sunday, february 23. i'm mike mibach. >> i'm claudine wong. let's check your weather with meteorologist rosemary orozco. how are things looking? >> we have another nice day in stored. many of us are waking up with low clouds as expected. the low clouds have moved into the bay as we're seeing some of our coast as well as our bay area cities with gray skies. fog also a factor in areas like santa rosa where you are seeing visibility down to a quarter mile. it's a cool start. i'll have a look at your temperatures and what you can expect. mostly cloudy, but we could be cooler in some areas in the extended forecast. i'll have a time line of when it will arrive and how much you could expect coming up. new developments in the bart train derailment. hoping throughout the system in about an hour from now. meanwhile we're here in the audio recordings of the moment right after friday night's

derailments. now, you just heard the train operator calling in the emergency. they are working in overtime. allie rasmus is live for us in concord to tell us if it looks like they will resume by 8. >> reporter: on a normal sunday, they would be pulling in at 8:07. everything is on track for that to happen. the service here at the station, they are set to resume at 8:00 a.m. after a 36-hour hiatus. the work has been around the clock since the train derailed on friday evening. when we arrived at 5:30 this morning, a dozen workers were on the tracks.

they say that they are electrical workers doing some of the final rounds of checks. it damaged the tracks and the third rail here near the station, but workers discovered that most of the damage was on a section that takes trains to the maintenance yard. not the tracks that the passenger train used. workers replaced the tracks to get those passenger tracks back in operation. >> it was torn up quite a bit. so that's the good news to show you the normal service. the tracks that are now in repair. >> this is the scene yesterday when they were brought in to halt four of the jackknife bart cars that derailed off of the tracks. we sped it up with the time lapse to show you the whole process as workers needed to remove the cars to get a good look of the damage on the

tracks, appearing that they were able to get things figured out. again, two sections of the track were put in place and so that the passenger trains, they could resume service and it looks like that will happen at 8:00 this morning. live in concord, ktvu channel 2 news. there is more coverage on our website. we have posted the town of the videos being removed from the tracks. and we are also constantly updating our twitter and facebook pages. an early morning fire has destroyed a home that started just after 4:20 a.m -- just after 4:20 a.m. about 50% of the home was on fire and neighbors, they were forced to evacuate. >> yeah, we thought it was going to blow or something. i went in and got my dog and went inside like you told us to. >> reporter: it took them about ten minutes to put out that fire. it appears as the fire started in the back of the trailer

because of the fire that is still under investigation. no one reported it injured. today, two scheduledappearances in the bay area. they will bless a new temple in richmond and starting last week, the volunteers have been preparing for the big visit. he is set to speak at the community theater about how to achieve the happiness and then tomorrow, he is set to talk about business, ethics, compassion at santa clara university. both events are sold now. yesterday they spoke to san francisco about the nature of mind. >> they visit has not been without the con to veer city. yesterday they need today protest the trips, accusing them of religious persecution. the protests are expected to continue today. and with the spiritual leader where they tweeted this photo

of the two at the restaurant. happening today, the man shot and killed, they will tell their side of the story. in a news conference, he plans to talk about the disability with the emotional and physical stress. last month they were called to their home, saying he became agitated and assaulted them. causing them to shoot and kill him. the family has hired an attorney as they say that the deputies fired 13 shots. police officers will be heading to fresno tomorrow as they honor two of their own killed in the line of duty. the 33-year-old and the 34-year- old died last month in a crash on highway 99 in fresno county. they were responding to a traffic rail while trying to avoid the multiple vehicles. after graduating from the academy tomorrow, they trained in the san jose office.

