mornings on 2 starts now. good morning. welcome to mornings on 2. the roads slick. pack some patients before you head out the door. this is a live look at conditions in martinez. alex savage is live with details on another problem scattered outages around the bay area. that could cause problems for a lot of people. good morning. >> let's talk about weather and traffic. steve, you don't think we need to take an umbrella, right? >> i don't think so. not right now. everything was last night. there could still be some drizzle or very, very light rain. fog is a bigger issue. rainfall is not too bad. danville two-thirds of an inch. that fell 10:30 last night in

ten minutes. sausalito 58. socal had a half-inch of rain. and antonio just sent me a message on facebook. daily city this 3.35. thank you for the information. a lot of cloud cover over us. there are a few breaks in the clouds but a mostly cloudy morning. mild. maybe a few light showers left, but not a lot. a few 40s. 50s. 56 livermore. also in san jose. overall, look for a lot of cloud cover in the morning and more decreasing in the afternoon with partly cloudy, partly sunny conditions. a lot of moisture in the air. lingering rain or light showers to the coast. overall, mostly cloudy. fog. 60s for some. >> thanks, steve. we have some major delays in contra costa county near martinez on highway 4 westbound at the morllo avenue exit. there is a two car crash, injury accident. two lanes are blocked. it is creating backup all the

way in the bay point pittsburg area. this is westbound traffic you are looking at on the bottom portion of your screen. at the bay bridge toll plaza lights have been on for almost an hour and very slow heading into san francisco. give yourself an extra 20 minutes at this stage. we had 880 year the oakland coliseum, as you make the drive towards hayward and opposite side towards downtown oakland, it is looking good right now. 7:03. >> thank you, tara. as steve just mentioned we are drying out after some pretty wild weather overnight. a powerful storm pounded the bay area bringing heavy rain and lightning and thunder. ktvu's alex savage live with new information involving this stormy weather. good morning, alex. >> reporter: good morning to you. there were scattered outages throughout the bay area overnight. we just hearing, in fact, about a new outage in concord. pg&e is trying to restore power

to 200 or more homes near ig naseio road. here in martinez, still a handful of people remain in the dark and it appears that lightning from some of those overnight storms triggered some of the outages. you can hear the thunder and see the lightning as this powerful storm cell blew through martinez overnight. this is right around the time the power went out to many customers in this area. the lightning and the thunder was followed shortly thereafter by heavy rain. along with the outages in martinez, there were thousands of people in concord and walnut creek who lost power as well for a short period of time overnight. many people who did lose power said they woke up to the thunder. >> it was loud. i didn't see the lightning, and that's kind of fun in a weird way just to see how long it takes and kind of guess where

it is, you know. if it's overhead or a distance away. >> reporter: that gentleman clearly enjoying last night's storms. this wasn't the only area that saw wet weather. there was a strong downpour in pacifica 10:00 or so. the roads were left wet in that area. >> also showers in francisco. the rain was short lived. these cells moved through quickly and throughout the morning lingering light showers in some spots. pg&e says that the height of the storms overnight, there were 5,000 or so customers in contra costa county who were in the dark. they are hoping to have everybody back online later this morning. we are hearing about a new outage in concord. we are headed in that direction and we will let you know what things look like in that neighborhood coming up at 8:00 this morning. we are live this morning in martinez, alex savage, ktvu channel 2 news. >> stay up to date with the latest weather conditions with the new ktvu weather app. it's available for apple android

phones. 7:05. the rain definitely good news in mar in. it means the water district customers, you won't have to worry about mandatory water rationing this year. take a look at what phoenix lake looked like back in january. it was 70% full. now the reservoir is at full capacity thanks to the 21 inches of rain that fell in the past four weeks. >> our reservoirs are enough above that threshold that it would require mandatory ration inning that we feel confident we don't need to go there this rear year. >> the water district still wants customers to reduce water use by 25%. it is 7:07. we are getting new information about a late-night homicide in oakland. police tell us a man was shot to death last night around 10:30 on 11th avenue and east 24th street. police are still investigating the circumstances of the shooting. there is no word on whether they have a suspect. a rich man schoolteacher is behind bars this morning after

