it's a problem giving mean people the heebie jeebie's this morning. that is a technical term. people living in san francisco's north beach say it's causing rats it invade the neighborhood. april is distracted driver awareness month and we are not off to a good start in the bay area. the crash that happened hours ago and how chp throughout the state will be cracking down. mornings on 2 starting now. we are looking at the live pictures of breaking news in san jose where police have just confirmed they are investigating the city's 11th homicide of the year. several blocks around the intersection of lania avenue are blocked off. you can see the red tape there. janine de la vega just spoke with investigators. how this could be connected to

a recent crash of violence in the south bay. good morning. welcome to mornings on 2. i am tori campbell. >> i am dave clark. i am loving the red, t.c. >> let's check weather and traffic. i gambled, steve, i left the umbrella home. was that smart? >> yeah, today, dave. maybe tonight, tomorrow you might want to grab that just in case. a weak system is giving us a lot of cloud cover. combination of low and high clouds. more 40s than anything else to right at 50. it will be a combination of these two all day long. the high clouds will continue to filter in. a little bit more sun to the south. we will go 66 in san jose today. these are pretty close, these forecasted highs today. seasonal averages. this is a much, much weaker system than anything we saw earlier this week. that's for sure. the clouds, though, preventing the lows from getting colder. still a couple returns showing up. the main part of the front is back here still holding to the. it doesn't look like of because it isn't much. high clouds in place.

the low clouds will peel off or burn off, if you will, by 9 or 10:00. patchy fog. good morning. we are looking at a commute that is slow and we have a new crash which is spotted on the peninsula. westbound bay bridge the traffic looks good. you may see an ac transit bus pulled over to one of the shoulders as it may have hit one of the toll booths. but it's not causing a major delay. also looking at the san mateo bridge, the traffic here is moderate. a little bit of slow traffic getting to the toll plaza area, but it's not that major yet. southbound 101 at wood side road there is a crash reportedly blocking two lanes here at wood side-by-side road. now, the traffic is going to be busy as you head out of the san carlos area here. let's go back to the desk. we begin with breaking news

from san jose. just moments ago police released important new information about the discovery of a body this morning. jeanine de la vega says this is officially a homicide case. good morning. >> good morning. the 11th homicide of the year for san jose. i just spoke with neighbors who told me they are not surprised this happened in this neighborhood here because there has been gang activity. some say they actually heard the gunshots at around 3 or 3:30 this morning. but the man was found shot a couple hours later. the discovery of his body. you can see there is lots of police activity here. they have this road blocked off while they continue to investigate. this all happened at 5:30 this morning. that's when officers were called to lanai and denali, which is just off tully road in east san jose. they had gotten a report that a man was shot in a car. when they arrived they determined that that man was

deceased. now, family members of the victim say they had been waiting for him to come home from work. they showed up here to the scene. they wanted to confirm that it is, in fact, their loved one. they are still waiting to hear from police. but they say that their loved one is a man in his 20s. he is married. he has a baby. they are just in shock and disbelief. at this point police are canvasing the neighborhood. they are collecting evidence. they are trying to see if anybody heard or saw anything. at this point there are no suspects who have been caught. no arrests have been made. in the last week and a half, i do want to mention that there has been a rash of driver-by shootings throughout various areas in san jose. some of them in east san jose. police have been so busy that we haven't had a chance to talk to them to see if there is any sort of connection between that, to see if this there is some sort of drive-by shooting. but we will stay on top of it

and give you any sort of updates as soon as we get them in the next hour of mornings on 2. reporting live from san jose, janine de la vega, ktvu channel 2 news. we have seen it far too many times. drivers getting hurt or hurting somebody else because they are distracted while they drive. april is distracted driving awareness month. ktvu's brian flores joining us live now in hayward with a new example. brian, we found this morning how dangerous it is and also what law enforcement agencies will be doing to try to get us all to stop. >> reporter: yeah. we are all affected about this, if you really think about it, whether you are the driver behind the wheel, you are a passenger in a car, if you are riding a bike or if you are walking. distracted driving certainly dangerous out there. that's why lean agencies throughout the state will be -- law enforcement agencies throughout the state will be cracking down. and this really couldn't come any sooner. as sal mentioned during the 5:00 hour, this was 3:45 this

