"mornings on 2" starts now. groorming. welcome to -- good morning. welcome to "mornings on 2." we're live where police are investigating the third pedestrian death on van ness avenue this year. what happened to the driver involved. that's coming up in a live report. good morning. i'm tori campbell. >> i'ming dave clark -- i'm dave clark. let's get to steve. a beautiful sunrise. we have a foggy morning. but a beautiful sunrise. a lot of fog. be careful. it's getting thicker here and visibility could be pretty bad in spots. a lot of high clouds to the

north. maybe rain late tonight, tomorrow morning. that would be for the north bay. the dense fog returns because we had rain, especially to the north bay. it's called the raidation fog. it seems to be less today than yesterday. mostly sunny south bay. i think it will be on the mild to warm side. 40s on the temperatures. temperatures have been stuck tu to these high, thin clouds coming over. the rain line is way to the north. it may dip south by this time tomorrow. not that far south. probably mendocino county,lake county. but drizzle. it looks like it will be in the forecast for us. mostly sunny to the south. 60s for some. upper 50s for others. here's sal. steve, good morning. we're looking at a commute that's moderately avenue. we have problems to report. first of all, let's take a look at the commute at the toll plaza. pardon me. westbound, bay bridge backed up

for a 25, 30-minute wait. that's the drive time into the city. no major problems into the city. and the earlier stall was not there very long. the traffic is pretty normal getting into the city. also if you are driving on 880 northbound and southbound, this has been a normal commute. it does begin to slow on southbound 880 right through hayward. but it gets better by the time you reach union city. speaking. that area, there's an injury -- speaking of that area there's an injury crash at care row carol avenue -- at carol avenue. a good area to avoid. back to the desk. we begin with new information about a deadly pedestrian crash in san francisco. it happened just before 1:00 a.m. at van ness and pacific avenues. it's the fourth pedestrian death in the city in six weeks. ktvu's tara moriarty has been at the scene since 4:30 and has details on why police just announced the driver has been

arrested. good morning, tara. >> reporter: well, good morning. we do want to mention the fact that van ness is now open between pacific and jackson. it was actually closed for about five hours because of this fatal accident. so the morning commute should go off without a hitch, at least in this area of town. we do want to mention that the person who struck and killed a pedestrian has been arrested for vehicular manslaughter as well as felony hit and run. witnesses say he was trying to leave the scene before police arrived. now, this all happened around 1:00 in the morning. the witness says that the suspect was driving southbound on van ness as fast as you could on a freeway, perhaps around 65 miles an hour. this is the third crash on van ness. police say the driver of the silver compact hit the man and the force of the impact so great that it shattered the windshield and caused the hood and roof to cave in. about a month ago, down the

street, a 36-year-old man -- a 38-year-old man, i should say, was struck and killed by a driver after he ran across the street, crossing several lanes of traffic following an argument. and then last week, an elderly man was struck and killed on sunset boulevard and yorba by an elderly woman. the next morning, another person was killed on van ness near city hall in a hit and run. last year, there were 21 deadly pedestrian car crashes. this year, officers say they've been really cracking down on issuing traffic citations for both pedestrians and drivers and the number of tickets was up about 43% for them as of january. we'll have to wait and see what the figures are like for february. live from san francisco, i'm tara moriarty, ktvu channel 2 news. >> thank you. more details now. a special service is planned for tomorrow morning in san francisco by families of victims as well as pedestrians who survived crashes. they will gather at van ness and grove, where, as tara mentioned, there were two recent crashes and it's not far from today's death.

organizers will hold valentines for their loved ones as they support the city's vision zero program, which sets a goal of zero pedestrian deaths in ten years. a statewide amber alert still in effect as police investigate a possible carjacking in oakland. take a look at one freeway sign showing that amber alert along interstate 880 in oakland. police all over the state are searching for three people in this kate. there are a lot of question -- case. there are a lot of questions involving a suspected shoplifter, a man and a 13-year- old girl. now, last night, police released this video of the shoplifting suspect in oakland. it was taken moments before he left the safeway store near highway 13 in oakland yesterday afternoon. witnesses say the man had a knife when he jumped into a parked vehicle and took off with a man and teenager inside. so far, no missing person report has been filed by family or friends of the two possible

