rain back in the bay area forecast. a couple times we could see rain. i'll detail and timeline the opportunity for showers in your neighborhood. >> the wet weather is certainly a welcome relief from the draught. it has some homeowners celebrating, but one of the largest water districts say it's just a drop in the bucket. we are live in lafayette with how that drop is helping a bit. john? >> reporter: right now the water agencies are telling us very little is actually going into reservoirs. outside is feels cooler and wetter than any time in this wacky winter. the key is soil moisture. last week it was the driest it's been in 120 years. today homeowners are doing something they haven't done in months. >> i'll turn off the water for a few days because i think there was enough rain. >> reporter: he's worried about new draught-tolerant plants

the death of a 3-year-old girl in napa. her mother and boyfriend were caught with the help of an alert employee at an ihop. family members are wondering if the girl's mother is also a victim. >> reporter: well, people in this neighborhood are still mourning the death of 3-year- old kayleigh. the memorial outside her apartment continues to grow. a short time ago, less than an hour ago, crime scene technicians return today the apartment where the child's body was found. the door to the apartment is open right now. the coroner is doing an autopsy today. we could learn the results and the exact cause of death as early as tomorrow. the district attorney's office is expected to file charges against her mother and the boyfriend tomorrow. 23-year-old sara and 26-year- old ryan warner is in napa county jail arrested for the assault and murder of her daughter found dead in her apartment saturday afternoon.

police say there were signs the child was sexually assaulted. kruger's mother says she's mourning the loss of her only granddaughter. >> i know sara did not do this. and anybody who knows and loves sara knows she did not do this. she was not involved. >> reporter: she says her daughter was a loving full-time mom who was going to school to become a preschoolteacher. kruger and warner fled their apartment without kayleigh. >> wondering if he forced her to leave with him. if he told her they're going to accuse you of doing this and you have to leave. i don't know what happened. >> reporter: what we do know is how the couple was found. 10:00 a.m. sunday morning, an employee at this ihop told the manager two of the customers in the restaurant looked familiar.

police put out word they wanted to find them for questioning. after the manager called 911, police sent out an alert to local law enforcement to be on the lookout. just 8 minutes later, police spotted them at the del norte station. >> they were on the street walking toward bart. >> reporter: the officers approached them, they cooperated with authorities, and were turned over to police. >> the female seemed upset. she was beginning to cry during their contact with her. >> reporter: and we're still trying to get information from investigators about where the couple was from the time they left this apartment on saturday to when they were spotted at that ihop on sunday morning. we don't know where they were headed when they were found. coming up at 6:00, we'll have more on this story. live in napa for ktvu channel 2 news. >> as we told you last night, police had been called to that apartment in napa before.

tonight we're learning police had actually spoken with the little girl during a welfare check that happened a couple of days before she was killed. 2 investigates is looking into what happened and if there were any other warning signs. we're working on that for tonight at 6:00. wants san jose to pay up because they say they're not getting to fires fast enough. sometimes when they do arrive, it's without proper equipment. in one case, a house right across the street from the fire station burnt down. here now with the show down brewing between the city and the county. >> reporter: we're at a maintenance yard to show you the large number of fire trucks put on reserve because of age or no firefighters to run them. this situation typifies what has many people concerned. a fire broke out at this house

last summer right across from the fire station, but the station had no engine that could carry water. flames ravaged the building. >> to have fire stations that have trucks that can't carry water, i don't understand the reason behind that. and how the firefighters are expected to put out firesn't. >> reporter: the issue came up against because of a deadly fire in a nearby neighborhood saturday. >> we lost a resident in the fire just off of bird avenue because the station didn't have adequate equipment. >> reporter: county supervisor said another related concern is the city's fire department is not meeting its contractual obligation to respond to medical emergencies within 8 minutes. he's proposing to fine the city if it doesn't rectify the problem by june. >> the city of san jose's response time has dropped like a rock over the last several months.

information on what led to hospital staffers either resigning or being dismissed. >> reporter: a new report by the california department of health and human services obtained today by ktvu describes how san francisco general hospital failed to provide a safe patient environment for lynn spalding. diagnosed with delirium, she was assigned a hospital sitter with instructions to never leave patient unattended. >> then in the report you'll see that a nurse canceled the order. that it wasn't necessary. why? i have absolutely no idea. >> reporter: deputies failed to perform an organized search. it also details several patient privacy violations after she was found dead in a stairwell 17 days later. a sheriff's dispatcher made several calls to his wife and