morning. a driver of an s.u.v. admitted to cpr she was distracted by her cellphone when she got in this roll other crash on eastbound 84. there was a lot of damage. looked pretty bad, worse than it was. but chp says she did not suffer any major injuries. our news crew there this morning says the driver declined comment as she was too embarrassed about what happened. quite frankly, she was lucky to be alive. this was the scene last month in santa rosa. a 30-year-old allegedly was looking for his cellphone and was high on marijuana when he didn't see the car in front of him. that crash killed 53-year-old susan hufford. also, her mother-in-law, 74-year-old sharon hufford as they were on highway 12 to celebrate a birthday in santa rosa. law enforcement agencies hope

that stops today. many law enforcement agencies and 200 others throughout the state will be participating in this crackdown today and throughout the month. here in the bay area, special patrols will be targeting distracted drivers. in south san francisco, santa rosa, pacifica, and petaluma. be aware if you are on the roads today and beginning throughout the month. chp says 3300 people nationwide were killed in 2012 from drivers who were distracted. we are going to talk with the chp about that crash that happened on highway 84 and more on the crackdown expected throughout this month. >> thank you, brian. 7:08. the chp office in sacramento county is investigating a tragic highway crash that killed a man and his 14-year-old daughter. two young men are facing felony charges in their deaths after a high-speed chase and crash, and a twin brother of one suspect is also being questioned. the tragic incident unfolded yesterday on interstate 80.

officers say the man led authorities on a chase that began in auburn and it ended with this horrific crash in antelope outside of sacramento. the father and his teen daughter were pronounced dead at the scene. officers arrested the suspects a short time later. >> i am glad everybody is in custody. certainly sad about the event and how it turned out. >> two sheriff's deputies were hurt in an earlier crash during the long chase of the suspects are expected to face homicide charges once they are released from the hospital. a new report suggests driving on california highways should be a smooth ride. the "mercury news" cites a caltrans report that 42,000 out of the 50,000 miles of state highways or 84% are in good operating condition. that's up from 75% in 2011. local roads receiving upgrades include interstate 80, 880 through san jose and oakland,

and 680 in contra costa county. the report also warns that nearly $4 billion in funding is almost used up. time now 7:09. happening today former san francisco school board president keith jackson is due in court this morning to find out if he could be released on bail. jackson is charged in the corruption case related to state senator leland yee and he is accused of collecting campaign contributions for yee in exchange for political favors. he is also accused of drug dealing, gun trafficking, and a murder-for-hire plot. the prosecutors are calling jackson is a one-man crime wave. they say he should not be released from custody. but jackson's lawyer says he should be released because jackson has no criminal record and no history of violence. now, another man arrested as part of that same fbi investigation, raymond shrimp boy chow, was a-pointed a lawyer yesterday. chow will appear in court next

tuesday for a detention hearing. now, he is accused of several crimes, including money laundering and drug trafficking. and leland yee has hired a new lawyer to represent him against the federal corruption and gun trafficking charges. the suspended state senator was first represented by paul demeester when he was first arrested and freed on bond. his new lawyer is james lasart. a former prosecutor now in private practice. demeester says the change was yee's decision. he is due back in court for an arraignment next tuesday. police officers in san francisco's chinatown are on alert because of the leland yee case. they are worried about potential gang violence. officers fear retaliation or a power grab between rival gangs after the arrest of suspected mobster raymond shrimp boy chow. >> it could be a personal

7:14. new developments in a mass shooting at the fort hood army base in texas. the military is still trying to figure out why an iraq war veteran would apparently turn on fellow soldiers. the investigation is now looking into the gunman's history of mental health. the accused gunman is identified as 34-year-old army specialist ivan lopez. investigation described the mass shooting as deliberate and calculated. reporter polo sandoval joins us from outside the furred, texas base with a look at the suspected shooter and what could have set him off. >> reporter: you know, that is the big question of the day. a lot of people are trying to find out exactly what led to yesterday's shooting. meanwhile, we have to mention it's been a very busy night for investigators. they have been probing into the past of this army specialist. he was a father.

