good morning. welcome to "mornings on 2." we're live in benicia where students at mathew turner elementary are heading back to school just days after a teacher was arrested. how district officials are handling the situation -- nup coming up in a live report. it's monday, january 27th. i'm tori campbell. >> welcome back. nice to have you back. >> nice to be back. i'm dave clark. let's talk about your weather and traffic. a lot to tell you about. steve has the forecast. our system is driving north, making for a beautiful sunrise. there's some fog. this is giving us a westerly breeze or an onshore push. fog near the coast seems to be lifting, santa rosa, napa, also san jose. so be careful with that. high pressure still reluctant to give up its ground. it says you shall not pass. that's what it's saying, dave. but it will be cooler. i'm not told on the rain here.

up north, yes. they are already backing off on it for us here, which wouldn't surprise me. we have some thick fog and the dense fog yields 40s and 50s. a couple of upper 30s. the front will give us partly cloudy skies to the north. mostly sunny to the south. morning fog. more in the 60s or a few upper 50s, low 60s if you're in the fog. here's sal. unfortunately, i have bad news for bay bridge drivers. we have your drive times severely impacted by a crash on the west side of the crash. it's in the clearing stages. it wasn't so serious an injury crash as it was in the lanes for the -- for about, i would say 40 minutes up there. the traffic on the bridge is beginning to thin out. but we have a big backup at the toll plaza. i want to show it to you. it's barely moving because the metering lights have been switched on to extra slow. we're talking about 30 minutes just to get out of the toll

plaza. another 20 minutes. we're looking at some an hour to get on the bridge. that's right. almost an hour. it went from being good to peaking a really bad commute. you might want to consider alternates like the san mateo bridge. a little heavy there but i think it would be better or taking b.a.r.t. if you can or waiting if you have the option of working from home in the morning. i know not everyone does that. let's take a look at southbound 680. that looks good. southbound 242 at grant, there is a new crash there. 580 is a mess because of earlier problems from the altamont pass. and pleasant hill road to the caldecott, seven minutes now. back to the desk. psychologists will be on campus when the first grade students of a benicia schoolteacher head back to class. she's accused of serving pot to her coworkers during an after- hours dinner in november. ktvu's alex savidge joins us live from outside of the school. alex, what's happening on campus right now? >> reporter: well, the district is doing everything they can

later today to support students during what is a very difficult time. that's why they will have school psychologists on the campus of mathew turner to help students who may want to talk about this arrest. a teacher here at this school accused of poisoning some of her fellow teachers with pot. investigators say first grade teacher teresa badger secretly served marijuana to her coworkers to an after-hours potluck. police say several people who attended the party became sick. one was hospitalized. police arrested badger on friday after a month and a half investigation. investigators have not said what the motive was here. ktvu tried over the weekend to get a comment from badger but we were unable to reach her. but she did obtain a letter that went out to parents here at mathew turner and in it, the district superintendent stresses that this party in question didn't happen on school grounds and didn't happen during school hours. classes get started here at this school at 8:30 this

morning. live this morning in benicia, alex savidge, ktvu channel 2 news. 7:04. this weekend, b.a.r.t. police are expected to release more information about last week's shooting tragedy. a b.a.r.t. police detective accidentally dilled his supervisor during a search of a dublin apartment. michael mays shot and killed tommy smith after mistakenning him -- mistaking him for an armed suspect. a san francisco police officer is due in court accused of molesting a 15-year-old boy and po setting chind pornography -- child pornography. richard hastings turned himself in on tuesday on an arrest warrant. he's facing ten felony charge, is being held on $910,000 bail and has been suspended without pay from the police department. he has an 8:30 bail hearing

this morning. san jose police are searching for suspects in a deadly stabbing over the weekend. it happened yesterday morning on sun crest avenue in east san jose. when police arrived, they found a man who had been stabbed at least once. he was rushed to the hospital but did not survive. it's san jose's fourth homicide of the year. if you have any information on this incident, you are urged to contact san jose police. 7:0 a. major work needs to be done on the science building at san francisco state university. a recent report found signs of harmful materials inside. now the building is closed for the rest of the semester. brian flores is live to tell us more about the impact on the students and the staff out there. >> reporter: well, it's day one of the spring semester for faculty students and staff here at san francisco state university. in terms of the immediate impact, though, it's gonna be inconvenient as 250 faculty and teachers need to find other offices. 10,000 students who study here or have classes here, they need

