two girls allegedly held against their will inside this home. tonight, the troubling charges against this man, and concern that there may be other victims. good evening, everyone. i'm frank somerville. >> and i'm julie haener. it is a disturbing case involving child molestation charges in a residential neighborhood filled with with families. she tells us about the man now under arrest, and how police were alerted to the situation. christina. >> reporter: police say a counselor came to them on friday, concerned about two girls and a man allegedly molesting them.

detectives here immediately wept to work and quickly found enough evidence to make an arrest the same day. >> reporter: clark place is home to many families. police say it was also home to an alleged child predator. he is accused of using his brute force strength of holding two girls in his bedroom while he attacked them. >> he physically held them against their will, and physically battered them at points during this as well. >> reporter: brody has no relation to the girls. a scary thought to parents. >> because they have kids. i want nobody to touch my kids. >> that's not right. a lot of people in this community are really good people, and we try to make this our home and our community. >> reporter: police say brody's home was different.

they found an unusual collection of child pornography booklets. neighbor jennifer says she saw a girl in and out of brody's duplex, but thought she lived there. police tell me, brody lived alone. >> he didn't seem to be a bad guy. but honestly, you never know who people are. i feel it's good that they finally got him. that way he's not going to be able to hurt any other people. >> reporter: police are urging parents to talk to their children who may have had contact with brody and to report suspected abuse. only on 2 tonight, new details in a case of kayleigh slusher. a monster, that's how kayleigh's grandfather is describing the man who is now under arrest, along with

sara's boyfriend, 26-year-old ryan warner. >> there's a monster that started all of this. i can say 10 months ago, when he came into my daughter's life, it's been, she has been a changed person. >> reporter: her father noticed what neighbors and friends also saw. sara, much thinner, rarely outside, signs of methamphetamine use. >> the sara that i know and love, used to call her dad every day. >> reporter: over time, calls dwindled, and communication became strained. >> she knew i didn't approve of her boyfriend. >> reporter: kruger last spoke to his daughter three weeks ago. he knows people will judge her harshly. >> we need to not focus so much on sara. this is more about kayleigh, than anything else. this is about a little girl who's life was ended way before it was time. >> reporter: calls to the police department, 9 in 9

months without kayleigh being removed. >> you can't really blame the police or circumstances. this is a tragic event all around. i just won't ever have these moments with her. that's going to be the roughest part the rest of my life. she's going to have to live with this day in and day out. >> reporter: john kruger got a lot of support, when dozens of people turned out for a vigil for kayleigh. autopsy results are expected tomorrow. so is his daughter's first court appearance. reporting live in napa, debra villalon. ktvu channel 2 news. >> tonight at 10:30, early warning signs that kayleigh may have been in danger. 2 investigates the long history of police visits to that little girl's home. a man was apparently struck and killed by a train today in oakland. police say he had sustained multiple injuries and died at the scene. investigators believe he was hit by a train and that

operators kept going, not realizing what it happened. so far, there is no word on the man's identity. now to the south bay, where supervisors plan a proposal to fine the san jose fire department if it doesn't improve its time to emergency calls. he says the fire department is not meeting its contractual operation to respond to 90% of medical emergencies within 8 minutes. >> the city of san jose's response time has dropped like a rock over the last several mobilities. it is now down to approximately 80%. >> he is proposing fining san jose $250,000 if it doesn't fix the problem by june. the department says crews responded within the allotted time nearly 88% of the time, when you factor in all

emergencies. u.s. stock markets saw big declines today, extending a slide that began in january. the dow lost 326 points. that's its largest one day drop in 7 months. nasdaq lost 106 to drop below 4,000. the drops were triggered by sluggish growth in manufacturing and autos. this year's stock market tumble has many investors checking their 401(k)s, and perhaps wondering how far it will fall. ktvu's ken wayne is live in san francisco, where he found many investors taking the long view. >> reporter: julie, nobody likes to take a hit on their retirement account, and 326 points can hurt. but investors we talked to seemed to be keeping things in perspective. the bad news was on full display across the city's financial district. for those who check their 401(k), it stings:

>> it's a shake up. a shakeup and a wakeup. >> reporter: many say wall street is due for a correction. with today's loss, the dow is down 7% from its high. >> if it was 700 points like 9/11, then i would be concerned. >> just 300 points down in one day doesn't bother me. because we've had 500 up in one day. >> reporter: wall street analysts warn there could be more downturns ahead. younger investors may be a bit skittish as they start thinking about their retirement plan. >> just have my savings at this point, and things are going fairly well. >> i felt sorry that maybe in another decade it will become more of a private for me about what to do. >> i'm not a spring chicken. >> reporter: yvonne ross has a different take. she has a 401(k).

the group hopes to get a measure on the june ballot that would require any project on the waterfront that exceeds the city's height limit. the design for the warriors project has already been changed twice, and delayed for at least a year. the target date, assuming it gets approved, is now 2018. also in san francisco, the presidio trust shut down three projects for prime real estate aside christy field. the one proposal that's gotten the most attention is filmmaker george lucas' plan for a visual arts museum to house movie memorabilia, and his collection of norman rockwell paintings. >> he has mentioned before, he might move his museum to chicago. i would be terribly, terribly disappointed if he decided to do that. >> a spokesperson for lucas said he will start listening to other offers. the trust museum said they

tonight a new campaign by mineta airport, to lure passengers away from sfo. a look at the battle for your business. >> reporter: frank, san jose airport officials tell me that they saw a 6% increase in passengers over last year. however, they might not be the biggest bay area airport, but any do have big aspirations. on this monday night -- >> it's funny that there's not more traffic going through here. >> reporter: the spacious terminal b is crowded. passengers flying through like it this way. >> it's close to work and i like the access in and out of the airport. >> flying in and out of san francisco and oakland all the time. first time here. not crowded, and nice restaurants and shops. i may actually make the effort to fly out of of here.

>> reporter: passenger travel is still behind the others. still less than oakland's 10 million, and a far cry from san francisco's 44.5 million. >> if i'm doing something international. i would go to sfo. >> reporter: perhaps not by coincidence, san jose's ad campaign comes just as sfo is warning about possible delays because of runway closures and construction there through the summer. reporting live in san jose, jana katsuyama, ktvu, channel 2 news. a juvenile court commissioner ordered a 14-year- old oakland boy today charged with killing his older sister to remain in custody. police say the boy killed 17- year-old justice tolliver in their grandmother's apartment on january 23. authorities searched for the 14- year-old for six days before he surrendered. the district's attorney's office said the boy was a danger to the community, and a

flight risk. the commissioner did give the teen permission to attend his sister's funeral. google is testing out a ferry service for employees in the east bay. today, they launched service between harbor bay and alameda. it's part of a trial program that runs through this friday. google already provides shuttle buses for its employees. this ferry service could become a permanent option, if enough workers choose to use it. and google's mystery barge is getting the boot from treasure island. the san francisco bay conservation and development commission says the project lacks the required permits. the agency is recommending that google move the barge to a permitted construction site. however, the treasure island development authority which leases the barge says it will try to apply for the correct permits. east bay mud says about 2 inches of rain fell in it's northern california watershed. that's more than the entire month of january.

the agency says the reservoirs are 83% of normal right now. >> begun planning for a water shortage emergency, and our board of directors is going to consider voluntary cut backs at the next board meeting on february 11. >> east bay mud serves 1.3 million people. the agency says storms, such as yesterday's, helped saturate the ground so the next storm can produce runoff. ktvu's rob ross did a little investigating today on whether people who have already cut back will have to cut back even more. >> reporter: jonathan petty and his baby showed us the water conservation measures they've already taken in their union city townhouse. water saving shower, and the low flow toilets. he waters the plants with leftover drinking water. petty is not sure if he can conserve much more. >> the future of our water usage is a big question for us.

we have no idea. >> reporter: the alameda water district has asked petty and 3,000 other customers to voluntarily reduce water consumption by 20% from last year. what happens if it orders more reductions? >> how are they going to impose the restriction? are they going to fine us? >> one thing we don't want to do is penalize customers that are being very supportive of our conservation requests. whatever happens next will be designed if we go there to not penalize those customers. >> reporter: the district says if it imposes mandatory restrictions, it may mean reducing, or banning certain practices, such as watering lawns, and it would be on a household average use over time. >> what we'll be looking at is how households have been doing relative to last year. >> it is confusing. >> reporter: several still want to see what happens over the next several months before

deciding whether to impose mandatory restrictions. >> more details now, we also checked with water districts that serve san francisco and marin county. sfpuc told us, rationing for its customers would likely be based on 12 month averages prior to this year. the marin water district says it would base mandatory reductions on up to 5 years of past usage. some people may already be at a level where they don't have to cut back further. showers yesterday, and more showers in the forecast as the jet stream starts to shift south a little bit. that brings us an opportunity for more moisture and clouds. that's going to happen as we med into wednesday night. here we go through tomorrow. 7:00a.m. tomorrow, a few clouds. notice over my shoulder, here comes wednesday morning, right? just some moisture moving offshore. as we move forward into thursday morning, these showers look as though they're going to move through the area.