victims. however, investigators are still treating this case as a possible stranger abduction. they say the three people could be in a car with this california license plate, 6jfm648. police say the car is probably a red sedan. now, ktvu's alex savidge has been on this story all morning. he will have a live report for you coming up at 7:30. a night of fun overnight turned deadly for a man in san jose. he was killed outside of a bar this morning. ktvu's janine de la vega joining us live from san jose now to tell us about the arrest that was made this morning and also how this case is affecting commuters. janine? >> reporter: things are slowly returning back to normal. police just opened back up east santa clara street near market street a short while ago. one of the westbound lanes between first and second street

is closed while investigators wrap up. now, their focus all morning has been outside johnny's bar where the stabbing occurred. now, in the last hour, these two men who say they are friends of the man who died outside of the bar approached the crime state. they were very emotional. they were at johnny's before the night before the stabbing happened but didn't want to talk more. some sort of argument started inside the bar at 1:30. it got heated, spilled out in the street and that's when a man was stabbed. there were many patrons who witnessed the incident and flagged down an officer moments after the stabbing occurred. >> witnesses pointed out the suspect, the possible suspect, and the officers went over there and made contact with them. >> reporter: was he trying to get away? >> it appears he was walking away in the opposite direction. >> reporter: officers were able to find the knife that they believe was used in the stabbing. at this point, no word on what the argument was about or if

the two men knew each other. police tell me that the suspect and the victim both appear to be in their 20s but their identities are not being revealed yet. now, for a while, this was affecting vta service. but the platforms opened up a little while ago. but bus service was also affected. right now, buses can't go -- go around the portion of santa clara. so if you do need to catch the 522 or the 22 westbound, you need to go to santa clara and market street. but again, police expect to have everything back open including that one westbound lane here on east santa clara in the next -- just in the -- definitely in the next half- hour. janine de la vega, ktvu channel 2 news. >> thank you. 7:09. the families of nine boys are filing lawsuits against a bay area elementary schoolteacher. the boys all claim that 45-year-

old joseph martin physically, emotionally and sexually abused them. he faces charges and is scheduled to go on trial next month. the families are suing the mt. diablo school district and a dozen current and former district employees. the boys who are not being identified attended woodside school in concord when the alleged abuse occurred. the district is accused of failing to report abuse. a grand jury has intitled an toe lynn garcia-er to -- antolin garcia-torres in the sierra lamar case. her body was never found. prosecutors say her dna was found in garcia-torres's car. >> any kind of progress at this point would be welcomed because we've been waiting for almost

two years now. and it's been really frustrating for the family. >> prosecutors say the indictment eliminates the need now for a preliminary hearing. so the case can go to trial. garcia-torres is scheduled to be indicted on the new charges tomorrow. happening today -- students at san jose state will hold a summit on the recent hate crime on campus. the black student union and the african-american fraternity will discuss the case at 6:00 at dudley morehead hall on campus. an african-american student is claiming that four white roommates tormented him, put a bike lock around his neck and put a confederate flag up by his window. police say vandals stole a stain-glassed window from the church in the tenderloin. church officials say the window

is 106 years old and there are few like it in the world. >> i don't know who would take it and what they would do with it. it would be very -- i think it would be very difficult to sell it or, you know, pawn it. >> the church is well known in the tenderloin for allowing the homeless to sleep in its pews at night. church officials say they don't believe the thief was one of the home les people. police say there are no suspects so far. 7:12. fans of shirley temple had to find an alternative to putting flowers on her hollywood walk of fame star. that is the traditional way to honor entertainment legends. but temple's star was temporarily removed because the sidewalk is closed. so fans put flowers near the women and film gazebo on hollywood boulevard instead. included there, a lollipop, in honor of had her son "on the

good ship lollipop" from the 1934 movie "bright eyes." happy 10th wedding anniversary. we'll tell you what's happening today, celebrating the pioneering same-sex marriages that happened at san francisco city hall ten years ago. a school bus driver and a student in wisconsin get into a fight while the bus is moving. what prompted the violence. right now, we are looking at a commute that is pretty slow in many areas, including highway 4. we'll tell you more about the contra costa commute along with the bay bridge. already some filtered sun out there. a lot of high clouds in the north bay and plenty of pockets of fog. some of that is very thick. maybe some rain this week. we'll see. we'll talk about what could be better next week.

boy attacking a bus driver on a moving bus. and the bus driver fights back. the student was mad that the driver demanded to see his i.d. for being disruptive. the driver got up from the steering wheel and fought back. the bus kept rolling. look. it hit three cars before it came to a stop. the teenaged boy is facing charges of battery in juvenile court. the driver, he's been fired. a winter storm in the southeast has knocked out power to 93,000 people, also all of today's flights between san francisco and atlanta have been canceled. our reporter is live in atlanta with a look at the conditions there right now. looks pretty chilly, sara. >> reporter: it is. we're just east of atlanta actually in a suburb.

