>> former secretary of state, hillary clinton, answers a direct question question about her plans for 2016. good afternoon. i'm tori campbell a popular ride sharing program is facing a lawsuit after one of its drivers struck and killed a 6- year-old girl and injured two of her family members on new year's eve. brian flores is live in san francisco with what both sides are saying today. brian? >> reporter: hi, tori. good afternoon. we're on the corner of polk and ellis in the tenderloin district where behind me a memorial remains for sophia liu. it's been emotional for the family. they are firing a lawsuit using the same attorney who hired christopher dolan. they claim the driver was on

uber's app at the time of the collision. the lawsuit claims he was distracted and looking at his app and looking for his next fare. uber disputes that and goes on to question the use of the app by uber drivers overall, saying while using it violates california law on the use of cell phones while driving. the suit is seeking unspecified damages, claiming uber was neglect and responsible for the wrongful death of liu. meanwhile, uber acknowledges he was the driver and are standing by a previous statement this afternoon that says the driver was not providing services on the uner system during the time of the accident -- uber system during the time of the accident. we extend our deepest cone dole lenses of the family during this time. sophia was killed on new year's eve as crossing the street here on polk and ellis. her younger brother and mother were hit. christopher dolan says he will be holding a press conference

at his office on market street in san francisco this afternoon. brian flores, ktvu channel 2 news. >> all right. thank you, brian. the fbi and federal prosecutors are reviewing allegations against a penn state student with bay area ties accused of bomb making. vladislav miftakhov graduated from carlmont high school in belmont last june and faces charges for possession of a weapon of mass destruction. authorities arrested the 19- year-old last week after police in altoona, pennsylvania found an explosive in his apartment. officials were looking for marijuana when they discovered bomb making chemicals, fuses and compressed air. former classmates say they can't believe it. >> very serious, especially with everything that's just been said about how his nationality, especially with the olympics coming up and all of the extra security. so i think it's very alarming, especially something within the

united states. >> reporter: vladislav miftakhov's family moved to san carlos a few years ago. investigators say he admitted buying the materials online saying he wanted to blow things up. authorities believe the teen experimented with explosives before he moved to pennsylvania, although he has no criminal record in san mateo county. he has not yet posted his $500,000 bail. his next court date is set for february 5th. in about an hour, b.a.r.t. police are expected to release more information about the accidental shooting that claimed the life of a b.a.r.t. police sergeant at 1:00, the police chief is scheduled to hold a news conference about the accidental shooting of sergeant thomas smith who was killed by another officer during a search of a dublin apartment last week. according to reports, the circular layout of the apartment appears to be a factor in this tragic case. oakland police are searching for a 14-year-old boy four days after he allegedly shot and killed his 17-year-old

sister over an argument about laundry. mario toliver is accused of shooting his sister, justice, at their grandmother's apartment in oakland's chinatown neighborhood on thursday. police say toliver may have been spotted on an a.c. transit bus in oakland yesterday afternoon. but by the time, passengers reported their suspicions to the driver, the teenager had already gotten off the bus. some developing news in san jose where police have arrested twin brothers in connection with a stabbing death of a 22- year-old man. ktvu's robert handa has confirmed with police that officers arrested 18-year-old twins ahn and duke this morning. investigators say the victim, richard phan, was trying to break up a fight at a birthday b.a.r.t. on sun crest avenue in east san jose when he was stabbed. e was rushed to the hospital but no did not survive. we're learning new details in the case of a san francisco police officer charged with

nine counts of child molestation. just a few hours ago, a judge reduced bail or richard hastings which means he could be out on the street soon. here's more. >> reporter: well, richard hastings entered a not guilty plea this morning. it was just over two hours ago that a judge reduced his bail from $910,000 to $100,000. that's despite the d.a.'s efforts to keep him in jail. hastings is -- is a san francisco police officer charged with nine counts of child molestation and for having child morning graphy. his attorney argued he has strong ties with the community and a decorative honor. she said the teen is over 18 and the sex was consensual.

the d.a.'s office said last year concord police confronted a 15-year-old boy on a street corner for a curfew violation, hastings was there to meet up with the teen and have sex with him in the car. they also say he tried to use his authority as a san francisco police officer to get out of the situation. deputy district attorney argued the teen looked young and consent is not a defense. >> when you pick up a boy on the night of the street and you molest that child, you -- as a police officer, you have a higher standard to the community and you have to maintain that high standard to the community. >> reporter: hastings's attorney said she's happy with the reduced bail amount. she said it's fair and hopes he will be able to post it soon. we're looking to learn more about the alleged incidents a happened from june of august last year. we'll have those details at 5:00. back to you. >> all right. thank you.

