now at noon -- crews are still on the scene of a crash in san jose where a big rig took out power lines and traffic lights. when the major street is expected to reopen. a major development in the murder case out of san jose. why the wrong person was charged with murder. much-needed rain is on the way. we're tracking the storm. we'll tell you when it will hit your neighborhood and how much rain we can expect. good afternoon.

i'm tori campbell. crews are still working to repair power lines and street lights after a big rig slammed into them early today. ktvu's janine de la vega has been on the scene all morning and joins us live from san jose to let us know when the street is expected to open to traffic. good afternoon, janine. >> reporter: good afternoon. electricians are working right now to try to get these traffic lights up and running here on stevens creek near the 880 ramps. this is a very busy intersection near the mall and santana row. we're hearing it could stay closed until at least 5:00 tonight. the accident started at 6:30, a caravan of big rigs was hauling portable classrooms. one of them hit power lines attached to street lights. live wires were strewn near the on and offramps of 880 along

stevens creek. it was frightening for the driver behind. >> we weren't expecting trouble. all of the other trucks exactly the same height as this one went through the intersection no problem. all of a sudden, there was a loud crash and the telephone pole and the lights came out into the intersection and made a big mess. >> reporter: police immediately shut down stevens creek in both directions. it caused a packup for morning commuters who had to take detours. there's a slowdown on 880 approaching the exit because the ramps remained close. pg&e crews deactivated the wires and caltrans and other wires came to the scene to start the lengthy repair process. >> we're working to get the traffic back onto the road and that's not gonna happen until we're able to get traffic signals working. >> reporter: that police lieutenant told me traffic lights were already temporary because there's construction going on at the interchange. he wasn't sure there were

regulations on how low the wires were hanging. that's a possible explanation why the big hit the power lines. this intersection controls traffic coming off the highway. police are just waiting for these electrics to fin -- electricians to finish the job which may not be before the afternoon commute. it's probably a good idea to avoid the area. we ran into a driver who stopped here at the mall and was sort of lost. he said there were not signs on the freeway alerting him to this. so he was lost and trying to figure out how to detour all of this. so again, good idea to a void the area. report -- to avoid the area. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you. major new details in the deadly stabbing of a san jose state student. robert handa has just learned that the wrong person was charged with murder in the case and he joins us now live. good afternoon, robert. >> reporter: good afternoon, tori. as you can imagine, it was quite a stunning moment in the courtroom today.

as you heard, this case here in san jose has attracted a lot of attention because there were two twin brothers arrested. after one was charged with the stabbing murder, it appeared the mystery of allegedly did it was cleared, an hour ago. 18-year-old duc tong was in court today and yesterday and there were strange delays going on with the judge. then this was announced the murder charge against duc was being trapped replaced by charges of the being an accessory after the fact. the prosecutor talked to us afterwards and says the brother, anh, will be charged with the murder. was there any sort of april tempt by these brothers -- attempt by these brothers to mislead investigators? >> what i can tell you about that, they were initially both arrested and booked on murder charges. the investigation has been ongoing and the police detectives have been interviewing witnesses since then. >> reporter: again, anh is in

developing approaching cape mendocino. that will be approaching the coastline later tonight and into tomorrow. what's more important all of this activity offshore, we have a storm track developing out here in the pacific that will impact our weather for this weekend. we're talking about a series of days with moderate to heavy rainfall in the bay area forecast. at least in the short term we do have this -- increasing clouds throughout the afternoon hours. by 5:00, 6:00 and 7:00 we bring the chance of a few scattered light showers especially up in the north bay, things will be trending wetter as we head into late wednesday and thursday. coming up at 12:20, we'll talk about the timing of the heaviest rain for your thursday. we'll talk more about the atmospheric river developing this weekend and more significant rainfall in our five-day forecast. >> thank you. despite the wet weather on the way, the city of pleasanton is declaring a water emergency and asking residents to cut their water use. yesterday zone 7 water officials plan to ask customers to cut back on waterrous by

20%. zone 7 covers dublin, livermore, pleasanton and parts of san ramon but there's also good news about the district water supply. >> they've stored a lot of water underground. we have had 2 to 3 years of water delivery stored underground locally here in the valley. >> pleasanton city officials issued a list of water saving practices. it includes things like washing only full loads of laundry and turning off water while brushing, shaving and washing dishes. napa county is offering rebates to save waters. homeowners can get $100 rebate for replacing old toilets that tend to waste water. otherses range from $50 to $200 go towards old washing machines for newer, water-efficient models. that's similar to the program in san francisco. san francisco police have released the name of the woman they say is responsible for

yesterday's deadly pedestrian crash. ktvu's tara moriarty joins us live from the city with the recent spike in pedestrian deaths there. >> reporter: we're here at octavia and market streets. the most dangerous intersection in the city according to the police chief. this is where the freeway empties into the street. recently the city has seen a spike in the number of pedestrian crashes. there were 21 deaths just last year. the most since 2007. yesterday, an elderly man was struck and killed in a crosswalk on sunset and yorba. the name of the driver is 71- year-old jenny ching. the chief says his department is going to work to curb accidents through sting operations and awareness programs. >> i think the one that got everyone's april tension was on new year's eve when sophia lui was killed in the crosswalk with her mother.