here's it's been on-and-off freezing rain. you can really hear the difference when that freezing rain hits the ground and it's ice and it turns to ice and it makes for a very slick road, very slick sidewalks. they are telling everyone, please stay inside because over the course of the next day or so, some areas could see up to an inch of ice. the first round of this week's winter storms brought ice and snow to the southern states from texas to north carolina. the major problems so far and the major concern looking into the future is ice. >> there's no way you can deal with ice. i don't care what yankees say. you can't drive in ice. >> reporter: the icy conditions have been blamed for a number of crashes, weather related incidents killed at least five people including three in texas who died in an ambulance, lost control, overturned and caught fire and two in mississippi died in two different crashes. more than 2400 flights have

been canceled ahead of the storm. amtrak says it suspended rail service, too. in the south, the mid-atlantic and the northeast. georgia's governor warned wednesday's weather could be much worse. >> i would caution everyone that the second round will be much more serious than what we've seen today in metropolitan atlanta. >> reporter: in a tuesday teleconference, the national weather service briefed emergency officials in the atlanta area on what was to come, warning ice storms could have a catastrophic effect leaving some people without electricity for as much as a week. >> this is not gonna be the same kind of event we had a couple of weeks ago where we had more traffic tieups. we'll lose power and folks will probably have to be rescued, et cetera. >> we're not kidding. we're not crying wolf. it's serious business. >> reporter: now, you heard the georgia governor say it's serious. one of the things they are most concerned about is the potential for a lot of people

to be without power. when you have this amount of ice falling in a short period of time, there's always the potential that a lot of people, downed power lines and downed trees could lose power. crews have been brought in from other states to be prepared, to have the crews work on that. we've also noticed the roads were -- sand was put down on the roads before the ice started to fall, which is different. a couple of weeks ago, the city was completely caught offguard by a storm that, quite frankly, was much less mile -- or much more mild than this one. this one is predicted to be a lot worse than that. kids are home from school today. a lot of people are not going to work. they are staying off the roads and officials are hoping that that will prevent those same problems, that same gridlock from happening again. reporting live in decatur georgia, back to you. >> all right. thank you. 7:19. kentucky senator rand paul plans to file a class-action lawsuit against president obama

and top officials in the national security agency over the government's surveillance program. the senator's political action committee said paul will file the lawsuit today. the nsa has been under fire since edward snowden leaked information about the surveillance programs. rand paul is a potential republican 2016 presidential candidate. he's been a critic of u.s. surveillance programs saying they infringe on basic civil liberties. president obama will sign his promised executive order to raise the federal minimum wage for federal contractors. he first announced the measure during his state of the union address. it raises the minimum wage for federal contractors from $7.25 an hour to $10.10. the president is also calling on congress to pass legislation to raise minimum wages for all workers to the same level. all right. 7:20. let's get everybody out the

door. sal, have you taken care of highway 24? >> we're trying to. it's a little bit slow out there on 24, between walnut creek and oakland. but it's not something we haven't seen. for example, the traffic continues to move along pretty well here on 24. but it's a 12-minute drive time between walnut creek and the tunnel and then more time on the other side. taking a look at the toll plaza, this is about a 30- minute delay before you get into san francisco. maybe a little more than that. maybe 35. i'm gonna say 35 minutes. live drive time for the average time, anyway, unless you are in the carpool lane. in san jose, northbound 101, slow traffic getting into sunnyvale, 85 slows at 87. 280 is the best bet getting up to highway 17. slow traffic. 680 and 880 getting down to the south bay. and slow traffic on 101 on the peninsula as you drive down 292. 7:21. let's go to steve. >> thank you, sir. kind of a cool shot here. higher clouds. but the fog snaking its way

around. some of it is really, really thick. in fact, no -- no fog advisory but things have thickened up here in the last hour. it should be this way until 9:00 and then it begins to lift and burn off. a lot of high cloud in the north bay. kind of a split forecast here. mostly cloudy to the clowrgt and mostly sunny to the south -- north and mostly sunny to the south. patchy, thick fog in spots. this may lead to light rain for the north bay. i think it will be mainly mendocino county, lake county. it does not look like much but we'll probably get some drizzle tomorrow morning. 40s on the temperatures. they haven't moved all morning long. higher cloud continue. we're on the southern edge of the moisture. it's 9 in chicago. that's a heat wave compared to what they've been. they've been subzero.