he was a husband. police say he was a soldier who turned against his own. this sprawling army post in fort hood, texas is yet again the scene of a shooting. this time authorities the say an army specialist killed three people before turning his gun on himself. 16 others were wounded. the base commander says specialist ivan lopez opened fire in one building. then continued firing while driving to another. military police caught up to him as he started shooting in that second building. lieutenant general mark millie says he took his own live when a military police officer confronted him. >> that was heroic what she did at that moment in time. and she did her job and she did exactly what we would expect of a united states army military police. >> reporter: ivan lopez had only been stationed at fort hood since february and had previously served four months in iraq. military officials say lopez was being treated for depression and anxiety and was being evaluated

for post-traumatic stress disorder. >> we are digging deep into his background. any criminal history, psychiatric history, his experiences in combat. >> reporter: neighbors tried to console his wife. >> she was worried and crying and she had a little girl with her. i walked over to her and i tried to console her and comfort her and let her know that everything was okay. but it didn't seem to, you know, pretty much, you know, sink in. as far as i knew, he was a nice guy. he always smiled and waved. that's about it. >> reporter: shooting bears a sad resemblance to the 2009 mass shooting at the same post when major nidal hasan opened fire. there is still so many unanswered questions here. investors are starting up right now. their first full day of look nothing this case. we -- look into this case. we have to note this there are several vehicles making their way into the base. a lot of them men and women in

vid. they are showing up to work, 1516 hours after those shots rang out. something has to be said about the resilience we are seeing here on this base. a lot of people not allowing something like this to get in their way. but still this whole investigation does shadow over what's supposed to be business as usual on this major base in central texas. tori. >> and, polo, at this point do officials believe there is any tie to terrorism? >> reporter: you know, that was one of the first questions that we asked, you know, just moments after this happened. they were very quick, officials were very quick to downplay any potential tie to terrorism. however, they did not eliminate it all together. so at this point, tori, all cards are on the table. all possibilities here. this could go either way. they still have a very long way to go. a lot of people to talk to. a lot of crime scene photos to take and a lot of evidence to gather. >> all right. polo sandoval joining us from

fort hood, texas. >> we want to note this just into the newsroom. the army secretary is saying the fort hood shooter saw no combat in iraq wand was not wound wash and was not wounded. time 7:18. meantime, the senate intelligence committee is expected to vote today on the classifying of secret report about interrogations of terrorists suspects. the report allegedly found that techniques like waterboarding and other controversial techniques were cruel and ineffective and didn't help in the hunt for osama bin laden. the cia is disputing many of the allegations and the report may cause a bigger rift between the cia and congress. an entire month without a single death. in all, 2309 american military members have died in afghanistan since the war started in 2001. the pentagon says american casualties have been dropping

as a number of u.s. forces has grown smaller. their role has also shifted away from combat to training and advising the afghan forces. their mission over there is due to wrap up at the end of the year. all right. it is 7:19. we want to check in with sal, who is keeping a close eye on the commute. how are it things in contra costa county, sal? >> it's busy on 24. we are going to start there. but also on 680 and highway 4. and we do have a live picture here to show you that 24 and lafayette as you head up to the tunnel, the traffic is going to be busy. one of our directors here, jeff green and be i, discovered years ago in the '90s that people slow to take a look at the people at the lafayette bart station. people can be seen from the freeway. if you wave, you might distract drivers. it's a strange phenomenon. after watching flask for -- traffic for so long, i thought i'd share that knowledge with you. the bay bridge toll plaza. this is a 30-minute drive into

welcome back. 7:26. some california scientists may have be figured out why zebras have stripes. and this may affect how you dress up while you are on vacation. researchers at uc davis say the zebras evolved with stripes to scare off flies. flies don't like to land on black and white stripes and the more biting flies in the region, the more stripes on the

animals. >> wherever you are really annoyed for long periods of the year by these biting flies, then you evolve stripes. >> got to remember that. that same strategy may actually work for humans. scientists say that in very hot countries wearing striped clothing may help people avoid being bitten by flies. now, although they are cautioning the type of the surface and the material may change the effectiveness of the stripes. 7:27. a new report says san francisco mayor ed lee and his wife were treated to more than $95,000 in travel last year paid for by private donors and foundations. that's according to the mayor's

good morning. i am tori campbell. >> i am dave clark. let's talk about weather and traffic. i just stepped outside. steve, you can still blow smoke out your mouth. it's cold enough. >> it is. i just stepped out myself. i was like, it's a little cool here this morning. a lot of cloud cover today. not much to this system. we will go cloudy to mostly cloudy. a couple of upper 30s. more 40s than anything else. partly sunny. mostly cloudy. a lot of high clouds. we will continue that theme all day long. it will be slightly warmer in the afternoon. these are will high, thin, filtered clouds. 40s and 50s. some of these temps, napa was 40 a couple hours ago. now 42. livermore was 41, again that cloud cover wasn't there, it would be even colder. you think there is a chill in the air, there is. but this system is going to give us the possibility -- i say that because there is not much to it. late tonight, tomorrow morning for drizzle or light rain. a far cry from anything earlier

