breaking news out in the east bay where police are searching for a 10-year-old boy who did not come home from school. i'm ken wayne. frank is off tonight. >> and i'm julie haener. we begin with that 10-year-old who never made it home from school this afternoon. sherry is a fourth grader on east 14th street. he is described as 5'3" inches

tall. he speaks mostly french he is haitian. the malatian jetliner took off and was headed to china. signals have been detected near a southwest coastal province. families of passengers were told to go to a near by hotel to wait for word. that's when the plane was already four hours late. the boeing 777 was carrying 237 passengers including two infants and 12 crew members. >> we're working to locate the airplane. there are passengers from 14 different countries on board

most of them are from china. our web team is following this developing story and we'll have the very latest details at ktvu.com. now information about an alleged sexual assault on an elementary school campus. we're now learning a 7-year-old girl was taken to the hospital to be checked. ktvu first brought you this story as breaking news at 5:00. the incident led to a school lock down on the campus. jana katsuyama comets our coverage including new details of the man who allegedly touched the girl unappropriately -- jana katsuyama continues our coverage. >> reporter: it seems they have been interviewing that 7-year- old girl and have a general description of the attacker. tonight police tell us that they are very upset because the school did not tell them about

the incident. there was confusion, concerning. pardons wait outside of the school. >> nobody can go in, nobody can go out. >> reporter: at 4:30 p.m., police had lined the street. officers told ktvu that a boy and girl encountered a stranger. the boys said he committed a sexual assault on at least one of the girls. officers searched the building, the grounds and surrounding neighborhood but did not find the man. about 5:00 the lock down ended a relief to parents picking up children who had been in darkened classrooms, some very scared. >> we were in the class classroom and we were not able to go to go to recess.

>> you know they just, police are inside the school and everything. >> reporter: police say the two girls were taken to children's hospital to be examined and interviewed. when a repeated request to speak to principal the staff refused to answer questions. >> parents are saying you didn't notify them. is in a reason. >> reporter: parents say they're upset the school never alerted them there was a problem. >> like me i'm thinking the worse. you know my two little ones i'm thinking somebody happened to them. it's their responsible to give us parents a -- responsibility to give us parents a call. >> reporter: police say they're looking for a hispanic or white male 6'tall, between 180 and 200 pounds.

he has black hair, mustache and is wearing a black shirt and jeans. robert guinto pled not guilty with 28 counts against him. those charges include kidnapping, lewd acts with a child and forcible sodomy. until a few days ago, he thought english and science. the alleged molestation incidents allegedly happened when he worked as a teacher at richland's making waves school. >> and fortunately this person was apprehended before they did any damage to our students. >> the west contra costa unified principal said he recently stole permission slips and sent them home to parents. the board president said the trip scheduled from april 9 through 11th was organized without the principal's

knowledge. ginto is being held on $17 million bail. the morgan hill ymca child worker accused of molesting children pled guilty to all charges. nicholas lerminae was arrested for assaulting 14 girls under his care. prosecutors say he faces a number of charges including lewd and lascivious acts with a child. the youngest alleged victim is just 3 years old. lhermine is expected back in court in may. a report of a kidnapping turned out to be false but it still delayed service. officers responded to the 16th street station after a woman said a man tried to take her son. police determined it was an argument between the boy's mother and father. the b.a.r.t. service was stopped at 5:30 p.m. while police searched the train's for a kidnapped boy. service resume at 6:00 p.m.

time actually helped solve the case. according to court documents we obtained today, dna found on an intimate part of zimmer's party was tested two years ago. that dna belonged to her brother-in-law, robert zimmer. >> the forensic science technology we have today did not exist 10 years ago let alone 1989. >> reporter: the physical evidence was a motive in the case. money the other. >> the financial gain was realized shortly after katie zimmer's death. >> reporter: under 125 years of freedom it's possible they thought they had gotten away with murder. but tonight they're both behind bars and the das office is determined to keep them there. patti lee, ktvu channel 2 news.

robbery take place behind me at that atm. bold and rare are words used by police to describe a robbery in this busy commercial area. >> i was surprised because the area is very safe and very crowded. >> reporter: but in all likelihood this area wasn't crowded at 6:45 thursday morning. busies in the area weren't open yet when a woman was robbed at a bank atm. the victim had just pulled out cash from the machine when she was approached by the suspect and she took the cash in her hand. and was forced to go to the atm and withdraw money two more times. images show what the suspect looks like. a man 20 to 30 years old. 5'11", in a newer model toyota was used to get away. the man shows the victim a silver handgun that he showed the victim and told her he

st.joseph health says they received confirmation that the information was deleted and has not been used. rob roth spoke exclusively with a boy's grandfather who made a jump to save the boy. >> what happened last night buddy? >> a fire broke out in the apartment where he was sleeping with his grandparents last night. the boy's grandfather who's recovering from a broken ankle in eden medical center told us the heat from the fire was intense. >> the room was just unbearable heart. so it's coming in here. it's on his leg and you heard the fire. the rumble of the fire. and that told me to get out of there. >> reporter: the only way out was the bedroom window. the boy's grandmother jumped first. mccain broke her pelvis and

we made it. he understands. in san jose two people are recovering tonight after being critically burned in a house fire there. firefighters say it started around 3:35 this morning on a patio area of the home then spread. a man and woman who were inside managed to escape through the garage. fire officials say metal security guards made getting out of the home more difficult. a light rain saw the return of the first friday's events. people who went out enjoyed a five week stretch of vendors.

