little bit later. right now it's mainly clear. we have a little bit of fog on the san mateo coast. 40s and 50s on the temps. haven't bumped of all morning long. this is a good system up north. you can see the rain there. the tail end of that might give us some drizzle and a no doubt about it cooling trend. today mostly sunny. patches of fog but not a lot yet. higher clouds in the south. overall 60s, 70s, 80s. good morning. we are looking at a commute that is going to be pretty busy in many areas this morning. i want to show you the bay bridge toll plaza. we had earlier problems on the bridge. we had a minor crash. we had a stall. we have had just a couple of things at the toll plaza that has slowed traffic. this is a 30 to 35-minute drive time and a lot of that time is waiting at the toll plaza. once you get onto the bridge it's not all that bad but it is slow wait to go get on that span. san francisco northbound 101 is

good. today a giants game 12:45 first pitch between the dodgers. that means it will be over right in time for the afternoon commute. if you are expecting someone from san francisco or you are driving there today be aware that's happening this afternoon. and on the southbound freeway, a lot of that slow traffic comes in san lorenzo and san leandro on the way to hayward. back to the desk. we are continuing to learn more this morning about a deadly sailboat crash last night year redwood city. tara moriarty is at the redwood city marina. since the sun rose you have seen indications about the severery of had this horrible accident in. >> reporter: now, unfortunately, that the sun is coming up. we have reached out to the redwood city police department. we have not heard back yet. an officer is on scene guarding

the evidence. the crime scene tape is up and we can see blood on the deck from here. you can imagine how horrific this accident was. last night we watched the coroner remove the body of the person who was killednd a another -- and another person was badly injured. before 7:00 the sailboat struck a marker buoy in the channel and got tangled up. the mast snapped off. a difficult time coming to bella's rescue because she was in shallow water. a geological survey boat was able to reach the sailboat. they were able to get the injured people on board and transport them to firefighters. the fire department says that the survivor suffered a head injury. we have not been able to receive an update on that victim's condition. the three others on the boat were not hurt. we know that the bella was racing with the sequoia yacht club. the beer can races kicked off last night for the first time of the season. we are told that the races are a very relaxed and casual event

with new and experienced racers with drinks served at the club. investigators spent overnight pouring over the bella. they may be releasing the name of the victim in an hour or so. we will definitely tell you what we learn. tara moriarty, ktvu channel 2 news. 7:05. we are continuing to follow the investigation into the death of a 9-month-old boy. police say the baby's father found him in a car around 7:20 last night. police sources tell ktvu it appears the father may have forgotten to drop the boy off with a babysitter before going to work. time now 7:07. investigators in san francisco still out there looking for the cause of a tragic fire in the visitation valley neighborhood. a mother and her 3-year-old son were killed in yesterday's fire at the sunny dale housing project. other people just jumped out of second story windows to escape the flames. we talked to the heartbroken

father of the little boy who died. >> he was a great kid. fun loving. smart. loved football, sports. a real boy's boy. i could sit here and go on and on about him. i am going to miss him a whole lot. i am just going to miss him just coming into the room and saying good morning, dad. >> the building that burned is part of san francisco's biggest housing department. there is a stunning new development in the investigation into a weekend fire that destroyed the former studios of a san jose tv station. investigators say you that specially trained dogs have detected possible human remains there in the rubble. this morning those dogs will join a special team of investigators to resume the search of this now gutted building on park avenue. they want to find out if this could be tied to the three people reported missing after sunday's fire. >> at this time what we have

going on is an excavation for a possible human remains that we may have found. we are hearing that there possibly could be other pets that were inside the structure. so that could be a hit. they are very much trained in looking for human remains. >> yesterday police arrested a homeless man suspected of starting to fire. he is no you in jail facing charges of arson and burglary. a witness watched him spray some kind of liquid on a mattress. if firefighters find human remains in the rubble he may face murder charges. happening now a sign the 49ers' new in santa clara is almost finish and you can't possibly miss it when you are watching the game. ktvu's janine de la vega is live at the game. >> reporter: yeah, about three minutes ago my photographer spotted it. we turned around and there was

