going on a vandalism spree. students, parents ask staff told -- and staff told me the animals were tortured. >> reporter: how are the students reacting? >> ridiculous. unacceptable. whoever is responsible i hope that they get what they deserve. >> this is a tragic and heinous event. also the vand throm the property. -- the vandalism to the property. talking kids at the middle school level. >> talking now middle school, we better look at the parents too. >> reporter: [ inaudible question ] >> better not be. >> reporter: police are still questioning the boys but they will they have all the people responsible for the deaths.

the school and district declined to comment. live in santa clara, robert handa, ktvu channel 2 news. a report by the california highway patrol show as sheriff's deputy was speeding when he struck two pedestrians killing one and seriously injuring the other. >> very unfortunate and very tragic. for everybody involved. and i think that most people think about a time they went 18 miles per hour over the speed limit and have somebody pop out in front of you, this can this could have happened to them. >> ktvu confirmed the deputy was speeding at the time. the times says he was going goy miles per hour in a -- going 53 miles per hour. we confirmed his siren and emergency lights were off at the time. the district attorney declined

to file criminal charges. there is new information about the mid-air collision between two small planes over san pablo bay. we know the crash happened as one plane tried to pass the other. this comes as search and rescue teams found the lost plane. ktvu's john fowler is live with more. >> reporter: pilots call it a high speed pass and there were doesbs of witnesses to it -- dozens of witnesses to it. >> reporter: an aircraft mechanic at the san pablo bay marina. she saw the planes, cessna 210 and a hawker sea fury tmk 20. the crash happened as the plane passed. >> going at a good speed. i see it veering to the right.

5 years ago. a civil rights lawsuit -- [ indiscernible ] >> he was grant's best friend and he died in 2011 after someone shot him at a gas station. he left behind two sons. today would have been his 28th birthday. this week a judge will hear motions of the federal lawsuit. b.a.r.t. wants it dismissed since he is now dead. but the family is arguing his mother should be able to pursue it. both sides head to court wednesday. the b.a.r.t. officer who killed oscar grant was released from jail in 2011. a jury acquitted him of murder but convicted him of involuntary manslaughter. he was sentenced to two years in prison and served half of that sentence in southern california. he always said he thought he may have had a weapon and he

says he meant to reach for his taser, not his gun. after a couple days of rain, warm weather is heading to the bay area but as people prepare for beautiful weather, california remains in the grips of a drought. ktvu's noelle walker joins us live where the city counsel is expected to vote on increasing water emergency levels to stage 3. what does that mean for customers? >> reporter: it means they have to conserve water or their rates are going to go up. the city is doing it. fountains that usually were all all day long are limiting hours to save water. >> reporter: when the sun sparked a heat wave, there is nothing better than a cool fountain. but one person's playground is

and donald sterling have to deal with. >> security is expected to be high. world series coach is asking a -- warriors coach is asking fans to protest the game. it is in reaction to comments by donald sterling telling his girlfriend not to associate with black people. the nba is expected to take action tomorrow before the game. the league will hold a press conference where it could announce it will force sterling to sell the team and it could impose a fine and suspend him. muni ridership is at a record high and so are connections about the reliability of the system -- questions about the reliability of the system. it one is of the largest public transit systems in california. ktvu's david stevenson looks at what is going right and what is

went to the home for drinks and sex but he didn't peek inside her window. he says he is still undecide about his future. smart phones are a popular target for thieves and police say people can take a step to protect themselves. it is a growing problem in the bay area and across the country. nationwide 3 million people have their cell phones stolen. ktvu's allie rasmus is live in oakland where police say a simple piece of software is helping officers make arrests. >> reporter: 60% of all robberies involved a mobile device but tracking software can help police find the thieves. >> reporter: she knows how effective tracking software could be.

[ indiscernible ] >> reporter: she helped customers use it to find lost phones and tablets. and she used it herself when burglars stole hers. >> it was $66,000 worth of stuff. >> reporter: she used tracking software to track the thieves down. >> it was 10 minutes away. they took it to mcdonalds where they offer free wifi. i was surprised. >> it was one of several thinks a consumer needs do. >> reporter: police use the technology on thursday when robbers stole a smart phone from a woman. she called police and using the tracking software told officers where to find her phone. police arrested two people. >> there is one called where is
