small items that were ejected from the car on impact. >> truly a tragic incident that could have been avoided. >> reporter: it happened at 1:00 this morning on san pablo avenue near stanton avenue. you can tell from police photos that the crash was horrific. >> one of the children, 5-year- old child, was not in a child restraint, which is required by law. currently in critical condition. >> reporter: two girls, three and five years old, were critically injured, but the 3- year-old has since been upgraded to stable condition. 39-year-old harold mason, jr. of richmond was killed. >> the driver was most likely under the influence of alcohol. >> reporter: police say the 36- year-old woman was at the wheel. >> she should not have been driving under any circumstances. >> reporter: flanigan is the mother of a 3-year-old girl and aunt to the 5-year-old. police believe mason was flanigan's boyfriend. >> her driver's license was currently suspended as a result of a prior dui. >> reporter: in investigators say they found open and unopened alcoholic beverages in the car. flanigan, mason and the girls

were reportedly heading home from a barbecue. >> the message here is don't drink and drive. you can call a taxi cab, public transportation, designated driver, or just stay at the location that you are. it's not worth it. lives will be changed forever. >> reporter: flanigan faces a litany of charges, including felony dui and vehicular manslaughter. live in oakland, john sasaki, ktvu channel 2news. more details now, the latest number from the chp showed drunk driving-related deaths have been increasing in recent years. 1997, 1100 people were killed in dui-related crashes. five years later, that number had increased to 1300. in 2007, that's the most recent year the statistics include, 1489 californians were killed in dui crashes. we are getting new information on developing news right now in berkeley where there is a water main break. it happened about 4:30 this afternoon at the intersection of parker and mcgee.

it's causing street flooding about a block away at parker and california streets. now, we just spoke with east bay mud. officials there told us the company is still in the process of turning off the water. until that happens, it won't know what kind of break crews are dealing with. there's still no word how many customers are being affected. with the drought in mind, we actually saw some people grabbing buckets to use the water to splash onto their lawns. a new clue tonight in a series of water bottle attacks on drivers in the north bay. just hours ago, we obtained these new surveillance pictures showing a white truck that authorities say may be involved in the attacks. the chp says the images were taken in downtown santa rosa on wednesday, just minutes before someone inside the truck launched water bottles on cars driving on highway 12. at least six water bottle attacks have been confirmed. the latest victim to come forward is a fedex worker. >> next thing i know, i see this thing flying at me.

i duck down and when i look up, there's -- my window was just gone. it was decimated. >> investigators are looking into other possible attacks, after reports of shattered windshields and blown-outside mirrors. investigators are interviewing witnesses tonight near san jose state after a campus police officer shot and killed a man not far from campus. it happened just before 11:00 this morning at south 8th street and east san salvador, just a block from san jose state university. ktvu's robert handa arrived on the scene shortly after and has new information on what happened. robert? >> reporter: well, things are finally calming down in this neighborhood. as you heard, right now officers are focusing on investigating and interviewing witnesses, trying to figure out what led to this officer- involved shooting. police cordoned off the area quickly around san jose state, after hearing university officers shot a knife-wielding man outside an apartment complex on 8th street, just after 11:00 a.m. 13-year-old abigail smith was

staying there with a friend. >> we heard, like, bang, bang. i was, like, what was that? she was, like, never mind, it was somebody upstairs. i was, like, oh. >> reporter: two campus police officers were confronting the man who had been seen earlier on campus with the knife. >> the suspect charged at the officers with the knife. one officer from the university police department actually discharged his taser. >> reporter: police say when the taser had no effect, the other officer shot the suspect. abigail's mother says her daughter called her right afterwards. >> she said she heard the two zaps of the taser and instantaneously, then right after two gunshots. >> we saw them doing cpr on him. >> what was happening? >> just like he had no shirt on and they were doing cpr. but then they stopped. >> reporter: police say the man died at the hospital. investigators say the man did not appear to be a student. abigail agreed. >> he was, like, kind of older and chunky and, like -- yeah, i didn't see his face.

