of traffic beginning right at 238 all the way down the fremont. no doubt this is going to affect your drive time in the region. i think it's going to be fairly high here. 25 minutes already from 238 to thornton avenue and it looks to grow as the commute continues. also getting to the san mateo bridge as people are bailing on the 880 freeway, it's going to be heavy on 92 before you get onto that span. let's go to the bay bridge toll plaza. a 35-minute drive time between the end of the line and the san francisco side of the bay bridge. and 880 northbound and southbound in oakland looks good so far. with he had a couple of earlier problems here. but they cleared and traffic is moving well. 7:03. back to the desk. >> thank you, sal. we are continuing to follow developing news in san francisco. a man was run over and pinned under a car at the chevron gas station at gary and 24th r avenue in the richmond district early this morning. ktvu channel 2 reporter tara

moriarty has been following the story since 3 this morning. she just got disturbing details from a witness. >> reporter: we spoke to him a couple of minutes ago and he says that he witnessed the whole thing happen. it happened shortly before 3:30 this morning. two men pulled up into the parking lot and they were hoping to change their tire. they were with the man about 45 to 50 years old who had been loitering at this chevron on 24th and geary. they spoke and then the older man collapsed. the passenger of the car ran to the gas station attendant and told him to call 911. the driver decides he doesn't want to be there when emergency crews arrive so he throws the car into reverse and runs over the man. firefighters, meanwhile, were responding so what they thought was a medical call and saw the victim pinned under the back wheel of the green sedan. >> when the fire department showed up he was lodged underneath the tire.

so in order to free his head it was imperative that they hoist the rearnd of the vehicle in order to free his vehicle from underneath the tire. >> reporter: now, the driver has been taken into custody where he will undergo alcohol testing. the passenger is being detained for questioning. there is surveillance video that police are reviewing to see if it provides any more clues. meantime, the victim is in critical condition at san francisco general hospital. he is not conscious, but he is expected to live. live from san francisco, tara moriarty, ktvu channel 2 news. new details about the suspensions of four san francisco firefighters for a crash involving a fire truck that injured a motorcyclist last year. firefighter michael quinn, who was driving the fire truck, resigned from the fire department and now faces three felony dui charges. assistant fire chiefs art kenny and david franklin are facing suspensions of 10 days and 8 days. they responded to the scene to

give drug and alcohol tests to quinn, who had left the crash scene. officials with the firefighter's union say the men did nothing wrong. >> the driver went missing. they notified the higher ups in command and they ultimately found the driver of the fire truck, brought him back and got the police involved. >> firefighters warn s&p -- on the truck that night face 30 day suspensions. the men say they will appeal their suspensions before the fire commission. alameda county sheriff's deputies captured a suspected rapist after he used a credit card of his victim. 38-year-old miguel torres was arrested yesterday at his home in hayward. investigators tell the oakland tribune that torres followed a 19-year-old woman to her east bay home on saturday and raped her. detectives say he used the victim's credit card for sexual enhancement pills and a carwash. he now faces sexual assault,

rape, and robbery charges. time now 7:07. opening statements scheduled today in bryan stow's civil trial against the los angeles dodgers. bryan stow was permanently disabled after a brutal beating at a giants-dodgers game in 2007. katie telling us about a warning being given to the jury. good morning, katie. >> reporter: good morning, dave. witness testimony will likely be emotionally charged. the l.a. times is reporting that stow's mother will be the first to take the stand following opening arguments, which are scheduled for 9:15. bryan stow has also been in court, as seen here, since jury selection began tuesday. the jury consists of eight men and eight women. there is an attorney, school bus driver, a nurse and a journalist. attorneys warned potential jurors there would be emotional testimony which was the case when stow's family spoke at sentencing for the criminal trial. >> as men, are you proud of yourselves? and as fathers, are you proud

