take too long. there's plenty of low clouds around. if you are suffering from the allergies, oak and olive, the trees continue to be the highest. grass is in the medium category. expect it to go up over the next couple days. heard from kelly up in bridgeport, almost .5 of rain. there's still some rain wrapping back around. that low though is too far east and south of us. our best opportunity was yesterday. low clouds left behind. pretty good fog bank trying to clear off parts of the sonoma and mendocino county. i think it might make it. might take it a while for the coast. a little warmer today. you can see that low cloud deck. it loses out to a northerly breeze. we still get a breeze out of the west or out of the southwest right now. below, though -- the low, though, is on its way. it will rain down in las vegas and southern california, they could use the rain down there. they will get some.

fog, sun, nice. it will be warmer, mainly inland. upper 70s. a few low 80s. 60s or very low 70s coast and bay. here's sal. steve, good morning. we have a word of a crash on 80 westbound 80 at gilman. this is -- would be at the top of the screen from our east shore shot here and i don't see anything up here. that doesn't mean that it's not there. there's supposed to be a crash on 80 kind of in this area here on 80 as you head up to the eastshore freeway right near gilman. kind of at the top of your screen here. we'll keep an eye on it for you. traffic this time is going to be changed by that if there is a crash blocking lanes. we'll continue to watch it. hopefully it won't be as bad as monday. bay bridge toll plaza, you can see traffic is backed up for a 25-minute drive time into san francisco with no major delays. traffic continues to move along pretty well around the bay area. 580 westbound, you can see a lot of slow traffic out of the

livermore valley. this has become kind of routine now. southbound 680 is also slow out of pleasanton heading down to fremont. let's go back to the desk. thank you, sal. concord police are looking for a teenager they say has already sexually assaulted three women. all of the alleged attacks have happened along a walking trail near ignacio valley and cal road. ktvu's tara moriarty is at the trail with reaction from people who walk there. good morning, tara. >> reporter: good morning. people say that they are shocked, quite frankly, because they feel very safe when they are walking here even when it's dark outside. now, we take a look behind me, you can see this is the greenbelt we're talking about. we're in the crossings. police believe that their suspect actually lives here. yesterday afternoon, concord police released a sketch. police say a teenager has been approaching women from behind and groping them over their clothing. they say that he struck in late march and then twice more this month during daylight and after

dark. >> very concerning, you know, i think if i were walking at times when there's not a lot of other people out there, but morning times, i'm surprised because there's a lot of walkers. >> reporter: police say the suspect is asian or latino. early to late teens. about 5'6". thin to average build with shoerlt black hair -- short, black hair. we've been in touch with concord police and they are hoping someone recognizes the teen from the sketches. we've seen a couple of walkers out this morning. we're looking to see if they are taking precautions as a result of what's happened here. we're live in concord, tara moriarty, ktvu channel 2 news. you new this morning, general motors announced another major recall. gm has recalled 20 million cars worldwide since the start of the year. alex savidge is live in san leandro to tell us about this newest recall and also why car owners are having a tough time

getting their cars fixed. good morning, alex. >> reporter: well, dave, good morning to you. the latest recall that came out this morning affects the chevy avaia. it's an issue with the daytime running lights that can potentially lead to fires. all of these recall, there have been 30 so far this year, have led to backlogs in terms of car owners getting their repair work done. we're at the fh daily chevrolet dealership in san leandro, where there are a number of people on the waiting list. one of the service managers here, marty shorts is nice enough to join us. good morning. you just opened the doors. you are still facing a backlog. a lot of people waiting to get recalls done. >> the biggest recall is the ignition switch on that. we have hired extra help. we check every day to see whether there's parts that are in and we call customers immediately. but there's still a backlog with as many vehicles that need service. we do have some new recalls

