at 6:00. police are not calling him a suspect. they're not even ready to say a crime was committed, but colin kaepernick is now at the center of a police investigation. good evening. >> a woman told miami police she partied with colin kaepernick and two other players before blacking out and waking up in a hospital. now police are trying to figure out if anything criminal happened. ktvu has been looking into this incident all day and he joins us now. >> reporter: the woman told police she had a sexual relationship with colin kaepernick in the past. kaepernick has not been charged with anything in this case, but investigators say they're talking to him about an encounter in miami that included alcohol and marijuana. by day, kaepernick has been posting pictures on social media from an off-season

training camp. he even took time to pose for this photo this past weekend. according to a police report, that's where a woman says she was in a room with kaepernick along with another foot ball player, ricardo lockett of the seahawks. the woman says they drank shots and smoked marijuana. the woman told police kaepernick undressed her in a bedroom, but they did not have sex. she only went to police after blacking out and waking up in a hospital bed. >> there's not much we can say. it's just an information report, so the detectives have just begin with the investigation. >> reporter: kaepernick's brother said i feel bad for my brother. when other websites fulls -- kyle kaepernick added because all people care about is money. >> no response to all of this from colin kaepernick so far.

jim hear baugh -- the 49ers organization is aware of the recent media report regarding colin kaepernick and is in the process of gathering the pertinent facts. the uncertainty of what really happened didn't stop the kaepernick story from spreading fast and undoubtedly potentially hurting his public image. how the lack of facts feed a story when people can fill in the blanks for themselves. >> reporter: many people we talk to acknowledge a positive image is made mostly out on the playing field. but when there is an incident off the playing field, the true impact is hard to judge. many people told us what got their attention was a rumor of a sexual assault, which turned out not to be the case.

>> you kind of get this bad vibe about whoever the person is involved in that story, however there's not any actual details, so i feel like poor kaepernick basically. >> reporter: chuck biers agrees. the professor of public relations and marketing says sexual inu endos are damages even without facts or allegations. >> the unfortunate part is they tend to be more negative than neutral. >> reporter: people fill in the gaps? >> they fill in the gaps with a story that they want it to be. >> reporter: biers points out kaepernick's incident follows serious charges involving other players, but the professor says it doesn't always impact a team's image. >> unfortunately what we're seeing is such a wide-spread record of less than favorable behavior that the public is seeing not as a team issue, but

vacaville. the -- 4 men connected to a failed bank in the north bay. this comes after the agents raided the mansion yesterday belonging to one of the man. a federal grand jury indicted him along with an attorney. they are accused of defrauding taxpayers by embezelling 9 and a half million dollars of bank rescue funds. can fan san francisco county is saying it is changing how it handles child abuse cases. they found a total of 24 out of 120 reports of child abuse were inaccurate or incomplete. the state is giving the counts 6 months to a year to work on improvements. >> in san francisco, they did have an increase in their resources and they also had a

decrease in their case load. we think they can implement these other procedures, the supervisory reviews, quality assurance with what they have. >> social workers need to do a better job with background checks. san francisco county agreed with the findings and says it has begun to put structures in place to improve the provision of services to the families and children we serve. >> you'll recall there were aa lot of questions raised about the handling of kaley'sa case in napa. she is the three year old girl found dead in her home back in february. police were called to her home 9 times on domestic disturbance calls. kaley's mother and boyfriend are facing murder charges. a three year old boy is in

critical condition tonight after he was struck by a car while riding his bike. police blocked off the intersection while they investigated the incident. past changes to make that street safer were not enough today. >> reporter: in this case, both the driver and the bedest trians had a green light. now investigators want to know if the driver may have been distracted. neighbors say it was a matter of time until something like this happened here. they say felton street and 40 third has long been a dangerous area. now their worst fear has come to pass. a three year old on a bicycle hit and critically injured. police say this pick up truck had a green light and turned right into the little boy. >> we know the child was a few

feet in front of the rest of the group. we also know all parties had a green light at this intersection. >> reporter: authorities say the driver is cooperating, but they say these types of accidents are aa growing problem? san francisco. they say educating people about safety has become a priority. >> even if you have the right- of-way, we want people to take an extra 2nd to look both ways before entering into the intersection. >> reporter: changes to the signs and traffic signal at this intersection helped a bit, but what happened today proves more needs to be done. >> we've always said it's going to take somebody getting seriously hurt for something to happen and that to me is too late already. >> reporter: so far no charges have been filed in this case. the three year old remains in critical condition in san francisco hospital.

hire plot. somebody has vandalized a statue of tommy smith at san jose state university overnight. someone damaged the gold medal on the statue ripping it off. san jose state police have no idea who did it or how much it will cost to fix it. the statue shows smith and john carlos in the absolute -- solieutenant on the stand. the desperate search for a teenage boy lost in the water in ocean beach is called off. why is one bay area city building hundreds of homes? a community some say is outgrowing itself. >> it's going to get cooler as we head toward the weekend. i'll show you just how much cooler it will get.

the coast guard today suspended its search for a 14 year old boy who was swept out to sea yesterday afternoon. crews had been searching from the air, on the water, and on land, all in a desperate search for 14 year old marco cornejo, but so far there have been no signs of him. yesterday a surfer pulled the missing teen's father and cousin from the water. the cousin wasn't severely injured, but the father remains in critical condition. a reputed oakland gang member learned his sentence today. he was sentenced to life in prison without the possibility of parole. he was convicted on two counts of 1st degree murder for a shooting at sweet jimmy's bar.

26 year old billy jenkins and 22 year old were innocent. >> it was me that -- [ indiscernible ] i was drunk. >> the prosecutor says he doesn't buy fox's story. he says both fox and another man opened fire targeting rival gang members but missed. tompkins was sentenced last month to life in prison. the community college in fremont wants to lease some of its land to housing developers. john fowler found out the students could suffer in the deal. >> reporter: booming fremont may soon get another and controversial housing development. >> single family dwellings

somewhere in the neighborhood of probably 300 units. >> reporter: they would lease college land here. two competing deals could bring the college $600,000 a year. >> it -- i think it's a horrible, horrible idea. >> reporter: uma moved to fremont so her children could go to public school that are not at capacity. there are 2,000 more students now than 6 years ago and no new schools. mission san jose elementary today has 618 students and no more space. >> we have 1800 students in the district where there isn't a seat in their neighborhood school for them. >> reporter: schools have added portable classrooms. >> there is no funding

available to pay for those classrooms. >> reporter: measure e is a school bond on the ballot, but even if it passes, some students may still not fit in public schools. >> they may need to find schools elsewhere in the area. >> reporter: the board is expected to decide on a development plan on the property at its next meeting. more details now on the crush of families living in fremont. the 2010 census found that 40 percent of households in fremont have children. 7 percent of residents are under the aga of 5 and 17 percent and a half of those living in the city are between the age of 5 and 18. the message walk around the block demonstrators brought to city hall today. 500 preschool kids, parents and child care providers tried to