a big rig hauling rolls and rolls of sod into levi stadium here. now, a lot of the iron workers have been coming in. they have been working on this project. we spoke to some who happen to be 49ers fans and they say they are looking forward to peeking inside to see the green laid down. now lets go to some pictures of the new grass field while it was being grown by west coast turf in merced county. it's bermuda grass. it uses half the water as the average turf. it will take two and a half acres of sod to cover the field. the 49ers chose the grass because it holds up better, stays green longer and they think it will cut the risk of players' injuries. the sod will be installed today and friday. construction workers, who are also fans, say it's exciting to see everything come together. >> it's really cool. we make pride in our work. every trade, of course, does. like a new big beam, a new bridge, new sod. it's exciting to be a part of

that in area. growing up 49er fan and working hard for the team, it's pretty awesome. >> reporter: here are some pictures provided by the 49ers. they were posted on the website of what it looks like inside the stadium. you can see the seats have been installed. the goalposts are up and there is signage throughout. so once the grass is put down it will really bring life to the field. the company being used also provides turf to other sports teams including the raiders, the a's, and the giants. now, while the 49ers' home opener hasn't been scheduled yet the first team to officially play on it will be the san jose earthquakes. they have a soccer match coming up in august. reporting live from santa clara, janine de la vega, chemical channel 2 news. a judge will consider more evidence before making a final ruling about the shutdown of the drake's bay oyster company. the judge ordered new environmental review. he says the state coastal

commission abused its discretion when it took steps to shut down the oyster farm at point rays national sea shore. the federal government allowed the farm's lease to expire in 2012. since then the oyster company has lost several court apeoples as to battles to stay open. san francisco's famous bacon bacon cafe is set to reopen with a few creative changes to control the cafe's smell. the restaurant shut down last year after people complained about the smell of bacon drifting through the neighborhood. the closure made national headlines. it was even featured on an episode of "saturday night live." in order to reopen the restaurant owner did make a number of changes. the most important being a new ex-aust system that cleans and deowed rises the air. the grand reopening is set for this seattle two days away.

pistorius murder trial are being cross examined today. former police officer roger dixon has questioned the positioning of the body of pistorius' girlfriend and the sequence of gunshots. prosecutors have accused dixon of making findings out the autopsy. after today's testimony the pistorius trial will adjourn until may 5 to avoid scheduling conflicts with other cases. hundreds of people in the southern california town of solvang are being ahoward to return after a bomb scare. deputies evacuated 500 homes yesterday afternoon after finding a potentially explosive military device. deputies removed the dough vice just after midnight and are now looking how it inned up in the downtown area.

solvan draws tourists from all over the world. 7 fiesta bowl. one year after the boston marathon bombings experts say little has been done to prevent future attacks from home grown terrorists. the ap reports that funds to help prepare for a possible attack may be cut. congress also failed to pass legislation to address intelligence failures that may have led to the attack. the analysis comes after russia said it warned the u.s. of the accused bombers several months before that attack. organizers of this year's boston marathon have run into a different kind of security problem. knowing exactly who is running the race. the runners are supposed to meet a qualifying time or raise thousands of dollars for an approved charity. but anyone who did not finish last year's race because of the bombing are also being allowed to run this year. well, some racing bibs are showing up for sale online with price tags that top $1,000.

>> it doesn't necessarily seem wrong. it depends on the way you go about it. and for why you are going to run it. >> now, that man says some of last year's racers are still hurt and they are looking for a charitable contribution. the boston athletic association says people should respect the rules for getting a bib. if they find out about any specific bib buyers or sellers, that would disqualify the runner. 7:17. this morning there is new information about an irs scandal after the agency was acoused of targeting consecutive groups. newly released email shows some 'party groups could have faced criminal charges. the emails obtained butt public interest group judicial watch show the irs was talking to the justice department about investigating some political groups for fraud. house republicans say the emails were sent the day before an irs official apologized for singling out tea party groups for extra security. all right.

