after a previous arrest last august that led to about a dozen charges including lewd acts with a child under 14, lewd acts with a child 14 or older. one neighbor who asked us not to identify her was upset wiseman had been out. >> it's kind of worrisome. it's happened multiple times and it shouldn't happen multiple times. when there's so much information out there. >> reporter: wiseman had been a foster child for 16 years. but the sheriff department says it's still searching for more victims because wiseman had volunteered at schools.

more from the investigation in terms of how wiseman got close with so many groups with children including how he used a preoccupation with snakes to do it. robert handa, ktvu channel 2 news. the 20 year veteran of the fire department faced drug charges today in a case that stunned the department and the community. 53-year-old mario enrique cuestas did not enter a plea to sale of meth. he was arrested last thursday on the large charges as well as alleged sex with a minor. that part of the investigation is still ongoing. >> that's why there are no charges that reflect any sexual assault. that investigation has not commenced. it's still under review. >> if convicted on the drug charges, prosecutors say he could face five years behind bars. alameda county sheriff investigator says that a man came with them with bat so they

were forced to open fire. family members say the man was never a threat. ktvu's john sasaki live with the investigation and the family's reaction. >> gasia the family came to the home this afternoon to gather things and lock up the house because they just can't stand to be here now. in san lorenzo family and friends of the victim could not stay here. >> he was a friend of mine. when i heard about it i was in shock. i'm still in shock right now. >> he was a stroke victim. he's had, he's physically, you know he had his problems physically. he walked with a cane. he was a great man. >> reporter: it started last night as paramedics came to

help goenz after he had a seizure. inside the ambulance he became combative than ran inside the house. they were confronted by goenz armed with a baseball bat. investigators took that picture of that bat. >> he comes out and violently attacks the sergeant hitting him with a baseball bat, and attempted to hit him again and that's when they opened fire. >> reporter: they've been to the house 19 times over the years for one emergency or the other including domestic violence and psychological issues. but goemz family says this never should have happened. >> this right here was unnecessary. they do not need to use deadly force on him. and i sure do hope that these cops are put under investigation. >> reporter: the sergeant and the deputy have been put on routine administrative leave

as the investigation continues. john sasaki, ktvu news. police are still trying to identify a woman that was found. the coroner's office said it is still trying to provide positive identification through dental records. her body was discovered at the entrance to redwood regional park late saturday night. police used evidence found near the remains to contact possible family members. new at 5:00, accusations that certain jail juveniles in contra costa county are being mistreated. a lawsuit has been filed on behalf of the juveniles. the u.s. department of justice and education have joined in. tom baker live in martinez with why uncle sam says this case should move forward in federal court. >> reporter: the federal judge is soon going to decide whether or not officials here are illegally mistreating hundreds of inmates in a way they should not.

of more than 1,000 inmates, more than 1/3 have disabilities. >> we're talking about disabilities that are mental disabilities. and this impact learning. >> reporter: smith is managing attorney at disability rights advocates which filed the lawsuit. >> this is very much like an adult penitentiary. >> reporter: smith offered up parents testimonials. >> he just sits there every day doing nothing. he did that for almost the last three years. >> no schooling, none whatsoever. the whole three weeks that he's in solitary confinement. >> california law specifically says that juvenile halls are intended to be a quote supportive home like environment. >> reporter: the lawsuit seeks to lessen if not eliminate solitary for the mentally disabled. it seems seem -- seeks to make sure inmates get education and rehabilitation. >> when the department of justice and the department of education become involved in a

lawsuit, it is uncommon. and it's because they see a real problem that has national implications. >> reporter: the feds want the county prohibition to stop pointing fingers at each other holding both parties responsible for the solitary confinement and lack of education for mentally disabled juveniles. >> it could be as high as 70% of populations in juvenile hall. >> now the director here said that his county's lawyer instructed him not to comment. and the case goes back to work sometime next month. reporting live, tom vacar, ktvu channel 2 news. a record number of california college students are applying for financial aid. that's according to a new report from the department of education. in the past six years there has been a 74% increase in the number of students applying for financial aid. and financial aid is not just for low income students there's also assistance for families americaning $150,000 a year. students are encouraged to