being arrested in his classroom on child sex abuse charges. ktvu's brian flores is live in richmond where there are questions about how the teacher got hired in the first place. good morning, brian. >> reporter: good morning, tori. well, shocked students, parents and staff this morning. school district officials say they ran the background checks on this teacher, but now admit that those background checks simply did not go for enough. here atmera vista school, school not in session. when students arrive they will be met with counselors to meet with affected students as well. many seventh grade students saw the arrest of 33-year-old ronald david ginto. he was place inside handcuffs by richmond police in front of his classroom yesterday. police say the teacher faces at least 14 counts of child sex abuse charges. they say those allegations did not stem from him being a teacher here at mira vista but instead his previous work at making waves charter school also in richmond. he was hired here back in

january. what comes into question for the district, they are looking at his background check. they say they vetted, questioned, even ran fingerprints on him before he was hired. he passed those checks. at the same time he was being investigatinged for the alleged charges from his previous school. the district officials admit to ktvu there is room for improvement on the background checks and there are definitely concerned parents this morning. >> i am deeply concerned how he could be a teacher without that being known. something's wrong. you hear stories like that left and right. that's crazy. you know, you hear about the stories, but you never know how, you know, until it actually happens to the school your kids go to. >> reporter: now, school officials say they ran the background checks in december. they say previously there were no red flags when they ran those checks. now they are questioning his interview process and they will be reexamining previous interview phone calls to his previous employer.

we're also learning that ginto was originally hired to replace another teacher who school officials say was not a good fit for the school or the students. as for ginto he is being held on $1.4 million bail. brian flores. 7:09. a former san francisco human rights commissioner was sentence today a year in jail for possessing child pornography. that sentence against 67-year-old larry brinken was handed down yesterday as a plea bargain. he will have to register as a sex offender for the rest of his right. he served as a guidelines officer for the human rights commission until he retired in 2010. he is also known as a strong supporter of gay rights. it is 7:09. investigators are help on whoever opened fire on a car. a person was shot while driving near the high street exit yesterday afternoon. officers learned about the shooting when the victim walked

into highland hospital with a gunshot wound. his car was found near the hospital with a bullet hole in the driver's side of the car and the passenger window blown out. however, police tell ktvu the victim is not being very cooperative. he is expected to survive. you may recall there was another freeway shooting last thursday evening on 580. here is the highway 238 interchange. four people were arrested in that case. time 7:10. a federal jury convicted an or ripped a man of economic espionage in an international plot. the prosecutors say walter lou stole trade secrets from the american chemical company dupont and then sold them to a chemical company run by the chinese government. the chemical is used in everything from paint to the filling of oreo cookies. the 56-year-old man is the head of a chemical company based in oakland. he will be sentenced in june. a 16-year-old boy accused in the suspected hate crime attack

on a transgender teenager is due back in court this morning. the suspect, richard thomas, will go before a judge in oakland at 9:00 for a preliminary hearing. the prosecutors say thomas set sasha on fire while they were riding a transit bus in november. the teenager is being tried as an adult. alameda police are warning residents about a recent series of home burglaries. investigators say there have been 17 break-ins since mid january. the neighborhoods that have been hit the most often are east of 8th street to the end of the main island, and most of the crimes have happened on mondays, tuesdays, and wednesdays. officers are also reminding people to close and lock all doors and windows. they also remind people who have home alarms to set them before leaving. and they ask people it to consider getting video surveillance systems. time is 7:11. there is a new study out confirming the technology boom may be widening the income gap

here in the bay area. researchers with the brookings institute found that san francisco had the largest increase in income in equality between 2007 and 2012. silicon valley also saw its income gap rise mainly due to housing costs. the researchers say a family making $50,000 a year in dallas would need to make $77,000 a year to live in silicon valley. 7:12. an unusual addition will be part of a makeover of san francisco's dolores park. it includes adding a $15,000 outdoor urinal. they don't have enough to handle the visitors who come to the park on weekends. the urinal will be installed at 20th and church streets near the muni metro trap. time 7:12. an overnight accident happened in san jose involving a

the middle of next year. they say the closures are part of a plan to focus more on online sales, which make up almost half of its business now. staples is facing increasing competition from online retailers like amazon. staples' stock is down 13% on this news. former federal reserve chairman ben bernanke seems to be on the fast track as a public speaker. reportedly, he earned a quarter million dollars for one speech in abu dhabi on tuesday. that's more than his yearly salary last year. they say he is likely to take in that kind of money for about a year or two. yahoo is eliminated log-in buttons from google and facebook. instead, users will be asked to sign on to yahoo pages using their yahoo user name. yahoo says that will give to the best personalized experience to its users. tech analysts say it also will