a report released today concludes san jose state university did nothing wrong with the alleged harassment of a black student by his white roommate. critics are finding fault with both the report and the university. >> reporter: an independent fact finder released his statement today, leading into the alleged harassment of a black student by four of his white roommates. the report says the university only learned of the incidents after the students' parents complained in mid-october and that the university president wasn't fully briefed until five weeks after the investigation began. >> changing some of the protocols so i'll be informed

much more timely fashion. >> reporter: the report concludes in part that quote university staff acted in compliance with relevant policies in past practice. however, evidence demonstrates that campus leadership did not follow its usual practice. the author concedes -- >> i think in terms of getting information which is going to be important to the task force process i do believe it's all there. >> reporter: the task force will resume the report. gary daniels has serious questions about the university's commitment to a diverse campus. >> for the most part, there are reports clear the university of any responsibility, and i feel as though that is unacceptable, considering the campus requirement. >> reporter: they are scheduled to be in court to face

misdemeanor criminal charges in march. from the san jose state university campus, kristin can't -- christian captain, ktvu, channel 2 news. >> our web team has posted the report on ktvu.com under hot topics. new information about the investigation into the death of actor phillip seymour hoffman over the weekend. the oscar winning actor was found dead inside his apartment in manhattan early yesterday morning with a needle in his arm. today police found 50 envelopes and some of those tested positive for heroin. they also found several used syringes, a charred spoon and prescription drugs. results aren't expected until some time tomorrow. police are treating the case as an accidental drug overdose.

phillip seymour hoffman was only 46 years old. new jersey governor chris christie's political aspirations may be taking a hit. a new poll shows he is losing ground in a hypothetical match up with hillary clinton. according to a cnn poll of registered voters, 55% support clinton, the democrat, while 39% support christie. back in december, christie had a 2% lead. but since then he has come under intense scrutiny. the family of former vice president walter mondale is in mourning tonight after his wife, joan mondale died at the age of 83. she was affectionately known as joan of art, for promoting art. she was an accomplished potter, and published three books, including one titled politics in art. no cause of death was released,

new at 10:00, the push to legalize marijuana for recreational use in california. momentum is building for a ballot initiative. in fact, there are now four separate groups collecting signatures for a vote. but among marijuana supporters, there's no united front. >> reporter: frank of the four initiatives now in the pipeline, the owner supports one that will strictly regulate where marijuana could be sold in california. another initiative would do nothing more than make marijuana legal with very few restrictions. all of these initiatives may need millions of dollars just to get on the ballot, much less win. marijuana, is already big business in california. that would only grow with legalization. in the pipeline, four initiatives approved by california secretary of state

to gather signatures. each needs more than 500,000 to qualify for the november ballot. each fighting for signatures and money. >> i think that the all the various different initiative efforts should try and come together on a unified strategy. >> reporter: steve d'angelo says the various sides are momentum, but the critical question is if they can raise enough cash to win. >> as long as we have 60% of poll numbers going into the initiative, and a budget of something like $20 million, we can win initiatives in california. >> reporter: some of the initiatives are already struggling. of all of these initiatives, this one faces the first deadline. february24, to gather half a million signatures. i talked to its author tonight. he says it would take a miracle to get there, but they plan to refile, and try again. division between legalization

proponents would be welcome news to those that want to keep it illegal. opponents of legalization concede that momentum is building. yet they expect to win. >> we're outnumbered. we're outgunned. we have to start early, and now we have already begun our campaign. >> reporter: if any of these efforts should make the november ballot, we should know by summer. in oakland, ken pritchett, ktvu, channel 2 news. the federal transportation department wants to make driving safer by having cars talk to each other. it's called vehicle to vehicle technology, or v2v. the technology allows vehicles to automatically exchange information, such as speed to