to find out where their classes are this morning now that the building is closed for the semester. that decision was made to close it after routine inspections. they found evidence of asbestos, mercury and peeling lead paint. according to a second inspection, it was much worse than originally thought. according to a report, asbestos was discovered in the basement of first and second floor and several areas for mercury vapors and a large concentration in the basement. a report indicated that mold was discovered in several areas of the building. university nils are working with -- officials are working with experts to determine any health effects. we spoke to some students on the way to class to talk about their impact. >> it was a big impact. a lot of our classes were moved. our schedules were a bit, like, changed and it's inconvenient for us since we have to move away from some of our classes. when it's over here, it's fine. but some of our classes were

moved farther away from our usual place . >> reporter: we haven't heard where many of the relocations are. but a let -- but many campuses were put on the website. along with science and engineering, the building houses business class, creative arts, liberal services as well as health and mew man services. mum -- human services coming up, we'll hear from the staff and faculty. we're live here in san francisco, brian flores, ktvu channel 2 news. members of a vacaville church are reacting to the news their pastor has been arrested again. >> our pastor is falsely aussed. he's been -- accused.

he's been falsely put in jail. >> mark lewis faces fraud and perjury charges for allegedly using church properties to raise bonds for hig $500,000 bail. lewis needed that bail after being accused of hiring members of fellowship baptist church to carry out a firebombing attack at it's ex-girlfriend's home. investigators believe he made harassing phone calls to the victim, broke into her car and set the bushes in front of her home on fire. new information is coming in about how a mountain view man died while boogie boarding in santa cruz. 47-year-old james zanker of mountain view came trapped between the rocks and the mainland, in an area known as the toilet bowl. witnesses say there were huge waves and strong ocean currents that day. >> i'm sure he suffered injuries from the rocks themselves and being held under the way the currents work, like, you get stuck down and held down for a lightning time. >> three swimmers jumped in,

trying to rescue zankg. two more rescuers arrived on jet skis. some were hurt during the rescue attempt and feared they wouldn't make it out. finally, they did get zank out of the water but he was later pronounced dead. tonight the city of livermore will consider a ban that could impact homeless people. the livermore city council will consider a new proposal to ban tents and temporary shelterers. it would apply to public and private property. it comes after complaints of noise and trash by nearby homes. the ordinance could punish repeat offenders with fines up to $300. 7:10. widening a road known for one of the worst traffic backups in the bay area may take longer than first expected. a $1.2 billion project to widen the novato narrows has been underway since 2001. but the project is $209 million short for funding for the work on paving a third lane.

>> we're very confident within a reasonable amount of time we can get the asphalt on the third lane to relieve the traffic. >> county officials are searching for state and federal money and they hope to have the project complete in two years. but if they can't come up with the money, construction may not wrap up until 2020. questions about where dogs can run free in the golden gate national recreational area will be publicly debated. the current proposal would ban dogs from some areas where they are now allowed to be off leash. dog owners say that's too restrictive. a teenager with bay area ties arrested in pennsylvania for allegedly trying to make a weapons make a weapon of mass

a journal they found at his home may provide important clues in this case. >> there is a journal that he does express in general unhappiness with his life. i really don't have any other information about that now. that's something we'll continue to work through. >> investigators have not found any connection between aguilar and the two people who were killed. 7:15. a georgia congressman is offering his support as a chance to win a semi-automatic rifle as part of his campaign for a u.s. senate seat. congressman brown invited members to enter to win a rifle. saying, "democrats and liberal media would love to take away our guns." brown's campaign says thousands of people have responded. we're hearing that congress may finally be close to passing a contentious farm bill. house and senate negotiators worked through the weekend on

the long, overdue bill. the biggest sticking point has been disagreement between democrats and republicans on funding for the food stamp program which is part of the farm bill. it appears the house will vote on the bill on wednesday. 7:16. well, this morning, the popular restaurant joe's of westlake in daly city is closed. last night, the restaurant served its last meals to long- time customers after more than five decades. the italian restaurant is closed after being sold to original joe's. now, the new owners have no affiliation to joe's of westlake. they plan to remodel the restaurant, then reopen it in a year. not clear yet how many changes they plan to make to the building and to the menu. >> i know everybody here and i know so many regular customers such as myself that come here. what's gonna happen in a year? >> now, the restaurant employees say they haven't yet been offered a new job at the restaurant when it reopens.