tori, time now 7:17. let's get everybody on the road or are they out there already, sal? any problems? >> people are out there. if you are watching at home and want to join your fellow commuter on the roads i want to give you some drive times to help out. let's look at highway 4, for example, and you can see the traffic is slow coming into bay point and pittsburg. but it's getting better that anitoch. the commute shifts over to bay point and concord from 680, for example, in concord to 680/24 walnut creek. that drive is taking 10 to 11 minutes. it's not too bad as you drive through. i want to mention that the traffic is going to be busy at the bay bridge toll plaza. 35-minute drive time. a lot of that time is waiting just to get to the toll plaza and to the bridge. once you makes it onto the bridge a 10 minute drive across. on the nimitz freeway slow traffic. san jose northbound 85 slows

tony barbera was honored by the san francisco board of supervisors and the fire chief who gave him a certificate in honor of his action. the fire chief even encouraged barbera to consider a career in emergency importance which seems to run in his family since his father is a fire captain. the high school student said he appreciates the honors and called the rescue of a man and young boy from a rip tide bittersweet since a second boy caught in a rip tide is still missing. and according to a memorial fund website for the family the critically injured father who was saved still remains in a coma at the ucsf medical center. the website says doctors have not declared him brain-dead though since they have found evidence of brain activity. after a long search oakland is a step closer to having a new superintendent of schools. antwan wilson is the final list named yesterday. he is the assistant superintendent for denver public schools. the board is scheduled to vote

next week on his appointment. it has spent a year searching for a new superintendent. oakland has also been looking at different educational models and has spent millions of dollars trying to reduce truancy. while graduation rates are increasing, some schools have high dropout rates. a follow-up to a 2 investigates report of possible bedbugs on bart trains. the bart says it took one train car out of service, thoroughly cleaned it up and returned it to service. we then checked on how often bart receives complaints about dirty cars and found out that bart received 39 such complaints last year. bart says it responds immediately to rider concerns. >> basically, every time the train reaches the end of the line, someone walks through quickly, picks up some small pieces and that night it gets a proper cleaning. and when people call in and complain about something specific, something that will require deeper cleaning, we

obviously respond and do that proper cleaning. >> bart said it met its goal for train cleanliness in its most recent quarterly review. however, an independent customer satisfaction survey in 2012 gave bart the lowest ratings in six service areas, including the condition and cleanliness of train seat. bart doesn't think it will have too many complaints about the new fleet of cars. they showed off a model during a presentation at san francisco's justin herman plaza yesterday. they say the new cars will have better seats, bike racks, more hand holds and leds screens that show the location of the train and its next stop. now, the first of the 775 new cars are scheduled to arrive in 2017. and the next public showing of the trains for you to see is tomorrow at the west oakland bart station. 7:26. new this morning a bay area man is getting a big honor today for his efforts to create jobs in

so don't think it's completely clear, but it's a little bit lighter than usual. we are following developing news. a busy san jose intersection will be closed for hours as police investigate a car crash. ktvu's brian flores is live at coleman with new information we are learning. brian. >> reporter: hi, sal. good morning. police just arrived on scene here. a police spokesman, rather, arrived on scene and they say that this intersection is expected to be closed until nine this morning. as you take a look now at just the destruction from this crash earlier this morning, at least one person now killed. another person seriously injured. as we go to video now, police saying now that one of the drivers in this crash may have run a red light and that alcohol appears to be a factor as well. this all happened after midnight. that's when police responded. when they got here both of the cars were in the embankment off coleman and alma din. according to the police of a driver of a black chevy suburban was headed northbound when he was t-boned by a driver of a

honda crv headed eastbound on coleman. police believe the crv driver is the one who ran the red light. both drivers were taken to the hospital. one person remains seriously injured and another one was killed. there was a baby seat, but police say no child on board. both of the drivers are in their 40s, according to san jose police. they say that alcohol may be a factor in this crash as well. this is going to take some time before the scene is cleared. lots of debris on the roadway. glass as well on almadiny and coleman. meridian is closed all the way to coleman and then north of here via montay is closed again. they say it's going to reopen sometime around 9:00 this morning so police can complete their investigation into what exactly happened here. live in san jose, brian flores, ktvu channel 2 news. 7:34. there is new information this morning about the ferry disaster in south korea. a local news agency is reporting that the death toll has now

