towards the south bay.

welcome back. time is 8:54. we're hearing of reports of a sexual assault last night near the college of marin. the sources are telling ktvu that a masked man assaulted another man at gunpoint last night. investigators later found the victim in mill valley. he was taken to the hospital where he was troated for injuries. investigators described the suspect as african-american, 6 feet tall. about 225 pounds. reportedly he was wearing a black sweater, black ski mask and black gloves. we'll have more details as available. as we have been talking about, all morning long, happening right now, we get to watch this live, thanks to news chopper 2. the surf catching, looks like a good ride there, dave, what do you think. >> that's pretty good in my professional opinion. >> exactly. >> yeah, maverick surf competition underway started almost an hour ago now. and there's another one, boy, it's just really great to be able to see this from our shots

body guard who claims the singer hit him and owes him money. that's scheduled to go to trial in la next month. a couple visiting relatives in southern california had a close encounter with a bear. bob and his wife were in pasadena yesterday when all of a sudden, look at the camera, a bear walks up to them as they were leaving the home, at first they didn't see the bear, once they did, they frantically ran inside. golden state warriors star steph curly will start at this year's nba all star game. he was considered one of the biggest snubs last season, but this year he had a great season as you know, more than a million fan votes, second only to kevin durant in the western conference. steph curry is the first all star starter since freewell in 1995. curry is having a career year averaging career highs in points, assists and rebounds just tremendous. >> he's fun to watch.