some of emthem have been working there for many years and say it's like saying goodbye to family. 7:17. an unusual flush landed a poker player in jail in new jersey. police say the man flushed fake poker chips worth $2.7 million down a toilet. it happened during the winter poker open in atlantic city. the flush was discovered after the pipes at the casino flogged forcing officials -- clogged forcing officials to cancel the tournament. he was charged with rigging the contest. 7:18. let's check in with sal. you got a lot to tell us with about problems in the morning commute. >> the bay bridge has not been good. we had a crash up there earlier. it's cleared. took them 45 minutes to do it. the traffic has improved, all of the lanes are opened. they had 0 to slow the -- they

had to slow the metering lights down. things are improving. the drive time, double what you normally see for this time of the morning, 40, 45 minutes to get across in the city unless you are in the carpool lane which will help you quite a bit. let's take a look at the -- i want to show you the area of san carlos near ralston avenue. this whole area here, there was a power outage centered 2700 block of san carlos avenue. it's causing some of the interchanges with lights not to be working. treat them as a four-way stop. pg&e is on the scene. 7:189. let's go back to steve. let's go back to the steve. >> vee have fog on the deck. santa rosa, san jose seem to be reporting the thickest fog. a partly sunny, partly cloudy day. more crowds to the north -- cloud to the north. what is this green here? a stronger system we're waiting

for that one to come in wednesday night into thursday. that's our best opportunity for rain. it's looking weaker and weaker. we'll see if it holds or makes a dent in the strong area of high pressure. a lot of low clouds. a myth of sun and clouds. there will be a lot of clouds coming in wednesday. thursday, we'll cloud it up. it will be cooler. possibility of rain. no doubt about it north. i'm not sold on it here. more 30s than 40s for sure. 50s because of the low clouds and also some of those high clouds. there are some breaks in the clouds. overall, though, this system will track to the north, we just get partly cloudy skies out of it. ukiah, 40 degrees. 20 up in tahoe. reno, 26 degrees. plenty here but the traffic of it is lifting north. this will drag across a lot of partly cloudy skies. this is our cloud and rain forecast. it will be a cooler pattern this week as far as rain goes unless you are points north. i don't think you will see most. our best opportunity will be late wednesday into thursday. that's it. after that, that's it. if we get anything, it will be

desirable for you to drive across. look at the macarthur maze and all of that slow traffic. the drive times have doubled this morning at the bay bridge. usually it's about 20 minutes or so. another ten into the city as you look at the toll plaza, it's beginning to move. but if it normally takes you 250 minutes this morning, it will take you about 45. not quite double but we're still looking at kind of a heinous commute across that upper deck of the bay bridge into san francisco. this is because of an earlier accident now cleared. southbound 242 at grant, there is a crash there. highway 4 is slow coming out of the area. also looking at 580 which has been very slow from 205 into the main part of livermore. 7:32. back to the desk. thank you, sal. a russian teenager with bay area ties is now facing charges in pennsylvania for allegedly making a suspected bomb in his bedroom. ktvu's tara moriarty, live in our newsroom with more on what his roommate at penn state university is saying about it. >> that's right. vladislav miftakhov's roommate calls the 19-year-old off the

wall and a crazy and dumb kid who was bored and impull sif but not -- impulsive, but not dangerous. the roommate said he told him to get rid of the mini booms after he set off three outside of the apartment. vladislav miftakhov is facing charges for possession of a weapon of mass destruction. this is a facebook page of the russian national that we found on book. authorities arrested the penn state freshman last week after altoona police found an explosive in his apartment when they came looking for marijuana and in a suitcase discovered bomb making chemicals, fuses an compressed air. the suspect attended carlmont high school and former classmates say they can't believe it. >> very seriously, especially with everything that's been said about how -- about his nationality, especially with the olympics coming up and all of the extra security. i think it's very alarming,

especially something within the united states. >> his family moved to san carlos a few years ago. his family told us that they did not want to talk to the media until they had a lawyer. investigators say vladislav miftakhov admitted buying the materials online and said he wanted to blow things up but what things and why remains unknown. authorities believe the teen experimented with explosives before he moved to pennsylvania, although he has no criminal record in san mateo county. his current bail is set up at $500,000. coming up in the next half-hour of "mornings on 2," the new details we just learned about who is now taking a closer look at this frightening case. live from the newsroom, i'm tara moriarty, back to you. >> all right. thank you, tara. 7:34. funeral is being held for 14- year-old girl hit and killed by a vta train. danica garcia was hit january 17th while riding her bike to delmar high school in san jose. friends say she may have been trying to beat the train to be on time for a singing performance. today's service begins at 10:00

a.m. at willow glen funeral home. garcia will be buried at oak hills cemetery. students at san jose state are starting their spring semester with a warning from camus police. over the weekend, two female students were grabbed in inappropriately -- inappropriately by a man on the campus. one of the incidents happened by the events center. the other happened by the hoover hall dorms. in both cases, the man rode up on a bike to those students, then grabbed them. students are now being told to be aware of your surroundings when you walk on campus late at night. new information about a shooting over the weekend at a bar in downtown pleasanton. police say they arrested 21- year-old jason landisaccuseed of firing shots inside of red coats pub and restaurant early sunday morning. police say most shots hit the ceiling but one person was hit. that person was taken to the hospital and is expected to be