warn drivers of a collision or road hazards. >> way beyond what your normal senses can do. >> reporter: transportation officials say it would help reduce the number of collisions, and save lives. the government is working on rules that mandate v2v in three years. some experts say it would take 15 years to get half the cars on the roads equipped. tonight, one of the two generators at the diablo power plant is shut down due to a storm. the electrical arc occurred from a build up of dust and lightning on the plant. the arc happened in a part of the plant that transmits power to the electric grid. the unit will remain offlynn until the incident is investigated and the lightning arrested repaired. tonight, 2 investigates warning signs that 3-year-old kayleigh slusher may have been in a dangerous home situation before her body was found this

past weekend. police spoke with the little girl just days before she was killed. >> reporter: napa police found the body of kayleigh slusher on saturday. but 2 investigates has learned officers had spoken to the girl on two different occasions only days earlier. >> they specifically saw the child? >> yes. >> reporter: one week ago, police checked out a verbal dispute between sara kruger and boyfriend ryan warner. both now accused of killing the girl. officers were back at the request of kayleigh's paternal grandmother. >> we talked to the child. if there was anything suspicious, we would have taken other action. >> reporter: kayleigh's grandmother declined to speak on camera, but confirmed she called police, concerned the girl's mom was on drugs. police responded nine times since may for a variety of

domestic calls. napa county records revealed some of those calls involved disputes with kayleigh's father, jason slusher who's been in prison since october for evading police. in a request to a restraining order last year, sara kruger wrote it was kayleigh's father who had been using meth off and on. >> reporter: eric rasmussen, ktvu, channel 2 news. police and rotor park say there has been no significant jump in crime since the graden casino first opened in november. while there was a slight increase in crime in november and december, compared to last year, police say crime was actually lower when compared to 2009 levels. however, more car thefts were reported near the casino. police say they'll be adding more patrols. donations to help the families of two slain santa

cruz police officers sit untouched almost a year after the officers' deaths. sergeant butch baker and elizabeth butler were shot and killed last february. more than $550,000 poured in to help their families. but the santa cruz sentinel says distribution has been delayed because baker's oldest child from a previous marriage is threatening legal action. the paper says she's upset about a plan to split the money between the two families, because it was originally promoted as a scholarship fund. coming up, a social media site accused of enabling child stalkers and predators. the eye opening information we found just seconds after logging on. >> a round of rain headed to the bay area. how much rain we'll see. >> next, feeling pressure to be perfect? the concern over a rising drug trend and the young group most at risk. one of the best things about covered california is that millions of people

an oakland jury today convicted two men for the death of a photographer who got caught in the crossfire of a gun fight. lionel fluker was a former freelance photographer at the oakland tribune. police say 38-year-old joe mcneily fired the shot that killed fluker. they say mcneily and darnell posten were shooting at each other after the two got into an argument at the gas station. the coroner has identified the victim as 30-year-old earl hamilton. was found shot to death in the parking lot of the green lantern bar. police are investigating the shooting, but have not pinpointed the suspect.

there were protests on both sides of the bay today against the proposed keystone exxon pipeline. some of the protesters call themselves climate parents responsible for protecting the environment. tonight, they gathered on market street to denounce the project, saying it will cause a spike in carbon pollution. earlier today, a smaller protest was held in oakland. protests called on president obama to pull the plug on the project. >> president obama said he wants to look our children in the eye and say he did all he could. all he could means opposing keystone excel, and it means 100% clean, kid safe, climate safe energy. >> labor grouping support the pipeline, which would carry oil from alberta, canada, to the coast. a report said oil inside the

pipeline would not have a signature impact on carbon emissions. six big internet companies are revealing limited information about the government's demands for data about their users. overall, the number of requests from the national security agency jumped in the second half of last year. google, microsoft, apple, facebook, and linked in, all released some basic information. but there are restrictions on how much information they can reveal. google could only say between 0 and 999 requests involving 9,000, it to 9,999 users. steroid use is far more prevalent among gay and bisexual boys than straight boys. the reason for the differences are unclear, but health experts say, issues of bullying, and

the san francisco city attorney has filed a lawsuit against meetme.com. that's a pennsylvania social networking company that boasts millions of users. the city attorney is concerned about protecting children from predators. >> reporter: san francisco city attorney accused meetme.com of breaking the law. these are screen shots from that site, which allows you to filter your search for friends, and pick their ages as young as 14. it tells you that person's location, and this lawsuit says it enables predators. it takes just seconds to sign up, and get connected on a site that calls itself the leading social network for meeting new people. san francisco's city attorney says it's doing much more. >> encourages them to meet young people in the most sort of offensive way, to track

