"mornings on 2" starts now. good morning. welcome to "mornings on 2." i want to show you some live pictures from interstate 680 in walnut creek where the bay area is seeing the first significant rain in more than a month, rein really several weeks. we've got complete coverage coming up on all of the rain and traffic and it's thursday, january 30th. i'm tori campbell. >> i'm dave clark. we're not out of the woods but the record-breaking dry spell, is somewhat over. we have live coverage for you. the roads are slick in some areas. let's go to steve paulson. how much rain did we get.

not much. a couple of 1/100ths. embetter in the sierra nevada. you see how the system is sliding through. we'll take you through the area. a little bit, dylan beach, santa rosa, petaluma, 101, also starting to expand to parts of marin county. also towards san mateo coast on skyline, back to san mateo itself. 280, 101 a little bit there. also in the santa cruz mountains things are picking up. they are very close to the radar site. it looks like things are winding down in part, of the east bay. there's not a lot there. occasionally you will get very, very light rain. the sierra's had about 2 to 4 inches around lake level. if you have had more, tweet me or e-mail me. some. ski resorts look like they are getting 6, 12. we'll take that. that's better than what we got to a couple 1/100ths to .10. it will be cooler.

light rain, not a lot. kind of a ez breezy afternoon. upper 50s closer to where we should be this time of year or very low 60s. here's sal. steve, good morning. the wet roads are figuring into the commute. interstate 880 traffic is moving along relatively well. the roadwork is long gone. the traffic looks good into downtown oakland. i want to take a look amount the bay bridge toll plaza. it's moderate here. you can see traffic is busy. i do see chp preparing to cross the lanes. there could be something going on on the span. we'll figure out what that is coming up for you. also looking a the livermore valley, a lot of heavy traffic coming into from the altamont pass. but the traffic has been superheavy as you drive through. chp is warning drivers to be especially careful when heading off to work or school due to the slick highways. tara moriarty is watching the rain in walnut creek.

good morning, tara. >> reporter: well, good morning. it's pretty dry although the roads are still pretty wet. if you take a look behind us, you can see that the traffic is actually getting worse here along 680 southbound as you approach the main street exit. but this rain is supposed to be on and off all morning, drizzle, nothing too heavy. right now we'll take a look at our camera on highway 24 in la fayette. the rain-slicked roads have the chp reminding people to drive slowly. part of that may be unavoidable if you are stuck in traffic. commuters say it's no one driving in traffic since this is the first rain we've had in months and the water mixes with the oil on the road creating these slippery conditions. one driver told us that he will take it. >> i wish it rained a lot, lot more. we need the rain. it's causing a drought. i drive by the reservoirs and see that it's very dry and, you know, knowing that we need the water. >> reporter: the highway patrol is reminding you to get your

windshield wipers checked, make sure they are in good working order, slow down on the roadways. give yourself plenty of time. try to check out the road conditions before you leave. remember if you have your windshield wipers on, state law requires you to have your headlights on. reporting live from walnut creek, i'm tara moriarty, ktvu channel 2 news. >> all right. well, the sierra, look at this. it looks like a winter wonderland this morning. a winter storm warning is in effect. they have snow and snow could fall as low as 5,000 feet. coming up for you in about ten minutes, brian hickey is out there. he will bring you a live report from blue canyon. 7:05. president obama called governor brown to check on california's water crisis and to offer offer federal government pay sis stns. according to the white house, president obama expressed his concerns for californians impacted by the drought. the president reinforced his commitment to provide federal support to state and local efforts. today, governor brown is

meeting with more than a dozen water officials in southern california to discuss possible water transfers. now, the straight may be causing concern among grape growers for next year's crop. but reports show this year there's no need to fear a shortage. allied grape growers say for the second year in a row california has crushed more than 4 million tons of grapes. but the state's $61 billion wine industry could be facing challenges next year. the drought could reduce crop size, increase vine stress and increase the potential for inadequate frost protection. we'll have continuing coverage on the rain throughout the morning here on "mornings on 2." you can always follow steve and the rest of the ktvu weather team online all day. we're posting weather updates to facebook and twitter as we get them into the weather center. we have new information about a fire last month at a recycling plant in redwood city that caused serious air quality issues all across the south