okay. a 23-year-old woman is facing multiple charges after leading police on a high-speed chase through marin county. it began around 6:00 p.m. last night when police say the suspect, morgan, ran a red light in downtown san rafael. it ended when we took a left turn at 50 miles an hour and hit a street. police say she got out of her car and tried to run away but they were able to chase her down. the suspect's mother says her daughter has a history of guesting into trouble. >> she got out of jail about three months ago, did get her g.e.d. but other than that she's been running amuck. >> police say she was wanted for three outstanding warrant, two for attempting to bring drugs and alcohol into jail and now hit and run and saw the charges will likely multiply. if you live in the south bay, you may have to start conserving water soon. with the drought situation getting worse, the governing

agency that provides drrging water in santa clara county is considering taking action. janine de la vega is joining us live from san jose. what's in store for the weeks? >> reporter: well, water officials think there's still room for people to conserve. people can do that by being more conscientious and maybe less careless. my photographer just walked into a cafe and when he was in the restroom, he realized somebody didn't turn off the sink faucet and kept the water running. the district is voting on whether to set a goal to reduce water usage by 10% from last year. another recommendation is spending $500,000 for a public outreach campaign to urge residents to conserve. district water officials recognize that the state's outlook for water resources is poor because of the lack of rainfall. local and state reservoir storages are below average for this time of year. some people we spoke to say they are already conserving because of the drought. >> my wife is picking on me to

make sure that i turn off the water when i'm shaving and when we do our dishes, we soap them all up and then we rinse at one time rather than keeping it running on the other side. >> reporter: the district may explore whether to double water conservation rebates to residents and businesses who conserve. water district officials will also consider establishing a water conservation committee and authorizing the ceo to pursue funding opportunities for water supply projects. the district provides water to city and private businesses in the county so the request to cut would be up to each provider. reporting live from san jose, janine de la vega, ktvu channel 2 news. new this morning, a 44-year- old transient facing charges after being arrested near a vegetation fire. police in petaluma say the fire started on lakeville highway near sunset park and quickly spread to a nearby palm tree with the flames reaching about 20 feet high.

police say mathew biland was sitting on a sidewalk close to the fire and tried to call police away from it. he was arrested for public intoxication and obstructing an investigate. 7:38. freezing weather is heading back to the midwest. temperatures are expected to drop today and should say that way through thursday. forecasters are predicting temperatures in the teens to below zero with a windchill making things even colder. schools in minnesota, including the university of minnesota, will be closed today and the chicago public school system also announced it will keep schools closed today. >> 6,000 kids walking to school and the other 6,000 standing at a bus stop. there's too much of a danger of them getting frostbite or hypothermia. >> today's forecast for chicago is a high of 4 degrees and a low of negative 17. the cold weather is also expected to spread into the

southeast later this evening, with the chance of snow in many cities including atlanta and montgomery, alabama. 7:39. president obama is due to give his state of the union address tomorrow night. in his speech, the president is expected to again push congress to pass immigration reform legislation. he will also probably focus on a theme he's addressed in recent speeches, the growing equality in the united states. he wants a higher minimum wage. aides say the president will let congress know he's prepared to issue executive orders if lawmakers refuse to take action. you can watch the state of the union address right here on ktvu channel 2. our coverage begins at 6:00 tomorrow night right after the ktvu channel 2 news at 5:00 with more coverage after the president's speech at 7:30. and the white house is saying pro basketball player

jason collins will be sitting with first lady michelle obama during the state of the union speech. last my, collins revealed he's gay in a "sports illustrated" cover story. he's the first active player in any of the pro major sports leagues to do that. collins also played basketball while a student at stanford where he graduated in 2001. president obama was among the many who congratulated collins for his courage in coming out. 7:41. even though the government's healthcare website is supposed to be fixed, people trying to sign up are still reporting problems. a new associated press gfk poll says 71% trying to stein are having problems. 440% are successful. that's up. the commerce department reported new home sales fell last month. december sales of single family

homes were down 7% compared to november. economists had expected the number to fall because of unusually harsh weather across much of the country. but sales were still good enough to boost new home sales for all of 2013 to their highest level in five years. and new home prices were up nearly 8 1/2% to almost $266,000. a shocking arrest in benicia. what a teacher is accused of bringing to a potluck that has her facing poisoning charges. we'll check apple stock to find out what analysts are expected this afternoon ahead of the earnings report. good morning. we're looking at the macarthur maze. one of the reasons why we're seeing some improvement is traffic at the metering lights has been speeded up. we'll tell you what happened to start this whole bad traffic off. we have fog back. clouds back. can we get rain back? we've been so long without it. there's been some to the north.