apply before the march 2 deadline. new action tonight on conditions in the richmond housing authority. our cameras found mold and bugs this morning when residents led us inside. now the city council is expected to weigh in in the meeting starting in just 90 minutes. rob roth reports after speaking with residents and seeing the deplorable conditions for himself. >> aisha jeffrey and 3-year-old daughter showed us their bathtub that barely drains. jeffrey says bath water recently came out of her sink. >> across the walk we saw mold on the wall next to a child's bed. >> it's getting bad. i have my little girl. i don't want her inhaling that mold. >> reporter: in one building the residents complained of cockroaches. one resident showed us where

bedbugs got her. about how money has been spent, richmond school board members have become concerned. approximately 500 school aged children live under the roof. >> if it's unhealthy you can't focus. >> reporter: school board president ramsey wants the district to meet with housing authority executive director tim jones. the richmond city manager told us he may call for an audit of the housing authorities maintenance records. >> our maintenance records are showing that we're responding to work orders, we're getting them done all the time in a timely basis. we're following up and we're getting the work done. there had been some stories where that hasn 't happened. >> they need to do something about that mold fast. >> reporter: rob roth tells us it plans to encourage housing authority residents to come guard with any problems. a house fire in bay point killed an elderly man who was trapped inside. the fire started in a home on mountain view avenue about 9:00

this morning. firefighters pulled the child out of the home and tried to revive him but he was pronounced dead at the scene. the victim lived alone and may have been sleeping in the back bedroom when the fire started in the living room. >> does look like the fire resulted from a combustible material over the top of furnace in the living room. unfortunately the home did not have any smoke alarms at all. >> the fire may have been smoldering for a while. and if that house would have had a smoke alarm the man who lived inside may have survived. a violent protest in ewe cane. the death toll for both protesters and police there continues to rise at this hour and julie haener is following the situation now from our newsroom. >> frank, at least 18 people were killed including police officers during clashes between protesters and police in

ukraine's capital. now here's a live look at the protest site at the independent square where protesters are camped out until their demands are met. the time right now is just after 3:00 a.m. they tried to bring order back at the capital. this is video from just a few hours ago. police stormed the area and have been burning down barricades and tents. earlier thousands of police battled against an estimated 40,000 protesters. police were armed with water cannons and batons as protesters fought back with rocks, bats and fire bombs. the government rejected a treaty with a european union and strengthened ties with russia. protesters say ukraine's president is the only one who can end the violence. >> he has to call for early

we got this video from a viewer it shows what appears to be a truck over the edge of highway 1. this is near gray whale cove in san mateo county. tweeted that both directions were closed for about an hour. the call originally came in as a car over a cliff but no injuries were reported. a gas main break forced the evacuation not far from at&t park. construction crews were working on a new restaurant and one of the workers accidentally tripped over a valve and bent it. that caused the gas to start leaking out. hundreds of people on south park street were told to get out or shelter in place. >> we just heard a little bit of a hissing noise coming from around the corner. that's about it. they just told us to evacuate so we figured it was better to leave than to stay in place. pg & e crews arrived within

the hour and temporarily cappedded the line and no one was hurt. in oakland, crews are wrapping up work on a ruptured gas line at skyline high school. the school was closed for the day as a safety precaution. the district says a contractor accidentally caused the break while working on the line yesterday morning. classes are set to resume again tomorrow. firefighters were honored today for their work. applause today as the rotary club of san francisco honored six public servants for their heroism and commitment to the community. two of today's honorees are from the fire department. they responded to the crash of

oceana crash. captain beach was the medical group supervisor in charge of getting all those injured the care they needed. >> we train for these things hoping it never happens and when it does happen you resort back to your training. and i'm glad with the training i had i was able to go out and do the job i was trained to do. >> also honored captain tony malloy who says he is proud of what every firefighter did there that day. >> taking people out of the aircraft without regard of their own safety is nothing but heroic to me. >> reporter: another honoree had a hand in one of the most joyous days. raymond radmore gave cancer survivor miles scott his wish of being bat kid for a day. >> at that point you realize you created the better good.