it just came across on twitter. the pictures coming in from atlanta. there's nobody out. it's a ghost town. rightfully so because they are getting the ice and it extends all the way to augusta, the best thing that could happen, snow. that would be better than the freezing rain. the rain line is far enough to the south. it's a mixed precip its a mess. it will be awful. there will be all sorts of downed trees and power lines all the way into the carolinas. that's heading to new york and washington and boston tomorrow. we have a lot of moisture but it's heading up towards the oregon border. a wind advisory is out. the moisture source is very, very heavy. it was over the north bay. overall, though, everything stays to the north. there could be a dip in the jet stream. it doesn't look like much. santa rosa showing up, .07. that would be by through saturday. i think that's a little overdone. we'll see. maybe we'll get a little bit out of it. fog, sun. a lot of clouds. a lot more sunshine.

ktvu's alex savidge will have more on who police are looking for and some of the strange twists we're learning about in this case. that's all coming up in a live report. good morning. welcome back to "mornings on 2." i'm tori campbell. >> i'm dave clark. a lot to tell you about. weather, traffic. steve's right over there. we have some fog. there's foggy conditions out there. a lot of high clouds. kind of favoring more to the north. but all part of that moisture source which was over us on the weekend has moved north. up near the oregon border. for us some of these higher clouds continue to drift across. mostly cloudy up in the north bay. machine to the south. 40s on the temperatures. very low 50s. again, kind of cool, chilly for some. that fog is thick. visibility quarter mile or less for a few locations especially around san jose or blossom hill. makes more sense to have fewer clouds. fog, sun, clouds, mix of sun and clouds here today. temperatures upper 50s for some. even some mid-60s for others, especially down towards the santa clara valley. here's sal.

traffic is moving along slowly in some areas. i want to point that traffic in san jose northbound 280 is slow from just before bascom avenue overcrossing. but 280 is the best freeway. 101 is slow from near the capitol expressway stop/start traffic up to sunnyvale. let's talk about the commute at the toll plaza. it's about a 35 to 40-minute drive time into san francisco. want to mention the peninsula, 101 south. backed out of burlingame to san mateo. 208 is a pretty good alternate there as we move to 280 out the daly city it slows to san bruno. southbound 101 is a better call there. 7:33. let's go back to the desk. >> all right. an amber alert still in effect this morning after the apparent kidnapping of an elderly man and a 13-year-old girl. now, oakland police think the two were carjacked yesterday outside of a supermarket. ktvu's lz also joining us live

-- ktvu's alex savidge is joining us live. >> reporter: one of the big questions, who the potential kidnapping victims are. that's something that's not been answered. no one has come forward to report this pair missing, yet police believe this was a stranger abduction. that's why as you head out the door, you will notice the caltrans signs are lit up along bay area freeways with information on this amber alert and the car. police are asking you to be on the look out for it. let me show youview released -- show you video released late last night. it's of the suspected kidnapper. it was taken inside the safeway store on redwood road near highway 13. police say the man initially was shoplifting inside the store. he was armed with a knife. witnesses say he then ran through the store, jumped into a parked car with an elderly man and a teenaged girl inside of it and that car sped off from the parking lot. witnesses told police it was clear the man and the girl were

in trouble. >> we're working with the federal -- with federal agencies as well as local agencies. one of our federal partners is the fbi. they've assisted us. >> reporter: oakland police say the suspected kidnapper they are looking for is described as a plaque man in his 40s, he's about 5'7", about 165 pounds. investigators believe that man and his two potential victims are in a red sedan, possibly a maroon sedan with california plates on it. 6jfm648. this morning i was told by oakland police by a spokesperson there's no new information in this case, no updates. the search still ongoing for those potential kidnapping victims. we're live this morning in oakland, alex savidge, ktvu channel 2 news. >> thank you, alex. 7:35. san francisco police are searching for two suspects from an overnight chase that ended in south san francisco.

