we're tracking a major backup on interstate 880 where a big rig crash has created a traffic nightmare. the family of lynn spaulding found dead in a stairwell at san francisco jen. hospital is now filing a claim against the city. we're learning about the new focus of b.a.r.t.'s investigation into the deadly crash on the tracks that claimed one person's life and resulted in one-hour delays and several station closures this

morning. we begin with a major traffic accident in fremont. these are live pictures from newschopper2. you can see the backup here, a big rig was on its side block all lane of southbound 880 and the backup is stretching for miles. we understand that a big rig has just been righted but still is blocking lanes. just about 20 minutes ago, a large tow truck arrived to take that overturned big rick out of the lanes. the accident apparently started in the northbound lanes of interstate 880 in fremont between auto mall parkway and stevenson boulevard. this all started around 10:00 in the morning. a witnesses says the big rig driver crossed over the median. one person was injured when debris from the crash hit their vehicle. and take a look at our realtime

traffic map. you can see all of the red on 880 indicating how bad the backup is and even in the opposite direction in the northbound direction also as people are slowing down to take a look at that crash scene on 880 in fremont. the family of lynn spaulding, the woman whose body was found in a stairwell of san francisco general hospital 17 days after she disappeared last fall is filing a claim against san francisco. tara moriarty joined us live. >> reporter: good afternoon. lynn spauld's attorney did file the name yesterday. this is it. it's 23 pages long. he expects the city attorney's office will reject it. the next thing you can expect to see is a lawsuit filed. typically with hospital claims, if one you can receive a $250,000 payout. , but she's been filed as a

dependent adult under the civil protection act. what that means is the $250,000 cap would not apply. this claim is, of course, fallout from the incident in san francisco general hospital last fall in which she taliban -- in which she vanished from her room. an investigation determined that both the sheriff's department and hospital shared the blame. >> the only thing that lynn spaulding's family has seen come out of this is the reassignment of sheriff adeputy -- sheriff's deputies. we do not think that reassigning a few deputies is a full enough price to pay. >> reporter: 2 investigates obtained documents. and the sheriff's deputy was understaffed and did not proper conducted searches because overtime was not available. one hospital transcript

revealed this, the person was going to be discharged anyway and decided to take off and her daughter made a stink about it. that's all it was. i didn't smell her but two of our guys messed up big time. they didn't do their job. nothing new. i'm just laughing. now, the city attorney's office has 45 days to decide what to do with the claim. tara moriarty, ktvu channel 2 news. the investigation is underway for the person hit by a b.a.r.t. train overnight. brian flores has the major delays and closures that impacted the commutes. good afternoon, brian. >> reporter: this is information we learned a short time ago. we're about a quarter mile south of the south hayward b.a.r.t. station. that key piece of evidence is along a fence line similar to what you see right here. not too far from here bart is

examining at least two holes found along the fence line that enclose esthe b.a.r.t. tracks and may provide more answers into how this happened. it's unclear how big the holes were but sources say it appears that one of the cases somebody somehow took the bolts off the fence and simply slit it open. now, these fences are not easily accessible to the public and there is an encampment nearby where the holes why found. a man was hit by a train and killed. he has yet to be identified but b.a.r.t. says he was a trespasser and not a b.a.r.t. employee. they say as the investigation continues it does not appear there was foul play either. >> our tracks are protected by very high seven-foot chain-link fences. it has sharp edges and it's not

easy to access the trainway. but there are people who do it. sometimes they get in there and steal copper or whatever. we're not sure why this person was on the track way. >> reporter: even though the incident happened at 11:30 last night, police had to wait until morning and daylight to conduct gathering more evidence in this case. three b.a.r.t. stations were closed. fremont, union city and hayward. b.a.r.t. told people to go to bayfair to begin service. many people we spoke with were inconvenienced this morning. >> it's completely inconvenient. it's something every day with b.a.r.t. >> reporter: yeah. >> exactly. we pay too much money to catch the train every day and there's a problem. they can't get it together. no bus. nobody can get to work. people are relying on b.a.r.t. >> reporter: an unrelated equipment problem added to the commute. headaches but no question, a lot of confusion and