they were killed yesterday while battling a huge apartment complex near downtown toledo. investigators say it appears the two firefighters became disoriented while looking for victims. >> i could see the flames coming through the ceiling. i told my boyfriend, come on. get out. the place is on fire. >> no one living in the apartment complex was hurt. investigators are still looking for the cause of the fire. a brain-dead pregnant woman in texas has been taken off life support after the hospital announced it would not fight a court ruling. she has been on a ventilator since november after suffering a blood clot while 14 weeks pregnant. her family wanted to take her off life support saying it was her wish. but the texas hospital that was treating her said a state law prevented doctors from denying life-saving treatment to a

pregnant woman. a judge ruled on friday that the law did not apply in this case because munoz is brain dead. the legal battle over weather an oakland teenager should stay on life support could change how the state determines the moment of death. the attorneys for the emergency math family says doctors should not be able to remove patients from life support if family purposes objecket for religious reasons. the family went to court for the right to transfer her to a private facility after being declared brain dead following tonsil surgery at oakland children's hospital. she was moveled to the facility earlier this -- moved to the facility earlier this month. investigators investigating an illness that rapidly spread on a caribbean cruise. more than 3,000 passengers and crew left new jersey last tuesday on the royal caribbean explorer of the seas. by the weekend, more than 600 people reported feeling sick.

that cruise is being cut short. it's expected to be back in new jersey on wednesday. let's check in with sal, see if things are getting wet better for folks trying to head to the toll plaza. >> they are better. we've seen some improvement. the bay bridge is kind of a mess because of an earlier crash on the upper deck cleared 45 minutes ago to an hour. but the traffic is still bad at the toll plaza. it was backed up all the way out to the maze. we're talking about a 40-minute drive time getting into san francisco. but it keeps getting better by the minute if you have the luxury of waiting around you might want to do that or take b.a.r.t. moving along to the commute here on the san mateo bridge, not too bad. it looks like the fog is not an issue. but when you get to the peninsula there's fog. 580 continues to be one of the slow problems or slow traffic spots in the bay area. we look at the peninsula. traffic on 101 does look okay. let's go to steve.

little bit. monday, today, we get low clouds. mix of sun and clouds. it will be cooler, especially wednesday, thursday, friday. there will be rain in the north, just not sold on it making it here, maybe to the north bay. 50s or 40s. the lows are held up due to the cloud cover. this system is driving north. it will be partly sunny, more clouds to the north. and temperatures still a little bit above average but the trend is to bring those town. it will not be as warm this -- down. it will be not as warm this week. here's sal. getting word of a crash on highway 101 at highway 12 involving a big rig with 56,000 pounds of wine. let's take a look at some of the bay bridge -- osh the bay bridge commute which has been backed up much more than normal. the drive time is double. it's taking you 40 minutes total time to get across. we have a crash on the bridge that's been gone for an hour

but the traffic is still slow. also, the morning commute looks okay if you are driving on northbound 880 passing the coliseum. i do see some smog up there near high street. i think that's normal. the drive time is 14 minutes near the caldecott. 880, 238 to thornton, 25-minute drive time there. let's go back to the desk. >> thank you, sal. psychologists will be at a benicia elementary school this morning when the first grade students of a benicia schoolteacher come back to school. that teacher is accused of serving pot to her coworkers during an after hours dinner. alex savidge is already there. you just talked to the school superintendent. good morning. >> reporter: well, good morning to you. the district superintendent told me she's stunned by what is taking place here. the arrest of a long-time teacher here at matthew turner. she calls this a very difficult time for the school.

that's why she has a psychologist on campus here today to help any students or teachers who want to talk about what's going on. police here in benicia have arrested a teacher and accused her of poisoning some of her fellow teachers with marijuana. teresa badger, they say, secretly served pot to her coworkers to an offcampus party back in november. several people who attended the party became sick. the superintendent believes eight people were sick. one person was hospitalized. several teachers told the school's principal about what happened and police launched this investigate. badger was arrested on friday after police investigated for more than a month and a half. the superintendent is stressing the party in question did not happen on school grounds or on school time and was not sanctioned by the district. still, students returning to class may have trouble understanding why one of their teachers was arrested and that's why the counselors will be onhand.