the governor will be among the thousands of people that will be attending the service. the officer from several law enforcement agencies, they will help cover for the large number bay areas, headed to the memorial. this morning the investigation is underway thanks to the deadly shooting from oakland. police were called to east 24th street. they found a man at the scene suffering from the gunshot wound, later pronounced dead. no arrests made in that case. about 21 poisonous meatballs have been found in their area as they believe whoever put them there, that they did so to harm or kill pets. warning signs were posted. they are urging pet owners to keep their pets indoors. now last july, the meatballs were found in the same exact area. today people in san francisco and their district will be able

to give their opinion on a colorful new project. and at jane werner plaza between 1:00 to 4:00 in the afternoon. now to the latest on the drought. it is now in effect as there are concerns that the low level waters there could harm them all. now, despite however the temporary banned, some were still out this weekend. >> i think that it will be irresponsible to fish. and yet that they are standing right there and fishing. >> and the fishing banned will be in effect through the end of april. tomorrow, president obama will talk about their proposal to change the way they need to fight the wildfires. they would allow you to help fight the huge wildfires.

it still limits the way they pay for disasters like the hurricanes and proposals. all included in the annual budget that they will send to congress next month. >> they will soon have more firefighters. they were awarded a grant of almost $2.5 million. the money will be spread over two years and will be used to reopen their fire station, which will go back to 2010. mike thompson will award the grant to the fire district tomorrow. all right, your time is 7:09. let's head over to rosemary that ended up being a fantastic day. what are we in stored for today? >> it will be another one -- another nice one in stored although the sun is up. many of us are waking up with the lower clouds and the fog, giving you a live look over the east bay where you could see a little bit of the fog drifting over the marine layer that looks like right about 1,500 feet. just enough to get inside that bay and drift to the east. and so where is the low cloud and fog cover?

let's take a look. santa rosa reporting visibility down to a quarter mile. if you do have an early morning drive, that's to consider the visibility by about five miles. it's out there. let's take a look at the north bay to the south bay, reporting mostly cloudy skies. all the cities around the bay, oakland, hayward, fremont, newark, along the peninsula, san francisco through san mateo into pal alto waking up with all the gray. most of us are anywhere above where we started yesterday morning. it is still going to feel quite cool. upper 30s. and 49 in san francisco and sf, and 51 degrees in mountain view. so by the afternoon, we do expect to see just a few degrees cooler for today. we will continue with our mild

pattern though. 60 degrees along the coast. a widespread 60s to near 70 degrees for our inland communities and then the big change comes next week. the first storm arrives on wednesday and the second system on friday. and we are still looking at the possibility of up to five inches or so of rain before it is all said and done. afternoon highs for today, 67 in santa rosa. 65 for san rafael. low 60s in oakland. upper 60s for concord. a few 70s out there for today. 68 san jose. 70 for morgan hill. and the extended forecast here at the bay area weekend, they are always in view starting out with the morning clouds by 10:00 to 11:00. we are partly cloudy for the rest of the day on monday and tuesday and a near repeat and the temperatures, they will begin to cool down, especially on tuesday and more like wednesday. and when the rain arrives, we could see anywhere from half an inch to an inch of rain with the very first system and

morning. >> and pope francis celebrated the mass with the cardinals he pointed to yesterday. telling them to live simply and humbly and avoid acting like a royal court that he wants them to wok together and avoid rivalry and jealously. pope benedict xvi shared and embraced. mexico's most wanted king pen after 16 years on the run was arrested on a beach resort. they worked together to capture guzman. he is believed to be responsible for hundreds of drug war killings in mexico and the distribution of drugs across the u.s. and europe borders. the accused billionaire has been on the run since escaping back in 2001. authorities think that he has been hiding out in seven homes that are all connected by tunnels. >> reporter: the doors to the homes where he was found was

reenforced with lead, causing several minutes of delay, allowing for an escape through the tunnels. >> the attorney general says that guzman's arrest is a victory for the citizens of both mexico and the united states. well there is more heartbreak for the family of the american soldier held hostage by the taliban. the army sergeant has been held by insurgence since 2009. u.s. diplomats have been holding sensitive talks with the chance of freeing him. the taliban cited a complex political situation in pakistan for scrapping those talks. tomorrow the u.s. military is expected to announce large spending cuts. the secretary chuck hagel will unveil a plan to cut the personnel costs, including higher fees for health care benefits, smaller allowance benefits and a one-year freeze. officials say that they will ensure that more significant parts of the military won't be