scrambling. as we take it back out here live, despite the fact that there's barbed wire even signs, tragedy struck late last night and eventually service was fully restored just before 8:00 this morning. we're live in hayward, brian flores, ktvu channel 2 news. >> thank you. well, as you can see, it's a little gray and cloudy right now over much of the bay area and more rain is on the way. mark tamayo is here to tell us how much we'll get and how long it will last. >> so far clouds out there. the clouds showing up and bay area wide. a few sprinkles early. primarily north of the golden gate bridge. not much yet. up towards cape mendocino. but what will be happening later on today especially at 3:00, this rain line will be shifting to the south. as a result, the rainfall, the chances will be increasing in the bay area. here's a closer inspection up towards northern california right around chico, redding eureka, approaching parts of

mendocino and a closer look at our radar here. not much in the way of coverage. i will put this into motion over the past hour. you can see a little bit of activity moving towards parts of marin county. probably not even reaching the ground. we could have a few sprinkles up towards novato and to the east. coming up at 12:20, we'll take a look at this, the timing of the heaviest rainfall and the forecast rain amounts. some areas could have amounts approaching 1 inch. we'll highlight those air yachtia -- areas at 12:30. we want to take you back to 880. this is in fremont. there was a big rig on its side causing a backup for miles. this sometimes can happen in the backup, another collision, this is what you are seeing right now. it looks like people were hurt some people sitting there in the median. an ambulance there. at least two cars involved in the backup. it looks like traffic is starting to move a little bit

after they uprighted that big rig. this is in the southbound lanes of interstatele -- interstate 880. the big rig went on its side about 10:00 this morning and traffic is still backed up there significantly and caused this. oakland police say they have located the driver involved in an accident that was initially reported as a kidnapping. they say a young woman in her 20s was driving and hit a light pole at 83rd avenue and burch street. this was around 5:30 this morning. it's not clear why the driver disappeared or where police found here but they said that witnesses may have stopped to help and they would be checking hospitals. they have found no evidence of a kidnapping. >> certainly if there is an area of the investigation that leads us to definite where we have a concern, regarding a kidnapping, we'll let you know. but at this stage, we're

looking at just a single vehicle accident. >> police say they have been knocking on doors and talking to witnesses to determine exactly what happened. dublin police are warning people to be on the lookout for three men into broke into a home, tied up an 80-year-old woman and stole her cash and jewelry. it hatched monday night -- happened monday night on saretto street. four other robberies happened in the same area in the last couple of days. the other robberies happened when no one was home. on monday night three young men break into a home while an 80- year-old woman was sound asleep. >> they tied her up and demanded cash and valuables and rummaged through the house and fled the scene. >> investigators are trying to determine if monday's incident is connected to the other burglaries. police plan to hold a community meeting tomorrow night at 7:00 at dublin city hall.

israel 'prime minister came to silicon valley this morning to meet with governor brown. the two men got together at the computer history museum in mountain view and signed and agreement to expand economic cultural and academic cooperation between israel and california. israel has a very strong high- tech industry with more engineers per capita than the united states or japan. about a dozen demonstrators camped out across the street calling for freedom for palestinians and opposing copration with israel. new developments in the crisis in ukraine. the russian incursion was the discussion on capitol hill. >> sequestration, this is a time for wise and steady and firm leadership.

and it's a time for all of us to stand with the ukrainian people in support of their territorial integrity and sovereignty. >> on the house side, speaker john boehner said congress should move to strengthen president obama's hand as he deals with the russians. members are working on a package of sanctions against moscow. oakland mayor jean quan casted a tie-breaking vote in favor of a new controversial new surveillance center. >> the mayor has cast an aye vote. >> no! >> and the item passes. [chanting] >> there were jeers in city council chambers after that vote by critics of the domain awareness center described as a 24-hour emergency operations facility. it will be a central base for collecting information from the

police, surveillance cameras and shot spotter systems. opponents of the new center fear it will be used to spy on people. mayor quan trying to ease those fears voted for a measure that only covers surveillance at the port of oakland and not the entire city. a prayer family is calling for -- bay area family is calling for changes at one area hospital after they say they were treated after the death of their daughter. >> there is a right way to handle it and the wrong way to handle it. we experienced the wrong way to the highest degree. >> 21-month-old morgan westoff died from complications after a heart procedure by children's hospital of oakland. the parents got a barrage of mail from the hospital, including a repeated request for donations. 2 investigates looks into morgan's case and asks the hospital what is being done about it.

the metropolitan transportation commission voted to expand the clippard card system to all of the bay area's smaller transit agencies. smaller carriers transport passengers to b.a.r.t. and a.c. transit which already have clippard card service. the system will be rolled over the next year making these system virtually seamless when it comes to paying. >> that will involve the omrateers, left a county connection. tridelta and the west part of the county. this will enable them to do their entire transit commute using clippard. >> san francisco this morning kicked off its latest homeless connect event. volunteers gathered at bill graham civic auditorium for the 10th year of the events. during the time, they've guided thousands of homeless people towards medical social and housing services. >> have we done enough? no, we have more to do.