mostly it's for the ignition switch issue that gm has said may be responsible for up to 13 deaths. the latest recall issuesed just -- issued yesterday and the one this morning has not been linked to accidents or injuries. this is the 30th recall so far this year for gm. a lot of car owners are getting the recall notices, they are being forced to wait quite a bit of time to get the repair work done. we're live in san leandro, alex savidge, ktvu channel 2 news. >> all right. you can find a list of all of the gm cars affected by the ignition switch recall. go to ktvu.com. click on the web links section. 7:08. a 70-year-old transient accused of breaking into a social security administration office in santa cruz and releasing a harmful chemical mixture. joseph anton lores was arrested yesterday. investigators say he used a big rock to break a window and

poured a mixture of chlorine and ammonia into the building. when employees arrived for work, many complained of feeling sick. that building was evacuated. exposure to the chemical mixture could be fatal. investigators identified lores through these images. police say he went on an anti- government rant after he was arrested but he did not confess to the crime. it's a first for california. santa cruz county is banning fracking. the board of supervisors approved banning the controversial hydraulic drilling process. the vote is considered symbolic since there are no known oil leases in santa cruz county. but supporters say this is similar to steps taken back in the 1980s to ban offshore oil drilling. that became a model for other california coastal communities. a 28-year-old richmond man is in jail accused of attempted armed robbery to steal ice cream from a market. employees at the bayview meat

and fish store approached the suspect monday night when they say he tried to steal some ice dream. that's when the -- ice cream. tea that's when the man pulled out a gun and pointed it at employees. he realized the gun was not loaded and put a bullet in the chamber. he never fired the gun as was captured by police a short time later. developing news from riverside county. that's where a freeway crash early this morning has killed at least four people and seriously injured several more. a big rig carrying steel pipes jackknifed on interstate 10 about 2:15 this morning. a tour bus that was traveling from texas to los angeles overturned, trying to avoid the mess on the road. that bus filled with passengers then rolled 40 to 50 feet down an embankment. the transportation officials are warning the death toll may go higher. this morning a mother in southern california is accused of killing her three young

daughters. los angeles county deputies say the little girl's grandmother called 911 and said her daughter had killed her 3-year- old, 2-year-old and 2-month-old baby at their home. investigators say they recovered several knives but say there could be several different causes of the deaths. deputies say both the father and the -- the father of the children and the grandmother were there at the home when they arrived. the father was taken to the police station for further questioning. happening now, president obama is holding a closed-door meeting in the oval office with the man on the right, embattled veterans affair secretary eric shinseki, criticized for the backlog of cases of wounded veteran militaries seeking treatment. some vets have died while waiting for medical care. the president has rejected calls to replace shinseki. but president obama plans to

7:14. ktvu has now learned the san leandro intersection where a teenaged girl was hit and killed by a train monday night was scheduled to have major upgrades this summer. 18-year-old britney silva died monday evening at hesperian boulevard and springlake drive. witnesses say she was talking on her cell phone and was wearing ear-bug style headphones as she walked along the tracks and did not see or hear the train coming. another young woman says a few weeks ago she came within 20 feet of also being hit by a train at that same spot. >> this angle is so deceptive. it's like sometimes the trains can come from this direction

and it's the same way. the angle, you can't see it. >> the city says it already has pedestrian signals installed at the intersection and the new plans call for barriers that will force people to stop and look and be aware of what's around them. a candlelight vigil will be held tonight for britney silva. it's set for 8:00 p.m. at san leandro high school. that's the school she was supposed to graduate from in three weeks. 7:16. republicans in congress want to allow schools to opt out of federal lunch rules that require children get at least one serving the fresh fruit or vegetables. now, a bill moved forward yesterday, one that would allow schools to apply for a waiver from the government lunch program if they are losing money. the healthy lunch standards were championed by michelle obama. some schools complain they've been forced to buy produce that students don't eat and it just ends up in the trash every day. the los angeles county city

