we had an accident westbound 4 at bailey road. it's been pushed to the side. when i say it looks okay because it is slow out of the antioch area to concord. but there are no major crashes blocking the lanes. 680, the same think. we had a minor accident nearby. north main. it was not -- ibts it's not in the lanes now. the toll plaza, 25-minute total drive time into san francisco. about 15 minutes waiting before you make it on the bridge itself. in san jose, northbound 101, 280 and 85 are getting slower throughout the area. 101 is slow. the expressway, a little bit slow because of an earlier crash near 280. let's go back to the desk. >> thank you, sal. and breaking news in belmont. this is about the search for a missing autistic teenager we've been telling you about since 4:30 this morning. tara moriarty is at the police station where we've learned just a few minutes ago, the teenager has -- was found safe. and tara joins us with

exclusive video of the teenager arriving with officers. good morning, tara. >> reporter: good morning. about a half-hour ago, we saw a couple of squad cars pull out of here very quickly. we wondered if perhaps they had found a teen and it turns out they did. a happy ending to this story. tyler simmons has been found. we saw him walking to the station a few minutes ago with an officer. he liked perfectly fine. his parents three minutes ago came and picked him up. he was sleeping on san carlos avenue, spotted by somebody. he woke up by the time police arrived. they were able to locate him. but tyler edwards, found safe. his parents were very concerned about finding him. but we're happy to report that this student has, indeed, been found this morning. live from belmont, tara moriarty, ktvu channel 2 news. memorial services begin tonight for the b.a.r.t. police officer who was

accidentally killed by another officer one week ago. the public viewing for tommy smith begins tonight at the chapel of the chimes on mission boulevard. the funeral will begin at 10:00 a.m. tomorrow in castro valley. that service will be at the neighborhood church of castro valley on john drive. b.a.r.t.'s police chief announced immediate policy changes as a result of last week's tragic shooting. sergeant smith was killed as he and other several officers searched a dublin apartment for a robbery suspect. yesterday, kenny rainey announced b.a.r.t. officers will need written approval for any future probation searches. he said the lack of police training played a role in this tragedy. >> we can train the people every day and have them perform on the field. on the off days something like this could go wrong. >> the police chief confirmed

for the first time. it was officer michael maes who fired the deadly shot that killed sergeant smith. the chief would not confirm reports that maes mistook sergeant smith for an armed suspect during a search of the apartment. officer michael maes will be among the hundreds of people at tomorrow's funeral for sergeant smith. one of officer mae's brother talked about his brother's pain and sadness during this exclusive interview with ktvu news. >> michael is very remorseful if you will and very sad. >> coming up for you at 7:30, we'll have more on this heartbreaking interview you will see only on 2. san rafael police are investigating a deadly accident involving a man on a motorcycle. it happened last night on smith ranch road. alex savidge joins us now with more on the crash and the investigation. good morning, alex. >> reporter: good morning to you. some neighbors believe the motorcyclist in this case was

going way too fast when he lost control last night. although san rafael police at this point can't say if speed was a factor in the crash. we know the man was thrown from his bike here on smith ranch road and he was found by officers lying here in the median last night. the man died here at the scene. the motorcyclist was -- the make i should say was found a good distance up the road from where the man was found. the accident was just after 7:30 last night. there were no other cars involved here. police tell us the victim was a 43-year-old man who lived here in san rafael and he was wearing a helmet when he crashed. now, the speed limit on this street is 35 miles an hour. one neighbor told me some people drive 50, of 60 miles an hour. >> people drive like mainny acs on this road -- mayny acs -- maniacs on this road. i've been been hit a couple of times. >> reporter: this was the third

deadly crash. there was a pedestrian hit and killed by a car. in early january, someone was hit and killed by a dump truck near the downtown transit center. i asked police if there may be additional enforcement. they say it's too soon to say if anything will be done. the san rafael police department will return to this crash scene on smith ranch road later on today to continue to investigate and trying to understand exactly why this motorcyclist lost control last night. live this morning in san rafael, alex savidge, ktvu channel 2 news. 7:08. president obama will deliver his fifth state of the union address tonight. here you can take a look. see the president last night putting some finishing touches on his speech. coming up for you at 7:15, we'll get a live report from washington, d.c. on what is expected to be the main theme of tonight's address.

the latest documents leaked by edward snowden indicate the u.s. and british governments are getting personal information from smartphone apps. the spy agencies have been gathering information from smartphone games like angry birds to collect user locations, phone logs, address books and even sexual preferences according to the documents. one document calls special editions of angry birds, farmville and call of duty a "particularly rich information source." >> i think it's terrible. i think as united states citizens, we're protected by the constitution. i think it violates four fourth amendment rights. >> the nsa says it does not target americans and that most of the data collected is inadvertent. now, internet companies, including facebook, yahoo! and google will be able provide more reassurance that they respect their user's privacy.