police at san jose state are warning students to be on alert after several women were grabbed inappropriately on campus over the weekend two incidents happened saturday evening when a man on the bike rode up behind the victims and groped them as they passed. yesterday morning, campus police say three men on skateboards trying to grab a female student near the hall. police are investigating all three cases but believe the skateboarding incidents are different from the man on the bike. a man is in custody after being accused of shooting into a bar over the weekend. police say he had a silver handgun and began shooting inside the red coats pub and restaurant early sunday morning. most shots hit the ceiling but one person was shot in the back. police say he was in possession of methamphetamine when he was arrested. today, councillers are on the campus of matthew turner elementary school in benicia to

help students and teachers cope with the arrest of a long-time teacher. on friday, police rea.ked first grade teacher teresa badger on allegations of serving marijuana-laced food to teacher fellows during an off-campus holiday party back in november. the district superintendent tells ktvu at least eight people became sick after eating the pot-laced food including one person who was hospitalized. the superintendent says badger has been on staff for the past 18 years and her arrest is difficult for everyone at the school. >> they are just here in case somebody needs to talk. they are having a difficult time or are struggling with this if they are struggling. they may not be used but they are here just in case. >> ktvu tried to get a comment from badger but we were unable to reach her. the superintendent has been on paid leave since last tuesday. today, a 14-year-old san jose girl was laid to rest more

speech at 7:30. students at uc berkeley this morning said students are paying too much for textbooks and they want publishers to offer less expensive alternatives. they presented the survey of 2,000 students compiled by the california research group. it found that students are paying as much as $1200 a year for textbooks and even alternatives are expensive and have restrictions on how long they can be used. >> with modern technology, it's totally unnecessary for textbooks to cost this much. the market is broken and students are paying the price.

>> calpirg found the cost of books affect which classes they choose sand how many they take. they found many are not buying the books for their classes. a science building in san francisco state university is closed today an will remain shut down for the rest of the semester after harmful toxins were found there. an inspection of the building earlier this month found asbestos, mercury and peeling lead paint. the university is working with experts to determine any potential leath effects of those -- health effects of those who spent time in the building. the closure affects 10,000 student and faculty who work and study there. >> it was a big impact. a lot of our classes were moved. our schedules were changed. it's inconvenient for us since we have to move away from some of our classes. >> the university is making repairs but says it does not know when the work will be completed. it's not mandatory yet but our dry weather conditions prompting south bay water officials to recommend cutting water usage. the santa clara valley water district is set to vote tomorrow on several new water conservation policies. they include water usage and

appliances and drought resistant plans. since last july, the county has only gotten 1.5 inches of rain. that's just 30% of normal. some south bay residents we spoke to say they don't mind being asked to voluntarily save water. >> i think it's do-able. i think considering the drought conditions we're having right now, it's probably reasonable, too. if you look at the reservoirs around here and the rivers and -- they are pretty dry. >> the santa clara valley water district provides drinking water to 1.8 million people. and we're expecting to hear more about the conditions of bay area vineyards tomorrow. the napa valley grape growers association will provide and update on impact of the drought and talk about what farmers are doing to prevent damage to grape vines. they are expected to issue a declaration in the coming days that will launch special funding and technical assistance for farmers dealing

with the drought. it's not a gold rush but the historically low water levels in rivers and streams has gold prospectors looking for something shiny in placer kook. the gold prospectors association of america says low rivers there are opening up areas that have not been touched by man in decades, if not over a century, says people panning for gold could find flakes and nuggets that would normally be submerged. the fog came back. it's a little cooler here. we had thick fog hanging on, napa, santa rosa. kind of cool. higher clouds drifting. a lot of high clouds. not much happening else. maybe some rain developing on the north coast. this is taking aim towards the northern part of the state and also up in washington and oregon. that's where the jet stream is. clouds are spilling over.

el granada, the sun is out there. there's some areas on the fog where it's pulled off the coast. it will be a nice day. inland areas get a lot of these clouds. it looks like the systems, we hope they bring us rain. it's looking weaker and weaker, morning fog giving way to mixed sun and clouds. a lot of clouds, maybe some rain to the north but the question is will it drop far enough south, i think we'll get drizzle. hopefully some rain will make it into the north bay. one forecast model just came in and shows no rain at all for us. things might be changing here. 50s on the temperatures. very, very low 60s. a lot of 50s. it's very, very cold, continuing. these are the current temperatures at noon. well, noon to us. 2:00 their time. they are issuing all sorts of freezing rain advisories down to the deep south even into new orleans. it will make its way to new york, which is 39. i think i saw a 43 things are

better. a couple of systems moving through. it will add to what looks like a wild week for most of the country. for you, the systems continue to drag across a lot of high clouds. on the mild side, partly sunny, mostly cloudy. 48 in tahoe. very mild there. it's not this system we're worried about. you can see where this is driving. it's the one out here. that's the one we hope has a little bit of oomph to it. it's a cooler pattern. there will be clouds. that's for sure. but any rain, we'll have to wait until late wednesday or thursday. right there. that's what our forecast model does. that's it. that's it. that's not a lot. afternoon that, things like look they go dry. high clouds, 60s, maybe isolated 70s down towards gilroy. but that would be it. it will be a cooler week as temperatures slide into the upper 50s low 60s by wednesday and thursday. still some patchy fog. higher clouds, cooler. partly cloudy. temperatures, though, in the 60s here. 50s and 60s. just a little bit more of a westerly push on these clouds and it's not that easterly

and the s&p is flat. federal safety regulators may tell toyota to recall thousands of its camry hybrids because of problems with their brakes. regulators are investigating complaints that power assisted brakes in those cars can fail without warning. the investigation covers about 30,000 camry hybrids from the 2007 and 2008 model years. the national hmp traffic safety administration has received 59 complaints. the loss of power brake assist causes increased stopping distancens and requires more pedal pressure to stop the car. two crashes have been reported but no injuries. a bay area latin jazz group was among the grammy winners last night. ♪ >> the pacific mom mumba.