of carson decided not to become the nation's first to outlaw bullying. the city council voted against an ordinance that would have made it a crime to bully anyone between kindergarten and 25 years old. the law was given preliminary approval earlier this month but it was defeated during last night's second reading. some council members thought it needed more clarification. there will be more muni buses on the streets of san francisco. yesterday, city supervisors approved a controversial plan allowing the number of buses with wraparound ads to double over the next five years. those ads cover the entire bus, as you can see, in this picture, including the windows. the supporters say the ads provide millions of dollars for muni and help replace the revenue lost when the city decided to end sunday meter parking. opponents say the wraparound ads are eyesores. the dmv has come up with rules of the road for self-

driving cars as they are being tested in california. it officially approved the rules yesterday. they require anyone testing a self-driving car to be in the driver's seat so they can take back control of the car if necessary and they must first complete a training program. all accidents must be reported and the manufacturer needs $5 million in insurance. the rules go into effect on september 16th. >> ready to see that? >> i don't know. it's still kind of a weird thought. >> it is. 7:18. hey, sal, that crash near the caldecott tunnel on highway 24, you still focused on that? >> actually, the chp removed that. >> okay. >> things are getting better, dave and tori, on 24. but we are watching 24. it's a good thing you asked because it's still looking pretty decent between pleasant hill road and the tunnel, about an eight-minute drive time. it was never affected at least on this side, 24, by that

there is a major new development in the donald sterling scandal. the los angeles times obtained 30 pages of documents detailing the nba's investigation into the long-time clippers' owner. those documents reportedly show sterling tried to persuade his companion, v.stiviano, to say she doctored the infamous recordings of his remarks. the times reports that he tried to get her to lie for him during a private meeting a week after the recordings became public. the sacramento city council has approved a financing plan for a new $447 million arena for the sacramento kings. macarthur maze is just shy of 40 minutes. remember monday when we had like 90-minute plus delays. >> today it's not quite as bad. bay bridge toll plaza, 30- minute drive time into san francisco. it's been a little bit slow on parts of the bridge. westbound 580 has become kind of a pretty slow commute on a general, everyday basis. people have been saying what's the deal? 580, especially if you come through livermore into the dublin area there, it will be slow and then 680 is slow leaving pleasanton. i also want to mention in san jose, all of the major freeways are slow, 85, 280 and 101. back to the desk. >> thank you, sal. happening today -- some angry protesters from southern california are on their way to a santa clara county courthouse. they are outraged over plans to release a man known as the pillowcase rapist into their community. ktvu's janine de la vega spoke to one protester now heading to san jose for this morning's

court hearing. good morning, janine. >> reporter: good morning, tori. santa clara county court judge is gonna be holding a public hearing here at the courthouse to decide whether the man known as the pillowcase rapist, where he should leave. the judge is proposing an areas in los angeles county east of palmdale. people who live there are traveling here to tell the judge not in my neighborhood. christopher hubbard was convicted of raining 23 women -- of raping 23 women in california in the 1970s. he moved to the bay areas in the early '80s and then raped 15 more women here. he was sentenced to prison for 16 years and after that was moved to a state mental hospital. a judge here in santa clara county ordered his release last year and has proposed an unincorporated area of palmdale. that's parked outrage and prompted people from that community to protest. we spoke to one woman attending the hearing today. >> it's upsetting. you know, it's a situation

where -- it's hard to put into words because you want to be angry and outraged ad at the -- outraged at the station but you can't be angry at the judge for following the law. >> reporter: feel prosecute community have -- people from the community have set up a facebook page urging people to come here to tell the judge hubbard is not wanted and to continue to look for another city to relocate him. thousands of letters and e- mails have been collected and will be given to the santa clara county judge today to help him make his decision. the l.a. district attorney opposes the decision to have hubbard live in the antelope valley area. they will be monitoring what happens in court closely. janine de la vega, ktvu channel 2 news. >> thank you. 7:35. a registered sex offender is due in court accused of assaulting a woman near a san jose mall. michael garcia was arrested