under a settlement with the nsa, tech companies will be able to provide more details about government requests for user information. the companies will be allowed to say what categories of requests are received but they still can't say the exact number of requests made to them by the government. 7:089. san francisco is on the verge of becoming the next major u.s. city to approve a measure known as ban the box. now, that law prohibits employers and lawmakers from asking applicants up front if they have ever been arrested or convicted of a felony. ex-offenders are often asked to check a box revealing their past troubles with the law. san francisco supervisors are expected to approve a ban the box measure in the city sometime this year. 7:10. in just about 90 minutes, the sonoma county board of supervisors will discuss a new program for the homeless. it will allow them to sleep overnight in cars on sonoma county fairgrounds property

between february 1st and april 30th of this year. it would also provide up to $50,000 in motel vouchers for the homeless during severe winter weather. and livermore city council is considering a new proposal that targets the homeless. a first reading of the proposal happened at last night's meeting. it would ban urban camping, the city's mayor says the goal is to clear encampments and get people into shelters. critics say finding people and threatening them with jail time is not the solution. you can find people who have no money. i mean, that's laughable. so the next choice is, you are gonna put them in jail? >> that's not the point. it's not the issue. it gives us the authority to remove encampments. that way protecting public health. a second reading of the ordinance and vote would come at the next city council meeting in two weeks. 7:11. some tough questions from parents after reports of a

this welcome back. 7:14. happening today, during his state of the union speech tonight, president obama will announce that some minimum wage workers are about to get a raise. the president will issue an executive order to make it happen. but as kyla campbell reports

from our washington, d.c. bureau, not all of the minimum wage workers will see that boost. kyla? >> reporter: president obama's executive order will increase the minimum wage for new federal contract workers. instead of $7.25 an hour, they would get $10.10 an hour. the proposal would raise the minimum wage for those workers in stages. for kitchen and laundry employees on military basis, construction workers at government building states among others. president obama will call on congress to increase the federal minimum wage to 10.10 for all employees nationwide. but republicans argue employers would then cut workers and hours. white house officials say president obama wants action even if he has to make decision without help from capitol hill. >> the president's view is that he should use every tool available to him. >> i've got a pin and i've got a phone. that's all i need. >> >> reporter: the white house

says we will here -- opportunity, action and optimism. ed lee will be a guest of the obamas at the state of the union address. mayor lee is also working to increase the minimum wage in san francisco. live in washington, kyla campbell, ktvu channel 2 news. two women are delivering the republican response for the first time to the state of the union address. kathy mcmorris-rogers will give the official rebuttal to president obama's speech. florida congresswoman eliana will give the spanish version of the response. and kentucky senator rand paul will deliver his own response to president obama's address which he will post on youtube shortly after the president finishes. mike lee of utah, he will deliver the tea party response to the president's state of the union address. a spokesman says the senator will address the real causes of

>> we're just checking. i was just gonna say we don't have a lot of crashes. whenever i say that, i put my foot in my mouth. starting with northbound 280 as you get up to highway 17, these things they can change at a moment's notice. right now, i'm not seeing any crashes on 280. 85 or 101 when it comes to the south bay traffic. there are no major problems as you drive through. let's take a wider look at the south bay now with the maps. you can see the road sensors are showing some slow traffic here and there but nothing major as you drive through the south bay. let's take a look at drive times. highway 4, from lone tree to loverrage, four minutes. not too bad. this is a look at the bay bridge toll plaza. that's backed up for a 25- minute drive in into san francisco. let's go to steve. look at this, sal. >> beautiful. >> there you go. >> all right. cody up in ukiah, stephanie in lakeport and tony up at cobb mountain light rain.

not things are beginning -- things are beginning to jet used up in the atmosphere. it's been -- to get used up in the atmosphere. it's been so light. i think .03 in ukiah. we'll take anything we can get. a lot of cloud cover. some of that will continue to stream in. points north will get light rain. for us, it's really mild. 40s and 50s. concord, buchanan and 53. casey has 55. same for sfo, half moon bay, 52. san jose, 50. i think you get the idea, a lot of cloud cover means very mild temperatures. you can see some of that rain beginning to stack up a little bit. most of it is moving north towards del norte and humboldt county. chloe in clearlake says there's been light rain. but there's not a lot here. you can see the ridge of high pressure continues to send everything well to the north. our best bet will be here. that will be late wednesday into thursday. unfortunately, after that, i

a special u.s. representative from north korea is urging north korea to pardon kenneth bae. now, bae is an american citizen. he was arrested in north korea in november 2012. he's accused of crimes against a country he was sentenced to 15 years of hard labor. the u.s. representative says

bae is in poor health and needs to return home. now, north korea has made no comment on this appeal. bae's mother and his sister, they are scheduled to meet with secretary of state john kerry later today. back here at home, a san francisco police officer charged with child molestation is due back in court in march. he was wearing a jailed jump suit instead of his police uniform during this court appearance yesterday. he's accused of molesting a 15- year-old boy in contra costa county last summer. hastings's lawyer says the relationship was conseen ual. prosecutors say the police officer poses a risk to everybody. >> police officers take oaths to protect and because of that, and because of using and taking advantage of that it's in my opinion that he is a risk to the community. >> now, officer hastings was involved in another high- profile case two years ago. he received a medal of valor

for his response in the controversial shooting death of kenneth harding junior. hastings and another san francisco police officer exchanged gunfire with harding during a confrontation in the bayview district. police say that harding shot himself in that exchange. 7:25. legendary folk singer and social activist pete seeger died last night at a new york hospital. ♪ >> seager was best -- seeger was best known for "where have all of the flowers gone" and "if i have a hammer." he marched for many causes starting in the 1960s and was part of the occupy wall street movement in 2011. his family said he died of natural causes at the age of 94. donations are pouring into the sonoma humane society this morning after the agency rescued 61 dogs from a puppy mill in shasta county last