of yourselves? >> february louie sanchez and marvin norwood accepted a plea deal. sanchez will serve eight years. norwood four. the civil trial seeks to determine if the dodgers provided adequate security on the day of the attack. stow's medical costs are expected to be in the millions. in our next report i will have more on how much his attorney is seeking in the civil rile. live in the newsroom. time 7:08. parents, teachers, students, they all packed last night's oakland school board meeting in a fight to try to save the oldest charter school in the district. >> they have been good to both of my daughters and i support them 100%. >> however, emotional pleas like that, it didn't sway the school board. they voted 4-2 to deny the charter renewal for the charter school and they cited three reasons. poor test scores, a big drop in

enrollment and major money problems. >> they were taking out a loan against future anticipated earnings. money that they would receive from the state in future years in order to meet their current financial obligations. they had to do that to meet payroll. that's very concerning. >> while this fight may not be over yet, the leadership can appeal to the county school board. if necessary, they can go to the state board of education. 7:09. food safety advocates are urging the federal government to respond to a salmonella outbreak from chicken that continues to make people sick. the outbreak started more than a year ago. it was traced to california-based foster forms. so far, there has been no recall of foster forms chicken. a group called the center for science filed a lawsuit in federal court in hopes of forcing the government to step in. no one has died from the outbreak, but the centers for disease control says there are about eight new cases of salmonella illness linked to

the outbreak every week. most of them in california. homeowners in alameda county will have to pay a new hazardous waste disposal fee despite many objections. the alameda county waste management authority approved an annual $9.55 fee for each house. it will be tacked on to property tax bills for the next ten years. opponents sent 50,000 letters objecting to the fee. it's projected to raise $5 million a year. the money will be used to keep four sites open where people can drop off old paint, batteries, and other toxic materials not allowed in regular trash. time now 7:10 you. sad story. the legendary owner of the north beach restaurant and petroni vineyards has died. the restaurant became a destination for locals and tourists when it opened on stockton street back in 1970. the petroni family says he came to this country flat broke from italy in the 1950s and worked

a man is in custody after after hours long stand-off in san francisco's mission district. police say an armed robbery suspect barricaded himself in a home on shot well street between 23rd and 24th about 4:30 yesterday afternoon. police evacuated the building and brought in a s.w.a.t team. the man surrounded rended after several hours. there were no hostages taken and no shots were fired. a hearing today in colorado could establish the rules for

the upcoming trial in the 2012 colorado movie theater case. the defendant, james homes, has pleaded not guilty by reason of insanity to that deadly attack where 12 people were killed. his lawyers will ask that jury selection be closed to the public. they are arguing that letting the public watch could cause prospective jurors to change their answers to really important questions like how they feel about the insanity defense. this trial is due to begin in october. a u.s. marine has been in a mexican prison for two months now. he has been ordered to go back to court next wednesday. sergeant andrew tom ressy is charged with bringing weapons into mexico. he says he was moving everything he owns, including three guns, from florida to california and accidentally crossed the boarder. it's against the law to bring guns into mexico. family members and friends are looking for help from the u.s. government. >> it wasn't just driving down

the freeway with, you know, these weapons. oh, gee whiz. he was relocating. he had all of his possessions in the car. >> tomarassi was continuing treatment for post-traumatic stress disorder after serving two tours of duty in afghanistan. now members of congress and secretary of state john kerry are asking mexico's attorney general to step into this case and set him free. 7:16. a fiery fight between the popular hot sauce and a southern california community is apparently over. the irwindale city council voted last night to drop its lawsuit against the maker of sriracha hot sauce. the town had declared the sriracha plant a nuisance as neighbors complained spicy odors made their eyes water and they had difficulty breathing. the factory owner has installed stronger filters that will block chile fumes in the future. a new study shows the