saturday afternoon at the plant shopping center. police say they responded to reports of a woman screaming and arrived him to find him sexually assaulting the victim. garcia is a transient who was living near the mall in a facility that helps find permanent housing for the homeless. a homicide investigation is underway in san francisco after a man was shot in the head and later died at the hospital. police say the shooting was reported about 9:15 last night on turner terrace in the public housing area on potrero hill. the victim was taken to san francisco hospital where he was pronounced dead. police say extra officers had to be called in after a large crowd gathered sat the hospital. there's no word of an arrest in this case. all right, tori. 7:36. the nfl facing a another player lawsuit. this time from former players who say they were not told about the long-term health effects from taking prescription drugs during their playing careers. brian flores is in the studio. tell us about a former 49er and

raider player who is part of this class-action lawsuit. >> hi, dave. good morning. jerny newberry was a lineman for 11 seasons. at 38 years old, he says he has stage three kidney failure and is blaming the nfl and the ill advisement of team doctors for his condition. he and other players are part of a lawsuit that was filed in a san francisco federal court yesterday. it alleges that injured players often received heavy doses of prescription painkillers all in an effort to get them back on the field despite the seriousness of his injuries. he said team doctors would heavily medicate team doctors rather than take the appropriate action to take the player out of the game. >> what did your team doctor say to you then? i'm like about what? they said they didn't point this out to you? i said no.

he said, they are not doing you any justice. >> reporter: we spoke with a former assistant to the new england patriots' team doctor. will workman says he never saw team doctors pressure players to take the painkillers. >> it's a conversation, an informed consent about what's going to happen. >> the lawsuit is from players who played from 1969 to 2008. the lawsuit also states another 500 players are unnamed plaintiffs in the suit as well. as for the nfl we've reached out to them and they said their legal team has not reviewed the lawsuit. newberry said he would like to see the league change its policies including adding more teams on rosters. i'm brian flores, ktvu channel 2 news. >> okay. thank you. 7:38. happening now, members of the bay area's disabled community, they are headed to sacramento

the risks are just too high, those comments from petco regarding deadly pet treats. pam cook is in our newsroom with the decision the retailer is making to keep pets safe. good morning, pam. >> good morning. well, petco is taking all treats made in china off its store shelves. now, the company says it can no longer wait for the fda to wrap up its investigation since it has been seven years since the first warning about the treats. the fda says more than 1,000 dogs have died after eating treats made in china and nearly 5,000 pets have become sick. but no recall has been issued. so petco is taking action. >> we had to do this. it was the right thing to do for the pets and the pet

barometer making a major announce -- president obama making a major announcement regarding the v.a. scandal. he just wrapped up a closed- door meeting with eric shinseki. let's listen in. >> when i hear allegations of misconduct, any misconduct, whether it's allegations of v.a. staff covering up long wait times or cooking the books, i will not stand for it, not as commander-in-chief but also not as an american. none of us should. so if these ail allegations prove to be -- if these allegations prove to be true, it's dishonorable, it's disgraceful and i will not tolerate it, period. here's what i discussed with secretary shinseki this morning

-- first, anybody found to have manipulated or falsified records at v.a. facilities has to be held accountable. the inspector general at the v.a. has launched investigations into the phoenix v.a. and other facilities. some individuals have already been put on administrative leave. i know that people are angry and want swift reckoning. i sim po thiz with that. but -- sim po thiz with that -- sympathize with that. once we know the facts, i assure you if there's misconduct, it will be punished. second, i want to know the full scope of this problem. that's why i ordered secretary shinseki to investigate. today he updated me on his review which is looking not just as the phoenix facility but also the v.a.