[laughter] >> if crescent city is only getting a .01, there's not much. there's been a little bit in lake county, mendocino county. a little fog here. mostly cloudy day. there will be very, very light rain to the north. 50s on the lows for most. there is a lot of upper 40s. novato, napa and santa rosa. but for the few locations, you can see some of that cloud cover streaming in. but again, very, very light rain. probably looks better for wednesday night into thursday. that will be the best opportunity by far because after that it doesn't look like there's much. for the bay area, it looks like a cloudy, mostly cloudy day. temperatures are starting to cool down a little bit. you would expect that with more of a west wind and a lot of cloud cover. some thick fog in spots kind of late to the party. cloudy to the north. maybe a few breaks to the south. a mostly cloudy day.

mainly 50s on the temperatures. a few 60s. here's sal. we're looking at traffic as peak right now. the bay bridge is backed up beyond the 880 overcrossing here for the toll plaza. you are looking about a half -- you are looking at a half- hour to get into san francisco. we've been looking at 580. it's still very slow coming from the altamont pass and then 680 is slow out of pleasanton until you get down to fremont. it gets better. you see some slow traffic there. 880 southbound, heading into the south bay is slow. 237 is slow at 880. back to the desk. >> thank you, sal. there are changes to security at the college of marin after a man was sexually assaulted after leaving class

last week. brian flores is live to tell us about the changes. >> reporter: the kidnapping and sexual assault was reported in parking lot 13, which is about two or three blocks from where we're standing. but since then, the campus has made changes to safety to make sure the students are safe. i want to go to new video. that photographer sid farhang shot of flour or five flood lots installed over the weekend in parking lot 13. previous there are no lights. they are increasing the number of on-duty campus police officering. also in terms of the parking lot itself, the college also says it will now close it after 5:00 p.m. when it starts to get dark. this comes after a man was reportedly sexually assaulted and kidnapped while leaving class around 8:15 last thursday night. when the man got into his car at lot 13, another man was already in the back seat and ordered the victim to drive off campus to a location somewhere in southern marin.

the suspect then sexually assaulted the man at gunpoint. police say the victim was able to run away and was treated at -- nearby for injuries at a nearby hospital. we spoke with students this morning to get their reaction of what happened last week. >> i'm really scared because i come to school on thursday, and i leave at 9:00. i've taken previous classes before. i leave almost at the same time all of the time. so i feel pretty insecure. >> reporter: we have limited details on the suspect. police are continuing to look for him. he's described as a plaque male between 6 feet and 6'2" and 220 to 250 pound. we have calls into the sheriff's department of marin leading the investigation as well as school officials. we've not heard back yet. but we understand that a school official is on his way to give us an update on the other changes that may be coming as a result of what happened last week. we're live in kentfield, brian flores, ktvu channel 2 news.

7:34. tough questions expected this morning from the family lawyer of a 6-year-old student at an el sobrante school. that's after reports the girl was inappropriately touched on campus. the girl's mother tells ktvu the alleged attack happened last week at east bay waldorf school. the mother says her daughter was pushed to the ground by one or more boys who took off her clothing and touched her. however, school administrators tell ktvu that the boys pushed the girl to the ground but did not take off her clothing or have any inappropriate contact. the richmond police department says they are just starting the investigation. 7:35. memorial services begin tonight for the b.a.r.t. police officer who was accidentally killed by another officer one week ago. the public viewing for sergeant tommy smith will begin at 7:00 tonight at the chapel of the chimes on mission boulevard in hayward. the funeral will begin at 10:00 a.m.

tomorrow in castro valley. that service will be held at the neighborhood church of castro valley on john drive. officer michael maes will be among the hundred of people at the funeral and one of maes 'brother discussed his sadness. ooches he said his brother and sergeant smith were close friends and golfing buddies. he said the tragic accident is a nightmare for everyone connected to the b.a.r.t. police force. >> it's something that stays with you. it's something that hurts. and it's -- its unimaginable. >> john maes says family members have been staying with his brother to provide him support since the deadly shooting one week ago. 7:36. it's possible, you heard steve, we may get rain this week. however, bay area water

