now at noon, a man convicted of raping nearly two dozen women in santa clara county now set to be released from custody. why some people traveled hundreds of miles to protest the move. local law enforcement discusses just how crucial eyewitness identification is. we hear from one woman who misidentified her attacker leading to an innocent man spending ten years in prison. and more than a hundred million ebay users be warned after a cyber attack on the san jose-based company. the information that may have been compromised.

good afternoon. i'm tori campbell. emotional testimony is being heard in a south bay courtroom with people begging a judge not to release a convicted serial rapist in their community. these people traveled from southern california to be at the hearing held in san jose. that's where ktvu's janine de la vega joins us live to tell us what happened and why it's being handled here. good afternoon, janine. >> reporter: good afternoon, tori. the case is being held here because a convicted felon last rapedwomen here. the woman was in los angeles county and must be placed back there. but people down there pleaded for the judge not to put them in their small desert community. cameras were not allowed in the courtroom but several people from l.a. traveled 350 miles to be there so they could tell the judge they don't want christopher

hubbard to live there. he's known as the pellow case rapist adding to raping 40 people throughout california. he's been living in a state mental hospital but the santa clara county court judge granted his conditional release. but under the law, he must be placed in an area that's 2,000 feet away from schools and parks. a home was located lake l.a., the people who live there are outaged and told the judge why hubbard should not live there. >> the neighbor next door to the house is a rape victim, two doors down, and we're sickened. we're disgusted. we're upset. flashbacks for us rape victims. we're not gonna stand for this. we'll fight this all the way to sacramento if we have to. >> reporter: thousands of letters and e-mails were given to the judge today from concerned citizens fearing for their safety. a handful of rape victims also gave testimony in court worried about court that -- that

hubbard would reoffend. the court has determined that he's rehabilitated. upon release he would be monitored by an l.a. county safety task force. that still does not calm fears of rape victims who live in lake l.a. and have young children. >> we have two cop cars to area. if there is an accident and somebody reports something, we don't have enough cops to go auld around -- all around. >> reporter: there's been opposition expressed to putting hubbard in the region. the court is in recess. the judge will listen to more testimony at 1:30 p.m. he has thousands of letters to review. it's not likely he will make a decision today but that's still undetermined. reporting live from san jose, janine de la vega, ktvu channel 2 news. >> thank you, janine. concord police are trying to find a teenager who has been groping women along a popular

trail. they say he's attacked three women since march along a walking trail along ig nare yovalley and cal road. he runs up from behind, gropes the women over their clothes and runs off. one woman says she feels safe because she walks with her dog. >> i will still walk my dog. i feel pretty safe here. i see the security quads. having a dog makes a difference, especially my dog is pretty protective. >> police released this sketch of the teenager. they say he's asian or latino, in his early to late teens, about 5'6" with a thin to average blild build and short, black hair. sheriff's deputies arrested a car thief. the sheriff's office said at about 10:45 deputies were chasing a man in a stolen car. at one point, the driver got out of car and started running. one of the dupes fired a -- deputies fired a shot but

nobody was hit. the suspected car thief ran through a house and jumped fences before anyone was taken into custody. eyewitness testimony is powerful but not always accurate. right now leaders are discussing the best ways to make sure innocent people are not wrongly convicted. alex savidge is live at the university of san francisco with more on the practices that many agencies are now putting into use. good afternoon, alex. >> reporter: well, tori, good afternoon. this event here today is put on by the northern california inknow sense project. that's a group that works to overturn wrongful convictions and they say in most cases where the wrong person is sent to prison it was because an eyewitness to a crime got it wrong. the innocence project for that reason is pushing for police departments to adopt certain standards when it comes to the identification process mainly they would like blind lineups that are done sequentially. that's when a person is shown photos one by one and the other

who is administering the lineup doesn't know which one is the suspect. today, the san francisco district attorney, george gascon, talked about easily an eyewitness can be influenced. >> we're human beings. and when you are dealing with things, sometimes there's mistakes. when we're dealing with the lives of people and we're talking about incarcerating people for extended periods of time, some, in many cases or impacting the ability of someone to have employment or housing, i think we have to put checks and balances. >> reporter: the police and prosecutors in attendance at today's event at the university of san francisco also heard from jennifer thompson. she was the victim of a rape back in 1984 in north carolina. sheet picked her suppose -- she picked her supposed attacker out of a photo lineup and that led to the man being wrongfully convicted to the crime and sentenced to life in prison.