they are just here in case somebody needs to talk, if any staff members or students are having a hard time. they are skilled and trained in that. so they are here if needed. they might not be used. it's a very surprising and sad thing. >> over the weekend, ktvu tried to get a comment from badger. we were unable to reach other. the superintendent says she's been on paid leave since last tuesday. that's when the district became aware that the criminal investigation was going on. so far, benicia police have not said what the motive may have been in this case. classes get started about a half-hour from now. we'll be trying to talk with parents this morning to get their reaction to this arrest and we'll be back here on "mornings on 2." alex savidge, ktvu channel 2 news. >> thank you, alex. this week, b.a.r.t. police are expected to release more information about last week's shooting tragedy. a b.a.r.t. police detective accidentally

killed his supervisor during a search of a dublin apartment. the chronicle reports officer michael mays shot and killed sergeant tommy smith after mistaking him for an armed suspect and sources say the circular layout of the apartment appears to be a factor in this tragic case. the police search goes on for a 14-year-old oakland boy accused of killing his 17-year- old sister. now, oakland police have been searching for mario toliver junior since he shot his sister justice in chinatown at their apartment. he was reportedly spotted yesterday afternoon on an a.c. transit bus in oakland around 1:00. police say several passengers reported their suspicions to the pus driver -- the bus driver but the teen had gotten off the bus. antioch police are investigating a shooting yesterday afternoon in the parking lot of a fast-food restaurant. it happened about 4:00 outside a jack in the box on lone tree

way. when police arrived, they found a 33-year-old man who had been shot inside of a van. the man was rushed to the hospital. he's expected to survive. at this point, no arrests have been made. 8:05. san jose police are searching for suspects in a deadly stabbing over the weekend. it happened yesterday morning on sun crest avenue in east san jose. when police arrived, they found a man who had been stabbed at least once. he was rushed to the hospital but he did not survive. this is san jose's fourth homicide of the year. if you have any information on this incident, you are urged to contact san jose police. 8:06 major work has to be done on the science building at san francisco state university. a recent report found signs of harmful materials in that building and now it is closed. the building is, for the rest of the semester. ktvu's brian flores is there on campus now to tell us how the staff, how the students are gonna be affected by this. good morning, brian.

>> reporter: good morning, dave. well, it's actually the first day of the spring semester for faculty and students here at san francisco state. in terms of the impact, it will be pretty much inconvenienced as the university has been trying to find temporary offices for 250 faculty, classroom space for students. the science building closed for the rest of the semester. the decision was made last week to close it after routine inspections of the campus science building found evidence of pretty harmful chemicals like asbestos, her cue rye and peeling lead paint -- mercury and peeling lead paint. now, reports also indicated that mold was discovered in several areas of the building. university officials say they are working with experts to determine any potential health effects for those who spent time in the building. it's not just students who are affected. many faculty members had to be relocated. some have not been allowed in

their offices since the building has been closed. >> the department has been struggling. i'm taking an office space from a professor on sabbatical right now. i mean, i can't access any of my former tests and paperwork, that kind of is a little bit of a pain. you have to do what you have to do. you just deal with it. >> reporter: she says she's been impressed with how quickly the school has been able to locate students and staff. many have been moved to different locations. some have been moved across campus. relocations, many of them, have been updated on the school's website. they've been updating students and staff on the situation as well on the school's website. this morning it's unclear when the building will fully reopen. we're live here at san francisco state, brian flores, ktvu channel 2 news. we're now learning more about the death of a boogie boarder in santa cruz. the victim has been identified as 47-year-old james zank of

mountain view. witnesses say he got caught between rocks and the mainland in an area known as the toilet bowl. it happened on friday when people say there were monster waves and a strong current. >> i'm sure he suffered injuries from the rocks themselves and being held the way the current works in the area, you get stuck down and held down for a long time. >> three rescue swimmers jumped in the water and two more came over on jet skis. some of them suffered bruises and water intake and said they didn't think they were gonna make it. finally, they were able to pull zank out of the water. he was taken to the hospital where he was pronounced dead. tonight, the city of livermore will consider a ban that could affect the homeless. the city council will consider a new proposal to ban tents and temporary shelters and this would apply to public and private property. this follows complaints about noise as well as trash in the area. the ordinance could push repeat

offenders with fines up to $300. we're finally getting a look at how many people are taking advantage of free wi-fi on market street in san francisco. it's part of a pilot program in the city which runs along market street from the castro to the embarcadero. the city says a month into the program, about 250 people used the service each day. but the service is experiencing some glitches. some phones and wireless providers are having better luck than others getting the free wi-fi service. a project that could reduce overcrowding on muni buses in san francisco could get a big funding boost. the san francisco examiner reports the transportation authority board could allocate more than $13 million to the project. the money would come from proposition k, a half-cent sales tax approved by voters in 2003. board members are scheduled to vote on the proposal tomorrow. new this morning, a report in the san francisco chronicle