touched. next month, two dozen veterans will receive a medal. one of those men, sergeant first class, melvin morris who came under heavy fire during a battle in vietnam in 1969. he rescued numerous troops, never officially recognized for that bravery, but now 45 years later, morse will finally receive the highest military distinction, the medal of honor. >> i have heard rumors to the fact that there were certain people that people were not sure if they received the medal of honor. >> in 2002 congress ordered a review of records looking for any discriminations towards jewish, latinos. of the 24 vets being honored next month, only three are still alive. some of the honorees fought in world war ii. after a surge of gang violence last year, san jose police say they have been working on new ways to stop the

violence. one of the programs involve children as young as 10 years old. robert honda takes a look at how they are making a difference. >> and name me one element of the definition of a gang. >> reporter: the classroom is a fancy school in san jose, gratifying to the officer. the instructor and the police department's pilot program, teen kids, aim at steering teen kids away from gangs. the interaction is a far cry on when they showed the first day of the program six weeks ago when students mostly listened. >> a common name, symbol, good. >> we're trying to get to the fifth and sixth graders to be leaders, mentors, role models. good older teammates to the other kid in the school. >> reporter: today is another last day and how the students took part in drills including one to rescue a friend.

>> they are trying to get the skills to help each other. >> reporter: and some lessons that stick. >> once you get in, you cannot get out. it's like a membership for life. >> it's kind of scary. did you think about that right now? >> no, not really. >> reporter: and the police department, they have long-term positive impacts. the program will be expanded to other classes and several other school districts. in san jose, robert honda, ktvu channel 2 news. a series of town hal meetings to address the crime issues. the first meeting held yesterday in west oakland's only public high school. about 150 oakland residents came out to participate. the mayor who was spearheading the series hopes to increase the graduation rates to get the students off the streets into the work force. >> that's what i'm hoping that

the neighborhood, they will embrace the school a little bit more and come in and mentor people and i've gotten a lot of reasons to hire. and all the summers off. >> the mayor, they say that improving the graduation rates that they would play a big part in the city's long-term plan, but some of the people that came out, they say they cannot wait for the long-term solutions when so many families will need help right now. well, miley cyrus' bangers tour is making its way to the bay area and a whole lot of controversy is coming right along with it. well the singer just kicked off her tour and parents across the nation are demanding the refunds. and some even want the show shut down. and then mocking the scandal. and tomorrow the tour will make

but this is the 7th annual fund and another polar plunge that will be scheduled for mark 2 in lake tahoe. they are celebrating not only the end of their chemo, but also a donation of $11,000. they are being called a local super hero since being diagnosed in 2010. he's used social media and fundraisers to help raise about $11,000 for childhood cancer research. tomorrow he will celebrate by passing gifts to other children battling cancer at children's hospital. >> yes, to help the other six children with what they are going through. >> let's check in with rosemary on this sunday morning. a little overcast. >> yeah, as expected, they are making a bigger push this morning as many of us are waking up with the overcast. we'll see the sunshine a little bit later. today it will take a couple of

hours, but we should be mostly sunny lingering along the coastline. but partly cloudy to mostly sunny skies expected for most today. we've been talking about it. the rain, it will be returning. it looks like the first storm on wednesday and the second by friday. and take a look as we're going to pick it up, just to save us the time. it will be developing throughout the morning and afternoon. and the morning drive that they may be dry, but the afternoon drive coming home midweek wednesday will be a wet one and it will continue as we dry out on thursday and we get a break on thursday. thursday looks mainly dry, but look what's over the pacific. that will work their way over the bay area by friday morning. so by friday morning if this remains on track, we'll be waking up with the wet roadways and the entire friday that looks to be wet with a nice soaking for us and even now here we are on saturday morning and the scattered showers, they will need to continue. expect the wet weather on wednesday and again on friday and lasting into at least the first part of the weekend.