district, they are still worried about the drought. today zlar's water district will meet and talk about -- santa clara's water district will meet and talk about a 10% voluntary reduction. marin county supervisors will talk about what action they should take. they already have voluntary water restrictions in place. ktvu has learned by the end of the week, san francisco's expected to call for water use cutbacks. other areas with voluntary restrictions, include alameda county and santa cruz. >> people want to help in any way possible. i think it will be okay. there's plenty of ways to save. >> some of the water districts say they could put restrictions in place by the end of february. today we'll find out more about the condition of bay area vineyards. a napa grape growers association will give an update on how the drought is impacting the area. it will also talk about what

farmers are doing to prevent damage to the wine grapes. the usda is expected to issue a declaration in the next couple of days that will provide special funding as well as technical assistance for farmers. now, on our channel 2 website, ktvu.com, we've got a special section dedicated to the drought. you will find up to date information on restrictions in your area and which reservoirs near you are hit the hardest. just check it out. look for hot topics on the home page. 7:38. the cost of parking on the streets in downtown san jose could be increasing quite a bit. the city council is considering a plan to install smart meters downtown. janine de la vega joins us from san jose to explain why this may happen and how high the rate could be. good morning, janine. >> reporter: good morning, tori. right now, it costs a dollar an hour if you park here downtown in one of these coin-operated meters. it's been that way since 2002, the price has not budged.

if smart meters are not installed, the cost could go up to $2. the city is set to install solar meters in the downtown area. they are similar to these ones that you aring looing at that -- are looking at that were installed in walnut creek. this will allow users to increase time by using an app on their cell phone. they can receive an alert before it expires. the cost is $1.3 million. to pay for it, the city may double the parking rate. we spoke to people who work downtown about what they thought. >> there's too many things running our lives. it's another tracking device in our society. that's why i don't like them. >> it's inconvenient to look for rains when we go to the market and park horn the street

but to -- park on the street, but to raise the cost, i would like to see the cost go down. >> reporter: transportation officials say the current meter rate is significantly lower than other cities and the rates that are charged in san jose's parking garages. city officials want the new meters because the current operators don't accept cards and have no reporting capabilities and are powered by batteries that need to be replaced. this will be voted on by the city council on february 4th. the new meters will be installed by the end of march. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you. house speaker john boehner is encouraging his republican colleagues to approve a farm bill when it comes up for a vote tomorrow. the five-year farm bill would boost phone mor crop insurance and ease cuts to the food stamp program. the house rejected a farm bill in june after conservative republicans said cuts to food stamps were not big enough.

7:40. still freezing cold in the midwest. that cold is heading into the southeast. take a look at this video of the winter storm in ohio. schools from eastern texas into the florida panhandle have canceled classes today before the freezing weather hits there. rain, sleet, snow, all in the forecast. power outages are expected. the forecasters say some of these cities, they haven't seen winter weather like this in 25 years. flights have been canceled because of the freezing weather. the airline say the snow and ice on the east coast also causing a lot of delays. sfo, for instance, already canceled more than a dozen flights. some flights into oakland were canceled but departing flights, they are now taking off okay. san jose mineta airport, not reporting any problems. now, if you are catching a plane today, you are advised to call ahead, check on the status of your flight.

7:41. san jose mineta airport is pushing for more passengers to fly from their airport to southern california instead of going to sfo and oakland. they have released this new ad which says why drive north to fly south? the airport says it has some of the best on-time departure and arrival rates from southern california and it mentions specifically the lack of fog, which often causes delays at sfo. >> yeah, we know that, tori. 7:42. the san francisco bulls' hockey team are calling it quits. the minor league team started playing at the cow palace in october of 2012. they only lasted one and a half seasons. they've been trying to find a new owner but a deal is never finalized. the bulls were affiliated with the sharks. they played at the tank with the nhl lockout. the team is offering refunds for upcoming games. the san francisco giants are shooting new commercials and you fans, you've got a chance to star in these

he tried to break up a birthday party in piedmont police. police arrested the suspects yesterday after getting information from witnesses. the twin brothers are due in court tomorrow. police in oakland are investigating a deadly shooting outside of a walgreens store in east oakland. it happened in the parking lot on high street near interstate 580 about 9:00 last night. police are hoping to check surveillance video this morning to get clues for their investigation. a couple of minutes later, there was another shooting in oakland, just miles away on hide street near peralta hacienda historic park. the man was taken to a local hospital. he's expected to be okay. so far no arrests have been made in either case. we're learning disturbing new information about the pennsylvania college student from the bay area charged with possessing a weapon of mass dez trucks. the 18-year-old is a russian citizen who graduated from

carlmont high school last year. police say he admitted experimenting with explosives whilive willing here in the bay area. the -- while living here in the bay area. the fbi says some of the bombmaking material found in his pennsylvania apartment was imported from china. >> like all bombmaking material, it depend what it will be used for. these items are used in the making of fireworks. >> investigators also say the teenager planned to go to a remote area of pennsylvania to set off the explosives but he was reportedly too afraid to detonate his homemade bombs. tickets go on sale this morning to see the dalai lama at santa clara university next month. the spiritual leader will give a talk on business, ethics and compassion from the heart of the silicon valley. his talk is scheduled for february 24th at 10:00 a.m. this is part of a swing through the bay area that includes an appearance in berkeley the day

welcome back. 7:55. a san francisco firefighter filed a legal claim accusing the fire department of defaming her in connection with the asiana plane crash at sfo. take a look at the video from a firefighter's helmet camera of the crews responding to that plane crash. in the claim, firefighter elise duckett said her name was released media. she was identified as the one who drove over a 16-year-old girl and killed her. however, miss duckett said another firefighter struck the girl first. duckett said she's being discriminated against because she's african-american and also a lesbian. 7:56. the san francisco family has filed a wrongful death suit against uber for the death of a