bay. janine de la vega joins us from redwood city where she just spoke to police and what are they telling you, janine? >> reporter: well, while authorities are still investigating an exact cause of this fire here at sims recycling, they believe it was deliberately set. now, the reason why is a lieutenant just told me he says there was nothing found in that fire debris file that was an accelerant or would self- ignite. he says it looks suspicious. that fire broke out at 1:00 a.m. on december 17th. a security guard reported hearing an explosion. it took firefighters nearly six and a half hours to get it under control. the fire marshal along with detectives from the police department have been reviewing video footage, the morning of the fire taken from multiple cameras from the area. investigators conducted interviews and combed through evidence but at this point do not have a person of interest identified. the smoke in that fire traveled south into san jose and even

morgan hill and a shelter in place was issued because of the poor air quality. now, there was a fire that broke out at sims a month earlier in a different area of the facility. but at this time, authorities are not linking it to the fire in december, they are saying because reports show that that one was accidental. because the fires happened within weeks of each other, it raised concerns and three staff members were asked to be on site 24 hours a day for a two- month period. i've reached out to sims metal recycling metal management here. somebody briefly came out to talk to us off camera just to say they are seeing if they can comment and give us reaction on this latest finding. we're not sure if that's gonna happen. if it does, we'll bring it to you later on "mornings on 2." janine de la vega, ktvu channel 2 news. >> thank you. jury deliberations start in the case of two oakland men

whose good night gun fight resulted in the death of a photographer. police say the man was hit and killed by a stray bullet as two mens fired shots at each other at a valero gas station. the prosecutor is pushing for a second-degree murder verdict against the suspects. police in morgan hill searching for a man accused of approaching a 15-year-old girl. it reportedly happened saturday as the girl was walking along monterey road. police say the man got out of his van, walked up to the girl and said, hey, beautiful. they say when the girl ran away, that suspect jumped back into his van and drove off. the suspect is described as a man of indeiant decent, mid- 30s, 6 feet tall, 180 pounds, with black hair and brown eyes. police say he was in a white work van with black rims and tinted windows. a candlelight vigil tonight will mark the tragic 25th anniversary in the east bay

city of dublin. 13-year-old eileen misheloff was last seen walking home from school in 1989. the somber ceremony begins at 7:00 p.m. at wells middle school on pen drive. dublin police have received hundreds of tips since the teenager vanished 25 years ago. but there are still no strong leads in this mysterious case. caltrans is responding to a report that the demolition of the old eastern span of the bay bridge is behind schedule. the state there were problems leading to a six-month delay. one of the problems, getting permits approved. the others relate making sure that the new span opened on labor day weekend. caltrans wants the chief contractor responsible for the demolition to reopen contract negotiations and to speed up the process. later today, congresswoman

jackie speier will host a forum about whether dogs should roam freely where dogs can be offleash. she says the latest recommendations do not reflect the concerns of dog owners who have used the area for years. there is a public hearing at the stern grove clubhouse from 8:30 to 10:00 this morning. the city is asking a federal appeals court to speed up the legal battle whether the oakland as can move to silicon valley. lawyers for the city of san jose want the court to set a march 24th deadline for all legal arguments. that could allow for ruling as soon as this summer. attorneys for san jose say it's critical to have a ruling in the case by early november. that's when the city's option on land for a downtown ballpark will expire.

visit. the first lady hit the road after tuesday night's state of the union address. last night she attended two democratic fund-raisers in los angeles. today at noon, she's due to arrive at sfo. michelle obama's first stop in san francisco will be a women's round table at katonia restaurant at 2:00 this afternoon. then a democratic national committee fund-raiser at 3:00 p.m. where she will be introduced by ed lee. tomorrow she's scheduled to meet with nancy pelosi at a fund-raiser for democrats. that's at the fair monthotel starting -- fairmont hotel starting at 11:30 a.m. president obama is on a national tour to promote the agenda from his state of the union address. the president is scheduled to tour a general electric facility near milwaukee to talk about the need to train workers for jobs that are in demand. the president has directed vice president joe biden to lead a government-wide review of federal job training programs.