for today, morning clouds, followed by the afternoon sunshine. temperatures, a lot like yesterday, they will feel a little cooler without the sun this morning and then for the afternoon, we're shaving off a couple of degrees for most of us. partly cloudy, increasing clouds on tuesday. and the rain, they will be arriving on wednesday and half an inch into an inch expected with the first storm. turning mostly cloudy on thursday. as i showed you how it goes, the next storm will roll in on friday. a look at your current temperatures coming up. the production company is suing them for cheating out the contestants of at least $10 million in royalties. the san jose mercury news reports that the federal lawsuit was filed on thursday by 19 recordings of the music company founded by the creator. some artists named in the lawsuit include carrie underwood. so far sony entertainment has not made any comments on the lawsuit. of course, you can watch them right here on ktvu airing on wednesday and thursday nights. well, they didn't have two

of their star players, but the home crowd was still happy and how they welcomed the head coach back to the bay area. and good news for the bart riders this morning as workers have repaired a section of the tracks affected by the train derailments. we'll tell you about the work that needs to be done before they could reopen.

well we are keeping a close eye on bart this morning as the transit agency is finally nearing the end of the repair work. good morning and welcome back to mornings on 2, i'm claudine wong. >> i'm mike mibach. developing news. the rail service is scheduled to resume in half an hour from now. allie rasmus is live for us this morning at the concord bart station where it is scheduled to begin to open back up. allie? >> reporter: the bart assessment analyst says they have to do test runs first with those trains that tonight have passengers on them. it looks like they are preparing to do the test runs any minute now. you can hear the trains and you can see the flashing signs there saying that the trains will not stop that they are running a test train right now on the platform. there's no one on the platform because the station is still closed. we can show you that they are

still up here, but it could be changing in about 30 minutes from now. according to the spokesperson, the trains will be back on track here at the station and with the first train scheduled to come on through and the passenger train coming through at 8:07. now the work on these tracks, they are essentially around the clock since they derailed here on friday evening. when we arrived here at 5:30 this morning, you could see the workers doing the final rounds of tests and checks. and the derailment on friday evening, they damaged the tracks and the third rail, but they discovered yesterday that most of the damage was on the section of the tracks, taking it to the maintenance yard, not the tracks that they needed to use as workers replaced two sections of track to make their repairs yesterday in overnight. and the spokesman, they explained what else needs to happen this morning before the first train comes through at 8:07. >> and i took a close look at the rail itself and replacing the cables, mentioning the power that it is all, you know, connected and testing all that

stuff. and more of the electricians, they are doing their work. >> reporter: well yesterday morning, we're showing you the view from the cam right now as we can get you a closer look at the test train that they are running on the concord station tracks. again they brought in two 39- foot sections to make the repairs. again workers were out here this morning doing last minute checks. we just showed you what looked like a test train being run on the tracks. and so it seems as everything is according to plan going according to plan in that 8:07, the first passenger train will come through. we'll have another update in 30 minutes to give you the latest. live in concord, allie rasmus al, channel 2 news. bart is apologizing to riders for the service disruption that affected a lot of weekend plans. the bus bridge made them so late that they gave up and they didn't end up going to the monster dream truck rally at

open coliseum last night. >> we were taking advantage of this time to have fun with the kids. it's a disappointment, but everything happens for a reason. >> instead of riding the bart buses, many people decided to drive last night. interstate 880 did get jammed up near the coliseum as you can see the red lights. that's headed on in there. that was for the monster truck show and the warriors game. now, disgruntled motorists pointed out the lack of parking between the coliseum and oracle arena. the police chief is calling criticism of the department's training and oversight misguided. last month they were shot and killed by the fellow bart officer michael mays. the chronical obtained a note that the bart chief said to employees, suggesting that a fewindividuals within outside the ayenisei were undermining efforts to approve the image of the bart police force.