it started last night when police spotted this silver suv at haas street wanted in connection with a shooting. the suv driver led police on a chase down highway 101 that ended when the suv crashed into another car near highway 380. police arrested the driver and are searching for two passengers who ran from police. police say several guns were found inside the suv. 7:38. police in gilroy investigating that city's first homicide of the year. investigators say two men got into a fight last night near a park. two other men became involved and someone pulled out a gun and started shooting. a 68-year-old man was shot and killed. a 34-year-old man was suffered life-threatening wounds. police are out there searching for two people who fled the scene in a white compact car. children walking to school in san leandro should pay extra attention this morning. a 13-year-old girl heading to bancroft middle school

yesterday says a man in a car pulled up alongside her and he told the girl that her mom wanted him to give her a ride. the girl ran to her school and alerted her teachers. the suspect is described as an african-american man, about 30 years old, he wore a camouflage baseball cap. he drove a car similar to a black chrysler 300 with tinted windows. 7:37. happening today -- french president francois hollande comes here to the bay area. he will stop here at san francisco city hall and meet with silicon valley leaders. this follows his two-day visit in washington. he was honored last night by president obama with a state dinner. now, president obama paid tribute to the close ties between the united states and france. >> it is true that we americans have grown to love all things french, the film, the food, the

[laughter] >> now, among the more than 300 guests at the white house state dinner, a lot of celebrities. there's julia dreyfus. 7:37. today marks ten years since the city of san francisco handed out the first marriage licenses to same-sex couples. as we've seen a lot has changed since those were first issued ten years ago. ktvu's brian flores is live in san francisco city hall with reaction to this historic anniversary. good morning, brian. >> reporter: good morning. a lot has changed since those first wedding ceremonies took place and licenses issued to the first guy marriage couples out there. this afternoon, many people including mayor newsom will hold a special ceremony behind me here at city hall. that's planned for 5:00 p.m. tonight. guest speakers include ed lee as well as newsom.

speaking of newsom, his move to issue same-sex marriage licenses to 4,000 couples was pushed back at the time. many remember the long lines of couples waiting to get married. that went on for a month. that launched several court battles and then you had to struggle with the battle over prop 8. that was brewing at the polls and then the eventual defeat with the supreme court allowing it to stand. during a ceremony this afternoon, newsom and several others will be honored for their work. we spoke to people at the castro district to see how they arerring the anniversary -- are remembering the anniversary. >> freedom for everyone is freedom for everyone. i believed it all of this time. being almost 40 did i think in my lifetime? maybe not. i love it. more power to us and to everyone, actually. >> it was interesting to see how it all played out. there was, you know, it's one

of those issues that has a lot of back and forth. a lot of repeal and reinstatement. >> reporter: according to the county clerk's office, the amount of marriage appointments have increased on a per week basis. the county says they average more than 300 appointments for marriage licenses and that number continues to grow. some of the first same-sex couples that got married ten years ago plan on attending the ceremony this afternoon and some say today will be a renewing of their vows. now, to go along with the ceremony tonight, tomorrow night, another ceremony will take place at grace cathedral church off california street to mark this very special anniversary. we're live here in san francisco, brian flores, ktvu channel 2 news. 7:40. in the meantime, a legal battle over gay marriage is taking place in another state this morning. a judge is set to hear arguments in a lawsuit challenging the bal on same-sex marriage in texas. attorneys for two gay couples will have the federal judge to immediately lift the ban while

a trial takes place. they say the texas law illegally diskim nates against them -- discriminates against them because of their sexual orientation. dr. susan hogan performed several autopsies, including one on 13-year-old janle conway ail en. she was found raped and killed in a fairfield park a year ago. the daily republic newspaper reported that hogan e-mailed the prosecutor suggesting the sex between janle and her alleged attacker might have been consensual and her death was accidental. defense lawyers are reviewing cases where hogan investigated. >> my office as well as the private defense bar in solano county are investigating whether or not dr. hogan was incompetent or competent, honest or dishonest. >> the hearing in allen's case

is the third deadly accident that's happened here. the good news, van ness is open. it's been closed for four years, sinc early it morning -- since early this morning. police arrested the driver who struck and killed the pedestrian for vehicular manslaughter and fellly hit and run. a witness says the suspect was driving as fast on van ness as he would on the freeway. perhaps around 65 miles an hour. this is the fourth deadly crash involving a pedestrian since the new year. the force of this crash was so great that it shattered the wild sheend and put a hole right through it. about a month ago, just down the street from here on van ness, a 38-year-old man was struck and killed by a driver after he ran into a street crossing several lanes of traffic following an argument. last week an elderly man was struck and killed on sunset boulevard. the next morning another person

killed on van ness near city hall. the police chief said his officers had been cracking down, issuing a lot of citations and the number of tickets was up 43% for the month of january. live from san francisco, i'm tara moriarty, ktvu channel 2 news. more details now -- a special service is planned for tomorrow morning in san francisco by families of victims as well as pedestrians who survived crashes. they will gather at van ness and grove where, as tara mentioned, there were two reap sent crashes. organizers -- recent crashes. oh,ers will hold valentines for their loved ones as they support the vision zero program. that sets a goal of zero pedestrian deaths in ten years. turning to our other top story -- ta statewide -- a statewide amber alert still in effect. last night police released this new video you are looking at of the shoplifting suspect who is the focus of this amber alert.

