>> once again here are the systems of measles. they begin 7 to 14 days after a person is infected. rash, fever, cough, running those, red watery eyes and achy and tiny white spots inside the mouth. private security guard shot a burglary suspect today near 4,000 water house road below highway 13. ktvu's ann rubin has been on the story all day. even though the guards carry weapons they are not supposed to make arrests? >> reporter: they are supposed to observe and report but after witnessing a burglary in progress here this guard took action. >> reporter: it was a burglary in progress. a private security guard spotted thieves making off with tvs and other things. according to police the

security guard followed one of them. the burglar confronted him. his supervisors say the guard tried to pupper spray the man who -- pepper spray the man and then he lunged at the security guard with a screwdriver. >> firing when shot striking the subject. >> reporter: that man in his teens was struck in the league. police believe another burglary struck out. the security guard is authorized to carry a weapon. >> security business is basically observe and report. unfortunately sometimes things escalate beyond our control and self-defense comes into play. >> reporter: residents pulled together to hire security code 3 in october. >> there was an incident or two happening every week. i didn't feel safe. >> reporter: they have noticed

a drop in crime since the parole started and believe today's incident is proof patrols make a difference. >> seems like it has been a deterrent. we are getting what we anticipated getting and i think that is great. >> reporter: the security company says not all of their guards carry weapons but the residents here pay for an armed guard. the burglar is at the hospital with nonlife threatening injuries. ann rubin, ktvu channel 2 news. the man accuse of killing sierra lamar pleaded not guilty today. two years after he was arrested. sierra lamar was 15 when she disappeared in 2012. ktvu's robert handa is live in san jose where getting a sense of the defendant's position. >> reporter: that's right. a very emotional day in san jose. supporters of the sierra lamar family packed the courtroom and finally got to see the case against the defendant move

forward. >> reporter: looking groomed and wearing a suit, antolin garcia-torres walked into the san jose courtroom to face the murder and kidnapping charges from the grand jury indictment. he is accused of killing sierra lamar who disappeared in 2012. a different looking antolin garcia-torres was arrested two months later but it would be two years before the sierra lamar's family would hear a plea. >> mr. antolin garcia-torres pleads not guilty. >> reporter: it was the moment sierra lamar search volunteers waited for. >> it is good that the the wheels of justerous moving forward. -- justice are moving forward. there would be more delays after the judge set a trial date of march 10. the defense made a motion to have theg transcripts seals the girl -- having the transcripts sealed. >> we knew it would be a long process so we were prepared.

garcia-torres on murder charges may 21, 2012. he was indicted by a grand jury. we posted robert robert handa's interview with sierra lamar's parents on www.ktvu.com. we know the name of a woman whose body was found inside a garbage room at a hotel. investigators say she was 54 years old. her body was found at hotel sun rise last night. no word on the cause of her death. police say there was no evidence of foul play.

new rules for organic farmers because of the drought. ktvu's john fowler broke the story this afternoon on twitter. john is live. john, the rules have to do with where the cows eat? not what they eat? >> reporter: where and what. right now the tough business of dairy farming has gotten tougher because of the drought. >> reporter: this is the family farm. greening a little today but in four generations never a drought so bad. >> we lost 2-1/2, 3 months of free feed. >> reporter: cows produce 5500 gallons of milk a day. he and other farmers asked for a change in federal organic rules that require 100 days of grazing, there is simply not enough gras. >> if the drought conditions -- grass. >> if the drought continues it

complete bay area news coverage continues right now, this is ktvu channel 2 news at 5:00 p.m. a b.a.r.t. police officer tasers a passenger twice and it is all caught on camera. the question tonight, was it necessary? b.a.r.t.'s taser policy back under fire following changes after the shooting death of oscar grant. ktvu's noel g asked -- noelle walker asked if this was a case of excessive forth. >> reporter: police were called here to the station by a station agent. what happened after they boarded the train is going viral on youtube. >> reporter: on a good day the b.a.r.t.

commute is mundane and on time. on a bad day the experience is memorable enough to get 16,000 youtube hits and counting. in january a passenger recorded this on a cell phone. a man moaning after b.a.r.t. police ask him to leave a train tasing him twice. >> he warned the suspect numerous times. >> reporter: b.a.r.t.'s policy says an officer can use a taser if the suspect poses an immediate threat of bodily harm. last year b.a.r.t. police had 56,000 calls for service of those officers pulled their tasers between 17 and 21 times and fired them 10 times. >> very, very unusual. >> the police chief says using a taser might have prevented a dangerous confrontation. >> an officer doesn't have to

b.a.r.t.'s police force carried tasers. b.a.r.t.'s police chief banned the use of tasers, that ended a couple months later. may 2011 the b.a.r.t. board voted to buy 130 additional tasers so all officers could have one. a wild high-speed chase crossed two counties today speeds at 100 miles per hour iand we learned the stolen car belonged to a former california highway patrolman. the white car was stolen in walnut creek from a retired chp officer. the california highway patrol said it started at 8:00 a.m. this morning on interstate 80. it ended when the driver lost control and the car flipped on the willow pass off ramp from interstate 680 in concord. these are pictures another viewer posted on facebook. the driver was taken into custody. he is a wanted parolee and armed with a weapon.

despite the rain just about every water utility in the bay area is saying they need to cut 10 to 20% of water use or face disastrous consequences. did you know water districts

lose large amounts of water every year thanks to their own leaks? ktvu's tom vacar investigates why customers are having to pay for the water that never reaches their meters. >> reporter: he knows a high pitch like this indicates a underground leak. this is critical information for him in the hills as well as any utility that has loose soils. >> it will get worse. >> reporter: they put sonic sensing devices at two test points and then a program traces the leak to a distance along the water main. >> when the ground moves usually at a joint, service connection it breaks there. >> reporter: they immediately call in a repair crew, one of

many to do the hard, expensive work. the crew also has to jackhammer out a road bed 8 to10 inches thick. -- to 10 inches thick. the digging goes on hour after hour. leading to the leak coming from a home service valve. this must be hand carved away. after 10 hours the leaking is finally fixed and reburied. crews handle 3,000 leak as year. some quickly fixed but many others worse. >> more than half are more than 50 years ago. >> reporter: the california department of water says utilities lose 10% of their water to pipe leaks. all bay area water utilities

reported less than 10%. advocates say it is way too much. >> 700,000-acre feed is what los angeles and san francisco use combined every year. >> reporter: east bay mud is replacing 2 miles of pipelines. it is two of 10 to 15 miles it replaces yearly. of the 4200 miles of pipelines in the system 100 miles have been identified as needed replacement. that cost $2.5 million a mile. in other words 100 miles is a quarter of a billion dollars. they blame misguided federal priorities. >> in 1978 the feds were providing 78% of all the money paying for water infrastructure and now it is under 3% and