let yahoo keep users on its pagers longer. we are finding out more about a possible drug connection in the case of a woman accused of brutally killing her 75-year-old mother in her east bay home. prosecutors say cindy lynn burley beat her mother to death with a sledgehammer early sunday morning. the newark s.w.a.t. team rush today the scene. the court records show the suspect's mother called police several times complaining about her daughter and her grandson moaking main. the 7 -- smoking marijuana. she pointed police to some pot plants that they are grandson was allegedly growing in the backyard. 7:17. two bay area men are due in court this morning to face felony drug charges. investigators identified one suspect as alfredo lopez, the owner of azteca market in san rafael. investigators say lopez ran the drug operation out of that

market along with a second suspect miguel masias of daily city. their arrests follow a year- long investigation by federal drug acts and the marin crime task force. 7:17. the cal state university system no longer plans to build a new school in concord. csu wanted to build a new campus on the former concord naval weapons station, but they couldn't work out a deal with the federal government, which still owns that land. contra costa is the only county in california that has more than a million residents but does not have a uc or usc school. csu east bay has a branch campus in concord with limited class offerings. the number of college freshman attending their first-choice school at its lowest point in 39 years. the annual ucla survey shows three-quarters of the students were accepted at their dream schools. however, only 57% are going

there. mostly because of the price. almost half of all students say receiving financial aid was a crucial factor in choosing which school to attend. a very close call for a truck driver in oregon after steel beams came crashing through his cab just missing his head. take a look. jack phillips was driving this 18-wheeler when another driver cut him off near tualatin. he was forced to slam on his brakes causing 30,000 pounds of steel that thinks truck was carrying to barrel into the back of his cab. >> well, all of the police officers, i told them i needed to buy them lottery tickets. i was very fortunate. >> yeah, as you can see the steel took out the dashboard, but amazingly missed the seats and the steering wheel. you could see a big beam out of the passenger window. he realizes he is lucky, but he says he feels sad about the condition of his truck. the driver who caused the accident was cited for unsafe

passing. >> that's one of the most incredible stories i have seen. >> it's incredible watching the damage there. >> when i see trucks loaded down with things like that i always get away. >> absolutely. >> far away. give them a lot of room. let's go to tara now. you have a new problem in the east bay. what happened? >> actually, this was that car crash we were talking about earlier in martinez on highway 4 westbound. actually, crews are still on the scene. this is a little bit removed from the accident but you can see that the traffic is very sluggish on the bottom portion of your screen there. this was a two car crash near themoriello avenue exit. looking at our map, i don't know if you can see at the bottom portion of the screen, highway 85 northbound at the on-ramp we have a two car crash. that has been moved to the shoulder but there is a massive delay because of that. so be aware. up next a look at the bay

7:25. facebook is imposing new restrictions aimed at keeping illegal weapons out of the hands of young people. yesterday facebook announced it's blocking minors from seeing postings related to firearms sales. the menlo park company will also delete all gun sale posts that don't require a background check. the changes also apply to instagram, facebook's popular photo-sharing site. san jose's mayor is among those who have strong feelings about facebook's new gun policy. >> i don't think criminals should be able to buy guns. i don't think children should be able to buy guns. i don't think people who are mentally unstable should be able to buy guns. >> when you start limiting the ability for people to exchange ideas about, you know, gun control or gun rights an an open forum such as facebook and just as long as that doesn't happen, i don't think there is going to

be any problem with it. >> facebook will begin getting rid of those posts during the next few weeks and it's counting on millions of users to flag those restricted gun posts. all right. 7:26. a former executive director of the peninsula symphony association was arrested, accused of embezzlement. steven j. carlton is accused of forging the name of board members on checks and taking out an unauthorized loan. the board members found out when their bank alerted them their endowment this fallen from $422,000 to just $700. the symphony was almost forced to close, but they have been saved by donations. >> it is important for not just the symphony, but for all businesses, to have better checks and balances regarding their finances. it's always a good idea to have more than one person in charge of the finances. >> now, carlton is due to appear in court next month. he faces up to 18 years in

