recycle the water but there was nowhere to put it. customers are asked to volunteery conserve 20%. the water district said the number one priority is water quality. mike mibach, ktvu channel 2 news. you might recall portland had to declare a reservoir tainted after a man urinated in it. surveillance cameras spotted him doing it and they had to drain the tank. it is another hot day in the bay area, especially in the east bay. temperatures hovered around 90 degrees on this first day of may. jack london scare, it was -- square it was a bit cooler. our chief meteorologist bill martin is tracking the hottest spots. >> we had highs yesterday and a

protesting and giving pleas from the steps of city hall on this may day. they called for more rights for workers. ktvu's noelle walker is live in san jose where the may day rally brings out a lot of people calling for immigration reform. >> they just arrived here at city hall after marching from east san jose through the streets of san jose to city hall. i think we have news chopper 2 -- we can show you how they filled the plaza here in front of san jose city hall. it is generally -- international workers rights day is general asky what may day is -- generally what may day is. people talking about immigration reform. we talked to two young boy whose found out yesterday their mother has been deported back

to mexico. they have been a scattered to the wind with friends and family. i heard that story or similar stories over and over again from people who are undocumented and here in the rally or who have family members forcing deportation. very focused on immigration rights. in an election year politics is probably not going to do much with immigration reform during an election year. they put it on the back burner but it is simmering here in san jose and it seems in some places waiting to boil over. this day is about both immigration rights and bonding together. this is also about celebrating different cultures and workers rights. they are gathed here at city

hall -- gathered here at city hall. they are getting ready for one of many rallies. they are getting ready to rally again here at san jose, it is just starting right now. reporting live in san jose, noelle walker, ktvu channel 2 news. >> may day was fist celebrated as a spring holiday, then in 1986 it marked the day workers demanded the start of an 8 hour work day. at that time a lot of people were working 10 to 15 hours a day. and international workers day around the world and used to be linked to socialism. police made a second arrest in connection with a deadly shooting three years ago. he is now in custody for the killing. police say another suspect was arrested last october. he was killed in 2011 outside a

market in oakland. this arrest is one of six arrests by oakland police in 7 days. the other five arrests are connected to a total of four unrelated killings. officers are continuing their investigation in hopes of bringing closure to the victim's families. a man described as a troubled war veteran is charged in two kidnappings in which one victim crashed her car to get away while the other escaped after being driven to a remote town. ktvu's robert handa is live outside the courthouse and we hear from the suspect's father. robert? >> reporter: after today's proceedings you can see a interesting legal battle shaping up. the man accused man accused made his first appearance here and watching his behavior today and after talking with his father, it could center around

the man's mental health. cameras were not allowed in where kenneth middlebrook was charged. the charges are for the two kidnapping attempts on sunday. one of a 61-year-old woman and a 19-year-old san jose woman, daniela alvarez who talked with ktvu about kenneth middlebrook's actions after she agreed to drive him to his father's house. >> he like attacks me. so he like holds my arms tight and i scream and then he starts choking me and i am like i am screaming louder, he is like, puts his hands on my face and says shut up, get in the trunk. >> is this complicated legal case? >> hard to tell at this time. we reviewed the police reports. >> reporter: his father says his son is a traumatized iraq war veteran and wants the court

to get him care and not put him behind bars. >> my son is mentally sick. he needs help. my fear is they will send him to prison where he will become worse than he is now. >> reporter: kenneth middlebrook is due in court may 7. he is held in jail on $331,000 bail. through his attorney he declined our request to be interviewed. robert handa, ktvu channel 2 news. university of california at berkeley is among 55 colleges accused of mishandling sexual assault complaints. they released a list of schools they are investigating. 31 students at university of california at berkeley filed a complaint against the school sparking the investigation. we talked to one of the students today. >> i know so many survivors and i will see people i know who are perpetrators. >> in a statement the university said much has been

down to strengthen how the campus handles these issues but we understand there is always room for improvement. here is a look at the other colleges and universities facing the investigation. among the other california schools named usc, ox dendal and butte glen community college. harvard, princeton are also on the list. new numbers released by the defense department show a jump in the number of military sexual assaults. 5,000 reports of sexual assault last year. that is a 50% jump compared to the year before. u.s. defense secretary chuck hagel say it isn't the result of more sexual assaults. he says they reflect more service members reporting the crime. he ordered six new initiatives, including it get more male victims to come forward and a review of alcohol policies. the senate approved legislation to eliminate the

words man and woman from california's legal definition of marriage. he says the bill removes language from the family code and it brings it into compliance with new state laws on marriage. it calls for gender neutral language. the bill passed with all but two republicans. california's work place safety agency slapped tesla with a fine related to an incident that left three workers injured last year. they failed to ensure a press was maintained in sape operating conditions. work -- safe operating conditions. workers suffered burns. they plan to appeal the fines. 400 elementary school have been named california

distinguished schools and some of the schools are in the bay area. contra costa county has 24 schools. for the first time they were recognized. 22 schools in alameda county were honored. the state department of -- u.s. department of education recognizes schools every year for narrowing the gap. two dogs on the loose attack two people on their morning walk. the attack that prompted a shelter in place and the weapon police used to subdue one of the dogs. >> residents bracing to pay more for the water they use. the one thing you can do to fight a rate hike and what it takes to win.

is something to keep that from happening. we have seen a number of rate increases and more are on the way. ktvu's tom vacar is live at the reservoir with what he found out that consumers could do to contest rates they feel are excessive. tom. >> community spirit can save a lot of water but cash, now that effects hearts and minds. >> the water agencies get less revenue when customers conserve. some want higher rates to off set that. under california law if they want to raise rates for any reason written protests from 50% of customers kills the increase. they are not required to say that to customers. our survey shows half don't.

even though they are seeking a 35% increase it is telling their customers they could kill it. >> we think it is good public policy to know. >> makes me upset. because the rates are high and we are conserving our water. >> if more than half protest the city would be soon bankrupt. >> the only option is the general fund would have to pick up the difference. >> reporter: they [ indiscernible ] customers who cut usage by 35% could see their bill go down a little bit. if not -- >> they will see a $20 permonth increase. -- per month increase. >> california is getting tapped out. >> 6-7 years are below normal

to critically dry. >> reporter: consumers who might want to exercise that power should be careful. reporting live, tom vacar, ktvu channel 2 news. a san jose woman accused of stabbing her baby was arraigned today from her hospital bed. the 23-year-old is being held at a hospital. her arraignment was postponed for medical reasons. she suffers from depression. she did not enter a plea. officers found her holding the lifeless body of her son on saturday at a livermore park. two loose dogs in a neighborhood this morning are in the custody of animal service officers. police say two dogs viciously attacked two people walking their dogs in a neighborhood. they say the dogs attacked two

small dogs first and then when the owner tried to protect them he bit him. another woman reported she was bit repeatedly in the face, hand and ankle by both dogs. >> these dogs are eating my dogs and now me. >> police say elementary school wept into lock down while they rounded up the dogs. they were able to catch the lab. the dogs are now in a bite quarantine with possible fines for the owner. the owner is upset and claims someone let the dogs out. an autopsy confirmed the pilot of the plane that crashed died of multiple blunt force injuries. the 33-year-old david everett plumb was piloting the plane when it crashed mid-air into another plane and plunged into the bay on sunday. the body was recovered yesterdays as they hoisted the