>> reporter: today celebrants shrugged off being called heros. in addition to all the applause and recognition today they're also getting the week of a free night stay at the sir mitchell hotel. a woman fell two stories into the shaft which narrows toward the bottom. we're told her injuries do not appear to be life threatening. and the maker of candy crush is going public. some analysts say they think the market could value the

company at more than $5 billion. candy crush was the most downloaded free app on iphones and i pads last year with 93 million daily. raising the federal minimum wage would cost jobs but would also lift 1 million people out of poverty. that's according to a congressional budget office. it estimates more than 60 million workers would see increases in their paychecks. 9,000 people would rise above the poverty line. the increase could cost the u.s. half a million jobs. congressional democrats are pushing for an increase by the year 2016. okay so i guess about a week and a half ago. we just got drenched with all that rain. we're all thinking it started. it's coming. >> we're in the red. >> then sort of drying up. frank as you point out it doesn't have near the push of that system we saw a week and a half ago. looks like just a few sprinkles at best. you can see still north of our

area. we'll come in a little closer and we can measure it out. the showers right now are running about 200 miles north of the here. showers are going to work their way south. we have seen a little bit of drizzle in san francisco. i've had drizzle in alameda. wet weather i wouldn't call it rain. drizzle is characterized by being smaller than .02-inches in die -- diameter and drizzle. outside kind of mild and temperatures today we got them up into the 60s. we had upper 60s toward the livermore area. the situation now is today we had a beautiful day. partly cloudy, plenty of warmth. this system that i just showed you is going to come south a little bit. tonight increases our clouds. brings us a slight chance of a sprinkle. here is our computer model and it bares that out.

i moved to midnight is what we'll be tracking. nothing going on. and that's the front basically. and then it pushes over the top of the bay area about 2:00 a.m. and this is where we have the best chance for drizzle and sprinkles. over toward concord wouldn't be surprised to see a nice glaze on the roadway for tonight. be prepared for that. or tomorrow morning because it'll probably stick around. tomorrow afternoon it clears right up. temperatures tomorrow will go back into the 60s. san francisco, tomorrow's forecast you're in the low 60s at 6:00. the clearing too. it's going to be cloudy in the morning but then it clears right now. san francisco is looking good in the afternoon. 64 in fairfield. mostly sunny. 65 in antioch. 64 in santa rosa. these are your highs. very similar to what we've seen the last couple of days. morgan hill 65. and this system is coming through right now. because that's the system and typical winter a half inch of rain. that's just not happening. that system is going to go, it's going to clear out.

a bay area high school student arrested because of this pellet gun. as you can see from the comparison it looks almost identical to a real one. vallejo police received several reports of a person with a gun near a campus. >> some are comparing this incident to another one that had a much different ending. >> reporter: this is the picture of the pellet gun the student was carrying on his way to vallejo high school this morning: two guns, the one featured on top is a pellet gun. the one under is the one police use. >> when you compare this gun to that they virtually look the same. >> reporter: which is why parents took notice when they saw a 14-year-old student

vallejo police confiscated the pellet gun. they detained the student, later released him to his parents. they're not going to recommend charges against him but they hope his parents have a good long talk with him tonight. live in vallejo, allie rasmus. more details now, it is illegal in california to sell, transfer or lone a bb gun to a minor. federal law requires bb guns to have special colors or markings so that they can't be mistaken for the real thing. allegations of hate words. it all started with a few posts on a student's blog. ktvu's david stevenson live in the city with what those posts said. >> reporter: gasia that muslim student has said that some of his posts were immature. but they have prompted calls from a woman who is known for criticizing muslim students

tweeted an update this morning on the impact of the unusually dry conditions. and agency spokesperson said that since january 1st, the agency has responded to 600 wildfires. those fires have only burned 1,500 acres still. the number of fires is a 330% increase compared to last year and forecasters say when it comes to the drought there is little relief in sight. the city of berkeley is planning to exterminate hundreds of squirrels. chavez park was converted from lorenzo. now the area is covered with holes dug by squirrels and gophers. the city is now planning a pilot program to fence off a 1 acre area of the park and then trap the rodents. >> it's causing pollution that