welcome at the toll plaza. you will probably need an extra 10 minutes to get across the span this morning. at the bay bridge toll plaza gridlock. not backed up all the way to the mesa. you are just looking at an extra 10 to 15 minutes to get into san francisco this morning. in the south bay 101 san jose? northbound on the right side of your screen towards the airport where we are seeing stop-and-go traffic. it's been like this pretty much for the past hour. 7:33. let's head over to the desk? thanks, tara. police are investigating a deadly accident in the south bay that occurred last night. janine de la vega joins us live from san jose with some new information that you have just learned. janine. >> reporter: tori, i just got off the phone with the coroner's office and they tell me that the man appears to be a trans gent cent. he was -- a transient. he was hit here where the speed limit is 50 miles an hour. cars are traveling fast.

you can still see the orange marking on the ground left from the accident. the 911 call came in at nine last night with people saying there was a man who had been hit by a car in the southbound lanes of almandine expressway. when officers arrived they found the man unconscious and lying on the ground. emergency crews responded but were unable to save him. he was pronounced dead at the scene. the driver responsible for hitting the victim did stop and is cooperating with investigators. at this point it's unclear who is at fault. no arrests have been made and the coroner's office has told us again that the man appeared to be homeless and they believe that he is in his late 30. but they are still attempting to reach his relatives. and back out here live, i do want to show you that there are nine lanes of traffic when you count the turn lanes in this section of alma don expressway. there is no crosswalks, but

there is underneath the overpass. we have a call in to the police to get an update to find out exactly where the victim was walking and if he was at fault. we haven't heard back yet from police. reporting live from san jose, janine de la vega. >> thanks. it's 7:34. san francisco will be tackling the issue of pedestrian safety today. five pedestrians have been hit and killed in that city this year. the most recent happened about two weeks ago when a 90-year- old woman died after getting hit by a truck at california and fill more streets. at 9:30 this morning san francisco mayor ed lee will introduce new safety measures. he plans to target the most dangerous streets, including the downtown, tenderloin, and south of market areas. there will be extra resources, including more police officers and road improvements. new developments in san jose's four-year-long legal bat well major league baseball of the possible relocation of the oakland a's.

last night the city of san jose filed an opening brief with the federal appeals court in their antitrust suit. san jose contends that baseball should no longer receive an antitrust exemption and should allow the oakland a's to move to the south bay. the san francisco giants have claimed exclusive territorial rights to san jose and major league baseball backed that claim last year by turning down the a's relocation request. tenants in richmond's public housing say they have lived with cockroaches, bedbugs and mice for far too long. people who live at the hacienda are demanding the city quickly resolve the issues they have to live with every day. they called the building the worst example of public housing in richmond. >> i am angry. i am frustrated. i want to see some change. >> we're still formulating plans based on the inspections right

now. >> the city plans to hold a special meeting next wednesday to discuss the problems. the city manager says one option is to tear down the hacienda, but he says there is not really any money to do that right now. time now 7:36. san francisco city attorney has 45 days now to respond to a legal claim filed on behalf of the family of lynn spalding. her body was found in the stairwell at san francisco general hospital last fall more than two weeks after she disappeared from her hospital room. now, the claim charges medical malpractice and negligence. another key claim could allow the family to seek damages beyond a $250,000 medical malpractice cap. >> there is no monetary cap on damages in a lawsuit brought under the elder abuse and adult dependency statute. >> now, that legal claim was filed yesterday. it is the first step towards a lawsuit. san francisco police are searching for a man in a

wheelchair. he is suspected of several assaults on women near san francisco general hospital. the latest attack was at 22nd street. a woman was punched. investigators say the suspect is responsible for at least five assaults in the past week. now, he is described as having a partially amputated right leg and he uses his left leg to propel his wheelchair through the streets very fast. it is 7:38. israeli prime minister benjamin netanyahu and governor jerry brown have signed a trade pact they say will benefit both sides. the agreement, which was signed yesterday in mountain view, calls for sharing research and information on new technologies and issues such as renewable energy, cybersecurity, and water conservation. the governor's office reports that last year trade between israel and california totalled more than $4 billion. crime prevention and the economy are expected to be

scheduled to give an update and this may reopen a horrific bay area murder case. ktvu's palm cook is in the newsroom -- pam cook to tell us what happened. >> they were often called the san mateo killings. five women stabbed to death in a four-month snap 1976. two were killed in pacifica, one in millbrae and two in daily city. one victim, veronica ann ka see owe, was just 18 years old. he was last seen waiting for a bus. her body was found in pacifica and she had been raped and stabbed 32 times. in an interview only on 2, one of her friends tell us family and friends never gave up hope that her killer would be found. >> i am glad that the case is not dead, you know. i am glad that people are remembering ronnie and the other women that were killed.