obesity crisis is not just affecting the u.s. more than 2 billion people worldwide are now overweight or obese. that is 30% of the global population and the highest rates of obesity are in the middle east and north africa. researchers from the university of washington reviewed more than 1700 studies from 188 countries to reach these findings. the study was paid for by the bill and melinda gates foundation. 7:17. the red carpet prankster struck again. this time brad pitt was the target. look at the scene after brad pitt was hit in the face by a man with a long history of pranks on the red carpet. that man jumped over a barrier and attacked him. that suspect was arrested. you can see brad pitt seemed to be unfazed. he kept walking with his body

guard. that same prankster has, in the past, hugged leonardo dicaprio and bradley cooper. he tried to kiss will smith. and most recently he actually put his head up the dress of actress america ferrara. >> hmm. restraining order. all right. it is coming up on 7:18. let's check in with sal and see what's happening on the roads this thursday morning. >> it's a little slow, which you might expect for this time of the morning, tori and dave, but we don't have any major problems. we did have that crash on 880 south that was in the lanes, but they were moving it to the shoulder and they have done that. but traffic is still very slow. your drive times here are elevated as you drive from 238 down to thornton avenue. it is going to take you 36 minutes and it keeps getting longer and longer on that drive time. and then we promised to look at the south bay. you can see 280 is very slow. northbound 280 near wolf road there is a crash clearing and traffic is backed up all the way to downtown san jose. you would say 85 at this point is actually a decent alternate

route. it's not all that bad. it's kind of surprising that 85 isn't slow. hey, we will take it. 101 is not that bad either. 280 is just a mess. live pictures now. westbound bay bridge backed up for a 35-minute drive time into san francisco. it's about normal now. these days it has really spiked up in the last month and a half or so. and this morning's commute on the eastshore freeway westbound 80 between the car teenis bridge and mcarthur maze, that's 20 minutes. that's not too bad. 27 minutes average speed. 42 miles an hour. sal, we have a clear sky. not much of a breeze here o quick shout out to mark. he is watching us in cabo san lucas right now on the internet. appreciate that. he hit me up on facebook. blessen ton 51. there were some upper 40s. walnut creek 54. the lafayette reservoir is 51.

i wouldn't recommend it. it's jam packed. contra costa county southbound 680 traffic is backed up from willow pass to walnut creek. and 880 continues to be really a bad commute from before 238 all wait down to the fremont. the site of an earlier crash. that's a 40-minute drive time between 238 and thornton. 7:33. back to the desk. time is 7:33. thinking of steve, but there is a privacy controversy brewing at the popular bay area coffee house chain phil's coffee. and this one involves the cellphones and computers of their customers. ktvu's janine de la vega joining us live from palo alto to tell us how customers were being tracked and the company is now responding. good morning. >> reporter: good morning, dave. the district manager has been speaking with the ceo of phil's and they tell me that their customers' privacy is important

to them and they feel like they don't want to use this technology any more. they are going to not use them beginning this weekend. the devices that were tracking people through their cellphone. now, most people i spoke to didn't know they were being watched that way. 2012's phil's is partnered with uhilz. it processes and stores certain data. specifically, how often customers stay. privacy advocates say there are concerns about eavesdropping and how much information is being collected. phil's does have stickers on the outside of their stores notifying people about the technology. >> i didn't know it was there before. i'm glad that they are not using it at this point because i would want to know a little bit more about it. if they are going to use something like that, i think it should be more prominent than just a sticker on the door.

>> reporter: on euclid's- website it says fhilz wanted to understand customers on the go. they did stay will this longer. now, in response they changed things about those stores. the district manager tells me again they don't feel like those devices are needed any more. that's not the direction that philz wanted to go and they do plan on stop using those devices this weekend. 7:35. the muslim service -- the memorial services continue for the people killed in isla vista. last night in berkeley hundreds gathered on the uc berkeley campus honoring the victims of the attack near the uc santa barbara campus. this villagele was a way for the entire uc community to heal after such a horrifying attack and there were several