as the greatest scene in the world, we invite the challenges and we work with them and we create new partnerships. >> today's home also connect event is scheduled to run until 3:00 this afternoon. park rangers say thieves are targeting california's world-famous redwood city trees. rangers are having to close the parkway at night in order to deter thieves. the national pfs service released this picture of one case of the poaching. they say the thieves use the stolen wood to make coffee tables and wall clocks. so far a lot of clouds in the bay area. that will be changing as rainfall probabilities will be increasing a cross a good portion of the state including the bay area. here's our live camera looking out towards walnut creek. a lot of cloud cover here and a few sprinkles, a few light showers earlier this morning. but the main action so far has been focused out to the north

of the bay area. right now on live stormtracker2, here is the radar loop over the past one hour, some rain showers approaching eureka, redding and chico. this is a fairly warm system. as a result snow levels coming up to 8,000 feet. a rain event for a good portion of the sierra. right now on the radar, a few spotty light showers nothing too significant. we'll come in tighter closer to the south and to the east of fairfield approaching parts of solano county. we could have spotty mist or drizzle out there. current temperatures if you stepped outside the door, you thought it moose mild. you were right on. santa rosa currently 62. oakland, 64. san jose, 68 and napa at last check reporting 61 degrees. for today, more cloud cover, the rain will be moving to the south. it's already up to the north. that will gradually move to the south. here's our live camera looking out toward the bay bridge towards downtown san francisco. for tomorrow morning clouds and

then skies becoming partly cloudy into the afternoon hours. this weekend, bick changes. temperatures will be -- big changes. temperatures will be soaring back to the lower 70s on saturday. sunday, we'll thicken up the clouds and cool things off. here's the weather pattern. this area of low pressure offshore. i'm looking at this moisture stream. here's eureka and the bay area and extending out to the southwest and us and that treatment stream will be focused up to the north the next 24 hours. this will pay us a visit as well. for today, the next system we're expecting the rainfall to make a comeback for the late afternoon and evening commute. but rainfall totals, not -- they won't be adding up to much. here is a look with the rainfall totals out there. most areas between .10 in the inland valleys to possibly .5. north bay hills we could have amounts approaching 1 inch, the coastal hills, some more significant rainfall. here's our forecast model. we'll put it into motion, the

rainfall focused up to the north, up towards santa rosa and then later on this evening especially after 6:00, the line moves to the south at 10:00 and 11:00, still pushing tlul the area. tomorrow a lot of clouds the possibility of a leftover shower, skies becoming partly cloudy into the afternoon. forecast highs in the 60s to right around 70 degrees. a lot of cloud cover and the rainfall developing especially late this afternoon up in the north bay, gradually spreading south and here is a look ahead to your five-day forecast with your weekend always in view. lingering showers. took at saturday. temperatures back up in the lower 70s. there is a chance of a shower on sunday. don't forget to change the clocks ahead one hour. >> i can't believe we have to do that already. >> thank you, mark. a small asteroid is about to fly by the earth at an extremely close distance, relatively speaking. scientists say is the space rock is about 100 feet wide and will pass by earth at 1:00 p.m. at a distance of 217,000 miles.

after the big surge yesterday, stocks not changing too much after a survey showed that u.s. companies added slightly more jobs in february than in the previous month. a short time ago, the federal reserve survey shows severe winter weather did hold back economic growth in much of the from january through early february. taking a live look at the big board -- the cost of avocados is going up. that means that guacamole could soon be eliminated from some menus. the popular restaurant chain chipotle is close lit monitoring the price -- closely monitoring the price of avocados. california scientists say because of climate change, the production of avocados could drop 40% in the next 30 years. and in a letter to shareholders, chipotle learns

that could lead to higher prices. the l.e.d. spites were installed on the western span one-year ago. but organizers say they want to raise $12 million in donations to keep the lights on until 2026. to do that, the lights would be removed next year for bridge painting and new stronger bulbs would be reinstalled. almost two miles long. an enormous structure. it's very difficult to access. there are many challenges to doing that. but i think the economic cost is far outweighed by the people. >> waterfront businesses have noticed a 10% spike in sales since the lights went up. to show people what they would be missing. organizers will turn the lights off at 7:00 for ten minutes tomorrow night. there is a new plan to make flying safer by making major changes to runways.
