on. it was a very scary experience. >> reporter: he walks the same path to school every week day. he wasn't far from home when he saw the car with the windows shattered. he tried to notify the homeowner. he had no idea the owner was calling police. minutes later officeresses sow round -- officers surround him. he was told to get on the ground. >> they said if you move we will shoot you. so i started crying and i was scared and i didn't know what to do. >> reporter: he was handcuffed, searched and questioned and then taken to school by an officer after the misunderstanding. >> this is my only child. for him to be treated like that, that is unacceptable. unacceptable. >> police are now apologizing. >> we are sorry at the police department. >> reporter: a woman described a man shot at the home and

vandalized the car. >> the 11-year-old was in the wrong place at the wrong time. it is a tragedy he had to go through something like that. >> reporter: his mother said police never called her. she is still waiting for them to reach out to her about the scary experience her son went through. >> it could have been a different way. i thank god it didn't happen like that. the way it happened i can't change it but i don't want to happen to anyone else's child ever again. >> reporter: she believes he was targeted because of the color of his skin. they said they believed there was a serious threat based on the call they received. cristina rendon, ktvu channel 2 news. the family of a six-year- old boy who was wounded during a police chase last year is suing the police department. the chase ended when officers

shot and killed the 24-year- old. the times reports the parents claim a bullet fired by police went through their car's windshield before hitting the youngster. the lawsuit allege police did not investigate who fired the shot. new developments in the spread of whooping cough cases in the bay area. ktvu's john sasaki is live now in martinez where one school is handling an outbreak. >> reporter: this is the school in contra costa county that has been hit the hardest by whooping cough. >> reporter: friday afternoon in martinez and as kids got out of school the air was filled with excitement. but at the elementary school there is concern. >> how easily spreadable it is. having someone with whooping cough and talking to them, you could get it.

pretty scary. >> reporter: there have been 49 cases of whooping cough across the county. 9 of them happened here. 20% of the cases have been here. >> i don't want my kids to be miserable. we have three. i don't want any of them to be sick. i don't want to be sick so i can't take care of them. >> reporter: officials say take time to get over whooping cough. babies under 6 months are more at risk. we have had four babies hospitalized this year in contra costa county. luckily all are recovering. in 2010, 10 babies died throughout the state. and what we are trying to do is protect the babies. >> reporter: one parent said he was taking his daughter to the doctor this afternoon because of a persistent cough. >> all night long. all night long coughing. wheezing. we thought it was asthma. but it might be more than that.

>> reporter: district sent a letter home, if parents notice their children have a cough for more than two weeks to see a doctor. john sasaki, ktvu channel 2 news. martinez is not the only place seeing a jump in whooping cough cases. in napa county there have been 17 cases this year with 9 in the last two weeks. in 2013 there were 13 cases in napa county for the year. all but three of this year's cases are in middle or high school. firefighter filed a lawsuit claiming she was wrongly identified as driving over and killing a teenager who survived the asiana airlines plane crash. elyse duckett said the fire department is using her as a scapegoat because she is african american and a lesbian. we got this video showing the chaos after the plane crashed. an investigation found 16-year-

old ye meng yuan initially survived the crash but died when she was run over by a truck. elyse duckett's lawsuit alleges another truck ran over the truck twice before her truck ran over her but her name was leaked to the media. followed by a robber and surveillance video caught the moment he attacked her and ktvu channel 2 news got access to the video. you can see the man approach the woman in san francisco's mission district. then here you see as he knocks can her down and grabs her bag and runs away. and she gets up and starts following him. san francisco police say it is what you can't see during the scuffle that is most disturbing. >> she was struck by the tire iron weapon and he pulled her down and takes her bag with force. >> the robber hasn't been caught. police tell us the neighborhood is changing, transforming as shops and housing move into the

area. we are learning more about the days before a fire chief was accused of killing his girlfriend. a man hunt is underway for orville fleming. this after his girlfriend sarah douglas was found stabbed to death at their home in sacramento. orville fleming ask a skilled outdoors man with keys to gates, trails and facilities around the state. authorities chairicide -- shared text messages from his wife. he asked to be picked up. orville fleming spent his final message to her after the killings saying you should have come and picked me up. report from the san francisco fire department says a smoke detector didn't go off last month in a fire that killed a boy and his mother on april 16 at a public housing apartment. a report released today by the

fire department says there was one smoke detector and it didn't work. it is not clear why or whose responsibility it was to make sure it was working. investigators say yesterday's fire at a mobile home park may have been linked to cooking. a fire killed a man and a woman. another man escaped the smoke and flames. firefighters say the fire appears to have started in kitchen but there isn't a cause that has been established. charges dropped against a protested against the shooting death of andy lopez by a sheriff's deputy. [ indiscernible ] >> the district attorney office says it will not retry to case of ramon cairo after a judge declared a mistrial yesterday when jurors dead locked on charges of resisting arrest. ramon cairo was arrested in

december. the president's swing through there bay area wrapped up. the president announced a number of government energy investments to workers at a walmart today. he praised walmart for taking such steps as installing solar panels early on. >> that is why i am here today. more and more companies like walmart are realizing that wasting energy is not -- wasting less energy is not only good for the planet, it is good for business. >> the president attended a $32,000 per ticket discussion with tech leaders and a fundraiser from 1,000 to $32,000 a head. labor unions, groups and activists protested outside the president appearance at walmart today, they criticized the president choosing walmart saying they pay low wages,

offers poor benefits, unreliable working areas. walmart long defended its policies claiming wages and benefits are competitive in the market. to california drought. the city of santa cruz is taking action to deal with people who are wasting water. they have water restrictions starting this month and now they have patrols and penalties in place to inforce the rules -- enforce the rules. ktvu's ann rubin has more. >> reporter: he will spend his days on patrols looking for the most serious offenders. >> we call it enforcement. it is more than that. >> reporter: in his job with the water department he is part enforcer, part educator. >> city of santa cruz water department. >> his goal find the water wasters. >> runs down the streets. >> gets them to comply with new restrictions on water use. >> we are asking all our

customers to achieve a 25% reduction. >> the water department hopes fines will help. a home is allotted 10 units a month. the first unit above that is a $25 fine. and for every unit above that, $50 fine. this family wracked up $275 worth of fines, hiking their bill to well over $300. the biggest problems comes from over irrigations and leaks. >> looking forlooking for water in the streets. >> reporter: that is exactly what we found. >> i could hear what sounds like a leak. >> notification to the renter leads to the promise of a resolution -- promise of a resolution. >> fix it right away before we get fined. >> reporter: most people have

across the freeway, it is by the coliseum, the tracks are b.a.r.t.'s new airport connector. ktvu's claudine wong got a look at what that ride is going to look like. >> reporter: we are at the wheelhouse of the airport connector. this is one of b.a.r.t.'s trains. the tracks are done. right now they are just doing testing and civilians aren't allowed to ride on the trains. we will show you what a ride will be like. >> reporter: we attached cameras. one to the side and one to the winnow -- window. >> after they sign off on it, we can allow people to ride the train. >> reporter: an 8 minute ride but we sped things up to show you what it would look like as the train makes it way down the

years at its location. they were given notice to move so it could be redeveloped into a condo building. the owner says they are looking for a new location in san francisco but given the market will likely have to down size. bill that would close a loophole in the ellis act is making its way through the capital. it would require people ensan francisco to own their -- in san francisco to own their property for 5 years before they could use the ellis act to evict tenants. supporters are saying it is being abused but opponents say they have every right to buy and sell as they choose. >> the difference is stark, a landlord's business is 100% occupancy.