emotional speeches. >> the biggest reason i feel like i had to stand before you all today was because james and david and george were students of mine last spring. because we are all a little bit sort of outcasts and the standard type of santa barbara, we are close. >> that young woman was one of the many alumni who attended last night's vigil in berkeley. now, tonight another candlelight vigil is planned on the campus of san jose's leland high school in honor of george chen. the 19-year-old uc santa barbara student was among the six people killed in friday night's shooting and stabbing rampage. he graduated from leland high two years ago. an east bay assemblywoman is proposing a bill aimed at preventing another massacre like the one last week near uc santa barbara. it would allow police to get a

court order to confiscate someone's weapons if family and friends report threats of violence. >> that restraining order then allows law enforcement to basically repossess the weapons and to put the individual on the list that would not allow them to purchase a gun. >> skinner says the situation in santa barbara might have been different if such a law had been in place. she says a similar sort of restraining order already exists for felons and in cases of domestic violence. in san francisco tonight an unusual group is teaming up to fight gun violence. musicians, including snoop dogg and m.c. hammer, will join former mayor willie brown at the benefit. swimmer diana nyad and joe montana will also be at the event to raise funds for the no guns allowed campaign and the snoop youth football league. the event is scheduled to get underway at 5 p.m. at air b and b's headquarters on brannon street in san francisco. time is 7:37.

freeway for example in vallejo are open again this morning after a grassfire yesterday that shut down the road for hours. it happened yesterday afternoon near the ramps to interstate 780 and 80. a lot of smoke out there caused the chp to issue a sig alert because of poor visibility on interstate 780. no one was hurt by this fire which was brought under control about 6 p.m. 7:38. at least seven people who were arrested in several drug raids are scheduled to appear in court today in oakland. the hearing comes after dea agents searched several locations yesterday in martinez, san pablo, pleasant hill and concord. sources tell ktvu a search at an industrial park in concord turned up tens of thousands of xanax pills. >> it's a constant battle. we feel real good about our efforts to try to reduce the amount of drugs on the streets available for our teens and

young adults. >> details about the charges and value of the drugs that were seized are sealed and not available to the public. all right. tore are you, time now 7:38. turning now to next tuesday's primary election in california. voters will choose which two candidates will face off in november in the race for governor. the governor jerry brown is expected to easily win the top spot in the primary. the battle is for the spot on the november ballot opposing governor brown. two republican candidates are in the lead. tim donnelly and former treasury official neel kashkari. recent polls show 42% of republican voters are still undecided. >> all the polls have come out recently have shown a lead for assemblyman donnelly still. a huge number of undecided this late in the election is pretty surprising. >> a new poll from the hoover institution shows 36% of people surveyed say they plan to vote for governor brown.

12% for donnelly and 5% for kashkari. bay area counties, by the way, are looking for poll workers for the tuesday primary. santa clara county needs 800 more poll workers. and there is another challenge. finding people who can speak a second language. poll workers, by the way, will be paid between 95 and $180 and work a 13-hour shift. vice president joe biden and his wife, they are waking up this morning right here in the bay area. they are going to fly to seattle for a noontime democratic fundraising event there. the vice president had two fundraising events in san francisco yesterday. one was at the home of billionaire tom styer. the other at the fairmont hotel with senator dianne feinstein. the vice president has no public appearances set for this trip. 7:40. the city of pleasanton has plans it to fight the drought by recycling more water. a move critics call toilet to tap. for the last eight weeks the city has been using watery

claimed from the sewage treatment plant to water two parks. pleasanton plans to use it to waterparks next year. >> it's a fabulous way kids play on a beautiful lawn and it helps us save water. >> to be using recycled water for my drinking water? that scares me. >> right now no recycled water goes into homes, but that could change. the state is considering a new rule that would allow treated sewage to be used for drinking water. right now any recycled water that is not used for irrigation is dumped into the bay. run over and pinned under a car. what a witness told us within the past hour about this morning's horrible scene at a gas station parking lot in san francisco. and next, sounds like a good deal. paying as little as $20 for work on your car. but it's not exactly legal. the makeshift auto shop set up

