>> 2 investigates the warning signs that may have been overlooked. >> a campus crime allegedly fueled by hate. when did officials find out, and did anyone take it seriously? we're going through a university finding following accusations of a hate crime inside a dorm room. >> could cutting back on water use now hurt you in the long run? the concerns for some customers as we go deeper into the caught. draught. a north bay mother and her boyfriend are now behind bars accused in the death of the mother's 3-year-old daughter. tonight we're learning more about how the suspects were caught and why police spoke to the young victim days before she was found dead. good evening, everyone. >> 3-year-old kyleigh was found dead in an apartment over the weekend. the girl's mother, sara kruger and her boyfriend, ryan warner, were arrested for the girl's

death. they're expected to be arraigned tomorrow on murder charges. there were signs the child was sexually assaulted. we're awaiting autopsy results. over the phone, kruger's mother says she devastated over the loss of her only granddaughter. >> i know sara did not do this. anybody who knows and loves sara knows she did not do this. she was not involved. >> her mother says her daughter was a loving full-time mom. she started dating warner about 8 months ago. >> early warnings the girl may have been in danger. eric, you looked into a history of police visits at that little girl's home. another family member's plea for help right before the girl died. >> the grandmother on her dad's side asked them to do a welfare check on the girl last week.

they believe kayleigh's mother was on drugs and unwilling to let her see the little girl. police found the body of 3-year- old kayleigh on saturday. 2 investigates learns officers spoke to the girl on two different occasions only days earlier. >> they physically saw the child? >> yes. yes. >> reporter: one week ago police checked out a verbal dispute between kayleigh's mother and boyfriend ryan warner, both now accused of killing the girl. officers were back again two days later. >> we checked the child, talked to her, made sure she's okay, and see what she says if there was anything really suspicious then we would have taken other action. >> reporter: kayleigh's grandmother declined to speak on camera, but she called police concerned the girl's mother was on drugs. police responded to the apartment nine times since may

for a variety of domestic calls. napa county records saw that some of the disputes included the father. in a request for a restraining order last year, sara wrote it was kayleigh's father who was using meth off and on. we've also been looking into the history of the boyfriend, ryan warner. court records show he had an outstanding record for failing to show up for court in what they said was a vandalism case. >> obviously more to come here. just the bottom line here, unfortunately a little girl is dead. continuing coverage on the much-needed rain that fell over the weekend. the bay area got more rain yesterday than in the entire month of january. we're going to need a lot more to help with the draught. in fact, one of the bay area's largest water districts say the

weekend's storm was just a drop in the bucket. they still have reservoir levels that are down some 4 inches from before the storm. >> it takes several inches of rain to saturate the ground, and at that point you'll have a good amount of run off. >> in order to get back to normal, east bay mud needs 30- 35 inches more rain. that's like having this past weekend's storm every weekend until the end of april. >> skies are much clearer today. we are joined in the weather center with what to expect next. >> we got a a little bit of shower activity yesterday. at this point, anything is helpful. %s of average are 18-20% of where we should be for this time of year. last year at this time we were 100% of average. what's happening as you look out in the pacific, you can see systems developing. look how far south they are.

there's moisture coming up in the sub tropics. the jet stream will undercut. it's a favorable pattern for more moisture moving into the state. when i come back after the break, we'll talk about the forecast timing on this next system. we'll kind of get you lined up on how to time it out for your commutes and your weekend. >> you can follow bill and all of our meteorologists online for the latest on bay area weather. they are constantly posing updates to twitter and facebook. scrambling to find ways to help some of the most vulnerable communities. intending to speed up aid for two communities hit hard by the draught. calls for spending $11 million on clean drinking water programs. the measure would also set a july 1st deadline for state agencies approve water

recycling and storm water reuse projects. our draught coverage continues with the concerns of some customers that cutting back on water now could hurt them later. the alleged attack of a black student at san jose state outraged many, but the campus says they acted appropriately. >> reporter: an independent fact finder delivered this report to the campus today. within hours it was made public to the campus community. a task force will use this to try to make the campus a better place. the report is the result of a month-long investigation following allegations four white students harassed a black student last fall. the report says the university only learned of the incidents