says the same chinese company that made faulty bolts for the eastern span of the bay bridge, also made 250,000 bad bolts for the retrofit of the carquinez bridge. the chronicle says the information on the carquinez bridge was in a recent report critical of caltrans for covering up problems with the construction of the eastern span. according to that report, the 250,000 bolts for the retrofit of the carquinez bridge in 1999 were made to the wrong size and had to be rejected and then remade. widening a roadway known for one of the worse traffic backups in the bay area may take longer than expected. a $1.2 billion project to widen the novato narrows has been underway since 2001. but the project is 209 million short of funding for work on paving a third lane. >> we're very confident within a reasonable able to we can get

the asphalt on the median to get us that third lane to really relieve traffic. county officials say they are searching for state and federal money. they hope to have the project finished in two years but if they can't come up with the money, construction may not finish until 2020. it's 8:11. trial begins in los angeles today in a case that attorneys say is an effort to get rid of bad teachers. nine california public school students are suing the state to abolish its laws on teacher tenure, seniority and other protections they say keep bad educators in the classroom. unions, though, say eliminating tenure would take away a vital support system for a profession that's already losing talented people to hire paid positions in the private sethor -- sector. a warning for students at san jose state university. a troubling incident that hanked for two student --

a misdemeanor charge of possession. the house said it would investigate whether he broke congressional rules or other laws. this morning, joe's of westlake of daly city is closed. last night, the popular restaurant served its last meal to long-time customers after more than five decades. the italian restaurant is closed after being sold to original joe's. the new owners have no affiliation to the original joe's. they plan to reopen in a year after remodeling. not clear about the changes to the building and the menu. >> i know so many regular customers such as myself who got here. we all got the same thought. >> what's gonna happen in a year? >> employees say they've not been offered at a new job at the new restaurant since it opened. some have been working there for many years and say it's

with 56,000 pounds of wine. this truck is blocking the lanes and this is normally light commute. so if you are driving northbound 101 near highway 12 look for that slowdown. let's go back to the desk. a russian teenager with bay area ties, now facing bomb making charges in pennsylvania. tara moriarty is live in the newsroom. there are new details about the agency getting a closer look at this case. >> good morning the fbi and federal prosecutors are reviewing allegations against the penn state student who graduated from a high school in belmont last year. this is the criminal complaint against vladislav miftakhov. his roommate calls him a dumb and crazy kid who was bored and inpussive but not necessarily danger. vladislav miftakhov faces charges for possessing a weapon

of mass destruct. he was arrested when police came looking for marijuana and found in a suitcase bomb making materials. classmates say they can't believe it. >> he was -- he stayed quiet. never raised his hand. had maybe like one or two friends. never was outspoken. vladislav miftakhov's family moved to san carlos a few years ago and lives about a mile from this high school. investigators say vladislav miftakhov admitted buying the materials online and said he wanted to blow things up. but what things and why remains unknown. authorities believe the teen experimented with explosives before he moved to pennsylvania although he has no criminal record in san mateo county. his current bail has been set at $500,000. his next court appearance is set for next tuesday. back to you. 8:34. a funeral will be held in just go about an hour for -- in just

about an hour for a 14-year-old girl hit and killed by a vta train. she was hit january 17th while riding her back to delmar high school in san jose. her friends say she may have been trying to beat the train to be on time for a siging performance. today's -- singing per per -- performance. students at san jose state are starting their spring semester with a warning from camus police. over the weekend, two female students were grabbed inappropriately by a man on the campus. one of the incidents happened by the event and recreation center. >> the other by the heaver hall dorms. the man rode up on a bike and grabbed the young women. students are being told to be aware of their surroundings when walking on campus late at night. the hearing for a san francisco police officer accused of molesting a 15-year- old boy and possessing child pornography is getting

underway. richard hastings turned himself in on tuesday. he faces ten felony charges and is being held on $910,000 bail. he's been suspended without pay from the police department. he's expected for a bail hearing and arraignment. a 23-year-old woman facing several charges after leading police on a high-speed chase last night through marin county. it started around 6:00 p.m. when police say the suspect, morgan bow, ran a red light in downtown san rafael. it ended when she took a left turn going 50 miles an hour and hit a tree. police say she got out of the car and tried to run away but they were able to chase her down. the suspect's mother said she has a history of getting into trouble. >> she got out of jail about three months ago. did get her g.e.d. but other than that, she's been running amuck. >> police say bow was originally wanted for three

