supervision that is to blame i am frank summer value. >> i am julie haener. for the first time the date of one of the two b.a.r.t workers killed last career is speaking out on camera about the loss of her father lawrence daniels on the left and christopher shepherd on the right were killed while doing maintenance work on the track in walnut creek. now the daniels flame as filed a wrongful death lawsuit against b.a.r.t. tonight, ktvu's eric rasmussen is here now with what daniel's date had to say and what her family is demanding. eric. >> reporter: julie, amber daniels isn't putting a dollar figure on her father, but he says the accident happened like you said, when workers were on strike with an operator in training at the controls. for months investigators have been looking into every detail of the crash. now his daughter says she is finally ready to talk about it. >> i am so rang ray that i don't have the opportunity to say good-bye to my the dad.

>> amber daniels says a call from the coroner is how she found out her father was one of two men killed on the b.a.r.t tracks in october. a veteran engineer and b.a.r.t contractor, 66-year-old lar ray daniels was considered an expert in safety. >> he was always the guy who was never going to cut corners. >> now, daniels' family is suing b.a.r.t. according to the lawsuit, the train was in automatic pilot. and, the trainer who was supposed to be supervising the inexperienced on rayer to in training was negligently anoraklessly seated in the passenger area with three other b.a.r.t employees. >> people weren't paying attention he was run over because of it was a try knee who wasn't paying attention. i'm just furious and sad. i have a lot of feelings about that. >> the accident was an absolute tragedy. >> but b.a.r.t managers say they can't comment about what happened until the national

transportation safety board finishes its investigation. osha has already fined b.a.r.t $210,000 and the transit agency has changed its policy that allowed workers on the tracks without warnings about on coming trains. a change that is now part of lair ray daniels' legacy. >> i can hope nobody else dice because of b.a.r.t's inattention to safety details. >> reporter: a coroner's report found both men had their backs turned at the time of the accident with no one acting as a look out. the attorney for the daniels insist with no forward facing camera on the train it is impossible to know what the men were king. eric rasmussen, ktvu channel 2 news jazz an update now on break news in san mateo. in the last 30 minutes, we vacaville area learned a worker died apparently after falling on his head at a construction see news chopper 2 is showing us live pictures from the scene. we now know it is the former

bay meadows racetrack. paramedics were called to the scene around 3:40 this afternoon but the man was already d. right now, cal osha investigators are trying to determine how that man fell. so far, no word on his identity jazz new information tonight a store ray we've been following since last night. within just the past hour, we have been told that the briman college campus in san jose will ray open tomorrow. the school abruptly shut down yesterday after eviction notices were posted. today, ktvu learned the school employed $83 -- $83,000 in back rent. the school tells us the issue has now been resolved and it is notifying students that classes will be in session as of tomorrow jazz when people think about san francisco, china town, alcatraz, lombard street probably comes to mind. now lombard is going to be shut down for part of the summer. ktvu's paul chambers with why the crookedest street in the

demonstrated at san francisco city hall hoping to get the attention of mayor ed lee. >> the door is locked. >> it turned out, the mayor wasn't in so they dropped off a pile of scrubs to represent the 235 vacancies they sigh need to be filled at city-run facilities including san francisco jean hospital. nurses are now negotiating a labor contract. additional staffing is one of their demands. >> i know some people might think this is a bargaining ploy. but we have had issues going back years. >> a spokesperson for san francisco jean said the hospital agrees more staffing is needed and says they are trying to fill vacancies. b.a.r.t has settled a civil rights lawsuit filed by five friends of oscar grant who are all held after grant was shot and killed in 2009. their attorney confirms that b.a.r.t will pay $175,000 to the five men. they were detained following the deadly shoot of grant

january 1st, 2009 by former b.a.r.t police officer. the suit claimed the men were held without just cause jazz a teenager hit and killed by a train just weeks before her graduation is prompting calls for kids to look up from their phones and listen. as we first told you on the 10:00 news last night, 18-year- old britney silva was crossing the tracks. apparently with ear buds in her ears and didn't appear to hear a witness telling her that a train was coming. ktvu's noel walker is at the crash scene, which is also just steps away from britney's home. noel. >> reporter: yeah. in fact, frank, britney liviers right next door to these tracks. about 10 minutes ago her family came out here to the memorial right at the time she was hit by that train last night britney was very familiar with this area. had to cross those tracks everyday. her mother said those ear buds were a deadly distraction. >> trains are not quiet.

police say they have three men and a juvenile in custody  for a crime spree that include a mother being held at gun point with her children watching. police say the suspects

ransacked that home in fre mont about 30 minutes after they break into another home. an officer then spotted them on interstate 880 near 237. here is a look at the three men who were arrested. police say physical evidence, witness statements and suspect confessions link them to those incidents and others that occurred outside faemont jazz two people caught on camera vandalizing a car. take a look. he take out a container and starts dousing the car. investigators say there have been several acts of vandalism here in the past six weeks. if same car had its tires slashed last month. earlier month, someone splashed it with paint. >> this is more like a hate crime. seems like it. for someone to do this continue

usually, and this is the third incident, that means that this person is very hateful. >> a family member tells ktvu he believes someone is retaliating against them. we are in close contact with police and will keep ewe updated on any suspect information or arrests jazz santa clara county is taking a first step toward establishing living wage for county workers and contractors. the board of supervisors voted unanimously today to begin the process of formulating a living wage plant county workers are currently subject to the state's minimum wage which is set to increase top $9 an hour in july. but one supervisor told us that even that isn't enough for most county workers to make ends meet. >> there's been sort of a destruction or degradation of the middle class. people aren't able to make it on ordinary wages like they once were. >> san jose raised us minimum wage last year to $10 an hour. santa clara county supervisor say they hope to vote on their

mountains, then, is some showers near grass valley. this is all rain. above about 6500 feet we are seeing a few snow flurries. nothing to really speak up. kind a wet, drizzle yeah day. these are the overnight lows. forecast for tomorrow morning. it will be chilly. these don't look that cold, but think about it. it's almost june and we're dealing with upper 40s, low 50s in the valleys tomorrow morning. so that's chilly this time of year. i would expect low to mid 50s. not upper 40s. san jose, as we head into tomorrow, slightly warmer than today. today, low 70s. tomorrow, upper 70s. thursday, lower 80s. friday into the 90s perhaps for the bay area weekend. we could easily see 90s throughout parts of the inland bay area. this low pressure is leaving. that's the mechanism it shall that was the mechanism for the winds and showers. add it leaves, it is the ran we're going to start to warm up because look at what falls