president obama will make a stop in tennessee to talk about education before heading back to the white house. 7:15. how and -- house speaker john boehner and other house republicans will lay out their principles for immigration reform. the senate passed a sweeping reform last year that would give undocumented immigrants a pathway to citizen shn. conservative republicans oppose that. house republicans want a step- by-step approach to immigration reform. there may be a new toyota recall. the ntsb is negotiating with toyota about a problem with the fabric on the car seats of several models. they include the standard and the hybrid versions of the camry and avalon. other models would be the corolla, siena, tundra and tacoma trucks. the possible recall would affect only those that have seat heaters because the seat

fabric may not meet the flammability standards. this would affect only those vehicles sold since oog of 2012 when the fabric was changed. schools and -- august of 2012 when the fabric was changed. schools will remain closed today in atlanta. many say it was a bad decision to close schools, businesses and government offices all at the same time on tuesday afternoon when snow began to call. the result, more than 1 million drivers jammed atlanta area roadways. many commuters abandoned their cars and sought shelter in places like home depot and taco bell. an alabama man went to great heights to rescue his father in the storm. he landed a helicopter at a birmingham church after icy conditions forced his father and 100 people to spoend the night inside -- spend the night inside. his father said he couldn't

believe his eyes when he saw the helicopter. >> that's what i deserve. it's unbelievable. i'm kidding. i can't imagine this. never in my wildest dreams. first i've been stranded and he came and picked me up. >> the helicopter was used in other rescues, including one involved a pregnant woman. the man rescued said his son owns the helicopter and was happy to help. 7:18. happening now -- a winter storm warning in the lake tahoe area. the ski resorts and other businesses they've been waiting for this. our reporter is live in blue canyon right now its. it's covered with snow. >> reporter: winter storm celebration is more like it up in the sierra. finally getting some snow here where just yesterday this was dirt here at the donner summit rest area. take a look at this this morning. we have about 4 inches of snow converting to a playground of white. our snow marker we've been watching. a sign post at the rest area.

you can see about 4 inches of snow there for you. it's pretty light and fluffy out here. for the skiers heading to the sierra and snowboarders that will mean the powder day. it's enough snow to hide the rocks out there, so watch out for that that's good news for the resorts, anything to freshen conditions to get the customers out here to the mountains after what's been a very record-dry winter. interstate 80 off in the distance, yes, you do need chains on all of the mountain passes. the storm is not done yet. the bulk has been sitting the southshore. we're on the north shore where we've had a light event. back to you guys. >> all right, brian. >> up at blue canyon. good news for the ski resorts also. let's check in with sal.

weather, not supergreat for traffic. a few problems out there. >> i'm kind of pleased tori and dave, that we haven't had a worse commute, i think yesterday was the first drizzle. today is not quite as bad. but we've had some slow traffic. let's take a look at highway 24. it's about an 11 or 12-minute drive time between the walnut creek interchange and the tunnel. not too bad. the traffic is going to be okay once you get to the oakland side. we do have a look now at the bay bridge toll plaza. that's about a 10 to 15-minute wait. another 10 minutes on the bridge. total drive time of 25 minutes. by the way, in oakland, eastbound 980, there was a two- car wreck. not causing major jams. we have a solo spinout on highway 85 at moffett on the shoulder. 580 has been slow coming out of livermore. an earlier problem at the dublin interchange.

with mcdonald's happy meals. police say the woman would sell the heroin to customers who provided a special code word. investigators say anyone who wanted to buy the drugs would just pull up to the drive-thru, order a happy meal and say i would like to order a toy. the bag of dope would then be snuck into the meal for an extra $80. >> possible this could have been given to somebody else with a child in the car who was legitimately buying a happy meal. it would be very dangerous for a child to get this heroin. >> dennis is the second mcdonald's worker in two weeks to be rea.ked for allegedly -- arrested for allegedly selling heroin on the job. police say it's not clear how long the operation had been going on. fishermen, stay out. that's the word from authorities when it comes to california's rivers. find out why. >> reporter: we're getting light rain across parts of the bay area today. we'll tell you what this may mean for the drought situation

do much of anything for california's drought situation. still, this is the first measurable rain we have seen in the bay area since early december. it's falling across much of the bay area this morning and it will throughout the day. forecasters with the national weather service say don't expect this light rain to make much of a difference when it comes to the drought. our state is still facing a water crisis after one of the driest years on record. reservoirs, many of them, are half empty. the governor is asking customers to convoive by 20%. some are talking about the possibility of mandatory rationing in the near future. people we're talking to are glad to see rain as they wake up this morning but they understand they need to start using water more wisely. >> running out of water is worst. >> i know i will still be conserving until the reservoirs start to get filled up again. now we have no idea.