in a san jose courtroom in an unusual homicide case. they are among five suspects facing murder charges even though prosecutors admit none of them did the actual killing. the charges stem from the deadly stabbing of their friend at a campbell park last month. a homeless man killed, 16-year-old ivan diaz, in an incident prosecutors later ruled was a case of self defense. now prosecutors are holding the gang members criminally responsible for diaz's death. >> it's not real common because it takes a unique type of facts for it to play a role. but ultimately under california law when you are responsible -- ultimately responsible for someone dying, that's where the criminal liability lies. >> prosecutors say diaz was among the gang members who attacked todd tharp who was living in the park. authorities arrested tharp originally but later agreed he was protecting himself.

he was then released and moved out of the south bay are for his own protection. police in san leandro are searching for two men for a frightening home invasion. it happened yesterday afternoon in broad daylight on donovan drive. the victim says two men forced their way into his home, blindfolded him, pepper sprayed him, and then ransacked his home. police say the victim was not seriously hurt and there are no details yet on whether anything was stolen. 7:35. new this morning a rat invasion. in one of san francisco's most popular tourist areas people in north beach say rats have been seen running across washington square pack. other people think that the construction of the subway system is pushing rats into their neighborhood. city leaders say they are getting complaints. they say they are working on a solution to this. ktvu's tara moriarty is live in north beach. tara, you talked to a business owner about this problem, plus you have some new pictures to show us about how big the

problem is? good morning. >> reporter: good morning. yeah, we talked to a merchant. he did not want to go on camera. but he says that at one point there were six rats outside of his business and he was chasing them with a pole. he says that he has contacted the department of public health several times. he says that actually he has had to set his own traps because nothing has really changed over the past couple of months. now, we want you to take a look at that amazing video that my photographer shot because i was too afraid to do it. these are seem rats who are mating out here on the square, washington square, before 4:30. breeding, adding to the growing rat problem. they were in south market last year and it seems now they have migrated to north beach. we found actual rat burroughs in washington square. we know that tourists have been scared by the rats. children playing in the park. the business owner that we spoke to took pictures with his cellphone showing just how big these rats are.

they're actually bigger than the traps and tricky to catch. >> i have seen rats, i mean, i have seen rats about this big with tails, i'd say, about this long. they will come darting out every now and then. not too often, but every now and then i have had had one race over my foot. >> reporter: now, the department of public health says that it has sent a city pest control contractor to treat and bait the area. again, the problems spring up last year. now the rats have pushed on to north beach. some of the city's most popular restaurants and tourist spots. one woman said the rats don't run away when they see you. they chase you. if you do spot any vermon when you are out here, call public health. we have heard they may be placing poison near the sewers to catch the rodents but we haven't been able to confirm that with city officials. tara moriarty, ktvu channel 2 news. it is 7:37.

police in ken wood say a man has died after a stand-off that lasted 19 hours. the press democratic reports it started late tuesday night at a trailer off highway 12 in sonoma county. police say the man died after several rounds of tier bass were -- tear gas were released and officers fired on him. it's unclear if he was shot by police or if he took his own life. police say the man was wanted on felony assault and child endangerment allegations and fired at police with an assault rifle during the stand-off. time now 7:38. a runner from modesto who survived two days lost in the freezing mountains is talking about it for the first time. >> tired. but i feel good. i'm very happy to be here. >> that's 55-year-old bob root. he went out for a jog with his running group on the western states trail early sunday morning but he got lost after running ahead of the group wearing only a light jacket,

some shorts, and running shoes. root says he is alive because he kept his cool in that freezing cold. >> i didn't really let myself get too freaked out about anything, too scared about it, because if i did that i knew i would have to fight that battle in order to get out. i would sitting there and i would fall asleep. i had these microsleeps. i couldn't help it. i mean, i would tip over and wake up. >> root finally met up with rescue teams early tuesday morning. he had a couple of cuts and bruises, but says otherwise he is in pretty good shape. time now 7:39. south san francisco police are warning everybody about several new internet and phone scams. investigators say these scammers, they are offering new cars, lottery tickets, or even home loans in exchange for cash. in other cases, the scammers are posing as irs workers. they say the victim is owing back taxes. in all these cases the victims are told to second money through wire transfers or on the green