>> his spannic, black, white? >> abigail's mother was relieved to see her daughter. >> i was scared, scared for her safety. >> reporter: san jose state says the shooting did not disrupt classes. the college alerted students through e-mail and social media. authorities say they believe this is the first officer- involved shooting in the school's history. robert handa, ktvu channel 2news. the santa clara county district attorney's office said today they have broken up an identity theft ring that used electronic devices at gas pumps to steal credit card information. prosecuters arrested six people from southern california. they say the suspects implanted so-called skimming devices at gas pumps throughout the bay area and elsewhere. those devices allowed them to access customers' credit card information. investigators say the suspects then used that information to create fake credit cards and then made purchases totalling some $500,000. in just the last 90 minutes, the state senate pro

tem called on assemblyman ron calderon to resign from office. this comes on the same day a federal grand jury indicted both calderon and his brother, tom calderon, on corruption charges. the u.s. attorney announced the indictment this morning in los angeles. the calderons are from montebello. the indictment says ron calderon took bribes in return for official acts, such as supporting legislation. >> the indictment describes a scheme in which ron calderon allegedly solicited and accepted approximately $100,000 in cash bribes, as well as plane trips, gourmet dinners and trips to golf resorts. >> ron calderon has agreed to surrender monday to federal authorities. his brother tom is already in custody on money laundering charges. you can read the indictment for yourself on our website, ktvu.com. just look under hot topics. state health officials confirmed today 35 new flu- related deaths in california this week. that brings the total number of

deaths in california this season to 278. that's more than double the 106 deaths during the entire flu season last year. another 29 deaths are still being investigated. here in the bay area, we've counted 48 flu-related deaths so far. here's a look now at the numbers divided by county. you can see santa clara county still has the highest number of the bay area counties, with 14. covered california says its website is still having problems tonight. the enrollment function stopped working on wednesday. software engineers hope to have it back online sometime tomorrow. in the meantime, people can still go to the site to get information and you can use the comparison tool to pick a health plan. covered california is the state's exchange to help people get affordable healthcare coverage. an open enrollment event is being held tomorrow in concord. contra costa county health officials will be on hand to help people sign up for covered

california and medical coverage. the deadline to sign up for covered california is march 31st. from 10:00 a.m. to 2:00 p.m. tomorrow at the meadows home elementary school on detroit avenue in concord, just bring a photo id, proof of residency, proof of income, and citizenship or immigration documents. a marine corps veteran was recognized today for risking his own life to save a young woman who was trying to commit suicide at a raiders game. he saw the woman jump from the third deck of the oakland coliseum and he broke her fall as he tried to catch her. today, he talked with ktvu's brian flores, saying he would do it all over again. >> reporter: for a while, donnie navidad did not want to be called a hero. but today, he's come to acceptance. >> i will say yes, i am a hero. [ laughter ] >> because it's been, it's been presented many times. i will acknowledge i am a hero. >> reporter: rightfully so. today, donnie received a special award and ceremony from the joint powers authority for

his heroic actions last november in which he saved a woman's life. >> and we thank him for his protective arms of compassion. >> reporter: donnie was attending the raiders-titans game, just hanging out, taking pictures near the torch honoring al davis, when he heard a person yelling at another woman not to jump from the third deck of the coliseum. donnie, a marine corps and vietnam vet, came running. >> i yelled up to her and told her not to do it, don't do it. then i turned to my coworker and i asked him, i says, do you think she's going to jump? he says, oh, boy, she's falling as we speak. >> reporter: he positioned himself to catch her, and in doing so, saved her life. the move left donnie with a bruised left arm and a sprained right heel. he's doing better, and according to donnie, so-so the 20-year-old woman from san jose who jumped. he's kept in contact with her sister. >> she says when she's feeling better and she's at 100%, they would like to meet, which i'll

be ecstatic to meet her. >> reporter: donnie, a father of three kids and grandfather to eight, also got four tickets to an upcoming raiders game for his heroism. donnie, however, says helping others is something he would do all over again. >> gave her a second life. and if you can do that, that's, that's tremendous. >> reporter: according to experts who spoke to donnie, they say the impact was equivalent to 1000 pounds at three times the force of gravity. his doctors say donnie is lucky to be alive himself. in oakland, brian flores, ktvu channel 2news. the federal government cuts off california's water supply. the signs from the government that this drought could be more dire than first thought. >> the dalai lama has arrived in san francisco. the special reception being held in his honor right now for the tibetan buddhist leader. >> and i'm tracking rain showers in the bay area.