>> reporter: there are a handful of water agencies in california in danger of running out of water within the next two to three months. that's why the governor is looking at moving water from southern california to other drier areas of state. he's working on a plan. he will be holding a summit in southern california later on today. the drought has become such a big issue nationwide that president obama called governor jerry brown to express his concern about california's water crisis. the president is promising federal assistance to support our state now. this weather system will be short-lived. it will only stick around for the next day or so. the rain is off and on. but a lot of people optimistic hoping there's more to come and glad that the dry days are over here in the bay area. live this morning in fremont, alex savidge, ktvu channel 2 news. >> all right, alex. because of the drought, california is now banning fishing in dozens of waterways. the department of fish and

this morning. in one case you have the loss of their daughter, justice, as you mentioned. the other case, you have the boy who stands accused of killing her. he was hiding. he turned himself into police yesterday afternoon. the 14-year-old stands accused of the murder yesterday, at the family apartment complex. he turned himself into police accompanied by his family yesterday at 2:00 and his attorney. hours after that, john sasaki spoke exclubsive with attorney adante pointer and brought the charges his client faces and the message for the district attorney's office. >> we hope the district attorney's office will take the complete picture into consideration as it relates to who he is, what took place, and that everyone has redemption in them. so, you know, that's what we're hoping that the process plays out. >> reporter: prosecutors will

decide whether to charge the 14- year-old as an adult in this case. pointer also says that the boy is dealing with many emotions, with the loss of his sister and these heavy charges he's facing. pointer disputes what some family members think started the shooting which some say was a dispute over laundry. the family remains tev stated over his -- devastated over his taur's death but relieved that the son has surrendered. they've set up an ondonation site. the goal for that was $10,000. at last check, they raised a little hoeferrer $3,000. we're live in oakland, brian flores, ktvu channel 2 news. governor jerry brown's approval record has hit a record high. 58% of adults approve of the governor's job performance. 60% of likely voters said the same. analysts say that puts brown in a strong position to he decides

to run for re-election. he has not yet announced if he will seek a fourth term this november but he is expected to run. 7:37. a santa clara county sheriff's deputy arrested for methamphetamine possession is due in court today. the 48-year-old man was arrested monday at his home. investigators say he had been renting out rooms to three other people who partially paid their rent with drugs. those people were also arrested. they are facing drug and weapons charges. 7:38. hundreds of police officers from across the country came out yesterday to remember a b.a.r.t. officer killed in the line of duty. >> mostly i could say it's really, really, really hard to get through. ♪ >> officers came from as far away as boston to attend the solemn procession. an emotional funeral service for sergeant tom smith. smith was mistakenly shot by a

fellow officer during a search of a robbery suspect's dublin apartment. he was remembered as a husband, father and brother and officers say he was a hero. >> he took his job very seriously. he took parenthood even more seriously. that's what made him such a fine person. >> he will be missed. >> smith leaves behind a wife and their 6-year-old daughter. he's the first officer in b.a.r.t.'s 42-year history to die in the line of duty. we were told that the officer who accidentally fired the fatal shot would attend that service but the police chief and former chief told us they did not see him there. the sonoma county police investigation into the deadly shooting of 13-year-old andy lopez of santa rosa is now complete. the findings turned over to the district attorney. the d.a.'s office will decide whether to file criminal charges against deputy gehlaus. the report was prepared by investigators from the santa rosa and petaluma police

departments. the deputy says last october, andy lopez carried an air soft bb gun that looked like a real assault rifle. gelhaus says he told lopez to drop the gun but then shot and killed him when lopez turned toward him with the gun. the candlelight vigil will be held mark, the 25th anniversary of the disappears of eileen misheloff. there will be a march in honern of her tonight. they will begin at wells middle school on pen drive. now, investigators have received hundreds of tips over the years. but still, no strong leads in this mysterious case. 20 minutes before 8:00. a puppy who was rescued last month from a recycling conveyer belt has a new home.