their geolocation. >> reporter: we logged on and within seconds could focus on teens. we reached out on twitter to find users of the social network. that's where we found alex reyes. >> the great to connect, but it's very important to be very careful who you meet with. >> reporter: city attorney dennis herrera says of the tens of millions of users on the site, 25% are under 18. he filed this suit today, arguing that the site violates the privacy of minors, and enables sexual predators, and child stalkers. meetme.com says it employs a 24/7 security team, and says it reviews hundreds of thousands of photos posted to our services every day, and we compare the information employed by our users to a sex offender registry. herrera says it's not enough, and says things need to change drastically.

mobile. bad weather has grounded flights on the east coast. a lot of flights, leaving a lot of super bowl fans stuck. at least one seahawks fan is taking it in stride. >> it's just a couple of hours. even if it was longer than that, i wouldn't care after what happened last night. >> pretty good game for you. >> absolutely. i've been waiting 30 years for this. >> more than 1,000 flights have been canceled across the country. many of them are out of philadelphia, new york, and new jersey. a winter storm moved in right after the super bowl, and dumped more than 6 inches of snow in the region. the rain moved through, then we got sunshine today. temperatures got into the upper 50s. we didn't really see any low 50s. 57 in fremont. highs tomorrow about the same. if you remember last week, we had temperatures in the 60s and 70s. the weather system that's moving in is going to undercut this ridge. right now, it's kind of just going up like this. up and over.

what's going to happen is the jet stream is going to push this weather system in here on monday night. it's not a big weather system, but it will bring a chance of showers. we'll talk about the valley fog. there will be a little patchy fog overnight. dew points in the mid-30s up here in the east bay. overnight lows in the mid-30s, low 30s, and that will get you fog. when the kids go off to school, you go to work. these are chilly temperatures, san jose, downtown 39 degrees. chilly when you leave the house. you've got frost at 38 degrees, easily. the computer model takes us through tomorrow. a few clouds. then we get in wednesday morning. tomorrow is a day a lot like today. here's what happens wednesday morning. then boom, into wednesday evening. it's light shower activity. not heavy rain, but showers. here we go into thursday

morning. wet on the roadway, snow in the mountains. quarter inch if we're lucky. then it moves out, and kind of works it's way out of the sierra nevada. the rainfall accumulations, maybe a half inch. if we work real hard. might get a half inch in the santa cruz mountains. these are high end numbers, but it's something. the thing i point out, is this is the begin of the storms being slightly more open. this is a weak up with. there's more behind this. this high pressure is breaking down, and as it does, we're getting this low pressure, the jet stream slipping south. forecast highs tomorrow, as i mentioned, mostly in the mid- and upper 50s. the five-day forecast, evening showers wednesday. thursday morning commute might be a little bit wet. friday, not much going on. just cold mornings. then saturday night into sunday, sunday it looks kind of juicy now. beyond this, there's more stuff. the storm door is cracked open enough, we're starting to see

movement. even though we're forecasting a quarter inch of rain for oakland. that's good, because it's something to start it off. then this thing on sunday, maybe we get some more. encouraging signs. >> yeah, because there's things on the horizon. >> progressive. >> starting to feel, and look a little more like winter. the super bowl had a really big payoff for nevada casinos. gamblers bet more than $119 million on the game. odds makers said peyton manning fans flooded casinos with wagers. the denver broncos were a slight favorite, but as we all know, the odds makers weren't even close here. the seahawks ended up winning 43-8. if you were a sharks fan, it wasn't smart to bet on the sharks. >> because of it tonight, the flyers will be partying like it's 1999.

better of the sharks tonight. super bowl xlviii was another eye popping reminder of what a devastating defense can do. the warriors prepare for the bobcats tomorrow night. plenty of talk about that super game for seattle. for the players, it wasn't lost on them. certainly not their coach. the impact that great d can make. no matter what sport you're playing. >> it certainly puts a stamp on it. makes people aware of just how important it is. from the beginning, the seahawks just made a statement with the physical play and the enthusiasm. it was awfully impressive. the hype was good defense against great offense. as a coach, i think that really sells the message better than anything you can show them. >> yeah, it got ugly quick. i did not expect that. i actually took the broncos. don't take my advice on betting. just how exactly did he do that shots to win a basketball