6-year-old girl killed in a traffic accident on new year's eve. sophia liu, her mother and brother were in the crosswalk at polk and ellis streets when investigators say they were hit by the driver. sophia's mother and drawer were hurt. the little girl was killed. the lawsuit said the driver was logged onto uber's app and was available to pick up passengers. >> available for people to pick him as a driver which is the very essence of uber's business. without those people having empty cars, uber has no business. >> uber says since the driver was not carrying any passengers, he was not actually working for the company at the time of the accident. so far, the driver has not been charged. 7:57. the police in palo alto say if you have a rental car, be aware of break-ins. at the fish market restaurant, this parking lot is a lot zone where the windows of nine cars were smashed in one night. several of the vehicles were

you can see -- traffic time has been slow. there's a stall out there. you might be able to see the tow truck on the side of the road. this is taking about 20 minutes to cross a bridge where normally it takes about half that. and then you are waiting a little time to get on the bridge to begin with. the drive times are up a little bit here. if you are driving to the south bay, the south bay all of a sudden has a lot of drive times that are slow. 85, 101, 280, slow traffic as well. if you are driving on the drive to mountain view, and over to the peninsula. do want to mention the bay bridge, that's backed up for about a ten-minute delay and another ten into the city. about 20 minutes to get across. 8:03. back to the desk. we have new information about the search for a missing autistic teenager in belmont. he was found safe about 90 minutes ago. tara moriarty is at the belmont police station where -- you have exclusive video of the return of the teenager and, tara, you found out a ktvu viewer played a role in bringing him home safe. >> reporter: that's right. good news all around.

the officer said that the tip actually came from a ktvu viewer who saw our broadcast and decided to call police. the boy had apparently been wandering around all night so he was in a little bit of a shock. but otherwise pretty good shape. tyler edmond simmons walked into the police station with an officer shortly before 7:00 this morning. ten minutes later, his parents came by to pick him up. according to dispatch, he was sleeping somewhere on san carlos avenue near alameda right at the belmont border about a mile from carlmont high school. that's when the ktvu viewer saw him. he had been woken up -- he had woken up by the time police arrived. they looked around a little bit. they were able to find him. he's 16 but only has the mental capacity of an 8-year-old. he can be pretty antisocial. so his parents were quite concerned about finding him. we're happy to report that he has been found this morning. a nice ending to the story. live from belmont, i'm tara

moriarty, ktvu channel 2 news. >> thank you, tara. memorial services begin tonight for the b.a.r.t. police officer who was accidentally killed by another officer one week ago. the public viewing for sergeant tommy smith begins at 7:00 at the chapel of the chimes on mission boulevard in hayward. the funeral re-- begins at 10:00 a.m. tomorrow. that service is at the neighborhood church the castro valley on john drive. the police chief has announced changes. sergeant smith was killed as he and other officers searched for a robbery suspect in a dublin apartment. chief rainey says there will be need to be written approval for the search of suspects. >> we can train our people every other day and have them

perform out on the field on the off days, and probably something like this could go wrong. >> the police chief confirmed for the first time it was officer michael maes who fired the deadly shot that killed sergeant smith. however, the chief would not confirm reports that officer maes mistook sergeant smith for an armed suspect during the search of the apartments. officer michael maes will be among the hundreds of people at the funeral. one of maes's brother discussed that and his pain during an interview with ktvu news. >> michael is very remorseful, if you will, and very sad. >> reporter: coming up at 8:30, more of that heartbreaking interview you will see only on 2. police in san rafael investigating a deadly accident involving a man on a motorcycle. it happened last night on smith

ranch road. ktvu's alex savidge here now with more on the crash and alex, the investigation is underway. >> well, good morning. some neighbors in this area reported seeing this motorcyclist speeding shortly before he lost control. san rafael police at this point are not saying if speed was a factor in last night's accident. the man was thrown from his bike as he was riding along this section of smith ranch road at about 7:30 or so last night. he was found right there in the median by officers who first arrived here on scene. the man died here at the crash scene. his motorcycle was found a good distance up the road. there were no other cars involved in this accident according to police. they say the victim was a 43- year-old man from here in san rafael. he was wearing a helmet at the time of the crash. the speed limit on this street is 35 but one neighbor told me some people drive 50 to 60 miles an hour. >> it's four lanes. people race each other and there's rarely any policemen out here enforcing the speed.