those lights shining for the next ten years. the bay area commute will get a little easier if you use a clipper card. right now these cards can be used on bart, san francisco's muni, and ac transit. however, the metropolitan transportation commission has voted to expand the clipper card system to include smaller transit systems. so over the next year the cards can also be used on transit lines and places like rio vista, vacaville, cloverdale, and petaluma. 7:47. a new study finds that playing with barbie could affect how girls view their career choices. researchers at oregon state gave girls either a barbie or a mrs. potato head to play with. then asked them which careers the girls could imagine pursuing. the girls with the barbies reported fewer career options even when playing with a career-oriented barbie doll like a doctor barbie. so interesting little sampling

debris in the lanes and that is causing some slowdowns. finally, 880 near the oakland coliseum looking good. you know, about half an hour ago, and then all of a sudden northbound very backed up. so definitely give yourself some extra time or use 580 as an alternate. richmond schoolteacher is in jail this morning after being arrested in his classroom on child sex abuse charges. ktvu's brian flores live in richmond now where there are lots of questions, brian, about how the teacher got hired in the first place. good morning. >> reporter: good morning, dave. and many parents that we spoke with are shocked at the fact that this teacher was arrested on campus. more importantly, they are concerned that the background checks done on the teacher did not pick up on any red flags or warning signs. that's something the district officials also say needs to be improved upon. we are live at mira vista school this morning. students and teachers and parents making their way to class. when they fet here counselors will be here to speak with

affected students. many of those students saw the arrest of 33-year-old ronald david guinto by police during school hours yesterday. police say he faces at least 14 child sex abuse charges. 11 of those charges were lewd acts on minors. richmond school officials say they ran background checks on guinto back in december, even fingerprinting him, vetting and questioning him, and at the same they say there were in warning signs to prevent him from being hired. what dropped through the cracks was the serious charges from his previous employer, making waves academy school in richmond. he passed the back ground checks and was hired in january. district officials admit there is obvious room for improvement when it comes to teacher background checks and are investigating how this could have happened. >> hindsight, looking back, we need to review and explore and maybe go deeper into our processes and background checks before we employ people. >> you know, you hear about the stories that you never know,

you know, until it actually happens to the school your kids go to. >> reporter: the school district also says they will be reexamining phone interviews to his previous employer. the school district emphasizes that the child sex abuse charges are not tied to guinto's short time here at the school. the school has notified parents of the arrest and will offer student counseling this morning. what is being lost in this is the affect on the students as well. apparently, we are hearing that guinto was originally hired to replace another teacher who the district says was simply not a good fit for the school or for the class. live in richmond, brian flores, chemical ktvu. oakland police investigating a late night homicide. a man was shot to death around 10:30 last night on 11th avenue and east 24th street. we don't have any other details. there is no word of any arrests being made. also, traffic is flowing as normal as can be on westbound interstate 80, but this is

after a major crash this morning involving seven cars. it happened about 5:30 this morning near the powell street off-ramp at emeryville. at one point three of the lanes were blocked and there was a major backup out there. no word of anyone hurt. it is 8:06. happening now, some people are still without power in the bay area. there have been several outages after some wild weather overnight. alex savage is live in concord with how long it could take to get the lights back on. good morning, alex. >> reporter: good morning to you. a good section of this neighborhood in concord is still in the dark this morning. actually, i should point out to you this intersection behind us where we are, the stoplights are out. as can you probably see here it's actually causing quite a big backup here on clayton road near ig neighborio valley road. according to pg&e there are 200 homes without power right now. we have seen pg&e crews driving

through this area into apartment complexes, down some streets, into some shopping centers as well, trying to, obviously, get the power restored to folks around here. it should be back online in the next couple of hours. it's unclear what caused this particular outage here, but in other parts of contra costa county the culprit was lightning. you can hear the thunder and see the lightning as this powerful storm blew threw martinez overnight. the lightning and the thunder was quickly followed by some very heavy rain. at one point almost 5,000 customers lost power in contra costa county in places like concord and walnut creek. some people who lost power say they actually slept through the lightning and thunder. >> obviously, we were dead asleep. we work too hard.