dot gift cards. investigators want everyone who gets a similar call or email to pull together as much information as possible and call the police. 7:39. a fisherman's wharf worker faces life in prison without parole after being convicted of shooting and killing two people who worked at a rival store. a jury found 56-year-old hong woo guilty. he was arrested shortly after the shooting in january of 2011. prosecutors say he killed the man and woman over a business rivalry. dixon police are searching for a couple with a 9-month-old baby after they failed to show up for a court hearing where they were set to hand over custody of their son. take a look. police are still looking for france juan and malik a. we have contacted police and there is no word on why the couple was due to hand over

large earthquakes are continuation to shake chick-fil-a. a -- it set off a tsunami warning. it came after a magnitude 8.2 earthquake killed at least six people. there have been dozens of aftershocks greater than a magnitude 5 since tuesday night's main quake. and look at this earthquake damage. it literally caused a road to split open. a state of emergency has been declared on the county's northern coast. about 2,500 homes and businesses were damaged. the quake and tsunami warning in chile have many people wondering about the bay area and whether or not we are looking at a big one. >> reporter: geeleologists say it's a matter of time before a

is backed up now, as you can see, getting up to the 80 split and getting out to the lower deck of the bay bridge. see if there is anything on the lower deck that was some sort of a traffic hazard near treasure island, but that was cleared. dumbarton bridge westbound traffic looks good. east paolo alt he you are going to see some -- alto you are going to see some slow traffic. 8:02. we begin with developing news from san jose. just one hour ago police confirmed they are now investigating the city's 11th homicide of the year. ktvu channel 2 reporter janine de la vega was the first reporter on the scene of this fatal shooting this morning. moments ago she got some new information from police. good morning, janine. >> reporter: good morning, tori. police lieutenant told us that they actually had gotten two calls from this neighborhood at 3:30 this morning and had responded out here and didn't find anything and left.

and then they finally got another call at 5:30, and that's when they made the discovery. detectives are now out here in this neighborhood near 101 and tully. trying to figure out who is responsible for this shooting. their focus has been on a car that's located around the corner. police say at 5:30 this morning they responded to a 911 call that a man was shot in a car at lanai and denali. when officers arrived they found the man in a red car suffering from at least one gunshot wound. he was declared dead at the scene. relatives of the victim have shown up at the scene. they are in disbelief. they are trying to get more information from police. they say family members were waiting for him to come home from work, but he never showed up. here's what police told us moments ago. >> it appeared from the crime scene and what we gather so far that he was probably shot while he was driving and then veered off down the street at a slow rate of speed and then hit the car in front of him.

and that's where the reporting party found him. >> reporter: police are canvasing the neighborhood trying to talk to anyone to find out if anyone saw or heard anything. crime scene technicians are also here. they are gathering evidence to see if that will provide any clues. we have seen them take security camera video from people's houses to see if, again, that will help them in this investigation. they haven't identified any suspects yet or made any arrests. there have been a number of drive by shootings that have occurred in san jose in the past week and a half. i did ask the police lieutenant to see if there is any connection between them. at this point it is just too early. same thing as far as any ties to gang-related crimes. they didn't know. but they did not believe that the victim had any gang ties. he was not known to police. they do know who he is. they say he appears to be a man

in his mid to late 20s. family members have expressed to me that this man is married and that he has a young child. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. 8:04. the chp office in sacramento county is investigating a tragic highway crash that killed a man and his 14-year-old daughter. two young men are facing felony charges in their deaths after a high-speed chase and crash. a twin brother of one of the suspects is also being questioned. the tragic incident unfolded yesterday on interstate 80. the men led authorities on a chase that began in auburn following a home burglary. it ended with this horrific crash in antelope outside of sacramento. the father and his teen daughter were pronounced dead at the scene. officers arrested the suspects a short time later. >> i am glad everybody is in custody. certainly sad about the event and how they turned out.