it's dark. and it's long. all of those things. >> reporter: this was the third deadly crash on city streets in san rafael. in mid-december, a pedestrian was hit and killed by a car while crossing civic center drive. in early january, someone was hit and killed by a dump truck near the downtown transit center. an an officer i talked to morning couldn't say if there would be stepped up enforcement regarding these accidents. we understand the major accident team will return back to this crash scene here on smith ran of road at some point -- ranch road at some point. alex savidge, ktvu channel 2 news. >> thank you. alex. happening today -- in his state of the union address tonight, president obama will tell congress he is prepared to

use his executive power if lawmakers won't take action. as an example, the president will announce he's going to sign an executive order to increase the minimum wage for federal contract workers. the rate will go from $7.25 an hour to $10.10. the president will say that he wants to work with congress on issues such as immigration reform but he'll say if they won't act, he will. >> mindful of congress's reluctance to be cooperative at times, the president is going to exercise his authority. he's going to use his pen and his phone. >> i think that with the debt ceiling vote coming up and things like that, that's set -- that's kind of throwing down a gauntlet to the republicans and challenging them to go against him. >> for the first time two republican are delivering the republican response to the state of the union address tonight. washington congresswoman kathy

of republicans and the cal democratic club plan to be here. this will be held in the united states stut interstut of government library. our coverage begins at 6:00 after the news at 5:00. we'll have a special edition. news after the president's address. 8:11. former intelligence analyst edward snowden has released more documents than these ones indicate. phone apps are being used to gather information on people. american and british spy agencies are using downloaded games like angry bird as well as google maps to get personal information. that can include user locations, address books and marital status according to the released files. one agency even falls special editions of games like angry birds a treasure trove for data

collection. >> electronic devices are feeding each other information. it's scary how fast your information travels. >> it's something that you wouldn't expect out of a game in your phone. i don't think it's right. >> the nsa says it does not target americans when it is gathering information. meanwhile, internet companies including facebook, google and yahoo! will now be able to provide more reassurance that they respect users' privacy. under a settlement with the nsa, tech companies will be able to provide more details about information requested from the government. they will be allowed to say what categories of requests are received but they still can't say how many times the government asks for information. members of the postal service union will protest against an agreement made between the postal service and staples. this is video from december of a similar protest held in berkeley. in october, the usps an announced an agreement to open postal counters in 80 staples

after several days of violent protests in ukraine, the country's prime minister submitted his resignation today. in a statement on the government website, the prime minister says he is resigning to encourage a peaceful resolution of the conflict. he was asked, though, to stay on in an acting role until a new government was formed. also today, ukraine's parliament repealed antiprotest laws that triggered violent clashes between protesters and

police after they were put in place this month. a u.s. cargo ship is heading to the mediterranean at this hour. it will help in the destruction of some of the deadly chemical weapons now being removed from syria. the cape ray carrying two huge machines that will help break down the toxic weapons. this is an effort to dismantle syria's poisonous gas. as we get closer to super bowl sunday, security in new york and new jersey is getting tighter. super bowl has been declared a level 1 national security event which means heightened security precautions for terrorist activity. an x-ray is scanning every vehicle and fg that is prout into -- everything brought into metlife stadium will be scanned. >> we're x-raying every piece of equipment, cargo, beverage, seat cushion, piece of merchandise, food, everything going in the stadium has to be

x-rayed before it goes in. >> the fbi set up a joint operations center in newark. agents are looking into information that may be related sot to the bole. a new jersey man is really upset with stub hub after his dreams of going to the super bowl were crushed. he bought two tickets for sunday's super bowl on stub hub for $480. most tickets were selling for three times that day. turns out the person who listed the tickets left out a zero at the end of the price. and stub hub refunded dolan instead of honoring that ticket price. the company said honoring the price is against their policy and that would set a precedent that encourages fraud. well, you can watch the super bowl right here on ktvu channel 2. kickoff set for 3:30 this sunday afternoon. 8:18. a new passenger boarding area at san francisco international airport is scheduled to officially open for business

today. we got a sneak peek at terminal 3's boarding area e last week. it features eight retail stores, four restaurants, some popup stores and a yoga facility. united airlines plans to start with four lights from terminal e and add more throughout the week. i went to a yoga place at the dallas airport last week. >> how was it? >> nice. >> i had a five-hour layover. 8:19. will we need yoga to go on 880 in oakland? >> well, you might want to be a little zen. you might want to bring your goodatety good attitude or your downward dog. i don't know what it is. traffic is recovering from a motorcycle crash. it wasn't that serious. the driver was up and walking around. i want to show you on a map what the road sensor is saying.