risen to 14 with 282 people still missing. a cnn affiliate also says there were 46 life boats on the ferry, but some one life boat was deployed. meanwhile, rescue crews say some of those missing could still be alive if they found some air pockets inside the capsized ship. the captain, who made it out safely, hid his face as he was swarmed by reporters. >> i am really sorry and deeply ashamed. i don't know what to say. >> the captain could face charges of negligence and accidental homicide. some survivors say there were instructions broadcast on board the ferry when it first started to capsize for people to stay put and not move when the ship first ran into trouble. caltrans and the chp are conducting tests that could help determine what caused a deadly

crash and fire on chico. a highway traffic team will go to the scene this afternoon to try to recreate last thursday's track between a fedex truck and a tour bus. ten people were killed, including five high school students. the chp will use vehicles similar to the ones in the crash to analyze issues such as speed, braking, and visibility. however, they will not actually crash the vehicles. ktvu will be on hand and we'll provide updates online and on the air throughout the day. time is now 7:36 this morning. police in anitoch are investigating a deadly shooting that happened in a usually quiet neighborhood. the victim a teenager boy. it happened about 8:30 last night on country hills drive. ktvu's alex savage has been out there since 4:30 this morning. you are back to tell us what neighbors saw near the shooting victim, alex. >> reporter: well, dave, good morning to you. neighbors tell me they saw a

small motorcycle, what's commonly known as a pocket bike, next to the victim on the ground. after people in this area heard more than six gunshots last night many came outside and that's when they found the victim in this case. a teenager boy was lying here on the sidewalk. this is country hills drive right off the hillcrest avenue. the victim had no pulse and appeared to have been shot in the chest, according to neighbors. the calls started coming into police after 8:30 last night. the first officers who got here tried to revive the boy. paramedics did the same thing when they got her but ultimately he was pronounced dead at the scene. the victim's name has not been released by authorities and police have not said at this point why that victim may have been targeted in this case. one neighbor told me as a fell leparent he is heartbroken over this homicide. >> it's sad to hear. your parents, you wake up and you don't see your kid again. i can't imagine how that feels. that's not a good feeling. >> reporter: and this was the

third deadly shooting here in anitoch in roughly the last week or so. first a man was gunned down outside a liquor store last tuesday, and friday a jewelry store owner shot and killed a suspected armed robber. as for last night's shooting we are working to get more information from anitoch police for the victim and shooter they are searching for. i have put in calls for police. as soon as we hear back with details we will keep you updated on that. and coming up for you this morning at 8:30 we will tell you what neighbors are telling us about the crime in this area. we're live in morning anitoch, am exsavage. also in anitoch two teenagers have now been charged in the deadly shooting of a man outside of a liquor store. prosecutors say 17-year-old anthony perez and 18-year-old antonio ayalla killed 36-year-old rashawn thomas last week. perez is being charged as an adult. prosecutors say both of the suspects have gang connections, but at this point police haven't

released a possible connection between the suspects and the victim. it is 7:38. the martinez city council has voted to ban the growth of marijuana in backyards. the vote comes after complaints about thieves targeting marijuana grows and the smell of the plants. opponents of the ban say it could make it harder for medical marijuana patients to get the medicine they need. >> it may be marijuana and gilroy would be garlic, correct? something that would also bother your nostrils, be a nuisance in the neighborhood. >> a second vote needs to be held next month before the ban takes effect. the city of concord passed a similar ban last year. the new home of the 49ers is buzzing with activity at this hour. why the focus is now on the ground game at levi stadium in santa clara. >> i'm bummed out. it's horrible and it kind of disgusts me. >> the trouble this man caused that now has the city of portland flush ag way millions