>> two sheriff's deputies were hurt in an earlier crash during the long chase. the suspects are expected to face homicide charges once they are released from the hospital. april is distracted driving awareness month and right now law enforcement agencies across the state are stepping up their efforts to crack down on this. ktvu's brian flores is live in hayward this morning with new information about a crash just this morning connected to just that problem. brian, we now know the driver was looking at her phone? >> reporter: yeah. we know that this morning as well, tori. good morning to you. as we talk about distracted driving awareness month, this is in conjunction with many bay area law enforcement agencies. you see a chp patrolman leaving as we speak as well as the u.s. department of transportation. as you mentioned, tori, they will be on full force. cracking down on distracted driving drivers. especially those who feel the need to use their cellphones like we saw this morning, for those that go behind the wheel, as april is distracted driving

awareness month. and this is what we saw this morning. in fact, sal mentioned during the 5:00 hour during the ktvu channel 2 morning news, this was a rollover crash involving a distracted driver. she admitted she was using her cellphone when she crashed her car this morning. it appears there was lots of damage. looked pretty bad. but chp says she did not suffer any major injuries. our ktvu crew that was there on the scene says that she declined to comment as she was just too embarrassed about what happened. but chp says she is quite frankly lucky to be alive. >> the driver was looking at her phone for gps reasons while she was doing that she lost control of her vehicle. subsequently resulting in the vehicle losing -- the driver lost control of the car and the vehicle ended up on its roof. >> reporter: and while this driver is alive, not everybody gets a second chance.

this was the scene last month in santa rosa, you'll recall. highway patrol says 32-year-old nicholas tarzogni was allegedly looking for his cellphone in his truck and was high on marijuana when he didn't see the car in front of him. that killed susan hufford and her mother-in-law, 74-year-old sharon hufford, along with injuring two others in their toyota camry. they were on highway 12 when this happened. they were on their way also to a birthday dinner. when it happened ktvu spoke with susan's husband jay and he urged drivers to stop using cellphones when driving. seems like those and these, drivers distracted, that law enforcement agencies hope to stop today. many law enforcement agencies and 200 others throughout the state will be participating. special patrols will target areas like south san francisco, santa rosa, pacifica and petaluma. maximum enforcement is throughout the state. so be aware if you are on the roads beginning today and

basically throughout the month. now, the national highway transportation safety administration says crackdowns like this basically cut down on distracted driving incidents, in half. by the way, a fine if you are caught, ranges from $150 to upwards up to $300. brian flores, ktvu channel 2 news. time now is 8:08. happening today former san francisco school board president keith jackson is due in court this morning to find out if he can be released on bail. jackson is charged in the corruption case related to state senator leland yee. he is accused of collecting campaign contributions for yee in exchange for political favors. he is also accused of drug dealing, gun trafficking, and of murder-for-hire plot. prosecutors called jackson is a one-man crime wave. they say he should not be released from custody. however, jackson's lawyer says he should be released because jackson has no criminal record and no history of violence. leland yee has hired a new lawyer to represent him against

himself. 16 others were wounded. the base commander says specialist ivan lopez opened fire in one building. then continued firing while driving to another. military police caught up to him as he started shooting in that second building. lawsuit mark millie says lopez took his own life when a military police officer confronted him. >> it was heroic what she did at that moment in time. and she did her job and she did exactly what we would expect of a united states army military police. >> reporter: ivan lopez had only been stationed at fort hood since february and had previously served four months in iraq. military officials say lopez was being treated for depression and anxiety and was being evaluated for post-traumatic stress disorder. >> obviously, we are digging deep into his background. any criminal history, psychiatric history, his experiences in combat. >> reporter: neighbors tried to console lopez's wife. >> she was worried and she was crying and she had a little girl with her. so, you know, i walked over to her and, you know, i tried to

the folks are dealing with a problem with rats popping up in the neighborhood. people say they are seeing dozens of them out there. our ktvu crew just this morning saw them. coming up in a couple of minutes you are going to see problems. some unbelievable video we shot this morning and a possible explanation of what is going on with that. it is thursday morning, april 3rd. i am dave clark. let's check weather and traffic now. i do know steve is right there. >> yes, sir, thank you. a lot of cloud cover. cold this morning. it will be a day of 50s, 60s, a few sun breaks in there. filtered sun. one more system is going to try to give us light rain or drizzle late tonight, tomorrow morning. your weekend looks sunny and warmer. a lot of cloud cover today. a teeny bit warmer compared to the temps the last few days. the system is falling apart. it's spinning in a lot of cloud cover. it will be a day where you get partly cloudy, but more likely than most mostly cloudy. after this system goes by then it's smooth sailing, as we like

unusual homicide case. now, they are among five suspects facing murder charges even though prosecutors admit none of them did the actual killing. the charges stem from the deadly stabbing of their friend at a campbell park last month. a homeless man killed, 16-year-old ivan diaz, in an incident that prosecutors later ruled was a case of self-defense. now the prosecutors are holding the alleged gang members criminally responsible for the death diaz. >> it's not common because it takes a unique type of facts to play a role. ultimately, under california law, when you are ultimately responsible for someone dying, that's where the criminal liability lies. >> prosecutors say diaz was among the gang members who attacked homeless man todd tharp. he was living in the park. authorities arrested tharp for the death of diaz before they later agreed he was just protecting himself. tharp was then released.