nice start to the morning for wall street. the u.s. economy grew at an annual rate of 3.2% in the fourth quarter. consumer spending improved and really helping is facebook's stock. right now, it's up over 15%. the social media company reported results that beat expectations. taking a live look at the big board, the dow is up 91. the nasdaq up 59 and s&p up 15. investigators have a big clue in the data breach at target. they say hackers got into the computer system after stealing information from one of the retailer's venue. they say knowing how the cyber attack started could help them figure out who stole credit and

a third person has died from the flu in san francisco. the latest report says 32 flu- related deaths have occurred in the bay area so far. officials are not saying much about the latest san francisco victim but that person did have a medical condition and was under the age of 65. the health department has not determined if that person died from the h1n1 flu strain. during this flu season, a new study says a lot of people go to work even if they are sick. the staffing company, office team commissioned a nationwide survey. it found that 70% of workers reported they often go to work even when they are sick. that's contrampry to what -- contrary to what doctors say. they say it's critical for you to stay home and avoid spreading germs. >> if you use one of our timeoff days for an illness or a day that you need to be out of the office because you are sick, then that comes from your vacation time. >> some people feel they just don't have a close.

bring some much-needed snow to the sierra. steve was just telling us, some resorts could get up to a foot of new snow and expect 4 to 8 at lake level. california water managers will return to the sierra mountains later today. they will be checking the sierra snowpack for the second time this month. the first check earlier confirmed their worst fierce of record-breaking low levels. the storm should help a little. president obama called governor brown recently to check on the water crisis here in california and to offer federal government assistance. according to the white house, president obama expressed his concern for californians impacted by the drought. the president reinforced his commitment to providing federal support to state and local efforts. today, governor brown is meeting with more than a dozen water officials in southern california to discuss possible water transfers.

the drought may be causing concern among grape growers for next year's crop. but reports show that this year there is no need to fear a shortage. allied grape growers say for the second year in a row, californians have crushed more than 4 million grapes. but vineyards could face challenges next year because the drought could reduce the crop's size and protection. we'll have continuing coverage of the rain all day long on channel 2. you can follow steve and the rest of the team online. they are posting updates to facebook and twitter as they come into the ktvu weather center. we have new information about that huge december fire in redwood city. it affected people all over the south bay. it happened at a metal recycling plant with a history of fires. ktvu's janine de la vega joining us live from redwood city to tell us what the investigators are now saying,

janine? >> reporter: the police lieutenant in charge of investigation tells me that it looks like this fire at sims recycling plant in redwood city back in december may have been deliberately set. it's the fourth fire that's happened here in the past six months, but he says there's no link to those and this latest fire seems to be an isolated incident. the fire marshal along with detectives have been reviewing video footage the morning of the fire taken from multiple fires and have combed through evidence including the pile of -- including the pile of metal recycleables that caught fire. they say nothing found in the debris appears to self-ignite. that's why it looks spik shis. it broke out in december when only a security guard was working and reported hearing an explosion. the fire burned for more than eight hours and the smoke traveled south triggering a shelter in place advisory. just a few weeks before that, sims experienced another fire

in a different area of the facility and because of the two fires happening within weeks of each other. it raised concerns. the city manager asked sims to keep three qualified managers on site for 24 hours a day for a two-month period. preliminary reports show that fire in november was accidental. we reached out to sims to get their reaction to this latest development. they've not gotten back to us. police say they have not identified any person of interest or suspect in the december fire. reporting live from redwood city, janine de la vega, ktvu channel 2 news. 8:08. jury deliberations start today in the case of two oakland men whose gun fight in april of last year lead to the death of a photographer. police say lionel flukier was hit and killed by a stray bullet as two men fired shots at each other during an argument at a valero gas station on macarthur boulevard. the prosecutor is pushing for a

police in menlo park make an arrest in a string of bank robberies. police say that the man was arrested in connection with two robberies at the bank of the west and u.s. bank this past fall. both were armed robberies. no one was hurt. toyota may be facing another recall. the national highway traffic administration is in talks with toyota about a problem with the fabric on the seats of models including the camry and the avalon. the other models would be the corolla, siena minivan, tundra and the tacoma trucks. possible recall would affect only those with seat heaters because the seat fabric might