deadly sailboat crash last night near redwood city. ktvu's tara moriarty is live at the redwood city mar even a with new information that you have just learned, tara, about this accident in. >> reporter: yeah. i just got off the phone with the coroner and he said the person who died in this terrible accident was a 39-year-old man from burlingame named yong sun. the survivor was a 59-year-old man from sankar close who suffered a critical head injury. he is expected to survivor, however. their boat, the bella, sits in the marina. the coast guard is coming out this morning to collect the buoy and the sail out in the bay. last night we watched the coroner remove the body of yong sun. this happened before 7:00 when their sailboat taking part in a race was preparing to set its sails and they got tangled in a marker buoy. the tall mast came crashing down hitting two of the four crew members. we spoke with the sequoia yacht club commodore by phone this

morning. >> of course, the club is concerned about everything that's happened. so we are at least for the time being are stepping down racing out of respect for the family and the crew and their friends and our hearts and prayers go out to all of those involved in this unfortunate incident. >> reporter: now, boats had a difficult time coming to bella's rescue because she was in shallow water. a geological survey boat was able to reach the 42-foot catalina sailboat. the crew was able to get those two people on board and transfer them to the firefighters. they were racing in the beer can races. it's a relaxed event. there was no alcohol involved. the skipper was tested and the results proved he was sober. again we do know the name of the victim in this case. it's 39-year-old burlingame man named yong sun. i am tara moriarty. time is 8:03. we are following the investigation into a death of a

military barracks near the cow palace. there is a new development into a investigation into a weekend fire that destroyed the former studios of a san jose tv station. investigators say specially trained dogs have detected possible human remains in the rubble. this morning those dogs will join a special team of investigators to resume the search of the now gutted building on park avenue. they want it to find out if this could be tied to the three people reported missing after sun -- sunday's fire. >> at this time what we have going on is an excavation for a possible human remains that we may have found. we are hearing that there possibly could be other pets that were inside the structure. so that could be a hit. but they are very much well trained in just looking for human remains. >> yesterday police arrested a homeless man suspected of starting this fire. 55-year-old stillman sef if er is behind bars facing charges

of arson and burglary. a witness said she watched him spray some kind of liquid on a mattress and seconds later a fire started. if firefighters find human remains in the rubble he may face murder charges. time now 8:09. fremont police have arrested three people in connection with an armed robbery of a man at an atm. investigators arrested 22-year-old problen sinbh. on tuesday police released inside surveillance video we showed you on the air. this he say it shows two of the suspects using the victim's credit cards at a convenience store. a short time after last week's robbery. san francisco's famous bacon bacon cafe is set to reopen with a few changes to control the cafe's smell. the restaurant shut down last year after people complained about the smell of bacon drifting through the neighborhood. the closure made national headlines. it was even featured on an episode of "saturday night

live." in order to reopen, the restaurant owner made a few changes. the most important is a new exhaust system that cleans and deodorizes the air. the grand reopening is set for this saturday. time is now 8:06. happening right now, boy, the 49ers are really establishing their new ground game. they are adding a critical piece to the new 49ers stadium. ktvu's janine de la vega live in santa clara with that very special delivery this morning. what is it, janine? >> reporter: it is what the players are going to be playing on. the turf. right now workers are preparing the field here at levi stadium for all the grass. several trucks hauling sod arrived earlier this morning. each load on the truck was 49,000 pounds. that's just a coincidence. but pretty fitting for the 49ers. now, here's some video of the flat bed truck carrying the giant rolls of sod into the

stadium. so far four trucks have come in. it's a big job because 2.5 acres will be laid down to cover the field. the installation will take place all day today and tomorrow. the sod was grown by west coast turf in mer sid county. it's bandera bermuda. it will take two -- excuse me. the 49ers chose the grass because it holds up better and they think it will cut the risk of players' injuries. we spoke to the man who grew it. he also happens to be a 49ers fan. >> with the excitement of the new stadium, it's, you know, it's especially tender loving care with the grass that's going into the ballpark. >> reporter: how does it feel to finally be delivering it? >> oh, it's awesome. everybody is all smiles on the field. you get that icing on the cake. that beautiful green pallet going down on the field. we have been at it since a little before five this morning. >> reporter: and here are some

welcome back. time is 8:13. another delay in the case against a man accused of killing missing south bay teenager sierra lamar. angela garcia was in court yesterday to set a trial date. but his lawyer asked for more time saying the district attorney is still deciding if he will seek the death penalty. garcia torres has pled not guilty to the kidnapping and murder of sierra lamar. she disappeared two years ago while on the way to school. garcia torres is due back in court on june 11. an oakland teenager is expected to be sentenced to life in prison today for the shootout that killed a young child. it was caught on surveillance video back in november of 2011. police say 18-year-old frederick coleman fired the bullet that killed 1-year-old hiram lawrence jr. coleman pleaded guilty to first-degree murder charges as part of a plea deal.