this was taken yesterday afternoon moments before he left the safeway store near highway 13 in oakland. witnesses say the man had a knife when he jumped into a parked vehicle and took off with a man and a teenaged girl inside. but there are a lot of questions about this incident. ktvu's alex savidge will explain it all coming up at 8:30. 8:05. happening now -- an investigation continues into a deadly stabbing in san jose. police say a man was killed outside a bar this morning. this is the city's sixth homicide of the year. ktvu's janine de la vega joins us live from san jose to tell us about the arrest that was made this morning and new information that you just learned about the victim. janine? >> reporter: tori, i'm standing at east santa clara near market. this is where the suspect was arrested. it's about a block away from where the staning occurred outside -- stabbing occurred outside of johnny's. police say witnesses told them that the victim works at a bar downtown.

it's unclear if it was this bar. it may have been a different establishment. police say some sort of argument started inside the bar, it got heated, spilled out in the street and that's when a man was stabbed. crews performed cpr but the man died at the hospital. there were many witnesses at the scene. someone flagged down an officer. the suspect was walking away. he was immediately taken into custody. >> there may have been alcohol involved. we don't know the relationships between the victim, suspect and witnesses. >> reporter: gang-related? >> it does not appear to be gang-related. >> reporter: earlier this morning, these two men who say they are friends of the man who died approached the crime tape and were very emotional. they were at johnthy's earlier in the night before the stabbing happened but didn't want to talk. officers were able to find the knife that they believe was used in the stabbing. at this point, there's no word what the arcment was about or

if the -- arcment was about or if the two -- argument was about or if the two new each other. this did affect vta light rail and bus service around santa clara because police had the road blocked off for at least five or six hours. service was restored shortly before 7:00 this morning. reporting live from san jose, janine de la vega, ktvu channel 2 news. 8:07. new this morning, a federal judge has just set a trial date for the suspect in the boston marathon bombing case. dzhokhar tsarnaev is set to go on trial november 3rd for the bombing that killed three people and injured 260 others. the judge sided with prosecutors. they wanted the trial to begin this fall. the defense lawyers wanted the judge to delay the trial until 2015 or even longer. if he's convicted, the 20-year- old bombing suspect could get the death penalty. the families of nine boys are filing lawsuits against a

bay area elementary schoolteacher. the boys claim that 45-year-old joseph morton, physically, emotionally and sexually abused them. martin is facing 125 felony molestation charges and is scheduled to go on trial next month. the families are also suing the mt. diablo school district and a dozen current and former district employees. the boys attended woodside school when the alleged abuse occurred. the lawsuit accuse district workers of failing to report earlier warnings of abuse by martin. a grand jury is now indicted -- has now indicted antolin garcia-torres for the murder of morgan hill teenager sierra lamar and also for attempting to kidnap three other women in 2009. the indictment comes almost two years after antolin garcia- torres was first charged with kidnapping and killing sierra lamar. her body was never found. but prosecutors say her dna was found in antolin garcia- torres's car. >> any kind of progress at this

point would be welcomed because we've been waiting for almost two years now and it's been really frustrating for the family. >> prosecutors say the indictment eliminates the need now for a preliminary hearing so the case can go to trial. antolin garcia-torres is scheduled to be arraigned tomorrow on the new charges from the indictment. also happening today -- a summit meeting by san jose state students about the recent hate crime on the campus there. it is organized by the black student union and the african- american fraternity alpha phi alpha. it will focus on the african- american student who claimed that four white roommates tormented him, put a bike lock around his neck and held a confederate flag outside of the dorm window. tonight's meeting is at the dudley more campus. 40-year-old timothy rodriquez is a former grad student instructor at the

university. police say on january 25th, he met a female student at a nearby bar. she reported feeling sick after leaving her drink unattended. rodriquez was arrested for a sexual assault and possession of controlled substances. a bay area nonprofit will make a big announcement today about an event that's expected to attract thousands of students from all over the state. the nonprofit we the children is expected to announce the youth education event will take place at the oracle arena in oakland. it will be hosted by natalie portman and manic jonson. 16,000 -- magic johnson. 16,000 students from all over came are expected to attend. california drivers are starting to notice they are paying more for gas in the last few days. gas prices go up as refineries go offline for winter