warrant, two for attempting to bring drugs and alcohol into jail and also a hit and run. they say those charges will probably multiply. 8:36. people in the stay may have to start conserving water very soon. the agency that provides drinking water in santa clara county is considering taking action. janine de la vega is live from san jose to tell us what is in store. good morning, janine. >> reporter: good morning, tori. well, the santa clara water district is reporting that since july, san jose has only received 1.5-inches of rain and that's normally -- it's only 30% of what we would normally have. just one reason why it's looking to have people and businesses to start conserving. the water district provides drrging water to 1.8 million residents in the county. at tomorrow night's board meeting, they will vote whether to target reducing water by 10%. district water officials are

responding to the drought declaration earlier this month. the state's outlook is poor. it's been the driest year in recorded state history. storages are below average for this time of year. some south bay residents we spoke to this morning say they don't mind being asked to voluntarily save water. >> it won't be tough for me but it might be tough for some people who have pools and take more than one shower. but we know what we need to do to conserve. >> reporter: a boat will also be taken -- vote will be taken by the board whether to spend $500,000 for a public outreach campaign to conserve and expand programs that offer appliances in homes. water district officials will consider establishing a water conservation committee. the district provides water to the city and the county so the request would be up to each provider and back out here live, some of the people we've been speaking to this morning,

harmful chemicals and peeling led paint. the first grade students of a benicia schoolteacher are heading back to school since that teacher was arrested, accused of serving pot to her coworkers after an of a-hours potluck. alex savidge is out there. you talked to the superintendent. >> reporter: the superintendent says this is all very hard to process for the students and teachers here. it's also quite difficult for parents as well. we've tried talking with a number of parents this morning as they dropped off their children, but none of them wanted to weigh in on this stunning arrest of a long-time teacher here at this school. a school psychologist will be onhand to help students and teachers through this process here. police say first grade teacher teresa badger was arrested for secretly serving pot to her

coworkers during an offcampus party that happened back in november. she was arrested on friday. police say several people who attended that party became sick. the superintendent told me this morning at least eight people were sickened. one person was hospitalized. several teachers told the school's principal about what happened and police in turn launched an investigation that lasted for a month and a half. the district superintendent is stressing this morning that the party in question didn't happen on school grounds or on school time and was not sanctioned by the district. still students may have trouble understanding why a teacher was arrested and that's why they will have counselors onhand here to help. >> it's a tough time for the whole community. we're here to make sure the children have as typical of a day as possible. we've notified the importants there may be press here so they can tell their children. we have counselors here in case any kild needs to -- child needs to talk. >> we tried to get a comment

from badger over the weekend. the superintendent says she's on paid leave. she's been on leave since last tuesday. that's because the district found out about the criminal investigation at that time. and she was then placed on leave. it's unclear at this point, according to police, exactly what the motive may have been. live this morning in benicia, alex savidge, ktvu channel 2 news. >> thank you. 8:47. under attack, the silicon valley startup is facing legal trouble from all sides. pam cook joins us in the studio with the action being taken today against uber. >> confirmation in the last half-hour that a wrongful death lawsuit against uber will be filed today in san francisco. uber is being sued by the drivers who accuse the company of stealing their tips. it's under attack from taxi drivers who claim unfair competition arguing that the uber drivers are not properly reck late and now a family is suing. the mother and son were injured

in that accident. the 6-year-old daughter killed on new year's eve. the lawyer who helped jahi mcmath's family is now representing this family. he says uber compares it itself to ebay, connecting a buyer and a seller but not libel for what happens in between. they say uber distracts its dive drivers -- its drivers. uber was created for years ago to challenge the traditional taxi business. it's in 60 cities from san francisco to new york and onto europe. it's valued at about kl 4 billion. the uber driver who killed the little girl and injured her mother and brother was arrested on suspicion of vehicular manslaughter. a statement from uber said he did not have a pass --

[audio difficulties] and that the accident had nothing to do with uber. u.s. health officials are looking for what caused an illness that rapidly spread on a caribbean cruise. more than 3,000 passengers and crew left new jersey on board the royal caribbean explorer of the seas last tuesday. by the weekend, more than 600 reported feeling sick. the cruise line ordered the trip cut short. it's headed back to new jersey. by mid wick lab tests will confirm if the norovirus caused so many people to become sick. time is 8:50. let's check back with sal. you've got a lot to talk about and you are watching our friended on 88 -- on 880, too. when something happens at the bay bridge, all of the commutes leading up to it get split. 880 will be slow. it's normally slow anyway.