veterans affairs committee holding a hearing on medical care for blind veterans. these are live pictures. we're right there in the middle of that hearing. this is happening amid new allegations that at least 1700 veterans who needed medical treatment were never given an appointment and never even put on a waiting list at a v.a. facility it phoenix, arizona. some of the republicans on the committee have called for the head of the veterans affairs to resign. they are investigating claims that 42 v.a. medical centers, including the one in phoenix, tried to cover up long wait times for veterans. some of the veterans may have even died waiting for appointments. two san diego police officers are being called heroes for going above the call of duty to help a vietnam veteran on memorial day weekend. they helped rescue gill larocque after his scooter there broke down on a busy street in the heat of the day. they pushed mr. larocque almost two miles in his

scooter, which by the way was more than 300 pounds. >> when we got to the intersection, we would be in the middle of the intersection and it would lock you -- up. >> mr. larocque had tunnel walking after suffering injuries in vietnam. he uses a scooter to run errands for himself and his 90-year-old father who, by the way, survived the attack on pearl harbor. 7:47. car problems. we have all had them. they are stressful and usually very expensive. ktvu's palm cook is in the studio with a cheap fix for your car in oakland, but it is stirring up quite a bit of controversy. >> reporter: yes, it is. some freelance mechanics are fixing cars in the parking loft of an oakland auto parts store. we went the out to the auto zone store this morning. this is at the 73rd and bancroft in oakland. and we saw the grease spots in the parking lot for ourselves, used car parts in the trash and bushes. the "san francisco chronicle" reports that traveling mechanics carry tools but may or may not

shore freeway and take a look at the carquinez bridge mcarthur maze stretch. that's 30 minutes. about average for this time of morning. your average speed is 30 miles an hour. bay bridge toll plaza 35-minute drive time into san francisco. again, news chopper 2 almost at the scene of that crash i mentioned. we will let you know more about that straight ahead. back to the desk. new this morning we are tracking the investigation after a man was run over at the chevron gas station at geary and 24th in san francisco's richmond district. ktvu channel 2 reporter tara moriarty has been following this story since 3:30 this morning and has disturbing details from the gas station attendant who witnessed what happened. >> reporter: he watched the whole thing unfold and it was pretty bad. especially when we first arrived on scene. this is the gas station where it happened. the gas station attendant says

two person were in a car. they were talking with 40 to 50-year-old man who had been loitering at this chevron off 24th and geary. the three spoke for about 20 minutes and then suddenly the older man collapsed. the car passenger ran to the attendant, told him to call 911 and the attendant says what he saw was that the driver suddenly threw the car into reverse in order to leave and ran over the man. now, firefighters meanwhile were responding to what they thought was a medical call and they saw the victim pinned under the back wheel of the green sedan. >> when the fire department showed up he was lodged underneath the tire. so in order to free his head it was imperative that they hoist the rear end of the vehicle if order to free his head from underneath the tire. >> the driver has been taken into custody where he will undergo alcohol testing. the passenger is being detained for questioning. there is also surveillance video that police are reviewing to see if it provides any clues.

the victim, meanwhile, is at francisco general hospital. he again is in critical condition. not conscious but he is expected to survive. live from san francisco, tara moriarty, ktvu channel 2 news. we have new details now about the suspensions of four san francisco firefighters for a crash involving a fire truck that injured a motorcyclist last year. firefighter michael quinn, who was driving that fire truck, resigned from the fire department. he now faces three felony dui charges. assistant fire chiefs art kenny and david franklin, they are facing suspensions of ten days and eight days. now, they went to the scene to give drug and alcohol tests to quinn, who had already left the crash scene. also, battalion chief mark hayes is facing a four day suspension. the firefighters union says the men did nothing wrong. >> the driver went missing. they notified the higher ups in command and they ultimately found the driver of the fire