his life sentence will include the possibility of parole after 25 years. 8:14. tonight a task force will hold its final public meeting on preventing hate crimes at san jose state university. the task force has spent the past few months exploring new policies that could help prevent future incidents like the one that stunned the campus last fall. an african-american student says he was the target of racially charged bullying by his white roommates at a san jose state dorm. last month he filed a $5 million claim against the university. time is 8:15. san francisco police investigating the latest accident involving a pedestrian and a taxicab. it's the second one in the past three days. police say a woman in her 60s was hit by a cab near bush and stockton streets yesterday. she was treated for injuries there at the scene. now, police and public safety groups are stepping up their campaign to make san francisco streets safer for people walking. seven pedestrians have been

the san francisco board of supervisors and the fire chief who gave him a certificate in honor of his actions. the fire chief even encouraged him to consider a career in emergency response, which seems to run in his family since his dad is a fire captain. the high school student said he appreciates all the honors. he called his rescue of a man and a teenager boy from a rip tide happy but also sad because a second boy caught in that rip tide is still missing this morning. and according to a memorial fund website for the family the critically injured man is still in a coma at the ucsf medical center. the website says doctors have not declared him brain-dead, though, since they have found evidence of brain activity. we have a follow-up to a 2 investigates report of possible bedbugs infesting bart trains. bart says it took one train car out of service, thoroughly cleaned it, and then returned it to the tracks.

affecting the san mateo bridge. we have a crash in san mateo on westbound 92 at highway 101. unfortunately, this injury crash has been there for a bit and traffic on the san mateo bridge is beginning to slow down. it hasn't quite made it all the way back to the toll plaza, but it is backed up for most of the way across that span. please give yourself extra time. also a car fire northbound 280 in daly city near the highway 1 exit just before you get to the highway 1 exit. there is a car fire on the shoulder. this is now a look at the bay bridge. it's improving a little bit. this is about a 25-minute drive time into san francisco. reminder. giants game today 12:45. should be a lot of people in the city and a lot of slow traffic getting out this afternoon. also, the morning commute on 280 is improving in downtown san jose. 280, 85, and 101 have been a touch lighter than usual. 8:32. back to the desk. this morning police in antioch investigating a deadly shooting that happened in a usually quiet neighborhood.

the victim a teenager boy. it happened about 8:30 last night on country hills drive. ktvu's alex savage has been out there since 4:30 this morning. you are back with new information and also you have a photo of the young homicide victim, alex? >> reporter: good morning. i just talked a short time ago with a friend of the victim. he told me this teenager boy was nice and respectful. right now, actually, you can see as we push down to the area where this boy was found shot to death last night there are a couple of friends that are gathering at that spot right now to remember this teenager. he was found here on country hills drive right on the sidewalk. this is just off of hillcrest avenue. if you are familiar with this area. according to the friend i just spoke with, the victim of this shooting was 17-year-old jose gur arrow who grew up here in antioch. the calls came into police last night as neighbors heard gunfire. the first arriving officers tried to revive that teenager. paramedics did the same thing, but he ultimately was pronounced dead here at the scene.