he moved out of the south bay for his own protection. time is 8:32. police in san leandro still searching for two men responsible for a frightening home invasion. it happened yesterday afternoon in broad daylight on donovan drive. the victim says two men forced their way into his house, blindfolded him, then pepper sprayed him. police say the two men then ransacked the house. the police are saying the victim was not seriously hurt. there are no details yet on whether anything was stolen. an east bay organization that helps children and teenagers with disabilities, they have been targeted by thieves and now they're trying to recover. a van that belongs to alacosta centers was stolen, even though it was kept locked behind three gates at the facility on malcolm street. the thieves also crashed through a fence and they cut off power to the center. the program director says those thieves are hurting very vulnerable people. >> these people are so

disadvantaged already. they are low-income people with disabilities. that's as challenging as it can get. they are really taking a lot from us. >> the police are now searching for a white van that has a license plate number 2475sdp. if you see it call oakland police. now, the center, alacosta, said they haven't insurance. they just don't have enough to cover the cost of buying a new van. it is 8:33. tonight san jose state university will hold its latest public meeting on the campus hate crime scandal. the meeting's focus is on a shocking health crime in the university's response to this racially charged bullying case. investigators say a group of white students tormented an african-american roommate for weeks at a campus dorm. that student has now filed a $5 million claim against the university. tonight's meeting begins at 5:30 at san jose state's engineering building. meantime, san jose state administrators say an employee

shake-up in the campus dorms is not tied to the hate crime scandal. 18 resident advisors have either been fired or have resigned. the university is not revealing why they were let go, saying it's a personnel matter. but the university issued this statement, quoting here, "these changes are not linked to the hate crime allegations." time is 8:34. we are finding out more from san jose about the disappointing police department recruiting numbers. the police say they only have 29 qualified recruits for 60 open slots at an upcoming police academy. that's in addition to two cadets from an earlier academy class. many police officers say the pay cuts and the lower benefits, that's the reason for the low recruit. numbers. >> we are kind of at a competitive disadvantage with the agencies that are around us. we don't have that compensation package that some of the others do. either in pay or other benefits. >> the police union and the city of san jose, they disagree

8:39. new this morning a rat invasion in one of the most popular tourist areas of san francisco. people in north beach say they have seen the rodents running across washington square park. some folks believe that the construction of the central

subway system is pushing the rats into their neighborhood. and the city has already received a number of complaints. officials say they are working hard to come up with a solution. ktvu's tara moriarty is live in north beach where she just talked to a business owner about this pesky problem, plus new pictures revealing just how big this problem really is for that area. good morning, tara. >> reporter: good morning. rats aren't stupid. they know where to find the good food, and it's here in north beach. i nearly jumped out of my skin when i saw two here in washington square. we have not heard from the department of public health, but one merchant said he has called them numerous times and nothing has changed over the past few weeks. let's take a look at those two rats. the infamous rats that we caught before 4:30 this morning mating in the square. department of public health officials say that the reason for the recent rodent problem is the central is subway system that stretched into north

beach. late last year rats were spotted south of market, but now they have migrated north. at the bakery they are not experiencing a rat problem, but the owners' granddaughter says she has been accosted by rats trying to get out of her car on washington square early in the morning. >> normally, rats are afraid of you. these seem to be unfazed? >> yes, humans do not seem to bother them, which is very surprising. you think they would run the opposite way. they actually chase back at you. >> reporter: we got a hold of an smta official who says rats typically surface at the beginning of a instruction project, not at the -- construction project, not the end. >> it was a week ago, more than a week ago it wrapped up. still there wasn't the same kind of large construction that there was a year ago. >> reporter: now, the sfmta says it is happy to work with the department of public health to alleviate the problem.