rafael. investigators say lopez ran the drug operation out of that market along with a second suspect, miguel macias of daily city. their arrests follow a year- long investigation by federal drug agents and the marin county crimes task force. 8:10. the cal state university system no longer plans to create a full campus in concord. csu was negotiating with the federal government to build on the old concord naval weapons station site. but they couldn't work out a deal. the cal state east bay extension campus in concord will continue to offer limited class snus a new ucla survey of college freshman around the country shows more than three-quarters were accepted by their first choice school, but only about half ended up going to their dream school. new students say they had to consider the cost when deciding which school to go to. almost half say the amount of financial aid they received was a key factor in where they went

is condemning a nato airstrike today that killed five afghan sol gers. an afghan official says it also injured 17 people. coalition forces say the bombing was an accident. president karzai has been highly critical of nato airstrikes? the u.s. senate is expected to vote today on legislation to curve sexual assaults in the military. the pentagon strongly opposes the bill that would take away the authority of senior commanders to prosecute rape. rape cases instead would be handled by independent military trial lawyers. the bill has the support of 54 lawmakers, but needs 60 votes to overcome a gop filibuster. time is 8:17. doctors are saying a los angeles baby who has hiv appears to have been cured. the hospital started aggressive drug treatment just four hours after this little girl was born

in april. her mother also is hiv positive. the doctors say after six days of treatment there was no sign of the virus, but she remains on three standard hiv medications so doctors can't say for sure yet if she is cured or if the disease just has gone into remission. the last year a baby in mississippi was also reported to have been cured of hiv. researchers say a company in richmond is part of a medical breakthrough in the fight against the aids virus. today's "new england journal of medicine" reports that gene therapy appears safe and may help control hiv. the scientists are modifying genes in the blood cells of hiv patients to help them resist the aids virus. the richmond company took part in this study which doctors say could eventually lead to people not needing medicines to keep the virus under control. it is 8:18. a 12-year-old boy from new zealand, who is losing his

this is the same story. off and on all morning. traffic on the right-hand side of your screen there, those are folks headed southbound towards san jose. we have seen a lot of bunching up there at the top portion of the screen. so definitely some delays. give yourself extra time. 8:33. let's head over to the desk. we are following a tragedy in san jose. a man has died after being hit by a car on a busy expressway. ktvu's janine de la vega joining us live now from san jose to tell us more about the accident, about the victim, and this particular stretch of road. >> reporter: dave, the accident happened here on al maddon expressway where if you count the turn plains there are nine lanes of traffic. now, there is no crosswalk here, but there is one underneath this overpass that pedestrians can use to cross safely. but that didn't happen here in this case. this is video of the accident that happened at nine last night in the southbound lanes of al maddon expressway south of

capital expressway. when officers arrived they found a man unconscious and lying on the ground. emergency crews rushed to help but were unable to save him. he was pronounced dead at the scene. several people in the area stopped to talk to police, including the driver involved in the accident. we're told that driver is cooperating with investigators. police say alcohol doesn't appear to be a factor in this accident. no one has been arrested. the coroner's office is working on trying to find the victim's relatives, but i am told the man appears to be a transient in his late 30s. now, back out here you are looking at a live picture, the speed limit mere on the expressway is 50 miles an hour. we don't know how fast the car was traveling when it hit the man, if the driver had time to actually stop. but that is something that police are still investigating. reporting live from san jose, janine de la vega, ktvu channel 2 news. an hour from now san francisco will tackle pedestrian safety. five pedestrians have been killed in the city this year.

the latest one was two weeks ago. a 90-year-old woman died after being hit by a truck at california and filmore. this morning ann lee will introduce new safety measures. he will target the most dangerous streets, including the downtown, tenderloin, and south of market areas. there will be extra resources provided, including more police officers and also improvements to the road. it is 8:36. new developments in san jose's four-year-long legal battle with major league baseball to bring the oakland a's to the south bay. we have just learned that last night the city of san jose filed an opening brief with the federal appeals court in their antitrust suit. san jose contends that baseball should no longer receive an antitrust exemption. last year major league baseball decided to support the san francisco giants' claim that they have exclusive territorial rights to san jose. time is 8:36.

