molestation charges is accused of sexually abusing six boys on a over night trip and he was weeks away from taking another group of students on another trip. hello. i am frank somerville. >> and i am julie haener. >> parents want to know why he was hired in january when he was already under investigation for sexual abuse. >> 2 investigates tonight the new details. ktvu's eric rasmussen is live where he has been looking into gaps in the process. >> reporter: i just checked with police again. they confirm prosecutors plan to bring felony charges against him involving sexual abuse. she now on leave from -- he is now on leave from teaching. he was preparing to take his class on an over night field trip. >> reporter: parents are still

trying to understand how a teacher could be hired while under investigation for sexually abusing kids. >> somebody dropped the ball. i mean, somebody needs to lose their job. period. >> police say he was still at the charter school when shoo he sexually abused several students. officers arrested him at his new job teaching 7th graders yesterday. >> something that wasn't disclosed in 2 weeks he was going to take kids on a field trip over night. >> reporter: 2 investigates compiled his teaching time line. hired as a substitute teacher in 2008, he took the job in 2011. he was fired last october when the school learned of alleged abuse and took that information

to police. yet he was considered a rehire when he started teaching again in january. that is why the school board president said the background check didn't include a call to his former school. >> we had a resume, a body of work on what he had done. good evaluations. principals liked him. >> reporter: some other school districts say that phone call to a former employer is part of their protocol. >> one of the main questions is would you employ this question again, if the answer is no, that is the end of that conversation. >> reporter: school board president said he will propose changes to the district's background policy, including calls to former employers. police are asking anyone who believes they were abused to come forward. eric rasmussen, ktvu channel 2 news. >> www.ktvu.com has resources

the clerk and customers and fires into the air. the video is evidence of one robbery in a string of hold ups in san jose. ktvu's robert handa joins us live with the arrest police have made so far. >> reporter: san jose police arrested two men in these robberies but here at headquarters it is still an ongoing investigation, searching searching for more suspects, witnesses and victims. they held up 20 markets. a surveillance camera caught one man shooting into the air before taking the cash. they saw pattern to the crimes and staked out several stores. two men showed up, saw police and fled. one man was caught, the other chased down by officers.

new evidence. the gypsy hill murders in 1976. five women all stand to death over the period of four months. today investigators announced a man's dna links several cases to the killing of a university of nevada student. officers will go to neighborhoods involved hoping maybe someone remembers details. >> we ask all members of the public think back to 1976 and if anything comes to mind notify us. >> investigators say they think the same person is responsible due to multiple similarities between the murders. san francisco is considering restrictions on the number of cars can have on the road in the wake of a death. he called for the hearing on the issue. people who use the ride sharing services praise their convenience but he says safety

should be the goal. the hearing was prompting by the accident in which a uber driver struck and killed a six- year-old girl. the family is suing uber over her death. >> uber and the other companies are denying responsibility for the harms their vehicles are causing. they are saying if they are not carrying a passenger we are not responsible. >> officials say they are also worried about the financial impact on the taxi industry. the attorney for the family of the girl killed says the family is devastated by her loss. and the mother is still recovering from her own injuries. the family filed a wrongful death lawsuit in the case. uber said it is not libel because the driver was not providing service however the lawsuit claims the driver was logged on to the uber app at the time. it might not look like much but the equipment on the platform secured to the eastern

the chp identified two boys accused of throwing water bottles at cars on highway 12.

they threw the bottles from a truck during a 2 week period last month. the owner of the truck is not cooperating but the chp says he may have loaned the truck to the boys. the case of a 16-year-old accused of setting an agender teen on fire is headed to trial. prosecutors say richard thomas set sasha fleischman on fire while they were riding a bus last november. it was all caught on surveillance video that might have been played during a preliminary hearing but this morning he waved his right to the hearing. he pleaded not guilty, he is tried as an an adult. police are crediting social media for helping them track down a man for soliciting tex from teen girls. a girl said the man approached

her and asked for sex. two girls saw the picture on facebook and told school administrators. police arrested the 41-year- old. he was booked on a variety of charges including assault with the intent to commit a sex crime. new at 6:00 p.m. there are half a million rape kits across the country that have yet to be tested and the kits provide critical dna evidence for prosecutors trying to put rapists away. one is putting pressure on the white house to eliminate the back log. ktvu's john sasaki is in oakland where he spoke with the district attorney, one of those who is leading the fight for federal funding here. john? >> reporter: the da is trying to get all the kits tested. >> reporter: the district attorney helped convince the president to include $35 million for testing back logged

rape kits in his new budget. >> focuses on the police evidence rooms where so many kits have been placed and never retrieved. >> reporter: there are 400,000 untested kits across the country, including 1900 here. most of which involve cases in which the rapist was convicted without the need for dna. what is important is determining if those samples match people who committed other rapes, including rape murders. >> the value of dna is remarkable and we have to get this evidence into the database so we can compare them against suspects. >> reporter: i spoke with a resident who was raped while in the army. she is appalled so many are untested. >> you have neglected everything the victim has given you as far as evidence. >> reporter: she says victims will only benefit. >> if they had dna matches and

found out there were other victims, that would be justice for those people. >> reporter: advocates say huge numbers of untested rape kits could discourage other victims from reporting crimes. >> very damaging emotionally. >> reporter: with a $1.5 million grant the county has they should be able to get all 1900 kits tested by next year. john sasaki, ktvu channel 2 news. apple lost its request to block the sale of some smart phones in the u.s. the judge in san jose said apple did not provide enough evidence that the the samsung phone features that violates pattens are a big enough draw to warrant a permanent sales ban.