a woman in pennsylvania is accused of selling heroin hiding inside mcdonald's happy meals. police say dennis would sell the heroin to customers who provided a special code word. investigators say anyone who wanted to buy those drugs would just pull up to the drive-thru, order a happy meal and say, i would like to order a toy. that bag of drugs was then hidden into that happy meal for an extra $80. >> it's possible this could

problems on highway 24 eastbound at the orinda crossroads. two lanes blocked with a pretty serious crash. traffic is beginning to back up into oakland out of the tunnel. so if you are driving over let's say to pleasant hill or orinda, you need to give yourself extra time. 24 on the west side. look at 880. it's very slow getting into downtown oakland from san leandro. as we push to the south bay, a lot of slow traffic on 101, 280 and 85. 8:32. this is a look at the toll plaza. that's about a ten-minute delay or less than that getting into the city. now, let's go back to 880 as i mentioned very slow. back to the desk. >> all right, sal. because of our trout, a lot of people were really pumped to see rain in the bay area even though we didn't get much. ktvu's alex savidge joining us live now to talk about that and what we have out there now. alex? >> reporter: yeah, we didn't get a whole lot out here in our location in fremont, dave. not a lot of rain.

things pretty dry right now. let me show you the scene. right now now, the are improving -- right now. clouds are improving. people woke up to measurable rain falling across parts of the bay area. still, though, forecasters say you can't expect this weak system to help california's growing water crisis. we've had one of the driest years on records. the governor is calling on californians to voluntary cut water use by 20% and a lot of local water districts asking the same thing from their customers, asking them to conserve. people i talked with this morning, they say they are ready to cut back but they told me they are happy about the drizzle we saw today. >> we can actually take a shower and flush the toilet the

same day. i think that's a good thing. we need the rain. it's crazy. we're getting great weather here in northern california but we need the rain. >> reporter: and a handful of water agencies in california are in danger of running out of water within the next two, three months. the governor is looking at moving water from southern california up to some of those drive areas of the -- drier areas of the state. president obama called governor brown to express his concerns about california's growing water crisis and the people impacted by it here and the president has promised federal assistance to support our state. the wet weather we're seeing now in the bay area, obviously won't be sticking around. but people hope that next rain system is not far behind. live this morning in fremont, alex savidge, ktvu channel 2 news. >> because of the drought, california is banning fishing in dozens of waterways. the department of fish and wildlife trying to protect the

coho salmon and steelhead trout. fishing is banned in several places from the oregon border to big sur. that includes pescadero creek and the san lorenzo river. we'll have continuing coverage on rain whatever we get through the morning and you can follow steve paulson and the rest of the ktvu weather team online. they are posting updates to facebook and twitter as we get them into the ktvu weather center. we have new video of a slow- speed chase in the stockton area this morning. the chp and stockton police chased a stolen big rig for nearly four hours. officers say they finally caught the driver about one hour ago, shortly after he got out of the big rig and ran. the chp says the truck was carrying about 80,000 pounds of scrap metal and about00 gallons of diesel fuel. but it's still not clear why the big rig was stolen.

the family of 17-year-old justice tolliver of oakland is dealing with many emotions following not just the loss of their daughter but also the fact that their son is her accused killer. brian flores is live in oakland to explain why the boy decided to turn himself in. good morning, brian. >> reporter: good morning. well, as you mentioned, certainly the family has dealt with a these past through -- with the with a lot these past few days. we spoke to the attorney. he's hoping for the best. now, prosecutors todd will decide whether the -- today will decide whether the 14-year- old teenaged boy will be charged as an adult. he stands accused of shooting and killing his older sister, 17-year-old justice tolliver last thursday at the family apartment complex. police were looking for him as he was hiding. until yesterday afternoon at 2:00 when he turned himself in

accompanied by his family and attorney. we spoke to his attorney, adante pointer. >> anyone dealing with charges like that and dealing with the lost of your sister, i'm sure you are dealing with a lot of emotions. some of which may be too big for you to necessarily process. >> reporter: pointer disputes what some family members think started the shooting which some said was a dispute over laundry. ktvu spoke with the kid's father. he says the family remains devastated over his daughter's death but relieved his son surrendered. i spoke to some familiar members and they say they are planning to release more information. they are not exactly sure when. they say it should be sometime around noon. the family has set up a fund- raising donation site for justice tolliver. their goal was to raise