san francisco's city attorney has 45 days now to respond to a legal claim filed on behalf of the family of lynn spalding. spalding's body was found in a stairwell at san francisco general hospital last fall more than two weeks after she disappeared from her hospital room. now, the claim is charging medical malpractice and negligence. another claim under the elder abuse and adult dependency statute, that could allow the family to seek damages beyond a $250,000 medical malpractice cap. well, only on two, one of the six current and former san francisco police officers facing federal corruption charges says he is innocent and doesn't think the case against him will hold up in court. some of the officers had a status hearing yesterday. one of them, is the ian terminger. talked to ktvu off camera. he flatly denies the charges against him. these officers are accused of violating the civil rights of

low-income hotel residents by performing illegal searches, even stealing money and drugs. >> we downloaded a year and a half worth of video and we compared that with the police reports that had been filed under penalty of perjury by the police. when you compare the two it was clear that the officers were lying. >> now, officer terminger told ktvu i can't makemy presents other than you have a better chance of getting me pregnant than proving i is anything wrong. it is 8:38. the former executive director of the peninsula symphony association has been arrested for embezzlement. prosecutors say steven j. carlton forged the signatures of board members on checks and took out an unauthorized loan. board members found out when they were alerted by their banks that their endowment dropped from $422,000 to just over $700. the symphony was almost close forced to close.

richmond now. there are a lot of questions about how the teacher, brian, got hired in the first place? good morning. >> reporter: good morning. lots of questions and many shocked, shocked parents and administrators, as well. good morning to you, dave. yeah, more importantly, though, they are concerned that any background checks didn't pick up on any red flags or warning signs. even district officials admit someone dropped the ball in this case. many of those students actually saw the arrest of 33-year-old ronald david guinto by richmond police during school hours yesterday. they say he faces at least a dozen child sex abuse charges. 11 of those charges were lewd acts on minors. richmond school officials say they ran background checks on guinto back in december. even fingerprinting him, vetting, and even questioning him. at the time they say there were no warning signs to prevent him from being hired. what dropped through the cracks was charges from his previous employer. guinto passed the background

checks and was hired back in january. district officials admit there is obvious room for improvement when it comes to background checks. they are now investigating how this could have happened. we spoke with many parents this morning. they are shaken up. some are pulling their kids out of school because of what happened. >> somebody dropped the ball and i think it was mira vista. so, i mean, somebody needs to do their job. period. you put my daughter in danger. you put them in danger. >> i think that someone really dropped the ball on this, you know. heads got to roll for this, man. you are letting a sexual predator into school, taking care of children. it's horrible. it's a horrible thing. >> reporter: now, the school district emphasize sizes the child excharges are not tied to guinto's short time here at mira vista school but while he was a teacher at making waves charter school. district officials will be reexamining the interview process and what happened between communication with

guinto's other school and why there is no mention of any red flags or warning signs. meantime, counselors will be on hand at mira vista to speak with affected students. brian flores, ktvu channel 2 news. >> thank you, brian. it's 8:47. happening today a new development in a very old case. ktvu's pam cook in the newsroom with what is being done to solve a murder spree 38 years ago. >> good morning. the fbi will make an announcement today on this case that dates back to 1976. they were often called the san mateo killings. five women stabbed to death. two were killed in pacifica, one in millbrae, two in daily city. now, one victim, ver annika ann ka see owe, was 18 years old. he was last seen waiting for a bus to go to a birthday party. her body was found next day at a golf course in pacifica. her friend remembers reading about it in the newspaper. >> it was really shocking.

it was horrific. the details were there. she was stabbed 32 times and raped and left in the golf course. >> reporter: now, she was the first in a series of young women stabbed to death in the same about area. now the fbi is expected to announce a new task force in this case. now, there is also talk about possible connection to a murder in reno and new leads in the case. a representative from the reno police department will be there for the announcement today. now, again, the fbi announcement today just about two hours from now at 11:00 at the san matej owe hall of justice. we are going to have an update on our channel 2 news at noon. reporting live in the newsroom, pam cook, ktvu channel 2 news. 8:49. tara, what just happened in walnut creek? >> so walnut creek on 280 southbound at the treat boulevard exit we have about a half a dozen potholes causing problems for drivers between treat and the north main