he was exonerated, however, through dna evidence, ten years later. >> i remember feeling paralyzed from the guilt that i felt. and then when other things come into our mind, into our brain, someone suggests something, someone moves the memory around a little bit. we make really bad mistakes and those mistakes lead to an an innocent person in prison and a guilty person on the street still. >> reporter: according to the project, 300 convictions have been overturned using dna. thethe directors here in northern california are hoping that even more agencies will follow suit. we're live this afternoon in

san francisco, alex savidge, ktvu channel 2 news. >> all right. thank you, alex. san francisco police are investigating a deadly shooting in the city's potrero hill neighborhood. it happened about 9:15 last night on turner terrace in the public housing area. the victim was shot in the head and taken to san francisco general hospital where he was pronounced dead. police say extra officers had to be called in after a large crowd gathered at the hospital. so far, there's been no arrests. san jose-based ebay is asking its customers to reset their passwords after hackers gained access to their system. and now millions of customers could be affected. brian flores joins us with more. >> good afternoon. ebay has more than 148 million active accounts worldwide. they are not saying how many were affected. but as a precaution, they are telling all of their customers to change their passwords just in case. the company says hackers

breached the system between late february and early march. but ebay didn't find out about the hack until a couple of weeks ago. they gained access to the corporate network by compromising a small number of employee log-in credentials. according to the official blog site. blog site, there's no information to compromised financial information. but the company is concerned they may have information to your name, pass woerd, physical address, phone -- pass woerd, physical a -- password, address, phone number, even birthday. >> it's enough to justify what's enough to go in and penetrate the firms and pull out the information. >> he believes the attacks originated in eastern europe. the company has not confirmed that but they say they are working with law enforcement and cyber experts to aggressively investigate the matter. unlike the target data breach, information on ebay is heavily

those things are catching so [bleep] fast. >> fire investigators in san diego are using this newly obtained cell phone video of the first few seconds of one of last week's devastating wildfires to figure out how it started. the video was recorded by a man in carles -- carlsbad working omhis home nearby -- on his home nearby. now investigators believe the fire started on a golf course nearby and as a retired fire investigator explained, it was likely sparked by a person. >> could he have started it with a golf club or a discarded cigarette and thought i have to get out of dodge before they catch me and charge me. >> the fire burned 600 acres killing one person. it gutted an entire apartment building and eight homes and two businesses.

four people are dead and several others are seriously injured after a bus crash in southern california near the arizona stateline. it happened near on interstate 10 west of blight around 2:15 this morning. investigators say it appears a tractor-trailer that spilled steel pipes may have triggered the crash. the bus with 32 confirmed passengers was traveling from el paso to los angeles. president obama spoke out today over the crisis at the nation's veterans hospitals. 26 facilities are under investigation for possible wrongdoing and mismanagement that may have cost lives. justin gray is live in washington where the president is promising action. justin? >> reporter: yeah, president obama vowed that employees who engaged in misconduct will be punished. >> so today, i want to -- every veteran to know we're gonna fix whatever is wrong.

america. we're gonna work with him to solve the problem. at any moment now, the house of representatives is expected to take a vote they say will help solve the problem. they would give more authority to the v.a. secretary to fire or demote employees who engage in mismanagement or misconduct. justin gray, ktvu channel 2 news. general motors issued yet another recall today that's adding to a dealership backlog for repairs. service managers at fh daily chevrolet in san leandro say they cannot get parts in fast enough for all of the recalls. today's recall is for some models of the chevy avao because of running lights at risk of fire. it comes after several other recalls for almost 14 million vehicles, including an ignition switch problem linked to 13 deaths. the san leandro dealership says more than 100 people are on a waiting list for parts. >> all of the dealers that i know, we want to take care of this as soon as possible for

fog banked up near the shoreline. a few patches around the bay. here is a closer inspection of the current satellite with the clouds hugging the coast from the golden gate down towards half moon bay pillar point. even a few patches left over around the bay as well. current wind speeds out there, a bit of a breeze kicking in out towards fairfield. winds out of the southwest at 17 miles an hour. out towards sfo. you can see winds out of the northwest at 17 miles an hour. the winds, not exextremely strong but i think te will be picking up -- they will be picking up at 22, 25 miles an hour out there. it's 73 degrees in santa rosa right now. oakland checking in, 65. concord, 74. san jose in the lower 70s reporting 71 degrees. forecasts throughout the day. we're thinking a lot of sunshine. temperatures maxing out in the mid- to upper 70s. even by 9:00 tonight, still mild out there in the mid-60s at 65. for today, we do have this, partly sunny skies. a bit of a breeze. the winds pick up especially after 2:00 or 3:00.