police say mildred lasardi, a 90-year-old woman apparently tried to walk around a cement truck when she was hit. she is the fourth pedestrian to be killed this year in san francisco. two men allegedly broke into a san jose home last night. now one is dead and the other is hospitalized after the homeowner says he shot them in self defense. the man told police that one of the intruders fired shots in his direction. that's when he armed himself and shot back. he says the men left the house, jumped into a car and took off. a short time later, police say a man in his twentiys was dropped off at an emergency room with a gunshot wound.

he later died. police later tracked down a second alleged intruder suffering from a gunshot wound. investigators say they do not know if the man shot the intruders will face charges. sex workers in california can now apply for compensation for the cost of medical care and counseling after a sexual assault or beating. the california victims compensation board took the action at a meeting today. the fund pays medical costs and related expenses for victims of violent crimes, but prostitutes have been excluded because their work is illegal. >> we feel that they should be allowed the same compensation that any other victim is getting, especially if they are being sexually abused, assaulted, lot of them have been assaulted and raped. >> money for the victims compensation fund comes from fines and restitution paid by criminals along with federal matching funds. the tesoro refinery has refused to allow federal investigators into its plant,

according to the san francisco chronicle. this comes after an accident last week in which a pipe leaked acid and burned two workers there. the report says tesoro considered the accident so minor that it did not meet the criteria for a federal investigation. the u.s. chemical safety board inspectors were able to get into the plant right after the accident, but when they tried to return, tesoro said no. the california drought has the federal government bracing for the long haul after dramatically cutting back water supplies to the state last year. today, they said farmers and local water districts will get virtually nothing. new federal water allocations released today are bad news for california. experts tell us federal officials think the drought is even more dire than first thought. john fowler reports on how all of this may affect you. >> reporter: a big impact could be on food prices, but depending on where you live, times could soon get tough. water supplies for half a million people in the east bay, from oakley to martinez to

walnut creek, today cut by half to 55 gallons per person per day, the lowest in decades. >> what that means to our customers is that we'll have enough water to meet the needs of indoor water use and also the needs of businesses. >> reporter: contra costa water district's jennifer allen says it's not enough for outdoor water, landscaping, car washing and the like, expected to decide in four weeks whether to impose rationing. other bay area districts are less vulnerable, but california farms are hit hard. this area, the westlands district, will get no state or federal water. they can pump from wells. some farmers today said they may plant nothing. >> probably hundreds of thousands of acres of farmland will be left unplanted this year as a result of the lack of water. >> reporter: today's federal water allocations for farms north of the delta, zero. same for south of the delta. municipal users north, 50%. south, 50%. but that's not the big

surprise. >> even some water users with very senior water rights are going to get cut back to 40% of their allocations, which is unheard of. >> reporter: water expert peter glick says the signal from the feds today is that our state, especially agriculture, which uses 80% of california water, is in serious trouble. >> there's going to be a big drop in what we grow, where we grow it and what's available in our supermarkets. >> reporter: beef and dairy prices will likely rise as feed becomes scarce and expensive. fruit and vegetable prices could rise as shortages develop. farmers say the critical time will be in about six months. the summer and fall harvests could be the smallest in decades. in the meantime, they are asking everyone, pray for rain. john fowler, ktvu channel 2news. dairy farmers and cattle ranchers say the drought is already taking its toll. pasture lands in the north bay should be a foot tall now, not a few inches as you see here. also, the cost of feed is high and getting higher.

farmers gathered in sonoma county to discuss ways to help them get through the dry season. one idea isn't a new one. they want to truck recycled water from treatment plants and freshwater from nearby springs directly to their farms. >> back in 1976, they had eight county water trucks that ran seven days a week, 12 hours a day for 18 straight months to help the dairies kind of survive this lack of water. so we're looking at resurrecting that to some degree. >> on average, a cow drinks 50 gallons of water a day. farmers say the increasing cost of feed could put them out of business. well, you sure wouldn't know it -- my apologies. >> we have a special page dedicated to the drought on our web page. looking outside, you wouldn't know it, but there is rain on the way for next week. hopefully substantial rain. >> yeah, after temperatures today in the mid-70s -- cows drinking 50 gallons a way,