we spotted some ratbauer owes on washington square and one merchant told us he chased six rats away from his store with a pole. he even set up his own traps, but the rats were too big for them. merchants say they are putting pressure on the department of public health to be more aggressive about this situation. one suggestion that they have for tourists, people who live around here, is to not feed the pigeons or leave scraps of food that might attract those rodents. tara moriarty, ktvu channel 2 news. >> all right, tara. 8:42. let's bring you up to date on some of the other top stories we are following right now. military experts in fort hood, texas are examining the members criminally health of army specialist of ivan lopez. he is accused of shooting and killing three people yesterday and wounding 16 others before he killed himself. officials say lopez was taken ambien to help him go to sleep. he didn't see combat during four months he spent in iraq in 2011, according to reports.

investigators say he was dealing with depression, anxiety, and possibly ptsd. the month of april is distracted driving awareness month and law enforcement agencies will be out all over the place cracking down on distracted drivers. especially people using cellphones as they drive. more than 3300 people nationwide were killed in crashes involving a distracted driver in 2012. and at this hour police in san jose, they're investigating a homicide this morning on the east side. that victim found in his car now police are trying to put all the pieces together on this story. ktvu's janine de la vega joining us from san jose. >> reporter: police are taking their time. they are being very meticulous in their investigation. you can see crime scene technicians have been behind me. they have been walking this neighborhood. this near 101 in tully.

it's blocked off to traffic. their focus is on a car that looks like it has crashed. it's located around the corner. now, police say they received some calls at 3:30 this morning that shots were fired in the area, but they came out here and they didn't find anything and left. then another person called at 5:30 this morning, two hours later, and he called saying that he had discovered a man who was shot in a car at lanai and denali. and when officers arrived that time they found the man suffering from at least one gunshot wound. he was declared dead the scene. detectives say it appears the man was shot while he was driving and then crashed. >> we don't have any witnesses that were actually saw the actual shooting. however, we're doing a canvas right now. we are gathering information and some leads that our homicide unit can work on. >> reporter: police are going door to door and talking to people to find out if anyone saw or heard anything. at this point they have not identified any suspects or made

any arrests. are relatives of the victim are here at the scene. they are very emotional. they tell us that family members had been waiting for him to come home from work and he had never showed up. they say he is in his 20s. he is married and he has a baby. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. 8:44. the recent quake and tsunami warning in chile have many people wondering about the bay area and whether or not we are prepared. ktvu's pam cook joins us in the studio with a high-tech answer to that question. >> reporter: a new app is about to be released in san francisco, which many people say comes just in time. geeologist us say it is a matter of time before a major tsunami hits the bay area. when the sirens go off it is time to take immediate action. but what action? well, san francisco will unveil a new mobile app in two weeks. it will have maps and icons

informing people on where to go and what to do following a natural disaster. the county emergency manager spoke to us about the importance of being informed and having a plan. >> the tsunami is not just one wave. it's multiple waves for roughly 24 hours or maybe even longer. so the idea that you are going to be evacuating your home and business for 24 hours or more as that tsunami comes in, into the bay and into the san francisco area. >> reporter: now, the app is designed to help prevent the chaos that often comes during an emergency and evacuation. the new san francisco mobile website is the first of its kind in the country. it is made by and created by google. and the website is up and running. it's called sf72 dot-org. 72 because, as a general rule, rescue services are maxed out following an emergency. people have to wait 72 hours before helping arrives. that's the time when you need to be connected and informed and

welcome back. time now just about 8:52. new this morning the death toll from that deadly landslide in washington state is up to 30, with 27 of the victims positively identified. however, medical examiners are struggling. they are trying to match one set of remains to anyone on the list of people still missing after the landslide. the crews recovered the remains of a man who had gold teeth. they can't figure out his age and they won't be able to use dna analysis for identification. also, we have new information about the search for that missing malaysia airlines jet. the focus is now turned to the food and the cargo on that plane. investigators say the questioning the company that provided the food on the plane

to see if the food may have been poisoned. they are also looking at the cargo that was loaded on the jet. despite these new developments, investigators say they may never know why the plane vanished more than three weeks ago over the indian ocean. 8:52. a lawsuit claiming a grandmother froze to death in a southern california hospital morgue freezer is headed to trial. an appeals court has ruled that a lawsuit filed by family members of maria dejesus orio can move forward. it claims that the 80-year-old was mistakenly declared dead after a heart attack and put in a morgue freezer at white memorial medical center in los angeles. family members say her bruises show she tried to escape from the freezer. ktvu news has learned that police officers in san francisco's chinatown are on alert because of the leland yee case. we're told the police department is worried about potential gang