$10,000. so far they've raised over $3,000. brian flores, ktvu channel 2 news. new this morning, we're just getting word that senior california congressman henry waxman of southern california is going to retire after 40 years in office. the 74-year-old democratic congressman is known as one of the most prolific and successful lawmakers. he says he's in good health and therefore thinks this is a good time to move on, so he can have another chapter of his life after congress. governor brown's approval rating has hit a record high. a new poll says 58% of adults approve of his performance. 60% of likely voters said the same. analysts say that puts brown in a strong position if he decides to run for re-election. he has not yet announced if he will seek a fourth term this november but he's expected to

run. 8:38. hundreds of police officers from all over the country paid tribute yesterday to a b.a.r.t. police officer killed in the line of duty. mostly i could say it's really, really hard to get through. >> police officers came from as far away as boston for this solemn, procession and emotional funeral service for sergeant smith. he was mistakenly shot by a fellow officer during a search of a robbery suspect's apartment in dublin. >> he was remembered as a husband, brother, and other officers say he was a hero. >> he took his job very seriously. he took parenthood even more seriously. that's what made him such a fine person. he will be missed. >> smith leaves behind a wife and their 6-year-old daughter. he's the first officer in b.a.r.t. police 42-year history to die in the line of duty. the sonoma county investigation into the shooting of andy lopez is now complete

with the findings turned over to the district attorney. the d.a.'s office will decide whether to file criminal charges against deputy eric gel haas. the report was prepared by both the santa rosa and petaluma police departments. deputy gelhaus says last october, lopez carried an air soft bb gun that looked like a real assault rifle. gelhaus says he ordered low lopez to drop the gun but shot and killed him when the teen turned toward him with the barrel raised. on a lighter note, a little puppy rescued last month from a recycling conveyer belt has a new home now. just before christmas time, little jim was rescued by recology worker. jim's only three months old. he was stuffed inside a garbage bag. the young puppy has fully recovered since being rescued and will go to her new home with one of the employees were the recycling center.

stocks moving higher in morning trading today helped by an encouraging report. the u.s. economy grew at an annual rate of 3.2% in the fourth quarter. also helping strong earnings from facebook, that stock is up almost 16% right now. google is up over 3% on news it is el -- it selling motorola's smartphone business. the dow is up 123. the nasdaq is up 73 and the s&p up 19. let's bring you up to date on tom of the other top stories for you right now -- investigators suspect arson at a fire at a recycling plant in

redwood city. it started early in the morning december 17th. it burned for more than eight hours. the smoke was so bad. health officials warned many south bay residents stay inside and close your windows. first lady michelle obama arrives here in the bay area in just a couple of hours to begin a two-day visit. among other things, she will attend several democratic fund- raisers in san francisco. and the bay area's record- breaking dry spell over -- we still have a long way to go. we got some light rain overnight after almost two months of bone-dry weather that triggered that drought emergency. ktvu's tara moriarty joining us live. you are out in baypoint with more about our weather. what's it like out there now? >> reporter: well, it's actually dropped a couple of degrees here. it's very chilly and windy. no rain. that's the good news. we are along highway 4 where you can see traffic is moving nicely. the drizzle has been on and off all morning.

college now elementary on international boulevard in oakland's fruitvale district. reportedly, it happened in a girls' bathroom during an after- school program. police say the girl ran away and reported the incident to an adult. the suspect described as a tall white man with heavy build, short black hair and a black mustache. a leak about the raiderettes is raising eyebrows. the los angeles times received a copy of the hand book. it includes how to shake hands properly and how to place a napkin on your lap while dining. the hand book states that the raiders are the only nfl team that does not explicitly ban cheerleaders from dating players. the hand book warns cheerleaders about becoming friends with raiders' staff who are married even if that friendship is innocent. the glamour girls of the olympics, they are the figure skaters. the bay area has another local to follow in the footsteps.