truck, brought him back, and got the police involved. >> now, firefighters warren derr and lieutenant matt schwartz were on the fire truck that night. the men will appeal their suspension to the fire commission. alameda county sheriff's deputies say they captured a suspected rapist after he used the credit card of his victim. 38-year-old miguel torres was arrested yesterday at his home in hayward. investigators tell the oakland tribune that torres followed a 19-year-old woman to her east bay home on saturday and raped her. detectives traced torres through surveillance video and they say he used the victim credit card for sexual enhancement pills and a carwash. he now faces sexual assault, rape and robbery charges. 8:06. opening statements in the bryan stow civil trial against the l.a. dodgers will begin in just about an hour from now. bryan stow suffered serious brain injury and lasting disabilities after being

attacked by two dodger fans in 2011. katie is joining us live to tell us what bryan stow is seeking as far as damages are concerned. >> reporter: his projected medical costs are estimated around $40 million. he is also seeking punitive damages, according to the l.a. times. the suit accuses the dodgers and former owner frank mccourt of failing to provide adequate security on the night of the attack in 2011 when two dodgers fans beat stow. he has been in court since jury selection began in los angeles on tuesday. the jury consists of eight men and eight women. the times reports of those people there is a hardware store manager, a nurse, and a mail carrier. attorneys warn potential jurors about the emotionally charged testimony they will likely hear, which was the case when stow's family spoke at sentencing during the criminal trial. >> you get to live your life as

schools. members voted 4-2 to deny a renewal citing three reasons. poor test scores, a big drop in enrollment and major money problems, they were taking out a loan against future anticipated earnings. money they would receive from the state in often years in order to meet their current financial obligations. they had to do that to meet payroll. that's very concerning. >> the fight may not be over yet though. the leadership. e.c. reams can appeal to the county school board and, if necessary, the state board of education. time is 8:09. the state senate rejected a bill to that would have given san francisco the oppourtunity limit evictions under the ellis act. it lets property owners evict their tenants if a property owner want to get out of the rental business. state senator mark leno authored a new bill to require property owners to own a property for five straight years before tenants could be evicted. leno may try again to get

house. it's going to be tacked on to property tax bills for the next ten years. now, critics sent out 50,000 letters objecting to this new fee. it's projected to raise $5 million a year and the money will be used to keep four sites open as places where people can drop off old paint or batteries and other toxic materials that's not allowed in regular trash. google admits its international work force is not as diverse as it should be. the search engine giant says 83% of its tech workers are men and 60% are white. 34% are asian with just 3% hispanic or african-american. google is releasing its diversity information at the urging of the reverend jesse jackson. jackson is pushing all tech companies to hire more women, african-americans, and latinos. time is 8:16. a u.s. marine who has been in a mexican prison for two months has been ordered to go back to

walnut creek, we have slow traffic as you drive to the walnut creek interchange. westbound 24 is also slow. 8:31. memorial services continue for those killed in last week's deadly rampage in isla vista. last night in berkeley hundreds of people gathered on the uc berkeley campus. they were honoring the victims of that attack near the uc santa barbara campus. organizers say this was way for the entire uc community to heal after such a horrifying attack, and there were several emotional speeches. >> the biggest reason i feel like i had to stand before you all today was because james, anthony and george were students of mine last spring and because we're all a sort of out casts from the standard type of santa barbara. we were all very close. >> that young woman was among the many uc santa barbara alumni who went to the vigil in berkeley. tonight another candlelight

vigil is planned on the campus of san jose's leland high school in honor of george chen. the 19-year-old uc santa barbara student was one of six killed in the shooting and stabbing rampage. he graduated from leland high just two years ago. 2,000 students at uc santa barbara got out in the water yesterday to hopper the victims of last friday's -- to honor the victims of last friday's attack. the students headed for the beach in what was called a memorial paddle out. many of those who took part said it helped them clear their minds after days of stress and anger. >> make sure that everyone knows that we're all together as a community and everyone has a very strong part to play in keeping everybody safe. >> many of the students say they're about to graduate and they wanted this water memorial to be their lasting memory of the tragedy.