that's a lot. never even thought about the cows drinking water. 50 gallons a day. we're not going to see much more water this weekend anyway. we'll see dry conditions with water coming, rain coming as we head down the road here. look at the record in san rafael. 74 degrees for daytime high. that's a record. 73 in antioch, 73 in morgan hill. some areas were in the mid-70s. i bet your backyard, especially in the east bay, concreted-in backyards, pretty warm. cloud cover clear out there right now. we take a peek at temperatures around the bay and they are, again, mid-70s, now mid-60s. temperatures are cooling off rapidly as we head into your friday night. as we head into the next few nights, we'll see temperatures about where they have been, upper 30s, low 40s, maybe patchy valley fog. then very little, if any. then we'll see coastal fog fill in tomorrow afternoon. it's mostly clear outside tonight. if you have outdoor plans, it's perfect. dining outside, going to a movie, whatever, you need a jacket obviously. but right now, the golden gate bridge is clear. fog will be here tomorrow night

at this time. you see the high clouds out in the pacific. things are changing around. the jet stream will start to move south a little bit heading into next week. there's the good news. this weekend sets up just like it has. high pressure stays there, mostly sunny, mild pattern. it's going to be a perfect weekend. been a bunch of perfect weekends. here comes another one. heading into wednesday, thursday, friday, into next weekend, this system and two more behind it. kind of these impulses will blow through and bring us a really good opportunity for some significant rainfall in the bay area. 15 inches of rain, i don't think so, like the last storm in the coastal hills. we could see 3 or 4 inches of rain throughout the bay area, so that would be great news. sunday at 9:00, coastal fog is back, but lots of sunshine. rain stays to the north at this point. going into tomorrow, 69 in fairfield. 70 in antioch. a day tomorrow, just like today. in the santa clara valley, 69 santa rosa, 71 in morgan hill. five-day forecast, you know the

weekend is a lock. monday, clouds come in. tuesday and wednesday, more clouds. then wednesday, it lights up. thursday, a break. friday, it goes off again, more rain. then into the weekend as well. so this pattern looks like it's going to be very productive as we head towards the middle and end of next week. in the meantime, julie haener, enjoy this bay area weekend, because it's stunning for february! >> oh, it felt so nice outside today. we need the rain, but it was just beautiful. >> enjoy it while you got it. >> thank you, bill. the dalai lama is in the bay area this weekend and he's booked for three speaking engagements. >> the crowd was on hand to welcome the exiled tibetan spiritual leader as he arrived at the ritz carlton hotel in san francisco. earlier today he met with president obama at the white house, a meeting that the government of china demanded be canceled. china considers the dalai lama to be sub versive. the dalai lama has talks scheduled tomorrow in san francisco, sunday in berkeley, and monday in santa clara.

. mark's here now. lot of people talking about jim harbaugh. any truth to the chance he could leave? >> well, you know, the thing is that back in indianapolis, they are having these combines. so you got a lot of coaches, lot of team executives, so it's a hot bed for rumors. man, put them on fast forward, too. jim harbaugh and the 49ers are involved in the heaviest rumor today, as actually take a look at some of the activity as it went on, the big news involving the niners, supposedly considering trading harbaugh to the cleveland browns for several draft choices. the 49ers now vehemently deny the story. cleveland officials, this is where it's interesting, would not either confirm or deny the story, but supposedly as it goes, harbaugh actually nixed the idea. we're moving into the second week of spring training and one of the big question marks with regard to the giants, tim lincecum, is he ever going to rediscover at least something resembling the magic of his two cy young

awards? he realizeds the need to buckle down and did during the off season. he rented a warehouse near seattle and made a mound and worked out like mad during the off season to try and help himself become a better pitcher. >> it went well. just gave me an opportunity to throw when i needed to, so it just gave me the access and, you know, it was on my time, which made it easier for me to do things and pick the time when i needed to throw. i think you need to get a good base, good foundation of confidence and readiness, both physical preparation and mentally. just the extra month in the off season kind of helps me get to where i need to be in that regard. we always give you the courtesy warning if you're planning on watching the men's canada-usa game tonight, might want to plug your ears. look away, as the final score was team canada 1, usa nothing.