on the ground next to the victim was a small motorcycle. what's known as a pocket bike. according to his friend he just left that friend's house to ride home when he was gunned down. >> i tried to call him because i heard four gunshots out of my window. and i called him. i texted him. i was like, you okay? i told him. he never called me back. so i told my girl, let's drive around because i don't feel good about it. i had this feeling. and i just seen all the cop cars. >> reporter: yeah, that friend told me the shooter in this case, he believes, likely knew the teenager victim and targeted him. police, though, hasn't talked about the motive in this case and we are working to get more information about this shooter that officers are searching for this morning. they have not put out a description of that person. but we have calls into antioch police and we are hoping to get more information throughout the day. neighbors have been telling us that generally speaking this is

a very safe area around here. but there has been a bit of crime recently around here and now this deadly shooting last night, and many neighbors say it has them on edge. we are live this morning in antioch. alex savidge. also in antioch two teenagers have now been charged in the deadly shooting of a man outside of a liquor store. prosecutors say 17-year-old anthony perez and 18-year-old tone know aiello killed 36-year-old sean thomas last week. perez is being charged as an adult. prosecutors say both suspects have gang ties. they haven't released a possible connection between the suspects and the victim. 8:35. happening today, important testing that could help determine what caused the deadly bus crash and fire on interstate 5 near chico. a caltrans engineer and a chp accident investigation team will go to the scene this afternoon to try to recreate the conditions leading up to last

thursday's crash between a fedex truck and a tour bus. 10 people were killed, including both drivers and 5 high school students on their way to tour humboldt state university. the chp will use vehicles similar to the ones in the crash to analyze issues such as speed, braking, and visibility. ktvu will be on hand and we'll provide updates online and on the air throughout the day. a south bay woman has filed a class action lawsuit against pier 1 imports claiming she was forced to take unpaid leave because she was pregnant. erin casselman works as a sales associate at a pier 1 imports store in south san jose. her doctor told her not to climb ladders or lift anything over 15 pounds. she says the store responded by putting her on light duty for 8 weeks and then forcing her to take unpaid leave months before her due date. >> i was shocked.

completely shocked. and hurt, you know, because i have been such a loyal, dedicated employee for that company for two years. i figured that they had some kind of policy for pregnancy. it wasn't just eight weeks and you're out the door. >> but according to casselman's attorney pier 1 has a policy of putting pregnant women on light duty for a maximum of eight weeks and then automatically placing them on unpaid leave if they continue to need accommodations. pier 1 has not commented on the lawsuit. time's now 8:37. the martinez city council voted to ban people from growing marijuana in their backyards. now, this comes after getting complaints about thieves targeting marijuana grows and also the smell of the marijuana plants. opponents of this ban say it will make it harder for medical marijuana patients to get the medicine they need. >> maybe marijuana in gilroy would be garlic, correct? that would also bother your nostrils and be a nuisance in

the neighborhood. >> a second vote will be held next month before this ban takes effect. last year the city of concord passed a similar ban. the city of san francisco is taking steps to deal with 40/20 gathering this sunday at golden gate park. it's slang for smoking marijuana. -city leaders say the police and parking patrols will be increased. now, last year thousands of people gathered at golden gate park leaving 10,000 pounds of crash behind. now, police say they will specifically be watching for illegal parking, camping, drug sales, and open alcohol containers. 8:38. after a long search oakland is step closer to having a new superintendent of schools. the board of education named antwan wilson as the final list yesterday. he is currently the assistant superintendent for denver public schools. he is credited with turning around one of denver's troubled

high schools. the board is scheduled to vote on his appointment next week. meanwhile, oakland has also been looking at different education models to boost student achievement and has spent millions of dollars trying to reduce truancy. while graduation rates are increasing, some high schools still have very high drop-out rates. a marin county judge says he will consider more evidence before making a final ruling on the shutdown of the drake's bay oyster company. the judge ordered a new environmental review. he says the state coastal commission abused its discretion when it took steps to shut down the oyster form at point rays national sea shore. the federal government let the lease expire in 2012. since then the oyster company has lost several court appeals as it battles to stay open. all right. time is 8:39. it could be a summer of dry lawns in the east bay. the drastic step a water agency

northbound when he was hit by the driver after honda crv headed eastbound on coleman avenue. according to police who interviewed witnesses they say the honda driver ran a red light and police said this morning alcohol appears to be a factor in this crash as well. now, earlier san jose police said that the driver of the chevy suburban had been killed but they clarified his condition just minutes ago. >> they are in serious life-threatening condition. they are on life support right now. so the officers are treating this like a fatal collision