sal, how's the toll plaza doing? >> it's a little bit slow. we might see some as we get closer to 9:00. but right now, it's still jam packed, 45-minute drive time if you are at the end of the line. i keep looking at the bridge to make sure we're not missing any crash on there. when there is a crash osh the bridge, it looks like it's at a dead stop. here we're moving a little bit. it's just very crowded. 45-minute drive time. let's take a look at the commute on the san mateo bridge. the commute looks okay. if you are wondering whether it's worth it to go around to the san mateo bridge, i would say probably not. you will encounter slow traffic in hayward as well and slow traffic on the peninsula. it's about the same drive time, that is. this is a look at 580, the pass commute has improved. dublin looks all right but 880 as i mentioned, slow from 238 all the way down to fremont and on the peninsula, you have slow

mountain view, 49. everyone is close here. mix of clouds. it's really ugly, ugly situation in the deep south, especially around atlanta to south carolina, freezing rain. they sent a picture of the -- one of the tv stations. it was a cbs station. this much ice in the parking lot. i mean, how do you get around that? you just can't. that will cause all sorts of problems down in atlanta and also in augusta, i've seen omfreezing rain there. it looks -- some freezing rain there. it looks -- the snow is lifting north. the freezing rain continues to move through. this is a really bad situation for all involved there. it's a ghost town the you see pictures from atlanta. nobody is out. cloud cover going to produce pretty heavy rain up towards mendocino county north. this moisture will continue to take aim to the north. over us, it just drifts south a little bit.

that's more than any other breed. the little dog named sky. beautiful girl, defeated a standard poodle. a portuguese water dog and a bloodhound in the final round. more than 2800 dogs competed in the show. well, there's high-tech ways for you to find a lot of dog. it's a new app -- a lost dog. it's a new app. it uses facial recognition technology and photos. the app allows people to register their dog in a special database and if someone seeps a dog that gets lost -- sees a dog that gets lost, they can smap a photo -- snap a photo. they say this comes in response to a heartbreaking problem for pet owners. >> i think the statistics are 9 million dogs were lost in the united states alone last year i think the number 30%, 40% make it home. we're gonna change that. >> the finding rover app was

tomorrow morning up towards mendocino county, lake county. there will be some very heavy rain points north. but for us, everyone is calmed down in the rain department. next week is looking better. fog, sun, cloud. mid- to upper 60s. a lot of upper 50s or low 60s with the cloud cover. here's sal. we have a problem in richmond. chp just issued a sig-alert saying they've closed 580 eastbound. that would be coming away from the richmond bridge at harbor boulevard. it's interesting. i don't see the road sensors indicating a lot of slow traffic there. maybe there's no traffic there eastbound 580 at harbor. but they've put that out. there is a -- some sort of a hazmat situation on harbor and hoffman on city streets below the police are there and they are using chp as traffic control to keep people away from this situation. we'll try to find out more for you. let's go to live pictures and show you the bay bridge. finally, it's showing some improvement.

released this new surveillance video of the man believed to be at the center of this kidnapping case. it was taken inside the safeway store on redwood road near highway 13. police say this man was shoplifting and as armed with a knife. witnesses say he ran from the store and jumped into a parked car with an elderly man and a teenaged girl still inside of it. that car then sped out of the parking lot. witnesses told police it was clear the man and the girl were in trouble. >> we also have information reported to us by witnesses that the okay pants of that vehicle did not know the suspects. >> reporter: police say the suspected kidnapper they are searching for this morning is a black man, believed to be in his 40s. he's about 5'7" and about 165 pounds. investigators believe that man and his two potential victims will be in a red or maroon sedan. it has california plates on it.

recently retired. dr. susan hogan performed several autopsies including one on janel conway allen. she was found raped and killed in a fairfield park. a report said that dr. hogan e- mailed the prosecutor suggesting the sex between the girl and her alleged attacker might have been conseen ual and that her -- consensual and that her death was accidental. defense attorneys are reviewing cases that dr. hogan investigated. >> my office, we're still investigating whether or not dr. hogan was incompetent, competent, honest or dishonest. >> the next hearing in allen's case, that's scheduled in two weeks. at least two dozen san francisco firefighters are being subpoenaed to testify in front of a criminal grand jury. this video from june 29th shows an allegedly drunk firefighter hitting a motorcyclist with his truck and leaving the scene.