after the student's parents complained and the president wasn't briefed until five weeks after the investigation began. >> i've already had conversations with my staff on changing some of the protocols so i'll be informed in a much more timely fashion. >> reporter: the report concludes that university staff acted in compliance with relevant policies and past practice. campus leadership did not follow its usual practice in its executive oversight of the incidents. now the report will be used by a task force headed by a retired judge. gary daniels will be on that task force and says she has serious questions about the university's commitment to fostering a diverse campus. >> for the most part, the report clears the university of any responsibility, and i feel as though that's unacceptable considering the campus climate. >> reporter: as for the alleged attackers in this case, they

are suspended and still face expulsion. they're facing misdemeanor criminal charges in march. the victim has asked that none of his information be released. >> san jose state's president says they will hold a meeting this thursday to talk about the report. the meeting will be from 5:30- 7:30 in the engineering room number 285. the public will be allowed to attend. the meeting will also stream live on the university's home page. on ktvu.com, you can read the entire report for yourself. our web team has posted it under hot topics. students are are not happy about a change in the academic calendar. uc students about the changes that leaves them with a shorter winter break. administrators are delaying the start of the fall quarter for

one week because of the jewish holiday rashashana. students who don't like the plan are circulating a plan for delays in the start of winter and spring quarters. organizers want 50,000 signatures before they send it off. the san jose fire department is under fire over its response times. officials say firefighters aren't getting to fires fast enough, and sometimes when they do show up, they don't have the right equipment. we are joined now with the fight brewing between the city and the county. robert? >> reporter: san jose and santa clara county leaders are going to go head to head about ier many general security interest response times and resources. firefighters say they're doing their best while dealing with budget cuts. firefighters are dealing with lay offs and budget cuts that the department acknowledges has taken a toll on response times and equipment. those concerns will be addressed tomorrow because

supervisor dave cortesi says san jose is not meeting contractual obligations to respond to calls in 8 minutes. >> if they're not -- my proposal is they'll pay a penalty of $152,000, approximate. >> reporter: they were echoed by a group that says a woman died in a fire saturday possibly because the first fire trucks were not the type that carry water. >> this is a big concern of ours. are the stations that are open and operating, do they have the correct equipment? >> reporter: the fire department says it responded to the fire within 4 minutes and and engine carrying water showed up one minute later. they acknowledge they've fallen short on medical emergencies. >> the money will have to come from tax revenues because our current taxes are growing with the economy or some sort of a new tax that the council might

put on the ballot in the future. >> reporter: the neighborhood group plans to bring up a fire last summer when a house burned downright across from a fire station. the proposal will be discussed tomorrow morning. patient privacy violations led to resignations and dismissals after a missing patient was found dead in a stairwell at san francisco general hospital. her body was found on october 8th, 17 days after she disappeared from her hospital bed. a new report obtained by ktvu says the hospital failed to provide a safe patient environment for spalding. it also notes missteps made by sheriff's deputies who searched for spalding. >> it says the hospital didn't do its job, and the sheriff's office didn't do its job. >> the report also says several

hospital staffers gained unauthorized access to her records after she was found dead. three of the four staffers are no longer on the job. san francisco city leaders are focusing on how to improve enforcement of building code violations. >> no person in the city or county of san francisco should be fearful of being retaliated against or fearful of living in an environment where there's mold, there's mildew, or other health concerns. >> supervisors cosponsored a hearing today to get answers about why some problem properties seem to slip through the cracks. the goal is to ensure better coordination. no significant jump in crime since the casino opened its doors back in november. there was a slight increase in november and december, crime was actually lower compared to 2009. more car thefts were reported near the casino. police will be adding more

♪ ordering google to move its floating barge near the site near treasure island. the commission says the proper permits were not obtained and that it did not authorize the construction of the barge. the agency also says that the treasure island development authority could face fines and enforcement proceedings. the san francisco city attorney filed a a lawsuit against meetme.com and allows you to search for new friends as young as 14. it also tracks users and can

show you where people are and how long ago they were there. he says 25% of the users are under the age of 18 and claims the website is violating the privacy and safety of minors. >> i'm trying to make sure that they aren't utilized as a way to target young people. right now, their practices are in violation of the law. if there's no other way to do it than shutting them down, then so be it. >> meetme.com says it has a 24/7 security team. it reviews posted photos and screens users for sexual offenders. the website confirmed they know about the lawsuit and is reviewing claims. introduced a bill to raise california's minimum wage from its current $8.00. the bill, sb-935 would increase the minimum wage to $11 in 2015.