> le 33:00. an east bay assemblywoman is proposing a bill aimed the preventing another massacre like the one last week. nancy skinserville would allow police to get a court order to confiscate someone's weapons if family and friends report threats of violence. >> that restraining order then allows law enforcement to basically repossess the weapons and also to put the individual on the list that would not allow them to purchase a gun. >> skin are says the situation in santa barbara might have been different if such a law had been in place. she also says a similar sort of restraining order already exists for felons and in cases of domestic violence. in san francisco tonight an unusual group is teaming up to fight gun violence. musicians, including snoop dogg and m.c. hammer, will join former san francisco mayor willie brown at the benefit, nfl hall of famer joe montana and swim he diana nyad will be at the event to raise funds for

the no guns allowed campaign and the snoop youth football league. the event is scheduled to get underway at 5 p.m. at headquarters on brannon street in san francisco. time is 8:34. now to next tuesday's primary election in california. voters will choose which two candidates will face off in november in the race for governor. the governor jerry brown is expected to easily win the top spot in the primary. the battle though is for the spot on the november ballot to oppose governor brown. two republican candidates are in the lead. assemblyman tim donnelly and former treasury official neel kashkari. recent polls show 42% of republican voters are still undecided. >> all the polls come out recently and they have shown a lead for assemblyman donnelly still, but a huge number undecided this late if the election is pretty surprising somewhere a new poll from the hoover institution shows 36% of people surveyed say they plan to vote for governor brown, 12%

for donnelly, 5% for kashkari. and bay area counties, they are looking for poll workers for the tuesday primary. santa clara county needs 800 more poll workers. and there is another challenge. they need to find people who can speak a second willingham. poll workers will be paid between 95 and $180 and work a 13-hour shift. it is 8:36. at least seven people arrested in several drug raids in the east bay are scheduled to appear in federal court today in oakland. today's hearings come after dea agents searched several locations yesterday in martinez, san pablo, pleasantville and concord. sources tell ktvu search at an industrial park in concord turned up tens of thousands of xanax pills. >> it's a constant battle. we feel real good about our efforts to try to reduce the amount of drugs that are on the streets that are available for our teens and young adults. >> details about the charges

and the value of the drugs that were seized are sealed and not available to the public. time now 8:36. concerns about privacy brewing at a popular chain of coffee stores here in the bay area. philz coffee uses technology that tracks your movement through your smart device. ktvu's janine de la vega joining uggs live now. you are in palo alto. customers are reacting. what are they saying? >> yeah, mixed reaction here at philz. most customers just come in to buy a cup of coffee and they don't realize that devices have been installed to track customers' movements by using their cellphones. well, a district manager tells me the ceo has changed his mind and decided to stop using this technology. they don't want people worrying about privacy. in 2012, philz partnered with retail analytics film euclid and installed devicees in the stores that picks under the wifi signal of customers' phones or tablets without their permission. it processes and stores certain

data. specifically, how often customers visit and how long they stay. but privacy advocates say there are legal concerns about location eavesdropping and also wonder about how much information is being collected. philz has small stickers on the outside of the stores notifying people about the technology. philz says they will end their relationship with euclid and stop using the devices this weekend. >> it sounds good if they are responds to go what customers want. sounds like a smart decision. >> i am not one of those advocates against it. i would be interested to know. >> reporter: how does it make you feel he stopped doing it? >> hopefully, the customer experience continues to get better. i think that's why they did it in the first place. >> reporter: on euclid's website is states that philz started using the technology to understand each store's personality. it allowed them to measure customer traffic. for example, in san francisco people were on the go and didn't linger in stores while in san jose and berkeley they stayed