health risk. that meant firefighters from station 48 had to pack up their belongings and head to another fire house. there's questions surrounding about when that mold was discovered. >> reporter: this san francisco fire station is no longer safe for firefighters. >> we're closing fire station 48 and moving it about a mile away. we have a construction report that we have some mold in the building. and so they don't know what the extend -- extent in until they open up the walls. >> reporter: when people from the fire department differ is when this became a problem. >> we just got the report yesterday and the department acted immediately. it's been 24 hours that we got the report. >> reporter: some members have been complaining about mold for years. >> over the years there have been statements and comments

under the influence was arrested again today. william beal. we told you about him in the past. he's had 19 arrests for dui. today he was picked up for driving with a suspended license. officers had been looking for repeat offenders when they found beall behind the wheel. airline cracks have appeared on the wings apparently because of a problem during the manufacturing process by the maker mitsubishi. a ruling by a administrative judge could open the door for drones. the drone was a model airplane and the faa has no regulations

the university of california is taking new steps against sexual violence on campus in a new policy unveiled today. this as it faces a pair of lawsuits from dozens of current and former students who say they were victims. ktvu's ken pritchett is live with how one victim says the policy is part of an investigation but victims say it does not go far enough. >> reporter: victims say that this policy change does answer some of their concerns but is not enough for victims. >> they told me it was nothing they could do. because it did not happen

physically on their campus. >> reporter: butler is one of 21 students who two weeks ago filed a pair of criminal lawsuits saying their sexual assault complaints were ignored by the university. today they announced a new policy that offers more protection for victims and education for students and staff. uc president napolitano said in a statement we have no toll tolerance for these crimes. >> i also found that it was very good that they changed their policy around consent. no longer did you say no but did you say yes. >> reporter: but butler says the policy still does not give victims the right to appeal when the suspect is given a slap in the wrist. she says more than a written policy it's what the university does to enforce that policy that concerns her and her fellow students in the lawsuit. >> i have a stake to make sure

that the university handles this correctly because as a survivor, it always works in the assault itself. >> reporter: butler says this policy change does not do anything to change the momentum of a policy going forward. she says it's too early in the process to know when these two lawsuits can be resolved. in berkeley, ken pritchett, ktvu news. the mother of a 15-year-old girl from the south bay who killed hearse announced she is pushing for a new law. she is hoping to change the way young people -- the names of the three teenage boys punished in connection with the case have never been made public. >> we believe that if the identity of the sexual offenders and their sentence is exposed, it would deter future incidents and put the community

on alert. >> the bill is named audrey's law and would also stiffen penalties for cyber bullying. the legislation is being sponsored by state senator jim beal. continuing coverage now of a major merger between safeway. the city will have to part way with the giant supermarket chain. bill martin takes a look at how the merger could impact the local economy and shoppers. >> within our conversations with safeway it's just far too early to tell. >> reporter: if safeway departs the state of california would lose the corporate income tax of a major fortune 500 company.

we have new developments on that breaking news now out of san leandro. >> we go to patti lee, where we learned that a missing 10-year- old has been found, patti. >> reporter: while we were getting an update on this missing boy from san leandro police. police got word that the missing 10-year-old had been found. he had been missing since 4:15 but it turns out he was at a friend's house playing video games and police tell us the only reason he was located was because the school, mckinley elementary had started calling all of his classmates.

integral part of ukraine. no concessions. >> two tv stations have been shut down but is broadcasting russian programming. the dow gained 30 points, nasdaq fell 15. the latest jobs report was better than many economists expected. the labor departmented the áf reported 185,000 people got new jobs despite of the severe winter weather in much of the country. the national unemployment rate rosed a fraction. that's because some people now back looking for work did not find jobs. here in california, more than 31,000 people lost their jobs. the bay area saw a slight up tick in the number of people without jobs. in solano county the unemployment rate jumped from 7.2% to 8.1%. san francisco, marin and san

a broken pipe from the sprinkler system created a high rise waterfall today in san francisco. that was the view inside here's the view outside. it happened on the 12th floor of an office building on market street. the building is home to a number of different businesses many of them remained open during the water everyone though it was shut off. the flooding created a spectacle that stopped passers by in their tracks. assemblyman richard bloom a democrat from santa monica introduced a measure after watching black fish a documentary about captive killer whales. the ban could stop the imports of whales. it would also mean keeping them