it would go up in 2016 and again this 2017. california's minimum wage is scheduled to rise to $9 on july 1st and to $10 in 2016. california residents awaiting word on whether they qualify for unemployment benefits may have to continue to wait. the department is reportedly facing a massive backlog of e- mails that number ins the hundreds of thousands. some unemployment claims are being processed late because of a shortage in staff. >> the real problem is we continue to lose staff and cannot afford to fill behind them. you cannot deal with a continuing high demand when you lose staff and resources at a much faster rate. >> some reports blame the backlog on new software being used by the agency, but the edd says its new software is working. we've been under a draught emergency for works, but what happens if mandatory restrictions kick in and you're asked to cut back even more?

we found out if people who are saving now will end up paying later. >> reporter: judging by the brown lawns here in this neighborhood, it appears people are conserving water. we have received several e- mails from people saying they're confused about what happens if they're asked to conserve even more. jonathan petty and his baby showed us the water conservation measures they've already taken in their union city townhouse. water-saving shower and the low- flow toilet. he waters the plants with left- over drinking water. >> the future of our water usage is a big question for us. >> reporter: the water district has asked petty and its 300,000 other customers to reduce water consumption from 20% from last year. >> how they're going to impose

the restriction. are they going to fine us? >> reporter: we asked the district. >> one thing we don't want to do is penalize customers that are being very supportive of our conversation request. so whatever happens next will be designed, if we need to go there, to not penalize those customers. >> reporter: the district says if it imposes mandatory restrictions, it may reducing or banning certain practices such as watering lawns and rationing would not be based on current usage but a household average over time. >> we'll be looking at how households have been doing relative to last year. >> reporter: the municipal water district says it would base mandatory reductions over five years of past usage. the san francisco public utilities commission says restrictions for its customer would likely be based on 12-

month averages. >> it is confusing. >> reporter: several water districts say they still want to see what happens over the next two months before deciding to impose mandatory restrictions. >> all that rain we got yesterday was so good to get. it looks like more is on the way. let's go back to the weather center for more on that. there's more this week in the five-day. we'll see it twice. these are the highs we had today. way down from where we were last week at this time. we had 70s last week. now we're back to where we should be. upper to mid-50s. the weather system is here. it's not just going to undercut it for one storm or one chance of a storm, it's going to leave it down for a while. the jet stream will shift south, and it means we have a shot at precipitation in here. right now i don't see anything massive, big, but i see clouds

and moisture headed our way, which is great news. these are the overnight lows. 34 in napa. valley fog showing up tomorrow morning. you might see a little bit again tomorrow morning up by napa and fairfield. december in january characterized by this strong high pressure. that's why it was the driest january on record in san francisco. records go back to 1850. oldest record ins the state. the jet stream shifts south, and when it does, it sets us up with what we saw yesterday and what we're going to see wednesday night into thursday morning. it will cool temperatures off too and get us some mountain snow. here we're going into wednesday morning. here's moisture out here, and here it comes wednesday night. it's not a big deal, but it's encouraging because it's a moist flow. wednesday night and here we are 9-10:00 p.m. wednesday night.

scattered light showers and there we are morning commute. wet roadways, maybe a few light showers still falling, and then we get a break. behind this, there's another one too. we'll track that for you. rainfall totals are going to be anywhere from a quarter inch to perhaps an inch of rain. there's your five-day forecast. thursday morning, wednesday night, thursday morning that's when the next one will come. i think sunday's system has some legs. next week after sunday there's a couple more that look like they're pretty juicy. at least something's happening. these aren't 10s, but they're wet. >> thanks. the super bowl may be over, but it's still a hot topic when it comes to sports. what a couple of warriors are saying about the game coming up next. 0!ockñ?çóxo?ñ=çñññçvxqx?ñññ?óioy

the top of the stat sheets when it comes to defend. we asked him about the game and the topic of defense translated to his team. >> it certainly puts a stamp on it and make people aware of just how important it is. from the beginning, the seahawks made a statement with their physical play, their enthusiasm. it was impressive. great defense against great offense. as a coach, i think that really sells the message better than anything you can show them. >> it got ugly quick. did not expect that. i actually picked the broncos, so don't take my advice on betting. >> those incredible last-second basketball shots, take a look at what happened in sacramento saturday night in a collegiate game. >> barry bonds up the three from deep. it's good. he knocks down a deep three with 27 to go.