facilities across the nation and i expect preliminary results from that preview next week. third, i've directed rob neighborrers to conduct a broader review of the administration, the part of the v.a. that delivers healthcare to our veterans. rob is going to phoenix today. keep in mind, though, even if we had not heard reports out of this phoenix facility or other facilities, we all know that it often takes too long for veterans to get the care that they need. that's not a new development. it's been a problem for decades. it's been compounded by more than a decade of war. that's why i whim came into -- when i came into office, i said we would systematic work to fix these problems. we've been working really hard to address them. my attitude is for folks who

have been waiting on the battle field, they should not have to at home to get the care they've earned. the presumption has always been we have to do better. and rob's review will be a comprehensive look at the look currently to access to care. i want to know what's working. i want to know what's not working and i want specific recommendations on how the v.a. can up their game. i expect that full report next month. number 4, i said that i expect everyone involved to work with congress which has an important oversight role to play. i welcome congress as a partner in our efforts, not just to address the current controversies but to make sure we're doing right by our veterans across the board. i served on the veterans affairs committee when i was in the senate and it was one of the proudest pieces of business i did. i know the folks over there

care deeply about our veterans. it's important that our veterans don't become another political football, especially when so many are receiving care. this is an area where democrats and republicans should be working together. even as we get to the bottom of what happened, all of us have to stay focused on the larger mission which is upholding our sacred trust to all of our veterans. bringing the v.a. in the 21st century which is not an easy task. we're made progress over the last five years. we've made historic investments in our veterans. we boosted v.a. funding to record levels and we created consistency to advanced appropriations so that veterans organizations knew there money would be there regardless of

the political wrangling in congress. we delivered disability pay to more vietnam vets, making it easier for veterans with those exposed to post-traumatic stress and traumatic brain injury to get treatment and improving care for women's veterans. because of these steps and the influx of new veterans requiring services, added in many cases to wait times, we launched and all-out war on the disability claims backlog and in the past year alone we've slashed that bag log by half. of course, we're not gonna get up because it's still too high. we'll keep at it until we eliminate the backlog once and for while. we're also reducing homelessness among our veterans. we're helping veterans and their families more than a million so far pursue their education under the post 9/11

g.i. bill. we're stepping up our efforts to help our newest veterans get the skills and training to find jobs when they come home and along with michelle and jill biden and joining forces, we've helped hundreds of thousands of vets find jobs. unemployment all of though still way too high is coming down. some of the problems with respect to how veterans are able to access the benefits that they've earned, that's not a new issue, that's an issue i was working on when i was running for the united states senate. taking care of our veterans and their families has been one of the causes of my presidency and it is something that all of us have to be involved with and had to be paying attention to. >> you've been listening live to president obama speaking at

ten people were killed when a fed-ex truck crossed the median north of sacramento and hit a charter bus filled with high school students from the leaks area. the family of one of the students who died filed the latest lawsuit. now, fed-ex is facing two other lawsuits in connection with the crash. a mother in southern california is accused of killing her three young daughters. los angeles county deputies say the little girls' grandmother called 911 last night saying her daughter killed the girls at the hole. investigators recovered several knives but say there could be multiple causes of death. dults say the father of the children and -- deputies say the father of the children and the grandmother were at the

courthouse. they are outraged about plans to release a man known as the pillowcase rapist into their community. ktvu's janine de la vega joining us live from san jose and janine, what's happening outside of the courthouse right now? >> reporter: well, some of the people from that area showed up a little while ago. we'll be speaking to one of them soon. but a public hearing will be held here at the courthouse so that the judge can decide whether christopher hubbard should live. again, they feel that the judge -- they are gonna tell the judge that the community isn't equipped to deal with monitoring a convicted serial rapist even if he is considered rehabilitated. christopher hubbard was convicted of raping 23 women in california in the '70s and served time. he moved to the bay area in the early 'le os and -- '80s and raped 15 more women here. he was sentenced to prison for 16 years and after that moved to a state mental hospital.