a memorial service for the uc berkeley football player who died will be held tomorrow night on campus. the public memorial will come after the family, friends, and teammates packed the funeral service over the weekend in bakersfield. the 21-year-old defensive lineman was a health major. he collapsed during a workout earlier this month. cause of death not yet released. two big fires broke out in redwood city. the fire happened last november in the sims medical facility. arson is expected for at least one of the fires. there will also be random unannounced inspections. the owner of the why toyota pickup truck that could be linked to the water bottle assault case haves hired a lawyer. the attorney has now been in contact with the highway patrol. the investigators say they are

the year. channel 2 news. and again the county's engineer is saying that the project, they could break ground by winter of 2014 as it will take about nine months to complete. police, they are turning to social media to help avoid the potential bank robberies after three suspects have been charging banks in fremont. in a twitter post, they could be targeted by these suspects next. and to help the pd with tips. the tweet also included pictures of the three suspects. police say that they are wanted for robbing serious banks in fremont as they started this past october. the sonoma county deputies are looking for this man who robbed a west america bank on friday afternoon. they say he demanded money from them at gunpoint and then left on foot. described as a white man in his mid to late 20s. about six feet tall with red or blonde hair. tomorrow the state legislature, they will turn themselves in. southern california and the state senator, they are facing

a 24-count indictment on bribery, conspiracy, and wire fraud. they accused the lawmaker of accepting tens of thousands of dollars in bribes. and his brother tom, he is a former assemblyman that now works as a lobbyist, facing charges of money laundering. the leader, they are urging ron to resign from office. apple and samsung have failed to reach an agreement in their latest smart phone patent case and the two companies told the judge in san jose that a day of negotiations, they did not produce results, but that they are still willing to work with a mediator. a trial is set next month on the accusations that the galaxy and the other devices that they copied their technology. and they are appealing a previous verdict about older devices that are currently carrying a $930 million fine. believe it or not, the last sunday of february. knocking on the door as they are here with us. it should be a nice one outside

later today and if this overcast sky clears out. >> you're right. you're waking up without the sunshine this morning and perhaps you're looking at gray outside your window as well. a little bit later this morning, partly cloudy as we need to get through the later half of your morning into the afternoon and that you can see a live look at the bay bridge into san francisco. and it will be a little tough to see even at times, santa rosa and perhaps the patchy dense fog and the visibility is down to a quarter mile along the valley floor there and take it easy as you need to hear the footprint from the coast to the peninsula into the bay and moving into the east bay this morning and again, most of us, they are just waking up with the overcast conditions, stretching into areas like san francisco, the airport, san mateo, pal alto, off to the east, we have fremont, alameda, all the small communities many between here and off to the

east where we even have partly to mostly cloudy skies reported to areas all the way like livermore. so by 9:30 or so, that they will begin to see off as we would have it for you. let's take a look at the widespread numbers. the only spot on this map is checking in at livermore. and even half moon bay is checking in with 50 degrees. the blankets are insulating sort to speak as we're warmer than where we were, but we don't have the sun as it will be feeling cooler out there for a bike ride maybe going to the farmer's market. as we get to the 9:00 hour, notice that they are still inside that bay and here we are at 10:00 along the coastline by 11:00 lunchtime and it is now clearing out of the bay as we're going to linger along the coast, but by the second half of the afternoon and a mix of -- and a mix of sun and clouds and the temperatures, they will need to remain above that average.