it is coming up on 8:43. an investigation is underway after a man was run over at a san francisco gas station. ktvu's tara moriarty has been live at the scene since 3:30 this morning. she has spoken with the attendant who witness the the strange ins didn't. now you have some new information you learned from police? >> reporter: yes. the driver has been arrested for dui. and not only is the gas station attend end witness this accident, but firefighters responding to a non-emergency medical call did as well. they watched as a green sedan backed up over the man who was lying in the parking lot here off of 24th and geary streets. this happened around 3:30 this morning. witnesses say that two people

inside the green sedan were talking to the man who was 45 to 50 years old. suddenly, the older man slumped on to the pavement. the car passenger told the attendant to call 911. when fire crews arrived the attendant says the driver, who appeared in intoxicated him self, suddenly threw the car into reverse and ran over the man twice. he tried to take off but firefighters say that they stopped him and then they had to get a jack to help free the victim. >> when the fire department showed up he was clocked underneath the -- lodged underneath the tire. in order to free his head it was imperative that they hoist the rear end of the vehicle in order to free his head from underneath the tire. >> reporter: now, the victim is at san francisco general hospital in critical condition but he is expected to survive. again, police have arrested the driver for dui. speaking with firefighters, they say that the driver, when he got out of the car, did not appear to even know what was going on. they said that he was clearly

intoxicated. again he faces a dui charge. as far as a possible hit-and- run charge, that has not been determined yet. >> thanks for the update. time's 8:44. car problems are stressful. they are usually expensive. most of us can't or don't want to do it for ourselves. ktvu's palm cook is in our studio to tell us about a new place, pam, to get your car worked on but it's not exactly a business and it's controversial, too? >> reporter: yes, it is. some freelance mechanics are fixing cars in the parking lot the of an oakland auto parts store. we're out at the auto zone store this morning at 73rd and bancroft and we have seen the grease spots in the parking lot and used car parts and trash in the bushes. the "san francisco chronicle" reports that traveling mechanics carry tools, but may or may not be properly trained with licenses from the state. now, the men charge as little as $20 to work on a car in the parking lot of the auto zone,

which is a huge savings for people who can't afford a licensed repair shop. >> some of these guys are legit. you know what i mean? these guys once had a job and for some reason they are unemployed. you got to put food on the table. >> you shop. it's more cheap. and the people are showing time to help the people here. it's more cheap. >> now, a spokesperson for auto zone says store employees cannot stop people from working on their own cars in the parking lot, but oakland city council woman brooks tells the paper she is working with police to put an end to it. the council woman concerned about liability. the city and state could go after them because no taxes are being collected for this work done out in the parking lot. >> yeah. thanks, pam. it is 8:46. want it check in with sal. it's been fairly busy. last time we saw the bay bridge toll plaza it was light?

time is 8:53. we have breaking news from san jose. the city's understaffed police department has taken another big hit. four more officers resigned this week shortly after learning the details of the city's revamped disability policy. one of the police officers, part of the department -- one of the police officers who resigned is part of the internet crimes against children unit. the city proposed a new policy that includes giving officers who are denied disability another job in the city. something opposed by the police union. a recent study shows an additional 175 officers could leave in the next two years. time is 8:54. we're continuing our coverage of the sad news we brought you yesterday morning. the death of maya angelou. the beloved author, poet, actress is among the 25

the city of pleasant on has plans it fight the drought by recycling more water and it's a move that critics are calling toilet to tap. now, the for the last eight weeks the city has been using watery claimed from the sewage treatment plant to water two it parks. pleasanton plans to irrigate parks next year and possibly the year after that they may use it for drinking water in people's homes. >> to be using recycled water for my drinking water scares me. >> i am hoping it will get rid of the yuck factor that people have. >> the state is considering the rule change that would allow treated sewage to be used in homes. right now any recycled water that isn't used for irrigation is dumped into the bay. the red carpet prankster strikes again and this time brad pitt was the target. the actor was hit in the face yesterday by a ukrainian man