brother. one call included a graphic description of spalding's body. the report notes a number of hospital improvements, including the development of a code green alert used last week to help find missing patient valerie gates. the family says those changes come way too late. >> think of the impact on the children she left behind and her friends. >> three of the four hospital staffers who gained unauthorized access to the records have either resigned or quit. the sheriff's department dispatcher was reassigned and we're also told that other disciplinary action may be taken within that department. an independent fact-finding report is out on a series oh you have hate crimes that terrorized an african american student. the incidents occurred in campus housing last fall. three adult males and a

outside the boys and girls club in west oakland. they were shot and killed saturday night. jones' sister is worried that the violence will just continue. >> we're losing all of our kids. they're our future. >> overall, statistics show crime in oakland is down. for one after-school program, those numbers are pretty much meaningless. youth uprising is an educational mentoring and after school center for at-risk kids and young adults. in the last two weeks, two of its members have been murdered. >> reporter: a staff meeting in the youth uprising living room touched on the familiar subject of death. >> there's no getting used to it. >> reporter: justice toliver and lamar brusard were members here. both were shot to death in oakland in the last two weeks. >> they are actually shooting

at each other all the time, and it is fully unacceptable. >> reporter: youth uprising president says the culture of crime is bred for a deficit of education, jobs, and hope. >> the opportunities that are available to other people in the city remain beyond reach for the people who live in this place. and that's a problem. >> reporter: oakland police provided us with stats that show crimes using guns are down about 30% city wide. but the people at youth uprising say they're not seeing that where they are. >> this is the playground area for us. >> reporter: a week ago thursday, youth uprising was on lock down. >> shots rang out, fired into the playground. >> reporter: more than 100 kids and parents were on the playground in the line of fire. >> when you cross over and you think it's okay to shoot into a playground full of children, you've absolutely gone too far. >> reporter: and she wants the daily gunfire to stop before it's too late. in oakland for ktvu, channel 2

news. there will be traffic delays on highway 101 all week. construction began on the capital expressway interchange. all in an effort to reduce the backup. there will be lane closures and detours. the upgrades cost $35 million. the state agency is ordering google to move its mystery barge near a site on treasure island. it did not authorize the construction of that four-story barge, and that proper permits are not in order. the agency says the treasure island development authority could face fines and enforcement proceedings as a result. a lot of people still talking about that rain we got yesterday. let's check in with our chief meteorologist to find out if more is on the way. >> more headed our way. that kind of opened the door a little bit. we talked about it on friday night that once you squeak the door open, it gives us an opportunity for showers.

rescued from a storm drain. yesterday morning firefighters pulled the woman from the 6- foot diameter pipe after she started screaming for help because the cover was too heavy to lift. the chief says sometimes homeless people use part of the drainage pipes as a place to sleep. the problem was the runoff from the rain yesterday made it a dangerous place to be. figures released show that yahoo led the way in the number of nsa requests for content on its e-mail accounts. the nsa requested information on more than 30,000 accounts in the first six months of last year. that compares to half as many for microsoft. they have the second-largest web-based e-mail service on the internet. members of congress are saying enough is enough. they're looking into creating new security standards that would better protect your information. >> i think this will be one that you can see the president, the house, and the senate on

it's a social media website that boasts 10s of millions of users looking to meet new people. but san francisco's city attorney says it's also being used by predators, and if he has to, he says he'll try to shut it down. the site is called meetme tomorrow. today city attorney filed a lawsuit against it. a key factor in a number of crimes involving sexually assault and illicit sex with minors. >> reporter: san francisco city

claims. report of delays in collecting donations for two policemen killed in the line of duty. gone to question a suspect when he shot and killed them both. the city, two banks, and the police officer's associate collected half a million dollars for the officers' families. not a dime has been distributed. at least one family member objected because the donations were initially promoted as a scholarship fund for the officer's children, then changed to a memorial fund. starting today, commuters taking the ferry are having to pay to park. the district has gun charging for parking. the new $2 a day fee is expected to generate $400,000 for the cash-strapped district.

they'll up load that to you. all you have to do is pay $140. that could have been stolen from target or neiman marcus. >> reporter: customers online shopping accounts, bank accounts, and financial institutions are being hacked and offered for sale. >> they offer customer service, they offer guarantees. >> reporter: catching cyber criminals is not easy. accused of operating silk road, one of the most well-known secret sites. the fbi says he was operating a sprawling black market bazaar of illegal drugs and other items for sale. he did $1.2 billion in sales before they arrested him in san francisco last october. sites selling stolen personal information can be even harder to find. they pop up and disappear overnight in a race to sell or use the data before victims notice and alert their banks. >> the fact that there's so much more stolen data now means that these markets are just