according to the san francisco chronicle, the grand jury is investigating whether other firefighters tried to help cover up what happened. the firefighter involved registered a blood alcohol level of 0.13 of a the accident. the motorcyclist suffered broken bones and a punctured lung. today marks 10 years since the city of san francisco handed out the first marriage licenses to same-sex couples. as we've seen a lot has changed since then. brian flores joining us live in san francisco city hall with reaction to this historic anniversary. good morning, brian. >> reporter: good morning, dave. well, certainly a lot has changed since those first ceremonies took place and those licenses were first issued ten years ago today, hard to believe for many people. well, today as well. a special ceremony will take place right here at san francisco's city hall. that's scheduled to take place at 5:00 p.m. again here at city hall this

afternoon. guest speakers include mayor lee and gavin newsom. at the time ten years ago, newsom's move to issue same-sex marriage licenses to some 4,000 couples was at first met with scorn and pushback. many remember the long lines of same-sex couples waiting to get married. that went on for a month until the state court stopped it from continuing. that launched several court battles and you had the struggle to get to this point with the battle over proposition 8. that brewed at the polls first and then the defeat by the supreme court allowing gay marriage to stand and opening up the opportunity for other states to follow suit. during the ceremony, newsom and others will be honored for their work. we spoke to others in the castro district to see how they are remembering the anniversary. >> i never thought it would actually come through but, yeah, i'm actually very happy for those who are able to, you know, marry who they love. >> what's great about the marriage thing. it opens up all of the federal benefits for guy couples and --

on some of the other top stories we're following for you -- police in san jose made an arrest in a deadly overnight stabbing. police say a man was stabbed after a fight at a bar spilled out in the streets. the customers flagged down a police officer and they took the suspect into custody. san francisco police have arrested the driver suspected of hitting and killing a pedestrian early this morning in pacific heights. it was a fourth pedestrian death in san francisco in six weeks. ktvu's tara moriarty has been on the story all morning. you have details now on the arrest. tara? >> reporter: that's right. we want to mention that van ness at this particular intersection was shut down for about five hours very early this morning. now you can see that southbound traffic is flowing here between pacific and jackson streets. it has been since about 6:00 this morning. police have arrested the driver who struck and killed the pedestrian for vehicular manslaughter and felony hit and run. the force of this crash was so

great, it shattered the windshield, put a hole through it and caused the hood and roof to cave in. witnesses say it all unfolded before 1:00 this morning. the suspect driving as fast on van ness as he would on the freeway. this is the fourth deadly crash involving a crash since the new year and the third one on van ness. about a month ago, down the street, a 38-year-old man was struck and killed by a driver after he ran into the street crouseing several lanes of traffic following age argument. last week an elderly man was struck and killed on sunset boulevard by an elderly woman and the next morning another person killed on van ness near city hall in a hit and run. the police chief said his officers have been cracking down issuing a lot of traffic citations for both pedestrians an drivers and the number of tickets was up 43% during last month. we also want to mention there was a very serious accident at the corner of market and octavia sometime overnight. we understand that that victim, the pedestrian is still in very

ktvu news has just confirmed that two workers at the tesoro refinery in martinez were injured when they were splashed with acid. this is new video of the accident scene. the two victims were airlifted to uc davis medical center. there's no word on their condition. it's not clear what caused the accident at the facility. next thing i hear is i love

jesus christ and i hear a smash. >> now, a los angeles tv news cruise captured a man attacking a police car. this happened yesterday afternoon on the hollywood walk of fame. victor bargas called 911 after seeing the man smashing the police car's windows. he was still rolling as the man reached into the police car and stole some things. he was later arrested by police. 8:54. continuing coverage now of a channel 2 investigation that's prompted a state assemblyman to take action. our story exposed a loophole that allows drivers to dodge bridge tolls by using dealer placards that come on new cars. that caused the state millions of dollars in uncollected tolls. now kevin mulllond plans to require all vehicles sold by

dealers to leave with a temporary plate. that would display a unique identification number and expiration date. >> we believe the cost will be relatively minimal given the fact we're not cre hating a brand-new system. it's simply dovetailing with the existing electronic system. >> reporter: he says the fee for the temporary plates could be as much as $80 which he admits the car dealers could pass onto customers. the bill is expected to be introduced next week. 8:55. the ground is still drying out after last week's big rain storm. trees and branches are still dropping all over the bay area. that's causing a safety hazard. in san francisco's north beach neighborhood, look at this. a massive branch from that 40- foot tree fell yesterday morning. they can't keep up with all of the calls for service. budget cuts forced the department to make staffing cuts. they say there are just five harborrists available in -- arborists available to keep an eye on 105,000 trees just on