cars got away but not before causing quite a match. rangers with the national car service spotted the thieves around eight clock last night and chased them across the golden gate bridge. the get away car had two patrol vehicles and later crashed into the toll plaza. the man abandoned the car and ran off into the precidio. the veteran photographer with the bay area news group was robbed at gunpoint tonight near 29th and eighth street in oakland. he says he had just finished taking pictures when two men ran up to him and robbed him of his cameras and money. detectives in california

are now following claims of a woman luring victims on craigslist. in an interview she says she has killed more than 22 people all part of a satanic cult. >> i said you're saying you killed people. she said yes. i said how many. and her initial response was well less than 100. >> barber and her husband have been married just three weeks when police say they strangled and killed a man in november. barber said she had joined a cult as a teenager in alaska. she says she killed bad people in four states. her husband elliot was evasive about the reported confession. >> you think she's lying that she killed 22 people. >> i didn't say that. >> you think she's telling the truth. >> well don't put words in my mouth. >> the los angeles police and the fbi are now looking into her claims. attorneys for the couple say they want psychiatric evaluations for their clients. prosecutors are seeking the

2 investigates a b.a.r.t. project that is supposed to help the most congested part of the system. the only problem, engineers can't get it to work. tom vacar has been looking into the time and money spent on special cross over tracks. >> eric joins us now on what he

found. >> reporter: an employee called it a $43 million white elephant. b.a.r.t. insists not so. they say these crosswalks will be working soon but that has proven easier said than done. >> at the height of the morning commute, they are b.a.r.t.'s busiest stations on b.a.r.t.'s busiest lines. few know that the solution is right under their feet. but so far it hasn't saved even one minute to commuters. >> are you satisfied with the way this has been handled? >> of course i'm not satisfied. it was way more delay than i was ever told it would be. >> reporter: a simple concept allowing the train to cross over to the opposite tracks and

head over to the other direction. it's key to getting around stalled trains and increased in capacity until b.a.r.t. can bring in new trains. b.a.r.t. officials produced this video highlighting construction of the cross overs in 2010. the $38 million budget made up of state, federal and b.a.r.t. funds climbed to 43 million. but more troubling b.a.r.t. insiders say is the time line. ever since construction was finished in july of 2011, engineers have been unable to get the new tracks up and running. >> why are these cross overs not working. >> the construction phase finished on time and on budget. where we run into troubles is implementing the components of it that makes the train run. >> reporter: a key issue is connecting new and old technology. >> we're talking wiring,

circuits getting to community together. >> reporter: two investigates got a tip to investigate. putting neighbors in hotel rooms mostly at the mariott in walnut creek over loud constructions over weekends. >> how was the room? >> very nice they had just renovated. >> reporter: julie was among those that took b.a.r.t. up on its offer. b.a.r.t. managers also wracked up 76 room nights in hotel that is included the project manager, assistant manager and at least four others. b.a.r.t. officials say it was necessary for work going on around the clock. but now some frustrated neighbors are wondering whether it was all worth it. >> you would like to see the money used wisely and have a plan that has been tested somehow. so that it would work. >> where does the buck stop? >> well the general manager of course is in charge of the whole organization. so i would say the buck would

stop there. >> reporter: two investigates asked to speak to b.a.r.t.'s g. m. but we weren't allowed to record our interview. allen said the unexpected retirement of four key managers and engineers who were working on the project has added to the delay. now on b.a.r.t.'s website where there used to be information about the cross over project there's no sign of it. now b.a.r.t. says it removed that project off the website. it has since launched a full audit and officials say one of the two cross overs passed a recent test and it could be in service they say next month. >> all right, keep us posted. thank you eric. high temperatures today back where they were yesterday. look at all those 60s. 66 in san rafael. 67degrees in the morgan hill area. in gilroy very warm in the south bay. we're looking for temperatures as we head into the next couple of days stay on the mild side.