67 in santa rosa for today. 64 in berkeley and the mid-60s in oakland and san francisco and upper 60s. concord, livermore, you're looking at 70 for the afternoon and 68 for san jose and going to 68 as well. 72 for gilroy into the afternoon. extended forecast here, your bay area weekend in view showing the view. and the morning cloud followed by the afternoon sun and the temperatures, a lot like yesterday. without the sun though, we'll be slower to warm up with a pretty rapid warm up yesterday morning as it will be a little slower. but by the afternoon, widespread 60s in the forecast on monday and tuesday and partly cloudy, morning fog. temperatures, they are changing very little. but as you get into wednesday, there's the rain, which will need to move on in as you move through wednesday spotlight evening commute, they will get the brunt of the storm as i will show you a detailed look as well as the friday system that will be coming up. >> great, thank you. the warriors, they were still able to grab that home

that issue. the investigation is underway in a deadly carbon monoxide leak inside a restaurant of a new york's mall. the manager of the legal seafood died and 27 others infected by the fumes. it may have come from the heating system. an open bar with a reputation for violence has finalized an agreement with the city to help make the surrounding neighborhoods safer. last year there were three shootings in connection to the bar on piedmont avenue in response the city attorney's office and police, they forced their bar owners to follow a new set of rules. from now on the bar has to close at midnight. two security guards need to be on patrol from 8:00 p.m. until close and that bart, they must ban anyone caught using drugs fighting or possessing a weapon. >> they are more secure than what they were before. >> and i would be concerned about it at this point. that i feel like they do a good job. >> the new agreement is posted in plain view just below the

oakland. this is going to clear as we'll be partly cloudy for your afternoon. temperatures this morning, slightly up because of the overcast skies. it is still going to feel cool out there without the sun shining on us. i'm tracking the storm for you coming up. happening right now, bart service is back to normal after a train derailment that shut down three bart stations east of pleasant hill. allie rasmus is live at the concord bus station awaiting the first train. hey, allie. >> reporter: hey mike, the gates are open here at the concord station. we've been watching for the past 18 minutes or so. we can show you that there are passengers that are waiting on the platform. but the bart station is back in service after the train derailed on friday night. the first train today is suppose to arrive here at 8:07 this morning as we are just a few minutes away from that. about 20 minutes ago we saw some of the test trains that are being run on these tracks. they had to do the test runs before they opened up for the regular service, just to make sure that everything was ready to go after the overnight

repairs. the work on the tracks, essentially it's been around the clock since they derailed on friday evening. and we saw several workers during some of the final rounds of the tests and check this morning. the derailment of the bart train on friday morning damaged the tracks and the third rail. but workers discovered most of it was on a section of tracks taking them to the maintenance yards. not the tracks that they viewed. workers replace the tracks to make the repairs yesterday and overnight and then after the last-minute tests, again it looks like everything will be back to normal here. >> it is the passengers that will deserve a big thank you for all the patients that they have shown and in understanding that sometimes things, they do breakdown in the repairs. and that we're not going to put it back in service unless it is safe. >> reporter: the removal of the bart tracks created a

his home as he became agitated and assaulted them. they called police for help and deputies say when they arrived they came at them with a bat causing them to shoot and kill them. they hired an attorney as they say that deputies fired 13 shots. heading to fresno tomorrow as they will be honoring two of their own killed in the line of duty. the 33-year-old and the 34-year- old brian lobb died last monday in fresno county as they were responding to a traffic accident and hit a guardrail while trying to avoid a multiple vehicle involved in that crash. and after graduating from the academy together, they train in the san jose office and in oakland. the governor will be among the thousands of people attending tomorrow's service and the officers from several law enforcement agencies, they will need to help cover for the large number of the bay area and their officers that will be headed to the memorial. about 20 more poisonous meatball haves been found in a neighborhood of san francisco's twin peaks area.

accidental shooting death of the bart police officer. and the police chief of the transit agency is calling on their training and overnight and misguided. their chronical obtained a note that bart chief said to the employees that they suggested that a few individuals within and outside the agency that that are were undermining their efforts all to improve the image of the bart police force. a memorial service for their football player that died during the team workout will be held on campus as they will come after family and friends and teammates, and what they had to deal with over the weekend. the 21-year-old defensive lineman needed to plan to attend medical school as they said that they collapsed during the workout earlier this month and that the cause of death not yet released. the new safety rules are in place and where two big fires broke out just weeks apart, which they happened last november and december at the