and her boyfriend are accused of beating the child to death. the couple has admitted to putting her body inside a suitcase and in a freezer. last night the mayor of napa demanded more details about several contacts napa police had with the couple in the weeks before her death. >> what did they encounter when they went out there before, what did they say? was all of the proper followup handled? >> the mayor said the grand jury could explore breaksdown in protecting the girl. prosecutors say the drug use appears to be a major factor in the child's death. hayward police and the alameda district attorney's office are investigating the police shooting of a woman last night. investigators say the woman called 911 saying she was depressed. officers say that when they arrived at her apartment complex in the 21000 block of foothill boulevard, the woman was waving a gun around. at some point, one of the

officers opened fire. >> there was five relatively loud gunshots, consecutive gunshots in a row. >> police have not released the nail of the woman shot or of the officer who shot her. we have new details now on the death of actor philip seymour hoffman. police have arrested four people they believe are connected to the heroin found in hoffman's apartment. the arrests came during a raid on the apartment last night. the new york city medical examiner said hoffman's autopsy was inconclusive and more tests will be needed to determine the cause of death. the country's second largest drugstore chain is calling it quits on the tobacco industry. cvs announced today it will no longer sell cigarettes or tobacco-related products in its stores. ktvu's brian flores has more on the decision and reaction to this rather expensive step. >> reporter: in a bold move for the second largest drugstore

chain in the country, cvs announce it's no longer selling sphwrets or tobacco-related products. company leaders say selling tobacco was inconsistent with the purpose, the health of its customers. >> it became clear that removing tobacco products from our stores is the right thing to do. >> reporter: cvs says the change will take a few months and all pro products will be off the shelves by october 1st. the company estimates it will lose did the 2 billion as a result. it's looking at other -- lose $2 billion as a result. it's looking at other opportunities. many say it's a good move. >> i think it's great they are making a move and doing for the better health of everybody. >> reporter: the move, according to company officials, was following san francisco's lead back in 2008 when the board of supervisors back then

banned tobacco sales at pharmacies. while reaction was positive for the most part, there were a few from our facebook page who thought otherwise. jason hunter of manteca said it's not going to stop people from smoking. you are only hurting yourselves. michelle stoner said i think it's a good idea but feel they should stop selling alcohol, too. >> i know smoking is very's dictive. if -- very addictive. if they want to smoke, they will smoke. >> reporter: reaction coming from president obama. he said as one of the largest retailers and pharmacies in america, cvs care mark sets a powerful example and today's decision will help advance my efforts to reloose tobacco- rerelates deaths, cancer and heart disease. and this is not offer for the drugstore chain. they will plan to launch a program to help smokers quit.

business code violations. firefighters are still cleaning untoday after a huge -- up today after a huge fire ripped through an abandoned grocery store in oakland. it started before 9:00 on international boulevard and burned for several hours. firefighters say this is not the first fire -- first fire at this boarded up building. >> no one was here through the arrival. someone was passing by and saw smoke coming out of the building. >> firefighters say previous fires had been started by home les people who broke into the building. no one was inside and the cause of the fire is under investigation. we started out wednesday with a lot of sunshine out there. cold temperatures will be winding up the day with more clouds and lane showers on the -- rain showers on the increase. this is in san francisco already the high clouds moving into this picture, they will be increasing over the next few hours. right now on live

stormtracker2, you can see the coverage out there. this happens to be the loop over the past six hours and you will see the activities so far approaching areas up to the north, especially right around cape mendocino up toward basically mendocino county and approaching humboldt county as well. right now there's a live doppler sweep. we're looking for the rain showers. so far, cloud cover out there. you can see some activity developing out there in the pacific. after a very cold start this morning, temperatures not too warm right now. it's only 48 degrees in santa rosa. san francisco, 51. san jose, 54 degrees. first storm in a series approaching the region for tomorrow. beginning tonight. but for tomorrow, rainfall expectations could be on the order to .5 to 1 inch 1 inch. the time line, 5:00 a.m. to 11:00. this will open up the door for more storms. a lot of moisture out here in the pacific. basically things are coming together to set up what we call the atmospheric river. the key here, it's a defined

area of heavy rainfall. it just depends where it is. that will produce a significant rainfall. the first system for your thursday. friday there is a slight chance of a shower especially by friday afternoon into the evening hours. into the weekend, we'll be tracking more rainfall. could be heavy at times. these numbers will not be spot on. you get an idea, this is the rainfall forecast fod model through the weekend -- forecast model through the weekend. we could be measuring totals in inches. especially in the bay area, could be on the order of 1 to 3 inches. we have this in the short term, the cloud cover. you will see what happens tonight. the rain showers increase in coverage. first thing tomorrow morning for the commute. there will be plenty of wet roadways out there. be extra careful and still some scattered showers. forecast highs this afternoon. increasing clouds, chance of a shower early this evening even late this afternoon up in the north bay. temperatures mainly in the mid-