8:25. new this morning, a special u.s. representative for north korea is urging north korea to pardon kenneth bae. he's an american citizen who was arrested in north korea in november 2012. he's accused of crimes against the country and was sentenced to 15 years of hard labor. the u.s. representative says bae is in poor health and needs to return home. north korea has not commented on this appeal. bae's mother and sister are also scheduled to meet with secretary of state, john kerry,

later today. a san francisco police officer charged with child molestation is due back in court in march. officer richard hastings of concord needed not guilty in contra costa county court yesterday. he's accused of molesting a 15- year-old boy last summer. hastings's attorney said the relationship was consensual. but prosecutors say the officer poses a risk to everyone. >> police officers take oaths to protect. because of that and because of using and taking advantage of that it's in my opinion that he is a risk to the community. >> officer hastings was involved in a high-profile case two years ago and received a medal of valor for his response in the controversial shooting death of kenneth harding, junior. hastings and another san francisco police officer exchanged fire with harding in the city's bayview district. police say harding shoot himself in that exchange.

some sunbreaks around mainly to the south. 60s for most on the temperatures. here's sal. we're looking at traffic that's still busy. we've had improvement in the 8:00. i want to say if you can get into san francisco, we can start there. it's backed up for make a five- minute delay and ten ten- minutes into the city. the trip isic taking 15 minutes. that's your drive time now which is not bad for this time of the morning. let's take a look at interstate 880. they've had an earlier motorcycle crash. no one was seriously injured. still a lot of slow traffic on 101 in santa clara valley, especially trying to get into sunnyvale here. as we look at the peninsula, southbound -- i'm sorry, northbound 101 at university avenue word of a new crash there. 8:32. let's go back to the desk. there are changes to security at the college of marin after a man was kidnapped and sexually assaulted last week after leaving class. ktvu's brian flores, live at

the colleges kentfield campus to tell us how campus security is changing. >> reporter: the sexual assault and kipping was reported on parking lot 13. this is a temporary free parking lot that at the time didn't have any lights. since that time, the college has made several upgrades to keep students safe. this comes after a man was reportedly sexually assaulted and kidnapped while leaving class around 8:15 on thursday night. according to marin county sheriffs when the male student got into his car at lot 13, another man was already in the back seat and ordered the victim to drive off campus to another location somewhere in southern marin. the suspect sexually assaulted the man at gunpoint. police say the victim was able to run away and was treated at a nearby hospital for injuries. now, since then, the campus has made security upgrades including installing five flood lights in parking lot 13. these will be removed because officials said a new gate will be going up starting today.

they have added more campus police officers as well. but the installation of the gate will come in conjunction with new hours for the lot as well. >> that was in lieu of putting up a gate. that will go up today. once the gate goes up, we'll be able to take the flood lights down mainly for the benefits of the neighbors behind us. they've never had lights like that in the parking lot. that's why we're trying to close the lights before it gets dark. >> reporter: we have limited details on the suspect. police describe the suspect as a black male between 6 feet to 6'2" in height and between 220 to 235 pounds. the marin county sheriff's department is leading this investigation asking for any witnesses to come forward. campus officials say they will be holding a series of town hall meetings to talk about this case as well as campus security to students and staff. the first one tomorrow night at 6:00 here. another one manned for tomorrow

-- planned for tomorrow. campus police say this is rare. the last time this happened was back in 2006. we're live in kentfield, brian flores, ktvu channel 2 news. >> tough questions are expected for the family attorney of a 6- year-old student at a el sobrante elementary school. this is after reports a girl was enfrowp yitly touched on campus. the girl's mother says the attack happened -- inappropriately kuched on campus. the girl's mother said the attack happened and was pushed to the ground by one of the boys who took off her clothes and touched her. school administrators say the boys did push the girl to the ground but did not take off her clothing or have any inappropriate contact. richmond police say they are investigating this story. 8:35. memorial services begin tonight for the b.a.r.t. police officer who was accidentally killed by another officer a week ago. the public viewing for sergeant tommy smith begins at 7:00

tonight at the chapel of the chimes on mission boulevard in hayward. the funeral will begin at 10:00 a.m. tomorrow morning in castro valley. that service will be held at the neighborhood church of castro valley on john drive. now, officer michael maes, the officer who pulled the trigger in that shooting he will be among the hundreds of children at the funeral. one of officer maes's brother talked about officer maes. he says the tragic accident is a nightmare for everyone connected to everyone connected to the bart police force. >> it's something that stays with you. it's something that hurts. and it's unimaginable. >> john maes says family members have been staying with his praur to give him support

-- brother to give him support since that deadly shooting one week ago. it is possible we could get some rain this week but bay area water districts are still concerned about the drought. today, santa clara district is meeting to discuss a voluntary 10% water reduction. the marin county board of supervisors will meet later this morning to scuts what further action it should take. it already has voluntary water restrictions in place. ktvu has also learned that by the end of the week, san francisco is expected to call for cutbacks. other areas with voluntary restrictions include alameda county and santa cruz. >> i'm one one of these -- i'm one of these people that will help in any way possible. i think it will be okay. there's plenty of ways to stay. >> some say there could be mandatory restrictions put in place that could mean a rise in

water rates. is the city takes away coin high pressure-operated meters, these meters -- people are saying that -- if they are taken away it might hurt downtown businesses. people may choose to go to another part of the city to eat or socialize where park something free. city officials say the coin-