a judge in santa clara county ordered his release in the area of palmdale. people there are upset about it. they say the community doesn't have the law enforcement resources to monitor hubbard. now, joining me now is cheryl holbrook. you are from the antelope valley. you traveled 350 miles just to be here and talk to this judge. talk to me about what you plan on telling him. >> we plan on telling him that christopher hubbard needs to stay in lockup. he committed his last crimes here in santa clara county. we are not a dumping ground. that's exactly what they are trying to do. we're not gonna stop this fight. we are gonna continue all the way to sacramento if we have to. he's not welcome in our valley, our community or anywhere else because he's a repeated sex

terrace in the public housing area on po ter row hill. the -- potrero hill. the victim was taken to the hospital where he was pronounced dead. extra police officers had to be called in because a huge crowd gathered at the hospital. there's no word of any arrests in the case. 8:36. several nfl players have filed a lawsuit claiming their health is deteriorating because of teen doctors who did not let them know about the risk of prescription drugs. brian flores is live with comments from a former 489er and raider leading the call for change. >> good morning. we know that football is a high- contact sport. but what is the little it when it comes to healing the injuries? jeremy newberry was a former lineman for 11 seasons. he says during -- during his playing career it went too far. he and others are part of a lawsuit filed yesterday. it alleges that the nfl illegally distributed

prescription drugs to basically keep players on the field instead of taking proper health action for injured players. we spoke with newberry at his hem and he says that team -- home and he says that team doctors would heavily medicate them and hand out prescription meds like candy and sometimes they were in jars for players to take as they saw fit. you newberry says many of the players have long-term health effects. >> this is the team doctor. he's responsible for your health. you are thinking if he's giving me the shots and pills, obviously it won't do long-term effects this is my doctor. this is the guy i'm entrusted in. he's the one telling me its okay to do this. >> he says especially young players don't question team doctors. he said during the '03/'04 season he was on crutches but doctors offered him the drug to

still play but he was never advised of the effects afterwards. he has stage three kidney failure he has says as -- as a result of taking those drugs. the nfl says they've not released the -- reviewed the lawsuit. newberry said he would like to see more players on team rosters so injured players have more time to heal. back to you. classes are due to resume this morning at bryman college in san jose. the school adruptly shout dunn -- abruptly shut down on monday surprising many students. a lawyer for the owner of the building says the school owed $82,000 in back rent. the school officials say that issue has been resolved. bryman is a vocational college that specializes in healthcare courses. 8:39. a popular ice cream truck that doubled as a rolling karaoke bar was totaled after a rollover crash near palo alto. this is what it looked like

after yesterday's accident. officials say the truck was heading northbound on 280 near page mill road when a car cut in front of it, forcing the driver to swerve and lowz control. the -- lose control. the truck tipped and rolled over twice. they are putting the finishing touches on a second truck right now. for the first time in 14 years, the delaware state police had to utilize the bee swarm removal plant. a big rig hauling an estimated 20 million honey bees from florida to maine crashed and overturned on a free onramp yesterday. when the tow truck driver and first responders arrived on scene, they found the bees had escaped their hives and were buzzing around. >> having traveled from florida up here, they are probably thirsty. now they are disoriented and angry. >> the plan of action involved rounding up the local beekeepers and spreading out to

development yesterday afternoon. the san mateo fire department says the worker fell about 15 feet and landed on his head. he was pronounced dead at the scene. the man's identity has not been released but police say he was in his 50s. registered sex offender due in court today. he's accused of attacking a woman near a san jose mall last weekend. michael garcia was arrested saturday afternoon at the plant shopping sheenter -- center. police responded to reports of a woman screaming and say garcia was sexually assaulting the victim. garcia is a transient, living near the mall in the facility that helps find permanent housing for the homeless. san jose's proposed pot club crackdown triggered another hot debate in last night's city council meeting. the city is considering a new ordinance affecting san jose's more than 80 medical marijuana dispensaries. it would move many of those pot clubs away from schools and daycare centers. that proposal has sparked strong emotions from both