operated. people can use their cell phone and would be able to get apps and get alerts. the cost of the new estimate is $1.3 million. the rate would increase from $1 to as much as $2. you live in silicon valley and -- everything was up, up, up. i don't think it's a good idea, though. i think we should keep the meters. they work fine. it's maybe inconvenient but it still works fine. i don't think you need to double the cost. >> the current dollar rate for the parking meters in san jose has not increased in 11 years. transportation officials say it's significantly lower than the rates charged in san jose's parking garage and at meters in bay area cities. the technology was tested downtown in a pilot program. the city showed it rated well

been canceled. san jose nin net tau is not reporting -- mineta is not reporting any problems. passengers are advised to go online and check the status of their flights before heading to the airport. the santa cruz fire department will review water rescue policy after a man on a boogie board died over the weekend we're told the 46-year- old man from mountain view declined help from rescuers. the fire department says live guards are allowed to close beaches and swim -- to swimmers and surfers when the surf is very large and dangerous. however, city law is not clear when it comes to whether people can be rescued against their will. the fire department is hoping to get more clarify about that today from city officials. tickets go on sale in just about 20 minutes to see the dalai lama at santa clara university next month. they cost $130 each and are limited to two tickets per order. the spiritual leader will give a talk on business, ethics and compassion from the heart of

and is with his parents. he was found about 6:30 this morning after being reported missing this morning. tara moriarty, you've been on the story since 4:30 this morning, you have video of the teen arriving. and how a viewer helped bring him home. >> reporter: that's right. you know, apparently the boy was in a little bit of shock when the police found him. but he physically was okay. we saw him come into the station here. we're at the belmont station. he seemed to be fine. all is well that ends well. joining me live is kasten pat atlantic with belmont police to tell more about what happened. we're excited that somebody watching our news was able to help you out. >> apparently a viewer was trirning on san carlos avenue at around 6:30 and saw the young man asleep amongst some trees by the side of the road. he called us right away. we sent units over there and we found the young man.

>> reporter: and he seemed to be in good shape. >> he's unharmed. apparently this all stemmed from a disagreement for an argument that he had with his parents over a cell phone. no foul play. he's unformed. >> reporter: he's 16 but his parents say he has the mental capacity of an 8-year-old because he has autism. >> that's correct. one of the things that had us concerned. we had search teams with dogs from the san mateo rescue search department. >> reporter: again, the teen has been found and the parents have come to pick him up. he should be at home resting after having an incredible night wander around all night not getting much sleep. i'm tara moriarty, ktvu channel 2 news. >> thank you. 8:48. we're learning disturbing new information about the pennsylvania college student from the bay area charged with possessing a weapon of mass destruction. the 18-year-old is a russian

citizen who graduated from carlmont high school in bellemont last year. police say he admitted to experimenting with explosives while living here in the bay area. the fbi says some of the bombmaking material found in his pennsylvania apartment was imported from china. >> like all bombmaking materials, it depends on what it will be used for. these items are used in the making of fireworks. >> investigators say the teenager planned to go to a remote area of pennsylvania to set off the explosives. bup he reportedly was -- but he reportedly was too afraid to detonate his homemade bombs. 8:49. let's check back with sal. you're following the east shore. how's it doing? >> not bad. we're seeing improvement. you can see the traffic is moving along better. when you get to the toll plaza, the total drive time is about 15 minutes across the span. you are waiting for five at the bridge and ten on the actual

one situation we're dealing with. you can see a lot of cloud cover streaming in. not a lot to it, yet but maybe things will get better this evening. the pattern is stuck. i mean, it's just incredible records being set one way or the other. these are current temperatures. you know, what is it? 10:50? 10 below in minneapolis. chicago, windchill is 30 below. 26 in dallas/fort worth. 34 new orleans. 27 atlanta. looking for ice storm in myrtle beach and savannah. here's the sky. look at this. it's freezing rain. ice storm right there. some of that is rain but a lot of us turning to freezing rain and also snow to the north. this will be a big issue down there. they just don't have the equipment to deal with something like that. this is a strong ridge of high pressure. there's our system, our hope for wednesday night into thursday. a low is forming that might slow it down a little bit. 30s in the mountains. there is a winter stormwatch

for thursday. today we'll get some sun breaks. our cloud/rain forecast doesn't do too much. things start to get better up in the north. not much for us. there will be drizzle for us. that's our system. after that, it's gone. that's why i don't want to say this is a major pattern change because we won't get a lot of rain. we'll get some. a major change would be we get some thursday, sunday, maybe monday. that's not happening. 50, 60s on the temperatures. temperatures will continue to ease down. there will still be some sun. might see some ring around the unis. that's ice crystals. up around 25,000, 30,000 feet. 50s, 60s on the temperatures. after that, it looks like we get cloudy and drizzle. thursday is our main day. after that it's out of here. friday, saturday. cooler, and clouds increase. the system is going south. >> thank you, steve.

palo alto police say if you have a rental car be aware of break-ins. at the fish market restaurant, this parking lot is a bit of a hot zone where nine cars had
